CIRCULAR

Amending and supplementing certain Articles of relating to road transport, supporting road transport services, vehicles, and drivers

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to Decree No. 65/2016/NĐ-CP dated July 1, 2016 of the Government on business conditions for automobile driving training services and driving examination services; Decree No. 138/2018/NĐ-CP dated October 8, 2018 of the Government amending and supplementing certain articles of Decree No. 65/2016/NĐ-CP dated July 1, 2016 of the Government on business conditions for automobile driving training services and driving examination services; Decree No. 70/2022/NĐ-CP dated September 27, 2022 of the Government amending and supplementing certain articles of decrees related to business activities in the road sector;

Pursuant to Decree No. 10/2020/NĐ-CP dated January 17, 2020 of the Government on business and business conditions for road passenger transport by motor vehicles; Decree No. 47/2022/NĐ-CP dated July 19, 2022 of the Government amending and supplementing certain articles of Decree No. 10/2020/NĐ-CP dated January 17, 2020 of the Government on business and business conditions for road passenger transport by motor vehicles;

BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;

At the request of the Director of the Transport Department and the Director General of the Vietnam Highway Administration,

The Minister of Transport issues this Circular to amend and supplement certain articles of the aforementioned Circulars relating to road transport, supporting road transport services, vehicles, and drivers.

Article 1. Amend and supplement certain articles of Circular No. 06/2011/TT-BGTVT dated March 7, 2011 of the Minister of Transport on providing legal knowledge training for operators of special-purpose motorcycles participating in road traffic

1. Repeal Point b Clause 2 Article 4; Point b Clause 2 Article 10.

2. Replace Appendix 1, Appendix 2, and Appendix 8 issued together with Circular No. 06/2011/TT-BGTVT respectively with Appendix I, Appendix II, and Appendix III issued together with this Circular.

Article 2. Amend and supplement certain articles of Circular No. 09/2015/TT-BGTVT dated April 15, 2015 of the Minister of Transport on providing, managing, and using data from vehicle telematics devices (hereinafter referred to as Circular No. 09/2015/TT-BGTVT), Circular No. 36/2020/TT-BGTVT dated December 24, 2020 of the Minister of Transport amending and supplementing certain articles of Circulars on periodic reporting systems in the road sector (hereinafter referred to as Circular No. 36/2020/TT-BGTVT), and Circular No. 05/2023/TT-BGTVT dated April 27, 2023 of the Minister of Transport amending and supplementing certain articles of Circulars relating to road transport, supporting road transport services, vehicles, and drivers (hereinafter referred to as Circular No. 05/2023/TT-BGTVT).

1. Amend and supplement Point b Clause 3, Point c Clause 3 Article 4 of Circular No. 09/2015/TT-BGTVT (already amended and supplemented at Clause 1 Article 9 of Circular No. 05/2023/TT-BGTVT) as follows:

a) Amend and supplement Point b Clause 3 Article 4 of Circular No. 09/2015/TT-BGTVT (already amended and supplemented at Clause 1 Article 9 of Circular No. 05/2023/TT-BGTVT) as follows:

“b) Data from the telematics device must be transmitted from the service server to the Vietnam Highway Administration server in chronological order. Within three days from the last day the Vietnam Highway Administration server received data, if transmission is interrupted, both old and current data should be sent simultaneously when connection is restored; for cases exceeding three days, the data transmitting unit shall notify the Vietnam Highway Administration to arrange a channel for retransmitting the data;”

b) Amend and supplement Point c Clause 3 as follows:

“c) The data transmission protocol shall be publicly announced on the Vietnam Highway Administration’s website.”

2. Amend and supplement Article 5 of Circular No. 09/2015/TT-BGTVT (already amended and supplemented at Clause 1 Article 9 of Circular No. 05/2023/TT-BGTVT) as follows:

“Article 5. Provisions on calculation methods

1. Calculations for kilometers driven, speed, continuous driving time, and daily working hours of drivers shall be conducted on the service server and the Vietnam Highway Administration server. Data in error messages shall not be used for calculations; detailed noise filtering procedures before calculations are specified in Appendix 3 issued together with this Circular.

2. Calculation of excessive speed

a) The method for determining excessive speed shall be carried out according to the provisions in Appendix 2 issued together with this Circular;

b) Software on the server will calculate excessive speed based on the coordinates and orientation of speed limit signs and restricted speed zones published by traffic management authorities. In cases where there is no data on the coordinates and orientation of speed limit signs and restricted speed zones published by traffic management authorities, calculations will be based on the maximum permitted speed for each type of vehicle outside densely populated areas. If the maximum permitted speeds for different lanes of a road are different, calculations will be based on the highest permitted speed lane.

3. Calculation of driving time

a) Driving time of a driver is determined when the driver operates a vehicle in traffic (only counting time when the vehicle is moving at a speed);

b) Excessive continuous driving time is determined when the total driving time of a driver exceeds four hours without stopping as required under Clause 4 Article 11 of Decree No. 10/2020/NĐ-CP dated January 17, 2020 of the Government on business and business conditions for road passenger transport by motor vehicles or without changing drivers;

c) Excessive working time of a driver in a day is determined when the total driving time of a driver in a day exceeds ten hours. A driver's workday is calculated from 00:00 to 24:00;

d) The calculation method shall be carried out according to the provisions in Appendix 6 issued together with this Circular.

4. Determination of non-transmitted data

Data transmission is not determined when the vehicle changes position from the recorded position at the time data transmission was stopped, and there is no data during the period the vehicle moves between two positions. The calculation method shall be carried out in accordance with Appendix 4 issued together with this Circular.

5. Calculation of kilometers driven shall be conducted in accordance with the provisions set forth in Appendix 5 issued together with this Circular.

6. The value of the calculation result shall be rounded to two decimal places.”

3. Amend and supplement Article 6 of Circular No. 09/2015/TT-BGTVT (amended and supplemented by Clause 1, Article 9 of Circular No. 05/2023/TT-BGTVT) as follows:

“Article 6. Provisions on Exploitation and Use of Data

1. Exploitation of data from the vehicle tracking device shall be carried out in accordance with the laws on the application of information technology in the activities of state agencies.

2. Information and data from the vehicle tracking device shall be exploited and used to serve the management of transportation activities of transport service providers; to serve the management of state administration over transportation activities, traffic order and safety, public security, taxes, and anti-smuggling efforts.

3. Information and data in the database from the vehicle tracking device on the network shall be kept confidential in accordance with the laws on information technology.

4. Publish publicly on the electronic information website of the Department of Transport the results of handling violations through the vehicle tracking device for vehicles and drivers licensed by the Department.”

4. Amend and supplement Clause 1, Article 7 of Circular No. 09/2015/TT-BGTVT (amended and supplemented by Clause 1, Article 9 of Circular No. 05/2023/TT-BGTVT) as follows:

“1. The Vietnam Highway Administration manages a unified information system nationwide, compiles and analyzes according to the input data indicators transmitted from the service server to serve the management of transportation business activities, including:

a) Comprehensive and detailed reports on cases where vehicles exceed speed limits; comprehensive and detailed reports on cases where drivers continuously exceed four hours; comprehensive and detailed reports on cases where drivers work more than ten hours in a day; comprehensive and detailed reports on cases where data is not transmitted daily; comprehensive and detailed reports on cases where data is not transmitted while the vehicle is moving; comprehensive and detailed reports on cases where full information is not transmitted as prescribed; detailed reports on abnormal data phenomena;

b) Comprehensive and detailed travel route reports; comprehensive reports on vehicles and transport service providers by type of business; detailed parking reports for vehicles;

c) Comprehensive and detailed reports as stipulated in Articles 6, 7, 8, and 22 of Government Decree No. 10/2020/NĐ-CP dated January 17, 2020, on business operations and conditions for operating road passenger transport services by motor vehicles;

d) Displaying vehicle information on digital maps to serve online monitoring and information retrieval.”

5. Amend and supplement Clauses 2, 6, 9, and 10 of Article 8 of Circular No. 09/2015/TT-BGTVT (amended and supplemented by Clause 1, Article 9 of Circular No. 05/2023/TT-BGTVT) as follows:

a) Amend and supplement Clause 2 of Article 8 of Circular No. 09/2015/TT-BGTVT (amended by Clause 1, Article 9 of Circular No. 05/2023/TT-BGTVT) as follows:

“2. Carry out the reception, compilation, and analysis of data transmitted from the service server according to the indicators specified in Clause 1 of this Circular. Issue warnings on the Vietnam Highway Administration's information system for data exploitation units to know cases where data has not been received for 30 minutes or longer or network transmission issues or server failures of the Vietnam Highway Administration.”

b) Amend and supplement Clause 6 of Article 8 of Circular No. 09/2015/TT-BGTVT (amended and supplemented by Clause 1, Article 9 of Circular No. 05/2023/TT-BGTVT) as follows:

“6. Exploit and use data from the vehicle tracking device on the Vietnam Highway Administration's information system when conducting inspections and checks at localities or upon written requests from competent authorities.”

c) Amend and supplement Clause 9 of Article 8 of Circular No. 09/2015/TT-BGTVT (amended and supplemented by Clause 1, Article 9 of Circular No. 05/2023/TT-BGTVT) as follows:

“9. Store report data on the Vietnam Highway Administration's information system for a minimum of two years.”

d) Amend and supplement Clause 10 of Article 8 of Circular No. 09/2015/TT-BGTVT as follows:

“10. Compile the results of handling through data from the vehicle tracking device of the Departments of Transport.”

