JOINT CIRCULAR

Guidelines for amending and supplementing Circular Joint No. 12/TT-LBdated April 29, 1994 on electricity surcharges

Pursuant to Article 8 of Decision No. 193/QĐ-TTg dated September 22, 1999 of the Prime Minister on electricity prices, the Government Price Board and the Ministry of Industry provide guidelines for amending and supplementing certain points of Circular Joint No. 12/TT-LB dated April 29, 1994 on electricity surcharges as follows:

I. OBJECTS OF SURCHARGES AND AMOUNTS OF SURCHARGES

Electricity surcharges aimed at creating capital investment funds for electrification in rural areas must be considered and adjusted in the context of adjusting national electricity prices. The implementation of electricity surcharges shall not be extended to localities that have not implemented such surcharges. Localities currently implementing surcharges shall adjust them gradually towards eliminating surcharges by the year 2000. In the short term, provinces and cities that have completed electrification in rural areas or where economic and social conditions do not require the implementation of electricity surcharges shall cease to impose surcharges. Localities continuing to implement electricity surcharges shall comply with the provisions below:

1. Objects of surcharge and amounts of surcharge

Based on the resolution of the People's Councils, taking into account the economic and social situation and the capital investment needs for power grids in each locality, the People's Committee of the province or city shall decide the specific amount of surcharge added to the electricity price for each object but shall not exceed the maximum surcharge level set forth below:

1.1. Electricity used for production (excluding the objects specified in Points 1.2 and 2 below) 40 đ/kWh

1.4. Electricity for lighting agencies

2. Objects exempt from surcharge

The following objects are exempt from electricity surcharges:

2.1. Electricity used for producing tap water, urban drainage, fertilizers, basic chemicals, steel rolling and drawing, printing paper, writing paper, pharmaceutical products, fiber production, textile weaving, grain milling, milk processing.

2.3. Electricity for agricultural production (including irrigation and drainage pumps)

Electricity used for public lighting

2.5. Wholesale electricity for living purposes (rural areas, collective residential areas, community clusters)

Electricity used for agricultural production (including irrigation and drainage pumping)

2.7. Electricity for production, business, services, and living purposes of enterprises with foreign investment and foreigners.

Electricity used for hospitals and schools.

In addition to the objects exempted from additional charges as stated in point 2, if any production or business household subject to additional charges as stated in point 1 faces significant difficulties, the People's Committee of the province or city shall consider temporarily exempting or reducing additional charges on a case-by-case basis.

II. IMPLEMENTATION:

Wholesale electricity sold for household use (in rural areas, collective housing, residential clusters)

2. The People's Committee of the province or city shall submit the Decision on additional electricity charges in accordance with the guidance of this Circular and report the results of implementing additional charges to the Government Price Management Board and the Ministry of Industry for monitoring and inspection when necessary.

Electricity used for household consumption of rural households purchasing at the ceiling price of 700 đ/kWh.

4. During the implementation process, any issues encountered should be reported to the Government Price Management Board and the Ministry of Industry for timely consideration and resolution.
