DIRECTIVE

On implementing measures to enhance and improve the effectiveness of the activities of the Vietnam Bar Association

The Vietnam Bar Association is a professional organization with significant political and social characteristics for those working in the field of law. Over 45 years of operation and development, the Vietnam Bar Association has gathered and united widely those who have been and are currently engaged in legal work in state agencies, economic and social organizations, lawyers, legal consultants, leveraging the potential and intellect of legal experts in building and defending the country, participating in legislative work, promoting and disseminating laws, bringing laws into life, strengthening socialist rule of law, building a law-based state of Vietnam. The Association has actively expanded relations with organizations and legal experts from countries in the region and around the world, contributing to implementing the foreign policy of the Party and the State.

Implementing Directive No. 56/CT-TW dated August 18, 2000 of the Politburo on strengthening the leadership of the Party over the work of the Vietnam Bar Association, further enhancing the effectiveness of the activities of legal experts during the period of accelerating industrialization and modernization of the country, for the goal of a wealthy people, a strong country, a just, democratic, civilized society, the Prime Minister issues the following directive:

1. Ministries, ministerial-level agencies, government agencies, provincial People's Committees under the central government, enterprises belonging to various economic sectors shall pay attention and create favorable conditions for the consolidation and development of the organizational structure of the Vietnam Bar Association, specifically:

a) In places where the Vietnam Bar Association has already been established, it is necessary to pay attention and create favorable conditions for the Vietnam Bar Association to consolidate and develop membership, fully and effectively implement its activities in accordance with the purpose and charter of the Association.

b) In places that have the necessary conditions but have not yet established the Vietnam Bar Association, support should be provided for the establishment of the Vietnam Bar Association and create favorable conditions for its activities.

c) In places where there are civil servants who are legal experts working but are not members of the Vietnam Bar Association, attention should be paid and conditions created for them to join the Association and actively participate in its activities.

- Coordinate with ministries, ministerial-level agencies, government agencies, and provincial People's Committees under the central government to implement measures to leverage the capabilities of the Vietnam Bar Association in legislative activities, promoting and educating the public about the law, supervising the enforcement of laws, mediating disputes at the grassroots level, providing legal advice, legal aid, contributing to promoting democracy at the grassroots level, protecting the legitimate rights and interests of the state, collectives, and citizens, actively participating in the implementation of the National Program to Prevent and Combat Crime; mobilizing the public to effectively participate in the movement "Living and Working According to the Constitution and Laws."

2. The Ministry of Justice shall be responsible for:

- Take the lead and coordinate with the Central Vietnam Bar Association and relevant ministries to urgently submit to the Government for promulgation of the following Decrees and draft Ordinances:

+ Decree on the regulation governing lawyers;

Decree on legal consultation, focusing on and strengthening the activities of free legal consultation and legal aid for the poor and policy beneficiaries by the Vietnam Bar Association;

+ Draft Ordinance on arbitration and guiding documents for the implementation of the ordinance to prepare for submission to the Standing Committee of the National Assembly for consideration and approval.

+ 3. The Ministry of Foreign Affairs shall cooperate with the Central Party's External Relations Board and the Central Vietnam Bar Association to continue expanding and improving the effectiveness of cooperation with legal organizations and progressive legal experts in countries in the region and around the world, contributing to implementing the foreign policy of the Party; promoting the Party's policies and the State's laws abroad to contribute to creating a favorable international legal environment serving the construction and development of the economy, maintaining national independence, sovereignty, and national security; assisting the Vietnam Bar Association in formulating specific plans to mobilize overseas Vietnamese legal experts to contribute to the construction of the country.

4. The Government's Organizational-Cadre Department, the Ministry of Planning and Investment, the Ministry of Finance, and provincial People's Committees under the central government shall, based on their functions and authorities, coordinate with the Vietnam Bar Association to take specific measures to support the Association at all levels with specialized cadres, funds, and other necessary facilities (offices, means of operation) in accordance with the provisions of the State Budget Law and current State regulations commensurate with the position and role of the Association in the new period.

5. Ministers, heads of ministerial-level agencies, heads of government agencies, Chairmen of provincial People's Committees under the central government shall coordinate with the Vietnam Bar Association to organize and implement this Directive. The Ministry of Justice shall be responsible for compiling the situation and reporting to the Prime Minister on the results of implementation./.

5. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of People's Committees of provinces and centrally governed cities shall coordinate with the Vietnam Bar Federation to implement this Directive. The Ministry of Justice shall be responsible for compiling the situation and reporting the results of implementation to the Prime Minister./.
