CIRCULAR

Regulations on Periodic Reporting of HIV/AIDS Prevention and Control Activities

Pursuant to the Law on Prevention and Control of Infection with Human Immunodeficiency Virus (HIV/AIDS) No. 64/2006/QH11 dated June 29, 2006;ứperson with acquired immunodeficiency syndrome (HIV/AIDS)No. 64/2006/QH11 Amended and Supplemental Law on Prevention and Control of Infection with Human Immunodeficiency Virus (HIV/AIDS) No. 71/2020/QH14 dated November 16, 2020;No. 71/2020/QH14 dated November 16, 2020;

Pursuant to Decree No. 09/2019/NĐ-CP dated January 24, 2019 of the Government stipulating the reporting system of administrative agencies;

Pursuant to Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to the proposal of the Director of the HIV/AIDS Prevention and Control Department;

The Minister of Health issues this Circular on the periodic reporting system for HIV/AIDS prevention and control activities.June 2024;This Circular stipulates the frequency, method, time, content, subjects, and procedures for periodic reporting of HIV/AIDS prevention and control activities.No.Article 2. Frequency and Method of Sending and Receiving Reports

Article 1. Scope of Regulation

1. Report Frequency: Quarterly and annual periodic reports.

2. Methods of Sending and Receiving Reports: Direct submission of paper reports, sending through electronic mail systems, or online submission via software applications for reporting HIV/AIDS prevention and control activities data.

3. Reports on HIV/AIDS prevention and control activities must be signed, stamped, and stored in accordance with legal regulations on archiving.

Article 3. Time for Finalizing Data for Reporting

1. Quarterly periodic report: From the 15th day of the month preceding the reporting period to the 14th day of the last month of the quarter.

2. Annual periodic report: From December 15 of the year preceding the reporting period to December 14 of the reporting year.

Article 4. Content, Subjects, and Procedures for Reporting at Commune Level

1. Quarterly report content includes intervention activities to reduce harm, HIV testing counseling, and HIV/AIDS prevention and control communication activities according to corresponding forms specified in Appendix 1 attached to this Circular.

2. Reporting units include agencies and organizations implementing HIV/AIDS prevention and control activities within the jurisdiction of the People's Committee of the commune.

3. The commune health station is responsible for receiving and consolidating reports in accordance with the provisions of Clause 1 of this Article.

4. Units specified in Clause 2 of this Article must submit their reports to the commune health station no later than the 16th day of the last month of the reporting period.

Article 5. Content, Subjects, and Procedures for Reporting at District Level

1. Report Content:

a) Commune health stations report in accordance with Clause 3 of Article 4 of this Circular;

b) Agencies and organizations under the management of the district People's Committee that implement HIV/AIDS prevention and control activities report quarterly and annually on intervention activities to reduce harm, HIV testing counseling, HIV/AIDS prevention and control communication, methadone substitution therapy for opiate addiction treatment, antiretroviral therapy (ART) management, co-infection management between HIV and Tuberculosis and Hepatitis C, mother-to-child transmission prevention, pre-exposure prophylaxis (PrEP), and high-risk population counts according to corresponding forms specified in Appendices 2 and 3 attached to this Circular.

2. Reporting Units:

a) Commune health stations;

b) Agencies and organizations under the management of the district People's Committee that implement HIV/AIDS prevention and control activities.

3. Units Receiving and Consolidating Reports: The district health center is responsible for receiving and consolidating reports in accordance with the provisions of Point b of Clause 1 of this Article.

4. Deadline for Submission of Reports: Units specified in Clause 2 of this Article must submit their reports to the district health center no later than the 18th day of the last month of the reporting period.

3. The unit receiving and compiling reports: The District Health Center is the unit receiving and compiling reports as prescribed in point b, Clause 1 of this Article.

4. Deadline for submitting reports: Units specified in Clause 2 of this Article shall submit their reports to the District Health Center no later than the 18th day of the last month of the reporting period.

Article 6. Content, subjects, reporting procedures at provincial level

b) Agencies and organizations under the management of the district People's Committee that implement HIV/AIDS prevention and control activities report quarterly and annually on intervention activities to reduce harm, HIV testing counseling, HIV/AIDS prevention and control communication, methadone substitution therapy for opiate addiction treatment, antiretroviral therapy (ART) management, co-infection management between HIV and Tuberculosis and Hepatitis C, mother-to-child transmission prevention, pre-exposure prophylaxis (PrEP), and high-risk population counts according to corresponding forms specified in Appendices 2 and 3 attached to this Circular.

a) The District Health Centers report in accordance with Clause 3, Article 5 of this Circular;

b) The agencies and organizations specified in points b, c, and d, Clause 2, Article 5 of this Circular report quarterly and annually on the results of their activities in accordance with point b, Clause 1, Article 5 and early HIV diagnosis for children under 18 months old, service provision points, funding for HIV/AIDS prevention and control services, and health insurance according to the corresponding forms set out in Appendix 4 and Appendix 5 attached to this Circular.

b) Agencies and organizations under the management of the district People's Committee that implement HIV/AIDS prevention and control activities.

a) District Health Centers;

b) Agencies and organizations under the management authority of the Provincial People's Committee that implement HIV/AIDS prevention and control activities;

c) Agencies and organizations directly under the Ministry of Health and other ministries, sectors implementing HIV/AIDS prevention and control activities within the province;

d) Agencies, organizations, units not falling under the cases specified in points a, b, and c of this Article that implement HIV/AIDS prevention and control activities within the province.