6. Amend and supplement Point b, Clause 1, Clause 3, and add Clause 9 to Article 9 (amended and supplemented by Clause 1, Article 9 of Circular No. 05/2023/TT-BGTVT) as follows:

a) Amend and supplement Point b, Clause 1 of Article 9 of Circular No. 09/2015/TT-BGTVT as follows:

“b) Exploit and use data on the Vietnam Highway Administration's information system to monitor, correct, and handle violations in transportation activities by transport service providers, vehicles, and drivers within the locality.”

b) Amend and supplement Clause 3 of Article 9 of Circular No. 09/2015/TT-BGTVT (amended and supplemented by Clause 1, Article 9 of Circular No. 05/2023/TT-BGTVT) as follows:

“3. Protect usernames and passwords for accessing, and information and data on the Vietnam Highway Administration's system in accordance with regulations. In case of need for reissue or additional issuance, a written request must be sent to the Vietnam Highway Administration.”

c) Add Clause 9 to Article 9 of Circular No. 09/2015/TT-BGTVT as follows:

“9. Notify the Vietnam Highway Administration of cases where data is abnormal or requires verification of information during the exploitation and use of data on the system.”

7. Amend and supplement Clause 2, Clause 7 of Article 10 of Circular No. 09/2015/TT-BGTVT (amended and supplemented by Clause 1, Article 9 of Circular No. 05/2023/TT-BGTVT dated April 27, 2023) as follows:

a) Amend and supplement Clause 2 of Article 10 of Circular No. 09/2015/TT-BGTVT (amended and supplemented by Clause 1, Article 9 of Circular No. 05/2023/TT-BGTVT) as follows:

"2. Accurately and completely transmit the data specified in Clause 1, Article 4 of this Circular to the Vietnam Highway Administration. Provide access passwords to the database and exploitation software, decryption algorithms in cases where information is encrypted in the unit's database to competent authorities upon request."

b) Amend and supplement Clause 7, Article 10 of Circular No. 09/2015/TT-BGTVT as follows:

"7. Handle management, monitoring, exploitation, and usage responsibilities for data for individuals and units' departments."

8. Supplement Clause 7 into Article 12 of Circular No. 09/2015/TT-BGTVT as follows:

"7. Provide access passwords to the database and decryption algorithms in cases where information is encrypted in the database to competent authorities upon request."

9. Replace Appendix I, Appendix II, Appendix III, Appendix IV, Appendix V, and Appendix VI issued with Circular No. 09/2015/TT-BGTVT respectively with Appendix IV, Appendix V, Appendix VI, Appendix VII, Appendix VIII, and Appendix IX issued with this Circular.

10. Repeal Clause 4, Article 7 of Circular No. 09/2015/TT-BGTVT; Clause 13, Article 8 of Circular No. 09/2015/TT-BGTVT (amended and supplemented by Clause 1, Article 3 of Circular No. 36/2020/TT-BGTVT and Point b, Clause 1, Article 9 of Circular No. 05/2023/TT-BGTVT).

11. Repeal Appendices VII, VIII, IX, X, XI, XII, XIII, XIV, XV, XVI, XVII, XVIII, XIX, XX, and XXI issued with Circular No. 09/2015/TT-BGTVT.

12. Repeal Appendix XXII of Circular No. 09/2015/TT-BGTVT (amended and supplemented by Circular No. 36/2020/TT-BGTVT).

Article 3. Amend and supplement some articles of Circular No. 29/2015/TT-BGTVT dated July 6, 2015, issued by the Minister of Transport on the issuance and use of international driving permits (hereinafter referred to as Circular No. 29/2015/TT-BGTVT), Circular No. 01/2021/TT-BGTVT dated January 27, 2021, issued by the Minister of Transport amending and supplementing some articles of Circular No. 29/2015/TT-BGTVT dated July 6, 2015, issued by the Minister of Transport on the issuance and use of international driving permits and Circular No. 12/2017/TT-BGTVT dated April 15, 2017, issued by the Minister of Transport on training, examination, and issuance of motor vehicle driver’s licenses (hereinafter referred to as Circular No. 01/2021/TT-BGTVT)

Replace corresponding Appendix IV with Appendix X issued with this Circular.

Article 4. Amend and supplement some articles of Circular No. 12/2017/TT-BGTVT dated April 15, 2017, issued by the Minister of Transport on training, examination, and issuance of motor vehicle driver’s licenses (hereinafter referred to as Circular No. 12/2017/TT-BGTVT), Circular No. 38/2019/TT-BGTVT dated October 8, 2019, issued by the Minister of Transport amending and supplementing some articles of Circular No. 12/2017/TT-BGTVT dated April 15, 2017, issued by the Minister of Transport on training, examination, and issuance of motor vehicle driver’s licenses (hereinafter referred to as Circular No. 38/2019/TT-BGTVT), Circular No. 01/2021/TT-BGTVT dated January 27, 2021, issued by the Minister of Transport amending and supplementing some articles of Circular No. 29/2015/TT-BGTVT dated July 6, 2015, issued by the Minister of Transport on the issuance and use of international driving permits and Circular No. 12/2017/TT-BGTVT dated April 15, 2017, issued by the Minister of Transport of the Ministry of Transport on training, examination, and issuance of motor vehicle driver’s licenses (hereinafter referred to as Circular No. 01/2021/TT-BGTVT), Circular No. 04/2022/TT-BGTVT dated April 22, 2022, issued by the Minister of Transport amending and supplementing some articles of Circular No. 12/2017/TT-BGTVT dated April 15, 2017, issued by the Minister of Transport on training, examination, and issuance of motor vehicle driver’s licenses (hereinafter referred to as Circular No. 04/2022/TT-BGTVT), Circular No. 05/2023/TT-BGTVT dated April 27, 2023, issued by the Minister of Transport amending and supplementing some articles of related Circulars concerning road transport, supporting road transport services, vehicles, and drivers (hereinafter referred to as Circular No. 05/2023/TT-BGTVT)

1. Supplement Clause 14 into Article 3 as follows:

"14. The nighttime driving lesson time is counted from 18:00 on the previous day to 05:00 on the following day."

2. Amend and supplement Clause 12, Clause 15, and supplement Clauses 20, 21, 22, 23, and 24 into Article 5 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Clause 1, Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

a) Amend and supplement Clause 12 of Article 5 of Circular No. 12/2017/TT-BGTVT as follows:

"12. Organize the examination and issue certificates for basic vocational training or training certificates for students learning to drive cars and tractors category A4."

b) Amend and supplement Clause 15 of Article 5 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Clause 1, Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

"15. Examination registration report"

a) For categories A1 and A2 driving training: the training institution prepares the examination registration report according to the model prescribed in Appendix 2 issued with this Circular and sends it to the Department of Transport; the report must have the stamp of the training institution;

b) For categories A3, A4, B1, B2, C, D, E, and F driving training: the training institution prepares the examination registration report for driving, student list (report 1), and the list requesting verification of previously issued driver’s licenses for upgrading purposes, according to the models prescribed in Appendices 3a, 3b, and 3c issued with this Circular and sends them to the Department of Transport; the report must have the stamp of the training institution;

c) Report 1 should be sent via one of the following methods: directly, postal service, electronic document, and simultaneously transmit data through the driver’s license information system to the Department of Transport before the examination for categories A1 and A2 at least four working days prior to the examination, for categories A3 and A4 immediately after the course starts, and not later than seven days after the course starts for categories B1, B2, D, E, and F, and not later than fifteen days after the course starts for category C; the head of the examination management authority shall check and sign each page (including all pages of Report 1);

d) For examination registration reports for categories A1 and A4 for ethnic minority people who cannot read or write Vietnamese, they should be sent to the Department of Transport via one of the following methods: directly, postal service, electronic document, and simultaneously transmit data through the driver’s license information system at least thirty days before the examination."

c) Add Clause 20 to Article 5 of Circular No. 12/2017/TT-BGTVT as follows:

“20. The training institution bases on the curriculum, textbooks, materials, teachers, classroom system, driving practice vehicles, and the needs of learners to develop a training plan with a number of trainees ensuring conditions as prescribed in Clause 3 of Article 4 of this Circular.”

d) Add Clause 21 to Article 5 of Circular No. 12/2017/TT-BGTVT as follows:

“21. A driving training institution that is dissolved shall be responsible for:

a) Before dissolving the training institution, submit a report on the policy and solution to ensure the rights of learners currently being trained to the Department of Transport for monitoring and management;

b) Ensure full rights of learners according to the training contract;

c) Within ten days from the date the decision to dissolve the training institution takes effect, hand over all files to the approved training institution to continue training including: the report on application for driving license examination, list of students (report 1) and the file of the learner driver; report to the Department of Transport for monitoring and management;

d) Within ten days from the date the decision to dissolve the training institution takes effect, review and compile a list of candidates who have been issued a basic vocational certificate or training certificate, and hand over the files of learners currently under management to the Department of Transport for continued monitoring and management.”

