Regarding the approval of the Charter (amended)

of the Vietnam Association for the Support of People with Disabilities and Orphans

THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

- Based on Law No. 102/SL-L004 dated May 20, 1957 on the right to establish associations;

- Based on Decree No. 181CP dated November 9, 1994 of the Government regarding the functions, tasks, powers, and organizational structure of the Civil Service Committee (now the Ministry of Home Affairs);

- Based on Decision No. 158/QĐ-TTg dated March 2, 1999 of the Prime Minister authorizing the Minister of the Civil Service Committee (now the Minister of the Ministry of Home Affairs) to permit the establishment of the Association;

Article 1: Approves the Charter (amended) of the Vietnam Association for the Support of People with Disabilities and Orphans adopted at the Second National Congress on December 12, 2002.

Article 2: The Chairman of the Vietnam Association for the Support of People with Disabilities and Orphans and the Director of the Department of Non-Governmental Organizations are responsible for implementing this Decision./.

VIETNAM ASSOCIATION FOR THE SUPPORT OF PEOPLE WITH DISABILITIES AND ORPHANS

Article 5. Functions of the Association

Propaganda and mobilization of all social strata to promote the national tradition of "loving others as oneself," providing care, support, rehabilitation, and improving the quality of life for people with disabilities and orphans. The Association participates with state agencies to encourage people with disabilities and orphans to fulfill their civic duties.

Article 6. Tasks and powers of the Association

Article 7. The Association organizes and operates according to the following principles

1. Voluntary, self-management, self-financing.

CHAPTER III

MEMBERS

Article 8. Members

Any individual or collective that agrees with the Charter of the Association, voluntarily applies to join the Association, and serves the purposes of the Association shall be considered for recognition as a member of the Association.

Article 9. Honorary members

Foreign individuals who have contributed to the Association may be recognized as honorary members of the Association.

Honorary members do not participate in the election or nomination for the Board of Directors and do not vote on issues of the Association.

Article 10. Rights of members

1. Participate in activities at the Association's organization.

2. Be eligible for election or nomination to leadership bodies of the Association, discuss and vote on matters of the Association.

3. Receive support from the Association within its capacity, and be protected when their legitimate rights and interests are violated.

Article 11. Obligations of members.

PART IV

ORGANIZATIONAL STRUCTURE OF THE ASSOCIATION

Article 12:

The Association is organized at the central level and locally. Local Associations are established upon consideration and decision by the People's Committee of the Province or City directly under the Central Government.

Article 13: Congress of the Association

1. The Congress elects the highest leadership body of the Association. The National Congress and the Congresses of local Associations are held every five years. In special cases, if two-thirds of the members propose, an interim Congress may be convened.

2. The Congress has the following tasks:

- Discuss and approve reports on the activities of the Association.

- Decide on directions, tasks, programs of activities of the Association, and organizational issues of the Association.

- Approve financial reports.

- Decide on amendments to the Charter.

- Discuss and decide on important issues in the activities of the Association.

- Elect the Executive Board.

- The Congress votes according to the principle of a majority of present delegates.

Article 14:

The Executive Board is the leadership body of the Association between two Congress sessions. The Executive Board convenes regularly every six months and meets irregularly as necessary.

Article 15. The Executive Board has duties and powers

1/ To implement the Resolutions of the Congress.

2/ To decide on work programs, annual plans, and financial plans.

4/ In cases where an inspection involves a member of the Executive Board at the same level, it must be authorized by that Executive Board.

CHAPTER V

FINANCE AND ASSETS OF THE ASSOCIATION

Article 18. Financial Resources of the Association

a/ Sources of income for the Association:

1/ Income from subordinate organizations within the Association

2/ Partial funding support from the State.

3/ Membership fees paid by members.

4/ Contributions from members.

5/ Income from lawful fundraising activities of the Association as stipulated by law.

6/ Money and materials donated by organizations and individuals both domestically and internationally.

7/ Other lawful sources of income.

b/ Expenditures of the Association:

1/ Mainly allocated to activities supporting disabled persons and orphaned children: emergency assistance, care, vocational training, job creation, cultural education, medical treatment, and functional recovery.

2/ For propaganda work.

3/ For activities of the Association.

4/ For awards.

Article 19: Assets of the Association

The assets of the Association include: offices, material infrastructure, equipment, and means of service for the Association's activities.

Article 20:

Financial resources and assets of each level of the Association are managed and utilized by that level of the Association itself, ensuring transparency, and being used for purposes determined by the Association's Executive Board, but must comply with state regulations and be subject to audit and inspection by financial authorities.

Chapter VI

REWARD AND DISCIPLINE

Article 21: Awards

Organizations, officials, and members of the Association who have outstanding achievements will be considered for awards by the Association. If there are exceptional achievements, they can be recommended for state awards. The award system is implemented according to guidelines issued by the state and the Central Executive Board of the Association.

Article 22: Disciplinary Measures

Organizations, officials, and members of the Association who violate the Charter, resolutions of the Association, or damage the reputation, honor, property, or finances of the Association shall be subject to criticism, warning, or disqualification as a member depending on the severity of the violation.

Chapter VII

IMPLEMENTATION OF THE ASSOCIATION CHARTER

Article 23:

1. The Charter consists of seven chapters and twenty-three articles, which were adopted by the Second National Congress of the Vietnam Association for the Protection of Disabled Persons and Orphans on December 12, 2002.

2. Amendments and supplements to the Charter of the Association are decided by the Congress or the National Congress of the Association.

3. All organizations and members of the Association are obligated to implement the Charter of the Association.

4. The Central Executive Board of the Association is responsible for guiding the implementation of the Charter of the Association.

5. This Charter takes effect from the date it is recognized by the Ministry of Home Affairs through a decision.