3. Units receiving and consolidating reports: The Provincial Center for Disease Control and Prevention, or the Tropical Diseases Hospital of Hung Yen Province and the Tropical Diseases Hospital of Hai Duong Province (hereinafter referred to as the provincial reporting focal agency for HIV/AIDS prevention and control activities) receives and consolidates reports in accordance with point b, Clause 1 of this Article.

4. Deadline for submitting reports: The units specified in Clause 2 of this Article must submit their reports to the provincial reporting focal agency for HIV/AIDS prevention and control activities no later than the 19th day of the last month of the reporting period.

Article 7. Content, subjects, reporting procedures at central level

1. Reporting content as stipulated in point b, Clause 1 of Article 6 of this Circular.

2. Reporting units: The provincial reporting focal agency for HIV/AIDS prevention and control activities.

3. Units receiving and consolidating reports:

a) The Central Institute of Hygiene and Epidemiology, the Western Highlands Institute of Hygiene and Epidemiology, the Pasteur Institute of Nha Trang, and the Ho Chi Minh City Pasteur Institute (hereinafter referred to as Institutes) receive, consolidate, and submit quarterly and annual reports on the results of HIV/AIDS prevention and control activities according to Appendices 4 and 5 issued together with this Circular from the provinces under their jurisdiction to the Ministry of Health (AIDS Control Department);

b) The Ministry of Health (AIDS Control Department) receives, consolidates quarterly and annual reports on the results of HIV/AIDS prevention and control activities nationwide according to Appendices 4 and 5 issued together with this Circular for reporting purposes and data management to serve planning and policy formulation.

4. Deadline for submitting reports:

a) The provincial reporting focal agency for HIV/AIDS prevention and control activities must submit their reports to the Institutes and the Ministry of Health (AIDS Control Department) no later than the 20th day of the last month of the reporting period;

b) The Institutes must submit their reports to the Ministry of Health (AIDS Control Department) no later than the 21st day of the last month of the reporting period.

Article 8. Implementation organization

1. The AIDS Control Department, Ministry of Health shall be responsible for:

a) Taking the lead and coordinating with relevant agencies and organizations to direct, inspect, review, conclude, train, and support the implementation of the provisions of this Circular throughout the country;

b) Developing and deploying online reporting software applications.

2. The Departments of Health of provinces and centrally-administered cities shall be responsible for:

a) Taking the lead and coordinating to organize and direct the implementation, inspection of the provisions of this Circular within their jurisdiction;

b) Taking the lead and coordinating with agencies and organizations to direct, support, and supervise the reporting of HIV/AIDS prevention and control activities by related units within their jurisdiction.

3. The Institutes shall be responsible for:

a) Guiding, inspecting, supervising, and organizing training for provinces and cities within their jurisdiction to implement the provisions of this Circular;

b) Reviewing, providing feedback on data, and supporting provinces and cities to ensure the quality of data reviews;

c) Consolidating, analyzing data, and reporting on the results of HIV/AIDS prevention and control activities within their jurisdiction quarterly and annually.

4. The provincial reporting focal agency for HIV/AIDS prevention and control activities of centrally-administered cities shall be responsible for:

a) Advising the Department of Health to implement inspections, supervision, and evaluation of the implementation of HIV/AIDS prevention and control activity reporting within the province;

b) Organizing training, guidance, and support for organizations, agencies, and units within their jurisdiction to implement reporting in accordance with this Circular.

5. Organizations, agencies, and units specified in Clause 2 of Articles 4, 5, 6, and 7 of this Circular shall be responsible for:

a) Assigning staff members responsible for consolidating and reporting in accordance with the provisions of this Circular;

b) Complying with the full, accurate, and timely consolidation and reporting of information as stipulated in this Circular.

Article 9. Effective Date

1. This Circular takes effect from May 1, 2023.

2. Circular No. 03/2015/TT-BYT dated March 16, 2015, of the Minister of Health on the reporting system for HIV/AIDS prevention and control work shall cease to be effective from the date this Circular comes into force.

Article 10. Responsibility for Implementation

The Director of the AIDS Control Department, the Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments, and the Directors of the Centrally-Administered Cities’ Departments of Health, and related agencies, organizations, and individuals are responsible for implementing this Circular.

In the course of implementation, if there are any difficulties, agencies, organizations, and individuals are requested to reflect them to the Ministry of Health (AIDS Control Department) for consideration and resolution./.