đ) Add Clause 22 to Article 5 of Circular No. 12/2017/TT-BGTVT as follows:

“22. A driving training institution when its training license is revoked shall be responsible for:

a) Within ten days from the date the decision to revoke the training license takes effect, review, summarize, and compile a list of learners currently under management; develop a solution to ensure the rights of learners currently being trained and report to the Department of Transport for monitoring and management;

b) Ensure the rights of learners according to the training contract. In case learners agree to continue training, negotiate with other driving training institutions in the area to transfer the obligation of training. If learners do not agree to continue training, negotiate with the learners and terminate the contract;

c) Within twenty days from the date the decision to revoke the training license takes effect, hand over the list of learners currently under management along with the files including: list of students (report 1), report on application for driving license examination, and learner's file and data (if any) to the receiving driving training institution; simultaneously report to the Department of Transport for monitoring and management.”

e) Add Clause 23 to Article 5 of Circular No. 12/2017/TT-BGTVT as follows:

“23. A driving training institution receiving students from dissolved training institutions or those whose licenses have been revoked shall accept the files and documents specified in point c of Clause 21 and point c of Clause 22 of this Article and be responsible for continuing to manage learners according to current regulations. The handover must be documented, including the following contents: fully and clearly record the transferred documents; commitment and responsibility of each party (both the transferring and receiving parties have obligations and responsibilities related to the transferred files, documents, and assets).”

g) Add Clause 24 to Article 5 of Circular No. 12/2017/TT-BGTVT as follows:

“24. Based on the content and training program for drivers stipulated in Articles 12, 13, 14, and Appendix 31 issued together with this Circular, develop a training program for drivers and report to the Department of Transport for monitoring and management:

a) The theoretical content can be conducted in one of the following forms: centralized at the training institution; centralized at the training institution combined with distance learning and guided self-study; distance learning and guided self-study. The development of systems, learning materials, methods of distance learning and guided self-study, and the system of applications for managing distance learning and guided self-study shall comply with the provisions of Appendix 40 issued together with this Circular. Specifically, for subjects such as vehicle structure and general repair, fire prevention and firefighting skills, rescue techniques, and driving techniques, learners must study centrally at the training institution;

b) Practical driving content shall be conducted in a centralized form.”

3. Amend and supplement Clause 1, Clause 2, Clause 3, and Clause 5 of Article 6 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at point a and point b of Clause 4 of Article 1 of Circular No. 04/2022/TT-BGTVT) as follows:

a) Amend and supplement Clause 1 of Article 6 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at point a of Clause 4 of Article 1 of Circular No. 04/2022/TT-BGTVT) as follows:

“1. The training textbook for drivers must be consistent with the framework training program for drivers stipulated in Appendix 31 issued together with this Circular; the training institution for drivers shall prepare, review, and issue the textbook in accordance with the laws on vocational education.”

b) Amend and supplement Clause 2 of Article 6 of Circular No. 12/2017/TT-BGTVT as follows:

“2. Forms and records used by automobile driving training institutions include:

a) Report on application for driving license examination;

b) Training plan according to the model prescribed in Appendix 4 issued together with this Circular;

c) Record of academic performance in accordance with the laws on vocational education.”

c) Amend and supplement Clause 3 of Article 6 of Circular No. 12/2017/TT-BGTVT as follows:

“3. Driving training institutions for category A4 shall use the record of academic performance as specified in point c of Clause 2 of this Article.”

d) Amend point b of Clause 5 of Article 6 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at point b of Clause 4 of Article 1 of Circular No. 04/2022/TT-BGTVT) as follows:

“b) Two years for graduation files, stored data management time for theoretical courses on traffic laws for automobile learners (except for category B1), data on practical driving training time on driving simulators; electronic storage for data management time for remote learning and guided self-study.”

4. Amend and supplement Clause 2 and add Clause 3 of Article 8 of Circular No. 12/2017/TT-BGTVT as follows:

a) Amend and supplement Clause 2 of Article 8 of Circular No. 12/2017/TT-BGTVT as follows:

“2. Individuals seeking a driving license for categories B2, C, D, E, and F shall be trained:

a) For theoretical content, one of the following forms shall be selected: centralized training at the training facility; centralized training at the training facility combined with distance learning and guided self-study; distance learning and guided self-study. Specifically, for subjects that must be studied through centralized training at the training facility, they include: vehicle structure and routine maintenance; fire prevention, firefighting, and rescue skills; driving techniques.

b) For practical driving training: centralized form.

Theoretical and practical subjects must be tested at the training facility to be eligible for issuance of a初级工证书 or training certificate.

b) Supplement Clause 3 to Article 8 of Circular No. 12/2017/TT-BGTVT as follows:

"3. If, within one year from the date of the training facility's examination or issuance of the certificate upon completion of the course, the trainee does not meet the conditions for issuance of a初级工证书 or training certificate, they must retake the course."

5. Amend and supplement Article 9 of Circular No. 12/2017/TT-BGTVT (which has been amended and supplemented by Clause 31 of Article 1 of Circular No. 38/2019/TT-BGTVT; Clause 2 of Article 2 of Circular No. 01/2021/TT-BGTVT) as follows:

Article 9. Application Documents of Driving Learners

1. A driving learner applying for the first time shall prepare one set of application documents and submit them directly to the training facility. The documents shall include:

a) An application form for driving training and examination for license issuance according to the model prescribed in Appendix 7 attached to this Circular;

b) A copy of the temporary residence card or permanent residence card or diplomatic identification card or service identification card for foreign nationals;

c) A health certificate issued by a qualified medical institution.

2. A driving learner applying for a higher category shall prepare one set of application documents and submit them directly to the training facility, and take a direct photograph to be retained in the driver’s license database. The documents shall include:

a) Documents stipulated in Clause 1 of this Article;

b) A copy of the secondary school graduation certificate or equivalent for those upgrading their license to categories D or E (the original must be presented during the examination);

c) A declaration of driving experience and safe mileage according to the model prescribed in Appendix 8 attached to this Circular.

3. Ethnic minority learners who do not read or write Vietnamese applying for motorcycle licenses A1 and A4 shall prepare one set of application documents and submit them directly to the training facility. The documents shall include the documents specified in Point c, Clause 1 of this Article.

6. Amend and supplement Clause 9 of Article 10 of Circular No. 12/2017/TT-BGTVT (which has been amended and supplemented by Point a, Clause 5 of Article 1 of Circular No. 04/2022/TT-BGTVT; Clause 1 of Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

"9. Information technology applications in managing the DAT system of the Vietnam Highway Administration ensure the reception, consolidation, and analysis of management data to serve the exploitation of management data and the management of driving training work of the Departments of Transport; ensuring the continuous and stable operation of the DAT system of the Vietnam Highway Administration and storing management data for a minimum of two years; information extracted from the software is compiled according to Model No. 01, Model No. 02, Model No. 03, Model No. 04, Model No. 05, and Model No. 06 in Appendix No. 32 attached to this Circular."

7. Amend and supplement Clause 3 and Clause 10 of Article 11 of Circular No. 12/2017/TT-BGTVT (which has been amended and supplemented by Point c, Clause 6 of Article 1 of Circular No. 04/2022/TT-BGTVT) as follows:

a) Amend and supplement Clause 3 of Article 11 of Circular No. 12/2017/TT-BGTVT as follows:

"3. Inspection of driving training activities at training facilities."

b) Amend and supplement Clause 10 of Article 11 of Circular No. 12/2017/TT-BGTVT (which has been amended and supplemented by Point c, Clause 6 of Article 1 of Circular No. 04/2022/TT-BGTVT) as follows:

"10. Utilize management data on the DAT system software of the Vietnam Highway Administration according to Model No. 06 in Appendix 32 attached to this Circular, and the confirmation printed on the driving simulator cabin indicating that the trainee has completed the required duration and content of practical driving training on the driving simulator cabin provided by the training facility to review the list of trainees eligible to participate in the examination period. In case the Vietnam Highway Administration announces the suspension of the DAT system for maintenance or repair or due to a malfunction, the Departments of Transport shall utilize the management data of the training facility."

