CIRCULAR
Guidelines for Implementing Decree 14/CP dated March 19, 1996 of the Government on the Management of Livestock Breeds
On the management of livestock breeds, Decree 14/CP of the Government

Implementing Decree 14/CP of the Government on the management of livestock breeds, the Ministry of Fisheries provides specific guidelines in the field of fisheries as follows:
A. GENERAL PROVISIONS
1. Aquaculture breeding stock includes:
(1) Original breeds, grandparent breeds, parent breeds selected from domestic breeds that have been domesticated or imported from abroad.
(2) Parent breeds, small breeds raised to become marketable products selected from natural populations such as freshwater shrimp, marine crabs, pearl oysters, clams, mussels, abalones, scallops...
(3) Products of breeding stock such as: Semen, fertilized eggs.
The subjects implementing Decree 14/CP of the Government on the management of aquaculture breeding stock are: organizations and individuals within and outside Vietnam operating in fields such as conservation, development of breeding resources; research, selection, and testing of new breeds; production, business, export, and import of breeding stock; and management of breeding stock quality.
B. SPECIFIC PROVISIONS
I. CONDITIONS FOR PRODUCTION AND BUSINESS OF AQUACULTURE BREEDING STOCK
- Production and business establishments of aquaculture breeding stock must meet the following conditions:
1. They must be facilities for selecting and propagating purebred aquaculture breeds or producing hybrids with a clear breeding direction aimed at continuously improving breed quality.
2. They must produce and trade aquaculture breeds listed in the annual catalog of aquaculture breeding stock published by the Ministry of Fisheries, including those breeds that need to be preserved for selection, development, production, and those that need to be phased out (Annexes 1 and 2).
3. They must have suitable production sites, breeding ponds, water sources, feed, disease control facilities, and other requirements according to industry standards and procedures. Effluent water must be treated through settling ponds and filters to ensure environmental hygiene.
4. Facilities for breeding original breeds and grandparent breeds must have a dedicated fisheries engineer and must hold a permit issued by the Ministry of Fisheries.
5. Facilities for breeding parent breeds must have a technical specialist with a fisheries diploma or higher and must hold a permit issued by the provincial fisheries department.
6. Facilities for breeding original breeds, grandparent breeds, and parent breeds must regularly monitor productivity, individual quality, population characteristics, and record identification and management of breeding stock according to the unified model prescribed by the Ministry of Fisheries.
II. SYSTEM OF AQUACULTURE BREEDING STOCK
The Ministry of Fisheries plans and builds a system of aquaculture breeding stock from central to local levels, including two regions:
National breeding region includes:
1. Centers under the Ministry responsible for:
- Selecting, preserving, and nurturing original breeds to supply grandparent breeds to provincial centers and farms.
- Transferring new breeds, new technologies related to breeding, feed, disease control, and environmental management to provinces.
2. Regional centers under provincial fisheries departments responsible for:
- Receiving purebred breeds from national centers, preserving them, and transferring new breeds and technologies to producers.
- Selecting, preserving, and propagating local breed lines and products.
National breeding centers are public service units funded by the state, receiving subsidies for original and grandparent breeds according to annual plans.
Production and Business Region
Production and business units of various economic components are supported by state policies such as loans, land and water use, and are subject to state management; they are tasked with receiving purebred breeds from regional centers to propagate and meet the needs of the people.
III. MANAGEMENT OF GENETIC RESOURCES OF AQUACULTURE BREEDING STOCK
The Ministry of Fisheries assigns institutes and research centers, national breeding centers to preserve genetic resources of aquaculture breeding stock for research purposes. The Fisheries Resource Protection Agency manages genetic resources, rare breeds, and promising breeds currently in natural reserves managed by the central government or the Ministry of Fisheries.
Provincial Fisheries Departments and Agriculture and Rural Development Departments assign regional breeding centers to preserve purebred, grandparent, and high-yield local breed lines for experimental application and regionalization. Fisheries Resource Protection Sub-departments manage genetic resources, rare breeds with potential for aquaculture currently in natural resources of the province.
IV. STATE MANAGEMENT OF AQUACULTURE BREEDING STOCK
1. The state management system of aquaculture breeding stock is organized uniformly from central to local levels as follows:
- The Minister of Fisheries assigns functional departments to assist the Minister in managing the state's aquaculture breeding stock throughout the sector.
- Provincial People's Committees assign Fisheries Departments and Agriculture and Rural Development Departments to manage the state's aquaculture breeding stock within their jurisdiction.
2. The Ministry of Fisheries registers original and grandparent breeds of aquaculture breeding stock nationwide. Provincial Fisheries Departments and Agriculture and Rural Development Departments register grandparent and parent breeds within their jurisdiction, select and identify high-yielding and specialty breeds, and submit files to the Ministry of Fisheries for registration in the national breed registry according to the breed registration guidelines provided by the Ministry of Fisheries.
