of the Office for Registration of Scientific and Technological Activities
THE MINISTER OF SCIENCE AND TECHNOLOGY
Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP dated May 19, 2003;
Pursuant to Decision No. 198/QĐ-BKHCN dated February 23, 2005 of the Minister of Science and Technology on maintaining the operation of the Office for Registration of Scientific and Technological Activities;
Considering the proposals of the Heads of the Office for Registration of Scientific and Technological Activities and the Director of the Department of Organization and Cadres.
DECISION:
Article 1. This Decision promulgates the Charter on Organization and Operation of the Office for Registration of Scientific and Technological Activities attached hereto.
Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette and shall replace Decision No. 219/QĐ-TCCB dated April 28, 1994 of the Minister of Science, Technology and Environment (now the Ministry of Science and Technology) on the issuance of the Charter on Organization and Operation of the Office for Registration of Scientific and Technological Activities.
Article 3. The Heads of the Office, the Director of the Department of Organization and Cadres, the Head of the Office for Registration of Scientific and Technological Activities, and the Heads of related units shall be responsible for implementing this Decision.

CHARTER
ORGANIZATION AND OPERATION OF THE OFFICE FOR REGISTRATION OF SCIENTIFIC AND TECHNOLOGICAL ACTIVITIES
(Issued pursuant to Decision No. 06/2005/QĐ-BKHCN dated May 19, 2005 of the Minister of Science and Technology)
Chapter 1:
FUNCTIONS, TASKS, AND POWERS
Article 1. The Office for Registration of Scientific and Technological Activities (hereinafter referred to as the Registration Office) is a unit established by the Minister of Science and Technology, with the function of assisting the Minister in uniformly managing the registration of activities of research and development organizations and scientific and technological service organizations; organizing the implementation of the examination and issuance of registration certificates for scientific and technological activities for research and development organizations, scientific and technological service organizations, and science and technology development funds..
Article 2. The Registration Office has the following main tasks and powers:
1. Proposing and drafting legal normative documents in the field of registration of activities of research and development organizations, scientific and technological service organizations, and science and technology development funds.
2. Organizing the receipt, review, and issuance of registration certificates for scientific and technological activities for research and development organizations, scientific and technological service organizations, and science and technology development funds within its jurisdiction.
3. Providing guidance on the examination and issuance of registration certificates for scientific and technological activities and organizing inspections of the issuance of such certificates by provincial science and technology offices.
4. Organizing inspections of the activities of research and development organizations, scientific and technological service organizations, and science and technology development funds according to the contents recorded in the registration certificates issued by the Ministry and recommending competent authorities to handle them in accordance with the provisions of the law.
5. Statistics, monitoring, and classifying research and development organizations and scientific and technological service organizations according to appropriate criteria systems.
6. Taking the lead and coordinating with relevant units within the Ministry to review the contents of scientific and technological contracts of research and development organizations and scientific and technological service organizations within its jurisdiction as a basis for tax incentives under current State regulations.

Chapter 2:
PRINCIPLES OF OPERATION
Article 3. The Registration Office operates under the head system, with clerks directly working under the Director of the Registration Office.
The Director of the Office shall be appointed and relieved from duty by the Minister, and shall be responsible to the Minister for the entire organization and operation of the Office.
Article 4. The Director of the Registration Office shall manage all activities of the Office based on the Charter of Organization and Operation of the Registration Office; implement work regulations and relationships with heads of units under the Ministry according to the Ministry's Work Regulations and other provisions issued by the Minister.
Article 5. The Registration Office shall closely cooperate with Science and Technology Departments of localities and other relevant agencies in performing assigned tasks.
Chapter 3:
IMPLEMENTING PROVISIONS
Article 6. The Director of the Registration Office shall coordinate with the Head of the Cadre and Civil Service Organization Department to organize the implementation of this Charter.
Article 7. Any amendments or supplements to this Charter shall be proposed by the Director of the Registration Office in coordination with the Head of the Cadre and Civil Service Organization Department for consideration and decision by the Minister of Science and Technology./.
