Pursuant to the Education Law dated June 14, 2005;

Pursuant to the Ordinance on Preferential Treatment for Persons with Merit in the Revolution dated June 29, 2005;

Pursuant to Decree No. 86/2002/ND-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 85/2003/ND-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Based on the proposal of the Director of the Department of Vocational Education,

 

DECISION:

 

Article 1. The Admissions Regulations for Intermediate Vocational Education are hereby issued along with this Decision.

Article 2. This Decision takes effect from April 30, 2006. This Decision replaces Decision No. 13/2005/QĐ-BGD&ĐT dated April 11, 2005 of the Minister of Education and Training on the issuance of the Admissions Regulations for Secondary Vocational Education.

Article 3. The Heads of the Office, Inspectorate, Department of Vocational Education, Examination and Quality Assurance Agency, Heads of relevant units under the Ministry of Education and Training, Heads of management agencies of intermediate vocational education institutions, Directors of Departments of Education and Training, Principals of intermediate vocational schools, Heads of intermediate vocational training centers are responsible for implementing this Decision.

Admissions for Intermediate Vocational Education

(Issued together with Decision No. 06/2006/QĐ-BGDĐT dated March 17, 2006)

of the Minister of Education and Training)

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Regulation governs admissions for Intermediate Vocational Education (IVET), including: organization, tasks, and powers of schools in admissions work; specific regulations on admissions work; selection and notification of successful candidates; rewards and penalties; reporting and record-keeping systems.

Article 2. This Regulation applies to schools and educational institutions offering IVET (hereinafter referred to collectively as schools) in conducting IVET admissions.

Article 3. This Regulation does not apply to admissions for overseas study.

Article 2. Admissions

Clause 1. Admissions for IVET include the following forms:

- Admission based on examination results;

- Admission based on assessment.

Clause 2. Each year, schools with enrollment quotas organize admissions to select students for their schools. The Ministry of Education and Training guides schools in conducting admission examinations or assessments to ensure practical, streamlined, and effective admissions processes.

Article 3. Management of Admissions Work

Clause 1. The Ministry of Education and Training is the state management agency and uniformly directs schools regarding national IVET admissions work.

Clause 2. At least three months before the admissions date, the Ministry of Education and Training publicly announces the enrollment quotas of schools, recruitment areas, target groups, admission forms, and timeframes.

Clause 3. The Ministry of Education and Training, relevant ministries, provincial people's committees (collectively referred to as provincial level), have the responsibility to direct, guide, inspect, and audit schools according to the regulations on admissions.

Clause 4. The Minister of Education and Training considers and decides on special cases related to admissions.

Article 4. Admission based on review

1. Admission based on review shall be conducted for schools or majors that do not organize entrance examinations.

2. Depending on the target group of applicants, schools shall base their admission reviews on the following grounds:

a) The results of the national high school graduation examination (THPT) or junior high school graduation examination (THCS);

b) The cumulative scores of subjects over three years of high school or four years of junior high school;

c) The cumulative scores of subjects in the final year of study;

d) The scores from the university (ĐH) or college (CĐ) entrance examination in the same year as the application for admission to vocational training centers (TCCN).

3. The grounds for admission based on review must be publicly announced before the review process begins. Principals of schools have the right to choose one or more grounds for review and select two subjects suitable for the major offered by the school to apply coefficients, or take the results of two subjects suitable for the major offered by the school.

4. Admission based on review does not apply to majors with talent tests.

Article 5. Entrance Examination

The entrance examination process includes four stages: organizing the examination period; setting examination questions; supervising and grading the examination, and conducting re-examinations; selecting and summoning successful candidates to attend the school. Principals of schools are responsible for organizing and implementing according to the provisions of this Regulation.

Article 6. Assignment for Admission

Assignment for admission to vocational training centers is carried out in accordance with current laws regarding the assignment system.