8. Amend and supplement Article 13 of Circular No. 12/2017/TT-BGTVT (which has been amended and supplemented by Clause 7 of Article 1 of Circular No. 04/2022/TT-BGTVT) as follows:

Article 13. Driver Training for Categories B1, B2, C

1. Examination and Issuance of Primary Vocational Certificate, Training Certificate

a) Examination at the end of theoretical subjects according to the set of examination questions on theory (the content includes subjects such as Road Traffic Law; vehicle structure and common repairs; transportation operations; traffic ethics and culture, prevention of alcohol harm and fire hazards, rescue and emergency response when participating in traffic) and simulation of traffic situations;

b) Examination at the end of practical driving lessons with continuous tests, reverse parking in a square shape, and driving on roads;

10. Amend and Supplement Article 15 of Circular No. 12/2017/TT-BGTVT (already amended at points a, b, c, d, đ, and e of Clause 11, Article 1 of Circular No. 38/2019/TT-BGTVT) as follows:

"Article 15. Detailed Content of Subjects

Based on the driver training program prescribed in Articles 12, 13, and 14, and the framework training program for drivers prescribed in Appendix 31 issued together with this Circular, the head of the driver training institution shall be responsible for organizing the detailed content of subjects for approval and inclusion in the training program."

11. Amend and Supplement Clause 13 of Article 16 of Circular No. 12/2017/TT-BGTVT as follows:

"13. The category of driver's license used for driving passenger vehicles shall comply with the provisions of Clauses 9 and 10 of this Article. In cases where the vehicle is designed or modified according to the regulations on modification of motor vehicles in accordance with the number of seats being less than that of similar models within the size limit, the category of driver's license shall be determined based on the similar model within the size limit."

12. Amend and Supplement Clause 7 of Article 18 of Circular No. 12/2017/TT-BGTVT (already amended and supplemented at Clause 4 of Article 2 of Circular No. 01/2021/TT-BGTVT; Clause 1 of Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

"7. Maintain a camera system for the theoretical examination room, traffic situation simulation, and driving test field in the form of a driving test at areas including starting, stopping and restarting on a slope, passing through tire tracks, turning at intersections, parking, and the final test; the system uses IP cameras with a resolution of HD or higher, interactive interface, connection meeting the minimum standard of ONVIF, synchronized with the theoretical examination server, driving test scoring computer; ensuring online connectivity, transmitting image data (in video format) using real-time two-way data exchange protocol between the server and terminal station (websocket) to the Vietnam Highway Administration. Provide access addresses to the system for direct supervision by the Vietnam Highway Administration and Provincial Department of Transport during the examination process and for management purposes. Image data (in video format) from the theoretical examination room and driving test field must be displayed directly on screens installed in the waiting room and stored at the examination center as prescribed. The above equipment systems must ensure security and prevent unauthorized external access."

13. Amend and Supplement the beginning of Clause 1, the beginning of Clause 2, the beginning of Clause 3, and the beginning of Clause 4 of Article 19 of Circular No. 12/2017/TT-BGTVT (already amended at Clause 1 of Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

a) Amend and Supplement the beginning of Clause 1 of Article 19 of Circular No. 12/2017/TT-BGTVT as follows:

"1. For first-time candidates for driving examinations

The driver training institution establishes one set of files, sent via one of the following methods: direct submission, postal service, electronic document, simultaneously transmitting data through the driver’s license information system to the Provincial Department of Transport. The file includes:"

b) Amend and Supplement the beginning of Clause 2 of Article 19 of Circular No. 12/2017/TT-BGTVT as follows:

"2. For candidates upgrading their driver’s license to categories B1, B2, C, D, E, and F

The driver training institution establishes one set of files, sent via one of the following methods: direct submission, postal service, electronic document, simultaneously transmitting data through the driver’s license information system to the Provincial Department of Transport. d) Amend and supplement the first part of Clause 4, Article 19 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Point a, Clause 1, Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“4. For individuals retaking the examination due to loss of their driving license,

The driver shall prepare one set of application documents and submit them directly to the Department of Transport. The application documents include:”.

14. Amend and supplement Clause 4 and Clause 5 of Article 21 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Point c, Clause 13, Article 1 of Circular No. 38/2019/TT-BGTVT; Clause 1, Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

a) Amend and supplement Clause 4 of Article 21 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Point c, Clause 13, Article 1 of Circular No. 38/2019/TT-BGTVT) as follows:

“4. The organization of driving examinations shall be carried out as follows:

a) The theoretical examination shall be conducted on a computer (except for the A1 category in areas belonging to cities from type 3 and above with a distance to the city center of type 3 and above exceeding 100 km, which may be permitted to take the examination using paper-based multiple-choice questions); the examination room for theoretical tests shall have cameras to monitor the examination process;

b) The simulation of traffic situations on a computer shall be conducted for categories B1, B2, C, D, E, and F; the examination room shall have cameras to monitor the examination process;

c) The practical driving test in a simulated environment for categories A1 and A2 shall be conducted at a driving examination center or training facility with a suitable examination area and automatic scoring equipment (except for areas with a distance to the city center of type 3 and above exceeding 100 km, which may be permitted to conduct the test using direct manual scoring);

d) The practical driving test in a simulated environment for category F shall be conducted at a driving examination center or an examination area with suitable conditions within a driving examination center; there shall be no examiner seated in the examination vehicle;

đ) The practical driving test in a simulated environment for categories B1, B2, C, D, and E shall be conducted at a driving examination center equipped with automatic scoring equipment; there shall be no examiner seated in the examination vehicle;

e) The practical driving test on public roads shall apply to categories B1, B2, C, D, E, and F, with an examiner seated in the examination vehicle;

g) The practical driving test on public roads for categories B1, B2, C, D, and E must use automatic scoring equipment.”;

b) Amend and supplement Clause 5 of Article 21 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Clause 1, Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“5. Examination procedures

a) Categories A1 and A2 shall be carried out in accordance with the provisions of Appendix 33 issued together with this Circular;

b) Categories A3 and A4 shall be carried out in accordance with the provisions of Appendix 34 issued together with this Circular;

c) Categories B1, B2, C, D, and E shall be carried out in accordance with the provisions of Appendix 35 issued together with this Circular; categories FB2, FD, and FE shall be carried out in accordance with the provisions of Appendix 36 issued together with this Circular; category FC shall be carried out in accordance with the provisions of Appendix 37 issued together with this Circular.”.

15. Amend and supplement Clause 1, Point b, Point c, and Point đ of Clause 2, and Point a of Clause 3, Article 22 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Clause 1, Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

a) Amend and supplement Clause 1 of Article 22 of Circular No. 12/2017/TT-BGTVT as follows:

“1. For the examination period for categories A1 and A2

a) Receive reports on registration for the driving license examination for motorcycle categories A1 and A2 submitted by training institutions;

b) Check the application documents and examinees' eligibility according to the provisions of Article 19 of this Circular;

The person assigned to check and approve the application documents of candidates for the examination shall cooperate with the training institution to prepare a report on the document check according to the model specified in Appendix 11c issued together with this Circular;

c) For training and examination programs for ethnic minority people who cannot read or write Vietnamese, the following procedures shall be followed:

Within three working days, the Department of Transport shall send a letter according to the model specified in Appendix 38 issued together with this Circular to the People's Committee of the commune where the ethnic minority people reside to seek opinions; the deadline for seeking opinions shall not exceed fifteen days from the date the Department of Transport sends the letter.

During the opinion-seeking period, if the Department of Transport receives a letter from the People's Committee of the commune, it shall include the eligible candidates in the list of candidates permitted to take the examination; if the Department of Transport does not receive a letter from the People's Committee of the commune within the opinion-seeking period, it shall not include the candidates in the list of candidates permitted to take the examination.

If the Department of Transport receives a letter from the People's Committee of the commune after the fifteen-day period, it shall include the eligible candidates in the list of candidates permitted to take the examination for the next nearest examination period;

d) Based on the list of valid candidate application documents accompanied by the report on the document check for driving license candidates according to the model specified in Appendix 11c issued together with this Circular, the Department of Transport shall issue a decision to organize the examination period and establish the Examination Team.”;

b) Amend and supplement Point b of Clause 2 of Article 22 of Circular No. 12/2017/TT-BGTVT as follows:

“b) Receive the report requesting the organization of the driving examination along with the list of candidates for the examination (Report 2) submitted by the training institution according to the model specified in Appendices 11a and 11b issued together with this Circular. Report 2 shall be sent via postal service and transmitted through the driving license information system to the Department of Transport seven working days before the examination period;”;

c) Amend and supplement Point c of Clause 2 of Article 22 of Circular No. 12/2017/TT-BGTVT as follows:

"c) Check the application files and conditions of candidates for driving license categories A3, A4, B1, B2, C, D, E, and F according to Article 19 of this Circular, and candidates must be listed in the student report (report 1), candidate list for the driving test (report 2), and have a verified copy of the previously issued driving license (in cases where the driving license category is being upgraded)."