3. Annually, in December, Provincial Fisheries Departments and Agriculture and Rural Development Departments report in writing to the Ministry of Fisheries on the results of breeding stock production and management work.
V. BREED TESTING AND RECOGNITION OF NEW BREEDS
1. New breeds imported into Vietnam or newly developed must undergo testing before being recognized as new breeds.
Organizations and individuals requesting testing must apply to the Ministry of Fisheries for testing. The testing file for new breeds includes:
- Application for testing, clearly stating the breed name, original breed source, and testing location.
- Scientific report on the new breed. If it is an imported breed, a summary of the biological characteristics of the original and grandparent breeds must be included along with photographs, drawings, or specimens.
- Production process or necessary technical instructions for producing the new breed.
- Comments from the breeding facility that conducted the trial.
After receiving the examination results, the Scientific Council of the Ministry of Fisheries will review and evaluate the results, then submit to the Minister of Fisheries for a decision to recognize the new breed, allowing it to be put into production and listed in the management directory, while simultaneously informing all production facilities.
The new breed will have its own unique code and may be kept confidential at the request of the breeder when deemed necessary.
In cases where recognition as a new breed is not granted, the Ministry of Fisheries will notify the breeder in writing.
2. Organizations and individuals wishing to export or import aquaculture breeding stock must submit an application form along with photographs or detailed drawings.
3. The Ministry of Fisheries shall establish and publish a list of rare and precious breeding stocks and those that are prohibited from being exported abroad (Annex 3).
Special cases requiring the export of such breeding stocks must be approved by the Ministry of Fisheries.
VI. POLICY ON AQUACULTURE BREEDING STOCKS
1. Annually, the Ministry of Fisheries will develop a budget estimate for investment in the conservation, research, selection, importation, and management of aquatic breeding stocks for affiliated breeding centers.
Provincial People's Committees under the Central Government shall develop plans and budget estimates for investment in the conservation, research, creation, importation, and management of aquaculture breeding stocks for local breeding facilities.
2. Policies regarding original breeds and grandparent breeds.
- The Ministry of Fisheries will define a list of breeding stocks that need to be preserved for selection and development of genetic resources, including original breeds and grandparent breeds eligible for subsidies.
For certain special breeds and strains with excellent qualities from localities, the Chairman of the Provincial People's Committee under the Central Government shall propose to the Minister of Fisheries for a decision.
- The entity entitled to financial compensation is a state-owned breeding facility assigned tasks by the competent authority or has contracts for preserving and breeding original and grandparent breeds.
3. The Ministry of Fisheries and the State Bank shall issue a joint circular guiding organizations and individuals engaged in the production and business of aquaculture breeding stocks on obtaining credit loans at interest rates suitable to the breeding cycle. (Circular 03-TT-LB Joint Circular of the State Bank and Fisheries Department on guiding loans for aquaculture households dated March 2, 1993).
VII. INSPECTION, AUDIT, REWARD, AND PENALTY REGIME FOR MANAGEMENT OF AQUACULTURE BREEDING STOCKS
1. The Fisheries Industry Department, the Fisheries Resource Protection Agency under the Ministry of Fisheries, together with provincial Fisheries Departments and Agriculture and Rural Development Departments under the Central Government, shall conduct regular inspections and audits once a year or at random regarding the implementation of Decree 14/CP on the management of aquaculture breeding stocks.
The inspection and audit content includes reviewing and evaluating conditions for breeding stock production and business, quality of original, grandparent, and parent stocks, compliance with standards, regulations, economic and technical norms, implementation of industry policies and local guidelines, and management of breeding stocks.
Inspection and audit results must be recorded in minutes. Inspection and audit minutes must be sent to the inspected entity, the supervising authority of the inspected entity, and relevant agencies.
2. Organizations and individuals who achieve outstanding results in implementing Decree 14/CP on the management of aquaculture breeding stocks, such as creating new breeds, developing genetic resources, expanding germplasm funds, and directing breeding stock production... shall be rewarded according to current regulations.
Organizations and individuals violating Decree 14/CP on the management of aquaculture breeding stocks shall be subject to administrative penalties and material compensation according to the law (Decree 25/CP dated November 22, 1993 of the Government on administrative penalties in the field of fisheries resource management and protection).
VIII. IMPLEMENTATION PROVISIONS
This circular takes effect from the date of signature. Previous provisions contrary to this circular are abolished.
Departments, Agencies, Institutes, Research Centers under the Ministry of Fisheries, and Provincial Fisheries Departments and Agriculture and Rural Development Departments shall guide, urge, and inspect the implementation of this circular within their functions and authorities.
Any issues encountered during implementation that require amendments or supplements must be reported promptly to the Ministry of Fisheries.
