Decree No. 054/SL Regarding the Establishment of the "Vietnam People's Liberation Medal," the "Victory Medal," and the "Vietnam People's Liberation Badge," the "Victory Badge"

DECREE

ISSUED BY THE CHAIRMAN OF THE COUNCIL OF MINISTERS DECREE NO. 054/SL ON FEBRUARY 2, 1958

THE PRESIDENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM

- Pursuant to Decree No. 34-SL dated March 25, 1946, Decree No. 35-SL dated March 19, 1947, and Decree No. 121-SL dated July 11, 1950 organizing the Ministry of National Defense under the General Commander,

- Pursuant to Decree No. 71-SL dated May 22, 1946 establishing the rules for the People's Army of Vietnam,

- At the proposal of the Minister of National Defense, approved by the Council of Ministers,

ISSUES THE DECREE:

Article 1

NOW ESTABLISHES:

1- The Military Liberation Order of Vietnam,

2- The Military Liberation Medal of Vietnam, to be awarded to officers and soldiers of the People's Army of Vietnam who have made contributions in building the army and fighting during the period before August 1945.

Article 2

NOW ESTABLISHES:

1- The Victory Order,

2- The Victory Medal, to be awarded to officers and soldiers of the People's Army of Vietnam who have made contributions in building the army and fighting during the resistance period.

Article 3

The Military Liberation Order of Vietnam and the Victory Order have three classes: first, second, third.

The Military Liberation Medal of Vietnam has only one class.

The Victory Medal has two classes: first, second.

Article 4

The Military Liberation Order of Vietnam and the Military Liberation Medal of Vietnam are awarded to officers and soldiers:

- Who participated in revolutionary armed teams organized into units established and led by the Indochinese Communist Party prior to August 1945.

- Who continued to serve in the military until now or at least for five years (and were then transferred by superiors to other work).

- Who always remained loyal to the revolution without committing serious errors while serving in the military or working outside the military.

1- The Military Liberation Order of Vietnam, first class, is awarded to officers who have contributed to leading and organizing the aforementioned revolutionary armed units.

2- The Military Liberation Order of Vietnam, second class, is awarded to commanding officers from platoon level upwards in units that participated in combat before August 1945.

3- The Military Liberation Order of Vietnam, third class, is awarded to soldiers in units that participated in combat before August 1945.

4- The Military Liberation Medal of Vietnam is awarded to commanding officers directly in charge of units from platoon level upwards, and to soldiers in units before August 1945 who did not meet the criteria set out in points 2 and 3.

Article 5

The Victory Order and the Victory Medal are awarded to officers and soldiers participating in main force troops and local forces during the resistance period, who always remained loyal to the revolution without committing serious errors while serving in the military or working outside the military.

1- The Victory Order, first class, is awarded to:

- Officers at the Division level or equivalent who held such positions for at least one year during the resistance period.

- Officers at the Regiment level or equivalent who continuously held such positions for at least five years during the resistance period, always actively working.

2- The Victory Order, second class, is awarded to:

- Officers at the Division level or equivalent who held such positions for less than one year during the resistance period.

- Officers at the Regiment and Platoon levels or equivalent who held such positions for at least one year during the resistance period.

- Officers at the Battalion level or equivalent who held such positions for at least five years during the resistance period, always actively working.

3- The Victory Order, third class, is awarded to:

- Officers at the Regiment, Platoon levels or equivalent who held such positions for less than one year during the resistance period.

- Officers at the Battalion and Company levels or equivalent who held such positions for at least one year during the resistance period.

- Officers at the Platoon level and soldiers with at least five years of service, always actively working.

4- The Victory Medal, first class, is awarded to:

- Officers at the Platoon level and soldiers with at least three years of service.

5- The Victory Medal, second class, is awarded to: officers at the Platoon level and soldiers with at least one year of service or less than one year of service during the resistance period, but who participated in the 1953-1954 Winter-Spring Campaign and continued to serve in the military for at least three years from the date of peace restoration (July 20, 1954), always actively working.

1- Military personnel who are disabled or injured in combat or work and cannot continue their service in the military for the required time shall be exempted from the service time requirement when considering awards.

2- Military personnel who have been discharged due to valid reasons and meet the criteria specified in Article 5 shall be considered for awards.

1- Military personnel who died in battle shall be considered for posthumous awards based on the criteria specified in this decree.

2- Martyrs who died in combat or work shall be posthumously awarded orders or medals based on their rank or position at the time of death.

The Military Liberation Order of Vietnam, first class, and the Victory Order, first class, are proposed by the Minister of National Defense and awarded by the President of the Democratic Republic of Vietnam.

- The Military Liberation Order of Vietnam, second and third classes, the Victory Order, second and third classes, the Military Liberation Medal of Vietnam, and the Victory Medal are proposed by the Chiefs of the General Departments, Commanders of the Military Regions, and Divisions, and awarded by the Minister of National Defense.

The Ministry of National Defense shall provide detailed regulations for implementing this decree.

The Prime Minister, the Minister of National Defense, and the Institute of Orders shall be responsible for enforcing this decree.

- Officers at the Regiment and Platoon levels or equivalent who held such positions for at least one year during the resistance period.

4. The First-Class Victory Medal shall be awarded:

The Military Liberation Order of Vietnam, first class, and the Victory Order, first class, are proposed by the Minister of National Defense and awarded by the President of the Democratic Republic of Vietnam.

2- Martyrs who died in combat or work shall be posthumously awarded orders or medals based on their rank or position at the time of death.

- To squad officers and soldiers with at least three years of military service.

5. The Second-Class Victory Medal shall be awarded to squad officers and soldiers with one year of military service or more, or those who have not completed one year of military service during the resistance period but participated in the 1953-1954 Winter-Spring Campaign and continued to serve in the military for three years from the date of peace restoration (July 20, 1954), always actively performing their duties.

Article 6

1. Military personnel who are disabled or injured in combat or work and cannot continue to serve in the military for the required time shall be exempted from the conditions of military age and time in position when considering awards.

2. Veterans and military personnel who were granted discharge for valid reasons and meet the criteria specified in Article 5 shall be considered for awards.

1. Military personnel who died in battle shall be evaluated based on the criteria stipulated in the Decree when considering posthumous awards.

2. Martyrs who sacrificed themselves in combat or work shall be awarded medals based on their rank or position in the military at the time of sacrifice.

Article 8

The First-Class Vietnam Liberation Medal and the First-Class Victory Medal shall be proposed by the Minister of National Defense and presented by the President of the Democratic Republic of Vietnam.

- The Second-Class and Third-Class Vietnam Liberation Medals, the Second-Class and Third-Class Victory Medals, the Vietnam Liberation Medal, and the Victory Medal shall be proposed by the Chiefs of General Departments, Commanders of Military Zones, and Divisions, and presented by the Minister of National Defense.

Article 9

The Ministry of National Defense shall provide detailed implementation regulations for this Decree.

Article 10

The Prime Minister, the Minister of National Defense, and the Institute of Medals shall be responsible for implementing this Decree.