The person assigned to check and approve the candidate's application files shall cooperate with the training institution to prepare a record of file checks according to the model prescribed in Appendix 11c attached to this Circular."

d) Amend and supplement Point đ Clause 2 Article 22 of Circular No. 12/2017/TT-BGTVT as follows:

“đ) Based on the valid candidate lists attached to the Record of Application File Checks for Driving Tests according to the model prescribed in Appendix 11c attached to this Circular, the Department of Transport shall approve and issue a decision to organize the driving test; establish the Examination Board and Examination Team according to the models prescribed in Appendix 12a attached to this Circular, and the candidate list for issuing driving licenses for various categories according to the models prescribed in Appendices 12b and 12c attached to this Circular.”

đ) Amend and supplement Point a Clause 3 Article 22 of Circular No. 12/2017/TT-BGTVT as follows:

“a) Review and check the conditions as stipulated in Article 36, create a list of candidates for re-examination according to the model prescribed in Appendix 13 attached to this Circular; based on the results of the review and condition check, the Department of Transport shall issue a decision to organize the driving test together with the period specified in Clauses 1 and 2 of this Article; in cases where there is no suitable driving test period, the Examination Board and Examination Team shall be established according to regulations (the Examination Board does not include members from the training institution).”

16. Amend and supplement Clause 1, Clause 2, and add Point i to Clause 3 Article 23 of Circular No. 12/2017/TT-BGTVT (already amended and supplemented at Clause 14 Article 1 of Circular No. 38/2019/TT-BGTVT; Clause 1 Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

a) Amend and supplement the name of Clause 1 Article 23 of Circular No. 12/2017/TT-BGTVT (already amended and supplemented Clause 1 Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“1. The Examination Board shall be established by the Department of Transport.”

b) Amend and supplement Clause 2 Article 23 of Circular No. 12/2017/TT-BGTVT (already amended and supplemented at Clause 14 Article 1 of Circular No. 38/2019/TT-BGTVT, Clause 1 Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“2. Composition of the Examination Board”

a) The Chairman of the Board is a civil servant of the Department of Transport who holds a motor vehicle driver’s license.”

b) Members include: Director of the Examination Center, Head of the Training Institution, Examination Team Leader, and Secretary Member. The Secretary Member is from the Examination Management Agency under the Department of Transport. In cases where the Director of the Examination Center is also the Head of the Training Institution, they must delegate a deputy to participate in the Examination Board.”

c) Add Point i Clause 3 Article 23 of Circular No. 12/2017/TT-BGTVT as follows:

“i) Duties and authorities of the Examination Board members as prescribed in Appendix 39 attached to this Circular.”

17. Amend and supplement Clause 1, Clause 2, Point b Clause 6, and Clause 7 Article 26 of Circular No. 12/2017/TT-BGTVT (already amended and supplemented at Clause 1 Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

a) Amend and supplement Clause 1 Article 26 of Circular No. 12/2017/TT-BGTVT (already amended and supplemented at Clause 1 Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“1. Based on actual circumstances, the Department of Transport shall organize unannounced inspections of the examination period.”

b) Amend and supplement Clause 2 Article 26 of Circular No. 12/2017/TT-BGTVT (already amended and supplemented at Clause 1 Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“2. The examination inspectors are civil servants of the Department of Transport's Inspection Office. For motorcycle driving tests, two inspectors are required, and for automobile driving tests, three inspectors are required, including one inspector as the Team Leader.”

c) Amend and supplement Point b Clause 6 Article 26 of Circular No. 12/2017/TT-BGTVT (already amended and supplemented at Clause 1 Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“b) Report to the Director of the Department of Transport for consideration and handling.”

d) Amend and supplement Clause 7 Article 26 of Circular No. 12/2017/TT-BGTVT (already amended and supplemented at Clause 1 Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“7. At the end of the examination period, the Team Leader of the Supervision Team shall submit a written report of the supervision results to the Director of the Department of Transport.”

18. Amend and supplement Clause 3 Article 27 of Circular No. 12/2017/TT-BGTVT (already amended and supplemented at Clause 16 Article 1 of Circular No. 38/2019/TT-BGTVT; Clause 1 Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“3. On the basis of reviewing and summarizing the results of the Examination Management Agency, the Department of Transport shall issue a decision recognizing successful candidates for the examination period along with a list of successful candidates to be issued driving licenses according to the models prescribed in Appendices 16a and 16b attached to this Circular.”

19. Add Point đ to Clause 2, amend Point d Clause 5, and add Clause 6 to Article 28 of Circular No. 12/2017/TT-BGTVT (already amended and supplemented at Point c, Point d Clause 17 Article 1 of Circular No. 38/2019/TT-BGTVT) as follows:

a) Add Point đ to Clause 2 Article 28 of Circular No. 12/2017/TT-BGTVT as follows:

“đ) In cases where the training institution has an examination field, in addition to storing the documents prescribed in Points a, b, c, and d of this Clause, it must also store surveillance data of the theoretical examination room and the driving examination field in simulation; data of the theoretical and practical driving examination results in simulation.”

b) Amend and supplement Point d Clause 5 Article 28 of Circular No. 12/2017/TT-BGTVT (already amended and supplemented at Point h Clause 17 Article 1 of Circular No. 38/2019/TT-BGTVT) as follows:

“d) Two years for the documents prescribed in Point đ Clause 3 of this Article.”

c) Add Clause 6 to Article 28 of Circular No. 12/2017/TT-BGTVT as follows:

“6. Examination results records that have lost their validity shall be destroyed in accordance with the law on archiving.”

20. Amend and supplement Clause 1 Article 29 of Circular No. 12/2017/TT-BGTVT (already amended and supplemented at Clause 1 Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

"1. The Vietnam Road Administration shall be responsible for managing driving license examinations and issuing driving licenses throughout the country."

21. Amend and supplement Clause 4, Point d Clause 5 Article 30 Circular No. 12/2017/TT-BGTVT (amended and supplemented at Point b Clause 18 Article 1 Circular No. 38/2019/TT-BGTVT; Clause 1 Article 12 Circular No. 05/2023/TT-BGTVT) as follows:

a) Amend and supplement Clause 4 Article 30 Circular No. 12/2017/TT-BGTVT (amended and supplemented at Point b Clause 18 Article 1 Circular No. 38/2019/TT-BGTVT; Clause 1 Article 12 Circular No. 05/2023/TT-BGTVT) as follows:

“4. Develop simulation software for actual traffic situations for examination centers to install on computers to serve the examination process; study the application of information technology to manage the examination and issuance of driving licenses; establish an information network connecting the examination management agencies under the Vietnam Road Administration with examination centers, examination management agencies under provincial transportation departments, and driving training institutions; maintain a system to receive and store data from surveillance cameras in theoretical examination rooms and practical driving tests at examination centers for competent authorities to serve management, inspection, and violation handling according to regulations.”

b) Amend and supplement Point d Clause 5 Article 30 Circular No. 12/2017/TT-BGTVT (amended and supplemented at Clause 1 Article 12 Circular No. 05/2023/TT-BGTVT) as follows:

“d) Develop training programs and plans, direct, organize training sessions, issue examiner cards to the national pool of examiners, and keep examiner records in accordance with regulations;”

22. Amend and supplement Clause 5 Article 31 Circular No. 12/2017/TT-BGTVT (amended and supplemented at Clause 1 Article 12 Circular No. 05/2023/TT-BGTVT) as follows:

“5. Implement network connections with local examination centers, driving training institutions, and the Vietnam Road Administration; utilize data collected from surveillance cameras in theoretical examination rooms and practical driving tests at examination centers under the Vietnam Road Administration to manage, monitor, and handle violations during the examination process; conduct inspections and verify cases of candidate assistance during the examination process to handle them according to regulations and report to the Vietnam Road Administration for tracking and summarizing. In case the Vietnam Road Administration notifies the suspension of surveillance cameras in theoretical examination rooms and practical driving tests for maintenance, repair, or due to incidents, provincial transportation departments shall use data from driving examination centers.”

23. Amend and supplement Clause 2 Article 32 Circular No. 12/2017/TT-BGTVT (amended and supplemented at Clause 1 Article 12 Circular No. 05/2023/TT-BGTVT) as follows:

“2. The Vietnam Road Administration designs security measures, prints, uniformly issues, guides, and manages the use of driving license paper templates throughout the country.”

