Amending Clause 1, Clause 3, and Clause 4 of Article 1 of Decision No. 123/2004/QĐ-BCN dated November 4, 2004 of the Minister of Industry on the transfer of the Tobacco Raw Materials Company South to the Hòa Việt Joint Stock Company

THE MINISTER OF INDUSTRY
Pursuant to Decree No. 55/2003/NĐ-CP dated May 28, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry;
Upon the proposal of the Vietnam Tobacco Corporation (Letter No. 03/HĐQT-CV-TC dated January 25, 2005) and the Tobacco Raw Materials Company South (Letter No. 26/NLTLN-CV-BĐM dated February 3, 2005);
At the suggestion of the Enterprise Reform and Development Board under the Ministry and the Director of the Personnel and Organization Department,
DECISION:
Article 1. Amending Clause 1, Clause 3, and Clause 4 of Article 1 of Decision No. 123/2004/QĐ-BCN dated November 4, 2004 of the Minister of Industry on the transfer of the Tobacco Raw Materials Company South to the Hòa Việt Joint Stock Company as follows:
"1. Registered capital structure:
The charter capital of the joint stock company is 107,270,000,000 VND (One hundred and seven billion two hundred and seventy million VND). Of which:
- State shareholding ratio: 73.28%;
- Shareholding ratio sold to employees within the company: 12.61%;
- Preferential shareholding ratio sold to tobacco farmers: 0.28%;
- Auctioned shareholding ratio sold outside the company: 13.83%.
The value of one share: 100,000 Vietnamese dong."
"3. Employee benefits.
The total number of preferential shares sold to 958 employees within the company is 88,888 shares with a preferential value of 2,666,640,000 VND.
"4. Preferential treatment for tobacco raw material growers.
The total number of preferential shares sold to four households of tobacco raw material growers is 2,980 shares with a preferential value of 89,400,000 VND.
Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.
The Head of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments and Bureaus under the Ministry, the Board of Directors of the Vietnam Tobacco Corporation, the Director of the Tobacco Raw Materials Company South, and the Board of Directors of the Hòa Việt Joint Stock Company are responsible for implementing this Decision./.
