CIRCULAR

JOINT MINISTRY OF INTERIOR AND EDUCATION DECREE NO. 05/TT-LB DATED FEBRUARY 11, 1964 GUIDING THE PROMOTION OF REGULATIONS ON HOUSEHOLD REGISTRATION
IN GENERAL EDUCATIONAL SCHOOLS

RESPECTED: Administrative Committees of Regions, Provinces, and Cities

In recent years, in some localities, there have been cases where students changed their surnames, given names, and ages on their own initiative, or teachers arbitrarily altered the surnames, given names, and ages in birth certificates and school records of students, contrary to the principles and procedures stipulated in the Regulations on Household Registration issued by the Council of Ministers in Decree No. 4/CP dated January 16, 1961. Some students who had already registered their births took advantage of the provisions regarding late registration to declare a different age. Some students used another person's school record to take the entrance examination for vocational high schools, then requested a name change after being admitted to match their school record. Some teachers unilaterally modified the names and ages in the birth certificates and school records of nearly half of the students in their class.

The above situation arises, on one hand, due to a lack of awareness among some teachers and students about the importance of adhering to state regulations, wanting new names that sound better, or having sufficient age requirements to meet for university or vocational high school entrance exams, avoiding certain obligations such as national service or military service. On the other hand, it is also because the promotion of the Regulations on Household Registration among teachers and students has not been extensive enough, with many people still lacking knowledge of the principles and procedures for household registration. Therefore, the Joint Ministry of Interior and Education proposes to widely promote the Regulations on Household Registration in general education schools according to the following plan:

I. OBJECTIVES AND REQUIREMENTS

Promoting the Regulations on Household Registration in general education schools aims to make teachers and students aware of the significance and purpose of the Regulations on Household Registration, understand clearly and strictly comply with the principles and procedures for household registration.

II. SCOPE, OBJECTS, AND CONTENT

The promotion of the Regulations on Household Registration will be conducted in all primary, secondary, and high schools in the northern region for all teachers and students from grade 1 to grade 10.

The content of the promotion includes the provisions set forth in the following documents:

1. The Regulations on Household Registration issued by the Council of Ministers in Decree No. 4/CP dated January 16, 1961.

2. Decree No. 484/NĐ/LB dated December 24, 1958 of the Joint Ministry of Interior and Justice concerning the change of surname, given name, and middle name.

3. Circular No. 13/NV/DC dated March 20, 1959 of the Ministry of Interior guiding the examination of applications to correct age.

For each of the above documents, attention should be paid to the following issues:

- Regarding the Regulations on Household Registration, delve deeply into Chapters on birth registration (Articles 1 and 2), note changes in household registration (Article 4), common clauses (Articles 16, 17, 18, 19, 20, 21, 22, 25, and 26).

- Concerning the decree on changing surname, given name, and middle name, only Articles 1, 2, and 3, which specify the circumstances under which a change can be requested and the authority to resolve them, should be promoted.

As for the circular on examining applications to correct age, only the procedure for requesting a correction and the authority to resolve them should be promoted.

When studying the above documents for promotion, additional reference should be made to the following documents:

- Circular No. 87/NV/DC dated December 26, 1958 of the Ministry of Interior guiding the implementation of Decree No. 484/NĐ/LB dated December 24, 1958 of the Joint Ministry of Interior and Justice concerning the examination of applications to change surname and given name.

- Circular No. 5/NV dated January 21, 1961 of the Ministry of Interior guiding the implementation of the new Regulations on Household Registration.

III. ORGANIZATION, METHODS, AND IMPLEMENTATION TIMEFRAME

AT Regions, provinces, cities, counties, towns, administrative committees are responsible for organizing and directing the implementation of this promotion. Departments of Education and Organization and Civil Affairs offices of provinces and cities (where no Organization and Civil Affairs office has been established, the responsibility falls to the provincial household registration officers) are tasked with assisting administrative committees in developing, guiding, promoting plans, inspecting implementation, and preparing reports after completion of the promotion. County and town education departments and household registration officers are responsible for assisting administrative committees in urging, guiding, and supporting communes, towns, and wards in implementation.

AT Communes, towns, wards, administrative committees are responsible for organizing the promotion in general education schools within their jurisdiction. Materials will be based on the printed Regulations on Household Registration distributed to communes, towns, and wards, while for documents regulating changes in surname, given name, and middle name, and corrections to age, regional, provincial, and city administrative committees may print and distribute relevant sections to communes, towns, and wards.

Depending on actual conditions, if there are many schools in a locality, they can be scheduled for promotion sequentially, and if there are too many students in a single school to promote simultaneously, it can be done in two or three sessions on different days. The promotion time should not exceed two hours.

After hearing the administrative committee's report, teachers and students need to relate the information to themselves, their classes, and their schools. If there are actions contrary to the Government's Regulations on Household Registration, they must actively and urgently rectify them. After the administrative committee has promoted the Regulations on Household Registration and called for the correction of actions contrary to these regulations, if there are stubborn individuals who refuse to correct their actions, appropriate punishment should be applied according to Article 26 of the Regulations on Household Registration.

The above are the main points of the policy and implementation plan. Regions, provinces, and cities will base their specific plans on this circular and adapt them according to local conditions.

This round of promoting the Regulations on Household Registration is significant and must be completed no later than April 1964, before examination periods, to minimize violations of state regulations. Therefore, the Joint Ministry of Interior and Education urges administrative committees to prepare plans thoroughly so that they can proceed quickly, smoothly, but effectively.

After completing this round of promotion, administrative committees will report to the Ministry of Interior and the Ministry of Education. The requirement for the report is to reflect fully the progress, results achieved, and provide supporting data.