24. Amend and supplement Clause 13 and Clause 14, and add Clauses 15, 16, and 17 to Article 33 Circular No. 12/2017/TT-BGTVT (amended and supplemented at Points a and b Clause 19 Article 1 Circular No. 38/2019/TT-BGTVT) as follows:

a) Amend and supplement Clause 13 Article 33 Circular No. 12/2017/TT-BGTVT (amended and supplemented at Point a Clause 19 Article 1 Circular No. 38/2019/TT-BGTVT) as follows:

“13. A valid driving license made of PET material is a license issued by an authorized agency, bearing a serial number, date of issuance, and expiration date printed on the license that matches the serial number, date of issuance, and expiration date in the driving license management information system or has been verified through VneID.”

b) Amend and supplement Clause 14 Article 33 Circular No. 12/2017/TT-BGTVT (amended and supplemented at Point b Clause 19 Article 1 Circular No. 38/2019/TT-BGTVT) as follows:

“14. Situations where driving licenses are revoked include:

a) Drivers who engage in fraudulent behavior to obtain a driving license;

b) Drivers who erase, alter, or distort information on their driving license;

c) Allowing others to use their driving license;

d) Issuing a license to someone who does not meet the requirements;

đ) Having errors in one of the following pieces of information: name, date of birth, nationality, place of residence, license category, validity period, date of passing the examination, and signature;

e) Being found to have drugs in their body through a health check-up (except for actions handled according to points c and d Clause 10 Article 5; points h and i Clause 8 Decree No. 100/2019/NĐ-CP dated December 30, 2019).”

c) Add Clause 15 to Article 33 Circular No. 12/2017/TT-BGTVT as follows:

“15. The authority issuing driving licenses shall carry out revocation procedures as follows:

a) The head of the authority issuing the driving license shall issue a decision to revoke and invalidate the driving license. The content of the decision clearly states the reasons for revocation and invalidation;

b) Within five working days from the date of receiving the Decision to Revoke Driving License, the driver must submit the revoked driving license to the revoking authority and the authority issuing the driving license shall be responsible for retrieving and invalidating the issued driving license according to regulations;

c) If the authority issuing the driving license has merged, split, or ceased operations, the authority responsible for revoking and invalidating the driving license is the current managing authority of the original driving license record.”

d) Add Clause 16 to Article 33 Circular No. 12/2017/TT-BGTVT as follows:

“16. Handling cases where driving licenses are revoked

a) Driving licenses revoked according to points a, b, d, and e Clause 14 of this Article are not valid for use. The driving license management authority updates violation data on the driving license information system from the day the violation is discovered; in addition, the violator must bear legal responsibility and cannot be issued a driving license for five years from the date of discovery of the violation; if there is a need to reissue a driving license, they must undergo training and examination again as if it were their first time obtaining a driving license.”

b) For individuals who have had their driver's license revoked according to point c, Clause 14 of this Article, one year from the date the decision revoking the driver's license becomes effective, if they have a need for a new driver's license, they shall register with the Department of Transportation to retake the examinations on the contents prescribed in Clause 4 of Article 21 of this Circular;

c) Driver's licenses that are revoked according to point d, Clause 14 of this Article shall be handled as follows: driver's licenses still within the validity period or expired for less than three months shall be handled according to the provisions of Article 38 of this Circular; driver's licenses expired for more than three months shall be handled according to the provisions of Clause 1 of Article 36 of this Circular.";

d) Add Clause 17 to Article 33 of Circular No. 12/2017/TT-BGTVT as follows:

"17. Drivers who commit acts of using fake driver's licenses or using driver's licenses reported lost to operate motor vehicles shall have the licensing authority update data on the violation in the driver's license information system from the date of discovery of the violation; in addition, violators must bear legal responsibility and will not be issued a driver's license for a period of five years from the date of discovery of the violation; if there is a need to reissue a driver's license, they must study and retake the examination as in the case of issuing a driver's license for the first time.".

25. Amend and supplement Article 34 of Circular No. 12/2017/TT-BGTVT as follows:

Article 34. Verification of Driver's Licenses

1. When receiving the list of requests to verify issued driver's licenses from training institutions and before approving the list of driver's licenses for upgrading, changing, or reissuing, the Department of Transportation must search and print information about the driver's license of the person applying for upgrading, changing, or reissuing the driver's license from the driver's license management information system (the driver's license verification report); in cases where there is no information, a written request for verification of the issued driver's license must be made to the issuing authority; the application for verification of the driver's license shall be in accordance with the model specified in Appendix 18a attached to this Circular, and the driver's license verification report shall be in accordance with the model specified in Appendix 18b attached to this Circular.

2. Conducting verification of driver's licenses

a) The verification of driver's licenses must be immediately conducted via telephone, email, or fax, followed by a written confirmation;

b) If there is no result of verifying the driver's license, the Department of Transportation shall not change, issue, or include the applicant in the list of candidates permitted to take the examination for issuance of a driver's license.

3. Time limit for verification

a) From the date of receipt of the list requesting verification of driver's licenses or a valid file as stipulated in Article 38 of this Circular, the Department of Transportation shall issue a written request for verification of the issued driver's license;

b) Upon receiving the request for verification, the Department of Transportation must respond to the verification of the issued driver's license immediately.";

26. Amend and supplement Article 35 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Clause 5 of Article 2 of Circular No. 01/2021/TT-BGTVT; Clause 2 of Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

"Article 35. Issuance of New Driver's Licenses

1. Individuals who pass the examination shall be issued a driver's license corresponding to the category they were admitted to; in cases of upgrading or reissuing due to expiration as stipulated in Clause 1 of Article 36 of this Circular, the original driver's license must be presented when collecting the new driver's license.

2. Based on the decision recognizing admission to the examination, the Department of Transportation shall issue a driver's license to the successful candidate. The admission date recorded on the back of the driver's license is the date of signing the decision recognizing admission to the examination.

3. The issuance of the driver's license shall not exceed ten working days from the end of the examination, and the driver's license shall be returned after the successful examinee has completed the obligation to pay the fee for issuing the driver's license.

4. Individuals who already hold a Class B1 driver's license may register to obtain a new Class B2 driver's license, and those holding a Class B2 driver's license may register to obtain a new Class C driver's license and must complete the entire training program as prescribed. The application of the trainee shall comply with the provisions of Clause 1 of Article 9 of this Circular; in cases of passing the examination, the examination organization shall request the issuing authority to revoke the old driver's license and request the Vietnam Highway Administration to delete the management number of the issued driver's license.";

27. Amend and supplement Clause 1, Clause 2, Clause 3, and Clause 6 of Article 36 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Clause 1 of Article 12 of Circular No. 05/2023/TT-BGTVT) at Clause 1 Article 12 Circular No. 05/2023/TT-BGTVT) as follows:

a) Amend and supplement Clause 1 of Article 36 of Circular No. 12/2017/TT-BGTVT as follows:

"1. Individuals with expired driver's licenses

a) From three months up to less than one year from the expiration date, they must retake the theoretical examination as prescribed in Point a, Clause 4 of Article 21 of this Circular to reissue the driver's license;

b) One year or more from the expiration date, they must retake the theoretical examination as prescribed in Point a, Clause 4 of Article 21 of this Circular, and practical driving tests in simulated and real road conditions to reissue the driver's license;

c) The application for retaking the examination shall comply with the provisions of Clause 3 of Article 19 of this Circular.";

b) Amend and supplement Clause 2 of Article 36 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Clause 1 of Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

"2. Individuals with lost driver's licenses still within the validity period or expired for less than three months may apply for reissuance of the driver's license. The application includes:

a) An application for replacement (reissuance) of the driver's license in accordance with the model specified in Appendix 19 attached to this Circular;

b) Original supporting documents corresponding to the driver's license (if available);

c) A health certificate of the driver issued by a competent medical facility in accordance with regulations, except for the reissuance of driver's licenses without a validity period for categories A1, A2, and A3;

When submitting an application to reissue a driver's license at the traffic management department's reception office, the driver shall submit one set of application documents, take a direct photograph, and present the original copies of the aforementioned documents (except for those already submitted) for verification. Within two months from the date of submitting all required documents, taking photographs, and paying the prescribed fees, if it is found that the driver's license is not being held or processed by competent authorities, and the driver's name appears in the records of the examination management agency, then the driver's license will be reissued.