Article 7. Conditions for Application

1. Citizens of the Socialist Republic of Vietnam, regardless of religion, belief, gender, family origin, social status, or economic circumstances, who meet the following conditions are eligible to apply for admission to vocational training centers:

a) Having graduated from high school (THPT) or junior high school (THCS) depending on the target group of the school;

b) Having sufficient health to study as stipulated by the current regulations of the Ministry of Health and the Ministry of Education and Training. Persons with disabilities; children of those who participated in the resistance war and were affected by toxic chemicals recognized by the provincial People's Committee as having deformities, disabilities, or reduced self-care abilities due to toxic chemicals, depending on their health condition and the requirements of the major, the principal will consider and decide on eligibility for admission;

c) Being within the age limit specified for majors with age restrictions;

d) Meeting the preliminary selection requirements (if applying for schools with preliminary selection requirements);

đ) Having permanent residence registration in the designated recruitment area if applying for schools with recruitment area requirements;

e) Submitting all required documents and registration fees within the prescribed time frame as stipulated by the Ministry of Education and Training;

g) Being present at the registered examination venue at the time specified in the examination notification, and paying the full examination fee;

h) Military personnel and public security officers on active duty may only apply for admission to schools designated by the Ministry of National Defense or the Ministry of Public Security after obtaining permission from the competent authority to study;

Military personnel on active duty nearing the end of their compulsory military service period, if permitted by the competent authority, may apply for admission according to their personal preference. If admitted, they must enroll immediately in the same year and cannot defer enrollment to the next academic year.

2. Those who do not meet the above conditions and the following individuals are ineligible to apply:

a) Those who fail to comply with the Law on Military Service; currently serving a criminal sentence;

b) Individuals whose eligibility for admission has been revoked or who have been disciplined with expulsion from school, and less than two years have passed since the date of the disciplinary decision until the date of application.

Article 8. Admission

A candidate who has participated in the examination for all required subjects (for schools organizing entrance examinations) or has submitted all required application documents (for schools conducting admission based on application review), if achieving the admission score to the school they applied for each category, according to each region of each major (if the school admits students based on majors), and does not have any subject with a zero score, shall be admitted to the school they applied for.

Article 9. Preferential Policies in Admissions

1. Preferential policies by category

a) Priority Group 1 (UT1) includes the following categories:

- Category 01: Vietnamese citizens whose father or mother is from an ethnic minority group;

- Category 02: outstanding employees who have worked continuously for five years or more, including at least two years recognized as Model Workers by provincial authorities or higher and awarded certificates of merit;

- Category 03: war invalids, disabled veterans, and persons holding certificates entitling them to benefits equivalent to those of war invalids; active-duty military personnel and police officers assigned to study; military personnel and police officers who have completed their service obligations and been discharged after serving at least twelve months in Region 1 (KV1);

- Category 04: children of martyrs, children of war invalids, children of disabled veterans, children of persons holding certificates entitling them to benefits equivalent to those of war invalids with a disability rate of 81% or higher; children of Heroic Mothers of Vietnam; children of Heroes of the Armed Forces, Heroes of Labor; children of individuals engaged in revolutionary activities before January 1, 1945 or individuals engaged in revolutionary activities from January 1, 1945 to August 19, 1945; children born to individuals affected by chemical warfare agents recognized by the provincial People's Committee as having deformities, disabilities, or reduced self-care abilities due to the effects of chemical warfare agents.

b) Priority Group 2 (UT2) includes the following categories:

- Category 05: active-duty military personnel and police officers or young volunteers assigned to study; military personnel and police officers who have completed their service obligations and been discharged after serving at least eighteen months;

- Category 06: children of war invalids and disabled veterans with a disability rate below 81%; children of persons holding certificates entitling them to benefits equivalent to those of war invalids with a disability rate below 81%;

- Category 07: employees recognized by provincial, municipal, central ministry, or sector-level authorities as Excellent Craftsmen, Artisans, Creative Workers by the General Confederation of Trade Unions of Vietnam or Innovative Youth by the Central Committee of the Ho Chi Minh Communist Youth Union; teachers without a secondary teacher education qualification (previously secondary normal education) who have taught for three years or more (as of the date of application) applying to the teacher training program; nurses, pharmacy technicians, health care assistants, and technical staff in the medical and pharmaceutical fields with a basic degree who have worked for three years or more (as of the date of application) applying to the medical and pharmaceutical field; workers with a vocational training diploma who have worked for three years or more (as of the date of application) applying to vocational high schools (corresponding fields).

Individuals eligible for multiple priority categories may only enjoy the highest priority category.

