THE MINISTER OF SCIENCE AND TECHNOLOGY

Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;

Considering the proposals of the Heads of the Department of Social Sciences and Natural Sciences and the Department of Organization and Cadres;

DECISION:

Article 1. This Decision promulgates the Regulation on the Organization and Operation of the Department of Social Sciences and Natural Sciences under the Ministry of Science and Technology.

Article 2. This Decision takes effect fifteen days after its publication in the Official Gazette and replaces Decision No. 733/QĐ-BKHCNMT dated June 12, 1998 of the Minister of Science, Technology and Environment (now the Ministry of Science and Technology) promulgating the Charter on the Organization and Operation of the Department of Management of Social Sciences and Natural Sciences.

Article 3. The Heads of the Office, the Department of Organization and Cadres, the Department of Social Sciences and Natural Sciences, and the Heads of related units shall be responsible for implementing this Decision.

Organization and operation of the Department of Social Sciences and Natural Sciences

PART I

FUNCTIONS, TASKS, AND POWERS

Article 1. The Department of Social Sciences and Natural Sciences is a unit directly under the Ministry of Science and Technology with the function of assisting the Minister in managing state activities in scientific research, technological development, and the development of scientific and technological potential in the fields of social sciences, natural sciences, marine sciences and technologies, natural resources, environment, military sciences, and security sciences.

Article 2. Within the scope of management assigned, the Department of Social Sciences and Natural Sciences has the main tasks and powers as follows:

1. Researching and proposing, organizing the drafting or coordinating in the drafting of regulatory legal documents within the scope of management assigned, and guiding sectors, localities, and grassroots units to implement them after their issuance.

2. Organizing the development of policies, mechanisms, strategic directions, planning for priority scientific and technological fields, programs, projects, five-year plans, and annual plans for scientific research and technological development, and the development of scientific and technological potential in the assigned fields.

3. Serving as the focal point for scientific and technological planning with other Ministries and sectors according to the division of labor by the Minister. Proposing budget allocations for scientific and technological tasks within the assigned fields.

4. Organizing advisory services to determine national scientific and technological tasks, selecting or directly assigning organizations or individuals to undertake such tasks. Directing the implementation, urging progress, and inspecting the execution process of these tasks, and organizing evaluations and acceptance of results of scientific and technological tasks within the assigned fields.

5. Advising on investment directions for basic construction, equipment, and the development of resources for state scientific and technological agencies, participating in reviewing economic and technical norms within the assigned fields.

6. Providing advice and advisory services to the leadership of the Ministry on issues related to social sciences and natural sciences, recommending lists of scientific and technological achievements within the assigned fields that can be applied in production and daily life.

7. Guiding the development of plans and inspecting the implementation of scientific and technological plans of sectors and localities assigned to manage. Coordinating in managing scientific and technological activities of localities. Guiding localities on the management of social science and natural science activities.

8. Implementing state management activities regarding scientific and technological information nationwide.

9. Cooperating with units within the Ministry to resolve specialized matters when required.

10. Managing cadres and civil servants, assets, and documents of the Department according to the division of labor and regulations of the Ministry.

Chapter II

ORGANIZATIONAL STRUCTURE

Article 3. The Department of Social Sciences and Natural Sciences operates and works under the chief executive system combined with collective discussion.

The Head of the Department of Social Sciences and Natural Sciences is responsible to the Minister for the entire organization and operation of the Department.

Deputy Heads of the Department of Social Sciences and Natural Sciences assist the Head in leading the work of the Department, are responsible to the Head for the tasks assigned, and have the authority to decide matters within the scope of their assigned tasks.

In the absence of the Head, a Deputy Head may be authorized to lead and manage the operations of the Department.

Article 4. The Department of Social Sciences and Natural Sciences implements a system where specialists work directly with the Department's leadership. When necessary, the Head of the Department of Social Sciences and Natural Sciences may establish working groups or teams based on the nature and requirements of the work and specify the specific tasks of these groups or teams.

Chapter III

WORK RELATIONSHIPS

Article 5. The Head of the Department of Social Sciences and Natural Sciences directs all activities of the Department based on the Regulation on the Organization and Operation of the Department of Social Sciences and Natural Sciences.

Article 6. The Head of the Department of Social Sciences and Natural Sciences implements the working system and relationships with the heads of subordinate units of the Ministry according to the Ministry's working regulations and other provisions issued by the Minister.

Article 7. The Department of Social Sciences and Natural Sciences is responsible for closely collaborating with relevant Departments of Science and Technology, functional Departments of other Ministries and sectors, provincial Departments of Science and Technology, and grassroots units in carrying out assigned management tasks.

 Chapter IV

IMPLEMENTING PROVISIONS

Article 8. The Head of the Department of Social Sciences and Natural Sciences coordinates with the Head of the Department of Organization and Cadres to organize the implementation of this Regulation.

Article 9. Any amendments or supplements to this Regulation shall be proposed by the Head of the Department of Social Sciences and Natural Sciences in coordination with the Head of the Department of Organization and Cadres to the Minister of Science and Technology for consideration and decision./.