Within five working days from the date of approval for reissuing the driver's license, the traffic management department shall issue the driver's license and return it to the driver upon completion of the obligation to pay the licensing fee; in case the driver's license is not reissued, the reason must be clearly stated.

c) Amend and supplement Clause 3, Article 36 of Circular No. 12/2017/TT-BGTVT as follows:

“3. Holders of lost driver’s licenses that have exceeded their validity period by three months or more, whose names appear in the records of the examination management agency, and who are not currently under the custody or processing of competent authorities, must retake the examination on the following contents within two months from the date of submitting valid application documents as prescribed:

a) For licenses that have exceeded their validity period by three months but less than one year, they must retake the theoretical examination as stipulated in Point a, Clause 4, Article 21 of this Circular;

b) For licenses that have exceeded their validity period by one year or more, they must retake the theoretical examination as stipulated in Point a, Clause 4, Article 21 of this Circular, and practical driving tests in simulated and real road conditions;

c) The application for retaking the examination shall comply with the provisions of Clause 4, Article 19 of this Circular.”

d) Amend and supplement Clause 6, Article 36 of Circular No. 12/2017/TT-BGTVT as follows:

“6. The process of reissuing a driver’s license shall be carried out as for new issuance (except for cases specified in Clause 2 of this Article).”

28. Amend and supplement Clause 8, Article 37 of Circular No. 12/2017/TT-BGTVT (amended and supplemented by Point b, Clause 6, Article 2 of Circular No. 01/2021/TT-BGTVT; Clause 1, Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“8. Procedures for exchanging a driver’s license:

a) The traffic management department shall check the application documents when receiving them; if the documents do not comply with the regulations, the department must notify the individual directly or in writing or through the online public service system about the necessary supplements or corrections within two working days from the date of receipt of the documents;

b) Individuals submitting documents directly are responsible for completing the obligation to pay the licensing fee according to the regulations upon submission of the documents; when submitting documents through the online public service system, they must complete the obligation to pay the licensing fee via the payment function of the online public service system according to the regulations and pay other service fees based on personal needs;

c) Within five working days from the date of receiving all documents in accordance with the regulations (including verifying the electronic identity account through the electronic identification and authentication system), the traffic management department shall carry out the exchange of the driver’s license; if the driver’s license is not exchanged, the reason must be clearly stated;

d) The issuing authority shall retain the original copy of the application documents for exchanging the driver’s license issued by the transportation sector (except for exchanges made through the online public service system); copies of the application documents for exchanging the driver’s license or foreign driving licenses, driving licenses issued by the police sector, military driving licenses issued by the Ministry of National Defense shall be retained for two years from the date of issuance of the driver’s license. The corner of the old driver’s license (except for foreign driver’s licenses) shall be cut off and given to the driver for safekeeping (in the case of a full online exchange, the driver is responsible for sending the old driver’s license to the issuing authority for cancellation according to the regulations);

đ) In case the driver requests to downgrade the category of the driver’s license, they must clearly declare this in the Application Form for Exchanging (Reissuing) Driver’s License prescribed in Appendix 19 attached to this Circular and bear responsibility for the declared information.”

29. Amend and supplement Clause 1 and Clause 2 of Article 38 of Circular No. 12/2017/TT-BGTVT (amended and supplemented by Clause 7, Article 2 of Circular No. 01/2021/TT-BGTVT, Clause 8, Article 1 of Circular No. 04/2022/TT-BGTVT, and Clause 1, Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

a) Amend and supplement Clause 1 of Article 38 of Circular No. 12/2017/TT-BGTVT (amended and supplemented by Clause 7, Article 2 of Circular No. 01/2021/TT-BGTVT and Clause 8, Article 1 of Circular No. 04/2022/TT-BGTVT) as follows:

“1. Documents for exchanging a driver’s license issued by the transportation sector include:

a) An Application Form for Exchanging a Driver’s License according to the model prescribed in Appendix 19 attached to this Circular;

b) A health certificate of the driver issued by a medical facility authorized to issue such certificates, except for exchanges of Class A1, A2, A3 driver’s licenses;

c) Copies of the driver’s license and passport still within their validity period (for foreigners and overseas Vietnamese).”

b) Amend and supplement Clause 2 of Article 38 of Circular No. 12/2017/TT-BGTVT (amended and supplemented by Clause 1, Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“2. Individuals shall prepare one set of documents in accordance with Clause 1 of this Article and submit them directly or through the online public service system to the traffic management department.”

30. Amend and supplement Article 39 of Circular No. 12/2017/TT-BGTVT (amended and supplemented by Clause 21, Article 1 of Circular No. 38/2019/TT-BGTVT; Clause 8, Article 2 of Circular No. 01/2021/TT-BGTVT; Clause 1, Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“Article 39. Procedures for exchanging a military driver’s license issued by the Ministry of National Defense

1. The driver shall prepare one set of documents and submit them directly to the traffic management department. When submitting the application for exchanging the driver’s license, the driver must take a direct photograph at the issuing authority and present the original copies of the aforementioned documents (except for those already submitted) for verification. The documents include:

a) An Application Form for Exchanging a Driver’s License according to the model prescribed in Appendix 19 attached to this Circular.

b) A copy of the Decision terminating service in the Military signed by a Battalion-level or higher Commander. For contractual workers in defense enterprises: A copy of the decision to terminate the labor contract, with a validity period not exceeding six months from the date of issuance by the authorized authority of the defense enterprise.

c) A health certificate for the driver issued by an authorized medical facility in accordance with regulations, except in cases where a Class A1, A2, or A3 driving license is being renewed.

d) A copy of the military driving license still within its validity period.

2. In case of suspicion, the agency responsible for renewing the driving license shall issue a document requesting the Motor Vehicle Department under the Ministry of National Defense to verify.

3. The application for renewing a military driving license consists of original documents listed in Clause 1 and Clause 2 of this Article and the military driving license which has been corner-cut, handed over to the driver for safekeeping.

31. Amend and supplement Article 40 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at point a and point b of Clause 22 of Article 1 of Circular No. 38/2019/TT-BGTVT; Clause 9 and Clause 10 of Article 2 of Circular No. 01/2021/TT-BGTVT; Clause 1 of Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“Article 40. Procedures for renewing driving licenses issued by the Public Security Sector

1. Application for renewing motorcycle driving licenses issued by the Public Security Sector before August 1, 1995:

The driver shall prepare one set of application documents and submit it directly to the Department of Transport. The application includes:

a) An Application Form for Exchanging a Driver’s License according to the model prescribed in Appendix 19 attached to this Circular;

b) Original documents (if available);

c) When submitting the renewal application, the driver must take a direct photograph at the issuing authority and present the original copies of the aforementioned documents (excluding those already submitted) for verification.

2. Application for renewing driving licenses issued by the Public Security Sector from August 1, 1995:

The driver shall prepare one set of application documents and submit it directly to the Department of Transport. The application includes:

a) An Application Form for Exchanging a Driver’s License according to the model prescribed in Appendix 19 attached to this Circular;

b) A copy of the driving license; A copy of the Decision to leave the sector or retire issued by the competent authority or a copy of the Decision of the competent authority regarding termination of service in the People's Police force or a copy of the Decision to terminate the labor contract and recruitment decision or a labor contract of twelve months or more from units within the People's Public Security;

c) A health certificate for the driver issued by an authorized medical facility in accordance with regulations, except in cases where a Class A1, A2, or A3 driving license is being renewed;

d) When submitting the renewal application, the driver must take a direct photograph at the issuing authority and present the original copies of the documents specified in point b of Clause 2 of this Article (excluding those already submitted) for verification.

đ) The application for renewing a Public Security driving license is an original application, including the documents listed in point a and point b of Clause 2 of this Article and the Public Security driving license which has been corner-cut, handed over to the driver for safekeeping.

3. Application for renewing driving licenses issued by the Public Security Sector to civilian students of public security schools before July 31, 2020:

The driver shall prepare one set of application documents and submit it directly to the Department of Transport. The application includes:

a) Documents specified in points a, c, and d of Clause 2 of this Article;

b) A copy of the Decision recognizing graduation from public security schools and academies;

c) Original application documents issued by the Public Security Sector, including: Application form for examination, issuance, and renewal of driving licenses with confirmation by the head of the unit where the applicant works; Health Certificate of the driver; Graduation Certificate of the driving course; Examination Results Summary;

d) When submitting the renewal application, the driver must take a direct photograph at the issuing authority and present the original copies of the aforementioned documents for verification, excluding the documents specified in points a and c of Clause 2 of this Article;

đ) The application for renewing a Public Security driving license is an original application, including the documents listed in point a and point b of Clause 3 of this Article and the Public Security driving license which has been corner-cut, handed over to the driver for safekeeping.

4. In case of suspicion, the agency responsible for renewing the driving license shall issue a document requesting the Traffic Police Corps under the Ministry of Public Security or the Department of Transport managing the driving license to verify.

