DIRECTIVE

On Strengthening the Assurance of Information Security for Postal, Telecommunications, and Internet Services in the New Situation

In the current situation, hostile forces are increasingly exploiting postal, telecommunications, and internet services to engage in activities that infringe upon national security and social order and safety.

Implementing Directive No. 26-CT/TW dated August 18, 2003 of the Politburo on organizing research, implementation, and execution of Resolution No. 8 of the 8th Plenary Session of the Central Committee (Term IX) and Action Program No. 44A-CTHĐ/BCS dated October 15, 2003 of the Party Cadre Board of the Ministry of Posts and Telecommunications implementing Resolution No. 8 of the Central Committee (Term IX) on the Strategy for National Defense in the New Situation; Joint Circular No. 01/2001/TTLT-TCBĐ-BCA dated June 7, 2001 of the General Post Office (now the Ministry of Posts and Telecommunications) and the Ministry of Public Security; To strengthen the assurance of information security to serve state management over the provision and use of postal, telecommunications, and internet services, and the use of radio transmitters and receivers nationwide, the Minister of Posts and Telecommunications instructs subordinate agencies and units of the Ministry of Posts and Telecommunications, postal, telecommunications, and internet enterprises to implement the following tasks well:

1. Strictly comply with laws on postal, telecommunications, and internet services; have responsibility to ensure information security in postal, telecommunications, and internet operations; implement requirements for network safety and information security as stipulated by law and the contents prescribed in Joint Circular No. 01/2001/TTLT-TCBĐ-BCA dated June 7, 2001.

2. Postal, telecommunications, and internet enterprises cooperate with local police to develop action plans when there are violent disturbances, riots disrupting social order and safety, and infringing upon national security:

a. Ensure communication services to support the direction and management of Party and State agencies, armed forces when violent disturbances occur according to the current provisions of the law.

b. Organize protective forces, equip network protection devices and telecommunications facilities under their management; shall not take advantage of or allow others to take advantage of networks, subscriber equipment, access passwords to cause interference, disruption, infringement upon national security, and social order and safety.

c. Cooperate with specialized units of the Ministry of Public Security to urgently prevent and stop service provision for cases causing violent disturbances, using postal, telecommunications, and internet services to infringe upon national security, opposing the Socialist Republic of Vietnam.

3. Postal, telecommunications, and internet enterprises strengthen strict inspection and supervision of the activities of telecommunication and internet service agents; Propagate and guide agency owners to understand the state regulations on ensuring network security and information security and strictly comply with regulations on providing postal, telecommunications, and internet services; must provide complete data when requested by the police to carry out necessary measures to protect national security and social order and safety.

4. The Planning and Finance Department will study and build mechanisms for exemption and reduction of fees to support specialized units of the Ministry of Public Security in using networks, postal, telecommunications, and internet services during violent disturbances, riots, disruptions of social order and safety, and infringements upon national security.

5. Subordinate units of the Ministry, postal, telecommunications, and internet enterprises have the responsibility to support professional training, dispatch technical staff to cooperate with related specialized units of the Ministry of Public Security to study technical solutions to meet the requirements for ensuring network security and information security on telecommunications and internet networks.

Heads of subordinate agencies and units of the Ministry, postal, telecommunications, and internet enterprises are responsible for organizing and implementing this Directive and submitting reports on its implementation to the Ministry of Posts and Telecommunications (Telecommunications Department); During the implementation process, if any difficulties arise, report to the Ministry of Posts and Telecommunications for consideration and resolution.

The Telecommunications Department and the Postal Department are responsible for inspecting and urging the implementation of this Directive and reporting to the Minister./.
