Issuing the List of Chemicals Not to Be Used and the List of Hazardous Chemicals Requiring Information Disclosure in Insecticides and Disinfectants for Domestic and Medical Use

BASED ON

The Law on Chemicals No. 69/2025/QH15;

Based on Decree No. 42/2025/NĐ-CP of the Government on the Functions, Powers, Tasks, and Organizational Structure of the Ministry of Health;

Based on Decree No. 26/2026/NĐ-CP of the Government on Detailed Provisions and Guidelines for Implementing Certain Articles of the Law on Chemicals Concerning the Management of Chemical Activities and Hazardous Chemicals in Products and Goods; In accordance with the proposal by the Director of the Department of Disease Prevention;

The Minister of Health issues this Decree to issue

The List of Chemicals Not to Be Used and the List of Hazardous Chemicals Requiring Information Disclosure in Insecticides and Disinfectants for Domestic and Medical Use.

Article 1. Scope of Application This Decree provides detailed provisions and guidelines for Articles 15(4) and 31(2) of the Law on Chemicals, including the List of Chemicals Not to Be Used and the List of Hazardous Chemicals Requiring Information Disclosure in Insecticides and Disinfectants for Domestic and Medical Use.

Article 2. Principles of Classification of Chemicals

Shall be implemented according to the provisions at Article 7 of Decree No. 01/2026/TT-BCT of the Ministry of Industry and Trade on Detailed Provisions and Guidelines for Implementing Certain Articles of the Law on Chemicals and Decree No. 26/2026/NĐ-CP of the Government on Detailed Provisions and Guidelines for Implementing Certain Articles of the Law on Chemicals Concerning the Management of Chemical Activities and Hazardous Chemicals in Products and Goods.

Article 3. Annexed to this Decree

1. The List of Chemicals Not to Be Used in Insecticides and Disinfectants for Domestic and Medical Use as specified in Appendix I annexed hereto.

2. The List of Hazardous Chemicals Requiring Information Disclosure in Insecticides and Disinfectants for Domestic and Medical Use as specified in Appendix II annexed hereto.

Article 4. Effective Date

1. This Decree shall take effect from May 15, 2026.

2. Decree No. 11/2020/TT-BYT of the Minister of Health dated June 19, 2020, on the List of Prohibited Chemicals and Restricted Scope of Use in Insecticides and Disinfectants for Domestic and Medical Use shall cease to be effective from the date this Decree takes effect.

Article 5. Transitional Provisions

For insecticides and disinfectants used in domestic and medical fields containing hazardous chemicals listed in Appendix II annexed hereto, which have valid registration numbers before the effective date of this Decree, organizations or individuals producing or importing such products shall be responsible for disclosing information according to Article 32 of the Law on Chemicals No. 69/2025/QH15 and Article 29 of Decree No. 26/2026/NĐ-CP of the Government on Detailed Provisions and Guidelines for Implementing Certain Articles of the Law on Chemicals Concerning the Management of Chemical Activities and Hazardous Chemicals in Products and Goods.

Article 5. Transitional Provisions

For insecticides and disinfectants used in household and medical fields containing hazardous chemicals listed in Appendix II annexed to this Circular, which have valid registration numbers prior to the effective date of this Circular, organizations and individuals producing or importing such products shall be responsible for making public information in accordance with the provisions set forth in Article 32 of the Chemical Law No. 69/2025/QH15 and Article 29 of Decree No. 26/2026/NĐ-CP, which details and guides the implementation of certain provisions of the Chemical Law concerning the management of chemical activities and hazardous chemicals in products and goods.

Article 6. Implementation Responsibilities

  1. Based on actual requirements and management practices, the Bureau of Disease Prevention is requested to propose to the Minister of Health for consideration and decision regarding the revision and supplementation of the List of Chemicals Not to be Used and the List of Hazardous Chemicals Requiring Information Disclosure in Insecticides and Disinfectants for Domestic and Medical Use (if applicable).
  2. Within ten days from the date of issuance of a new registration number for insecticides and disinfectants containing chemicals not listed in Appendix II attached to this Circular, the People's Committee of provinces and municipalities directly under the Central Government shall report in writing to the Ministry of Health (Bureau of Disease Prevention) along with a copy of the new registration application.
  3. Persons or organizations producing or importing insecticides and disinfectants containing hazardous chemicals listed in Appendix II attached to this Circular are responsible for disclosing information as prescribed by Article 32 of the Chemical Law No. 69/2025/QH15 and Article 29 of Decree No. 26/2026/NĐ-CP.

In the course of implementation, if any difficulties or obstacles arise, relevant agencies, organizations, and individuals shall promptly report to the Ministry of Health (through the Bureau of Disease Prevention) for timely consideration, revision, supplementation, or guidance.