32. Amend and supplement Clause 1 and add Clause 4 to Article 41 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Clause 23 of Article 1 of Circular No. 38/2019/TT-BGTVT; Clause 1 of Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

a) Amend and supplement Clause 1 of Article 41 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Clause 23 of Article 1 of Circular No. 38/2019/TT-BGTVT and Clause 1 of Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“1. The driver shall prepare one set of application documents and submit it directly to the Department of Transport (where the driver is registered as residing, staying temporarily, or permanently). The application includes:

a) An application form for renewing the driving license (for Vietnamese citizens according to the model prescribed in Appendix 19 attached to this Circular, for foreign citizens according to the model prescribed in Appendix 20 attached to this Circular);

b) A certified translation of the foreign driving license into Vietnamese by a Notary Office or Embassy, Consulate General in Vietnam where the translator works, stamped with a matching seal on the copy of the driving license; for Vietnamese citizens, present the legalization of the foreign driving license or driving permit according to the provisions of the law on consular certification and legalization, except in cases exempted by law;

c) A health certificate for the driver issued by an authorized medical facility in accordance with regulations; except in cases where a Class A1, A2, or A3 driving license is being renewed;

d) A copy of the temporary residence card or permanent residence card or diplomatic identification card or official identification card; a copy of the document verifying long-term residence in Vietnam for foreigners.

When submitting the renewal application, the driver must take a direct photograph at the issuing authority and present the original copies of the aforementioned documents (excluding those already submitted) for verification.”

b) Add Clause 4 to Article 41 of Circular No. 12/2017/TT-BGTVT as follows:

“4. In case of suspicion regarding the entry and residence of foreigners in Vietnam, the agency responsible for renewing the driving license shall issue a document requesting the Ministry of Foreign Affairs, the Immigration Management Department under the Ministry of Public Security, and the Provincial or Central City Immigration Departments to verify.”

33. Amend and supplement Clause 4 of Article 43 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Clause 25 of Article 1 of Circular No. 38/2019/TT-BGTVT) as follows:

"4. Training for motorcycle driving license categories A1 and A4 for ethnic minority people who cannot read or write Vietnamese:

a) Form of training: individuals wishing to obtain a driving license must register at a permitted training institution to review according to the training program specified in Article 12 and Sections A and B of Appendix No. 31 issued together with this Circular. Classes for ethnic minority people who cannot read or write Vietnamese must be taught separately and have interpreters present;

b) Method of training: through visual images, system of road traffic signs drawings, models, scenarios, and skills in handling traffic situations on roads; question-and-answer sessions and practical demonstrations to implement the training program content."

34. Amend and supplement Clause 4 of Article 44 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Clause 26 of Article 1 of Circular No. 38/2019/TT-BGTVT) as follows:

"4. Examination to issue motorcycle driving licenses for categories A1 and A4 for ethnic minority people who cannot read or write Vietnamese:

a) Content and procedure of the examination: carried out according to the content and procedure of the examination for categories A1 and A4 as stipulated in Clauses 1, 2, and 3 of Article 21 of this Circular;

b) Organization of the examination shall be conducted as follows: separate examinations. Theoretical examination by question-and-answer format; using multiple-choice tests on paper; examination time is 30 minutes. Two examiners will conduct the examination sequentially for each candidate; each candidate randomly selects one test from the set; one examiner reads the questions and observes the candidate, the other marks the corresponding box on the theoretical test that the candidate chooses; Examiners score, sign and confirm on the theoretical test, the summary record of the examination results, and notify the examination results to the candidates. The examination content is conducted through interpreters, interpreters must accurately and fully translate the questions of the examiners and the answers of the candidates; the training institution is responsible for hiring interpreters;

c) Candidates sign or stamp their name in the designated place in the summary record of the examination results, the theoretical test, and the examination record of practical driving."

35. Replace the Appendices in Circular No. 12/2017/TT-BGTVT as follows:

a) Replace Appendix 3a issued together with Circular No. 12/2017/TT-BGTVT with Appendix XI issued together with this Circular;

b) Replace Appendix 4 issued together with Circular No. 12/2017/TT-BGTVT with Appendix XII issued together with this Circular;

c) Replace Appendix 7 issued together with Circular No. 12/2017/TT-BGTVT (replaced by Appendix I of Circular No. 01/2021/TT-BGTVT) with Appendix XIII issued together with this Circular;

d) Replace Appendix 8 issued together with Circular No. 12/2017/TT-BGTVT with Appendix XIV issued together with this Circular;

37. Repeal Clause 8 of Article 10; Point e of Clause 5 and Clause 6 of Article 30; Clause 9 of Article 31; Appendix 5, Appendix 6, and Appendix 21.

38. Appendix 24 issued together with Circular No. 12/2017/TT-BGTVT (supplemented at Point c of Clause 29 of Article 1 of Circular No. 38/2019/TT-BGTVT).

39. Repeal certain phrases in the following Appendices:

a) Repeal the phrase “Vietnam Highway Administration” in Appendix 11a (amended at Clause 1 of Article 12 of Circular No. 05/2023/TT-BGTVT);

b) Repeal the phrases “HIGHWAY ADMINISTRATION”, “Director of Vietnam Highway Administration”, and “DIRECTOR GENERAL” in Appendix 12a (amended at Clause 1 of Article 12 of Circular No. 05/2023/TT-BGTVT);

c) Repeal the phrases “DEPARTMENT”, “Vietnam Highway Administration”, “General Department”, “DIRECTOR GENERAL”, and “DEPARTMENT HEAD” in Appendix 13 (amended at Clause 1 of Article 12 of Circular No. 05/2023/TT-BGTVT);

d) Repeal the phrases “HIGHWAY ADMINISTRATION”, “Director of Vietnam Highway Administration”, “Department Head”, “Vietnam Highway Administration”, and “DIRECTOR GENERAL” in Appendix 16a (amended at Clause 1 of Article 12 of Circular No. 05/2023/TT-BGTVT);

đ) Repeal the phrases “Highway Administration” and “Vietnam Highway Administration” in Appendix 18a (amended at Clause 1 of Article 12 of Circular No. 05/2023/TT-BGTVT);

e) Repeal the phrases “Highway Administration” and “Vietnam Highway Administration” in Appendix 18b (amended at Clause 1 of Article 12 of Circular No. 05/2023/TT-BGTVT).

Article 5. Amending and supplementing certain provisions of Circular No. 22/2019/TT-BGTVT dated June 12, 2019 of the Minister of Transport on registration of special purpose vehicles

1. Supplement Clause 3 to Article 22 as follows:

"3. The owner of a special purpose vehicle when performing the following procedures: Issuing a Certificate of Registration and license plate for a special purpose vehicle for the first time; issuing a Certificate of Registration and license plate for a special purpose vehicle with a limited period; reissuing, exchanging a Certificate of Registration along with the license plate; reissuing, exchanging a Certificate of Registration without the license plate; issuing a temporary Certificate of Registration along with the license plate; retouching the frame number and engine number shall be responsible for completing the payment of fees before receiving the administrative procedure result."

2. Replace Forms No. 1, No. 2, No. 3, No. 4, No. 8, No. 9, No. 10 in Appendix 2 correspondingly with Forms No. 1, No. 2, No. 3, No. 4, No. 8, No. 9, No. 10 in Appendix XXXI promulgated together with this Circular.

Article 6. Implementation Provisions

1. This Circular takes effect from June 1, 2024.

2. This Circular abolishes: Appendix 24 of Circular No. 38/2019/TT-BGTVT dated October 8, 2019 of the Minister of Transport amending and supplementing certain provisions of Circular No. 12/2017/TT-BGTVT dated April 15, 2017 of the Minister of Transport on training, examination, and issuance of motor vehicle driving licenses.

3. Transitional Provisions

a) For training courses that have enrolled students before the date this Circular takes effect, training institutions continue to organize training according to the provisions of Circular No. 12/2017/TT-BGTVT (amended and supplemented by Circulars No. 38/2019/TT-BGTVT, No. 01/2021/TT-BGTVT, No. 04/2022/TT-BGTVT, No. 05/2023/TT-BGTVT).

b) Persons who were absent or failed in examinations to obtain a driving license before the date this Circular takes effect and register for a driving license examination after the date this Circular takes effect shall be reviewed and examined according to the provisions of this Circular.

c) Persons studying to upgrade their driving license who have already learned fire prevention, firefighting, and rescue skills in the course to obtain their current driving license shall retain their results (no need to repeat the course).

d) In cases where the competent authority cannot perform electronic identity verification of organizations or individuals due to errors in the Electronic Identity Verification System, organizations and individuals must present one of the following valid documents: a copy of the business registration certificate, a copy of the citizen identification card, a copy of the national identity card, or a copy of the passport when performing administrative procedures.

4. The Director of the Ministry's Office, the Inspectorate Chief, Heads of Departments, Directors of the Vietnam Highway Administration, Directors of Provincial Departments of Transport and Construction, Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
