REGARDING THE RECOGNITION OF HERITAGE SITES

THE MINISTER OF CULTURE, SPORTS AND TOURISM

Pursuant to Article 34 of the Constitution of the Socialist Republic of Vietnam in 1992.
Pursuant to Article 69 of the Land Law adopted by the National Assembly of the Socialist Republic of Vietnam at its Ninth Session on July 14, 1993, and promulgated by the State Council on July 24, 1993, concerning the regulations on the management and use of land for heritage sites.
Pursuant to Ordinance No. 14-LCT/HĐNN on the Protection and Utilization of Historical, Cultural, and Scenic Heritage Sites issued by the State Council of the Socialist Republic of Vietnam on April 4, 1984.
Pursuant to Decree No. 81-CP dated November 8, 1993 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture and Information.
After reviewing the heritage site dossier and the proposal submitted by the Chairman of the People's Committee of Tuyen Quang Province.
Considering the proposal of the Director of the Heritage and Museum Management Department.

DECISION: 

Article 1. Now hereby recognizes the historical site of the President's Residence - Prime Minister's Residence from 1947 to 1954 located in Binh Yen Commune, Son Duong District, Tuyen Quang Province.

Article 2. Strictly prohibit any construction or exploitation activities within the delineated areas of the heritage site. In exceptional cases where land use is required within historical, cultural, and scenic heritage sites, permission must be obtained from the Minister of Culture, Sports and Tourism.

Article 3. LOCAL PEOPLE'S COMMITTEES SHALL IMPLEMENT THE STATE MANAGEMENT OF HISTORICAL, CULTURAL, AND SCENIC HERITAGE SITES IN ACCORDANCE WITH THE LAW.

Article 4. The Heads of the Ministry’s Office, Director of the Department of Museums and Heritage Conservation, Chairmen of the Provincial People's Committees, and Directors of the Departments of Culture, Sports and Tourism of Tuyen Quang Province are responsible for implementing this decision./.