2. Preferential policies by region

a) Candidates who have continuously studied and graduated from high school or junior high school in a particular region shall enjoy preferential treatment according to that region. If there was a transfer during the academic years, the longer period spent studying in a particular region will determine the preferential treatment according to that region. If a student attended different schools or spent half of the time at one school and half at another, the preferential treatment will be according to the region where they graduated. In cases where there is no school in the place of permanent residence, candidates must attend a school located in a region with lower preferential treatment than their place of permanent residence and shall enjoy preferential treatment according to their place of permanent residence;

b) Students from boarding schools for ethnic minorities; preparatory classes; students from classes opening sources according to decisions of the Ministry or provincial People's Committees shall enjoy preferential treatment according to their original household registration before attending these schools.

Military personnel and police officers assigned to apply for admission and stationed in a particular region shall enjoy preferential treatment according to that region.

c) The recruitment regions are divided as follows:

- Region 1 (KV1) includes communes and towns in mountainous areas, highlands, remote areas, islands, and communes in regions with extremely difficult socio-economic conditions as defined by the Government;

- Rural Region 2 (KV2-NT) includes communes and towns not belonging to KV1, KV2, or KV3;

- Region 2 (KV2) includes provincial cities (not directly under the central government); districts and suburban counties of centrally-administered municipalities;

- Region 3 (KV3) includes inner-city districts of centrally-administered municipalities. Candidates from KV3 do not qualify for regional preferential treatment.

3. Framework for preferential points by category and region:

a) The difference in points between two consecutive admission regions is 0.5 points, and the difference in points between two consecutive priority groups is 1 point;

b) For schools or training programs with specific employment addresses, which train special talent majors, the points for admission may be set differently from the provisions in point a of this clause to ensure sufficient enrollment;

4. Direct admission policy: direct admission applies to the following categories:

a) Heroes of Labor, Heroes of the Armed Forces, National Model Workers who have graduated from high school or junior high school, depending on the admission criteria of the school;

b) Individuals who were admitted to vocational high schools but were immediately conscripted for military service or assigned to young volunteer units, and have now completed their service obligations and been discharged, but have not yet been enrolled in any regular long-term educational institution, provided they meet the health requirements, shall be directly admitted to the school they were previously admitted to;

c) Candidates who are members of national teams participating in international Olympiads (Mathematics, Physics, Chemistry, Informatics, etc.) and have graduated from high school or junior high school;

d) Athletes who are members of national teams participating in international competitions or athletes ranked first, second, or third in the National Fitness Festival and have graduated from high school or junior high school shall be directly admitted to vocational high schools for physical education and sports. The eligibility period for preferential treatment is no more than five years from the date of winning the award to the date of registering for admission to vocational high schools.

đ) Students with artistic talent who have graduated from high school or junior high school and have officially won awards in national art competitions (approved by the Ministry of Culture, Sports and Tourism) or international competitions in singing, dancing, and music shall be directly admitted to study corresponding majors at arts schools (if such majors are offered by the school). The period for enjoying preferential treatment shall not exceed five years from the date of winning the award to the date of registering for admission to vocational training centers;

e) Students who have won awards from commendation level and above in national high school student excellence selection exams after graduating from high school shall be directly admitted to study at vocational training centers;

The results of the national high school student excellence selection exams of students currently in grade 11 shall be preserved for the next year's admission to vocational training centers;

g) Students who have graduated from high school or junior high school with good conduct ratings and final-year scores in Mathematics and Literature subjects of 6.5 points or higher, and belong to one of the following categories:

- Orphaned by both parents, with one of them being a烈士;

- Both parents are disabled veterans, with one of them having a labor capacity reduction of over 81%;

- Orphaned by both parents, with household registration and residence in areas classified as extremely difficult regions for at least three years up to the date of application;

5. Direct admission according to the provisions of points c, e, and g of Clause 4 of this Article shall be conducted based on the following principles:

a) It can only be applied once in the year the student graduates from high school or junior high school;

b) A student who wins one or more awards in the high school student excellence competition shall only enjoy the highest priority standard;

c) Students who win awards in national high school student excellence selection exams shall be directly admitted to study majors that match the subjects they won awards in;

d) Only those who meet the preliminary screening requirements of schools with such requirements shall be considered for direct admission;

đ) For arts majors or schools, candidates eligible for direct admission (excluding those specified in point đ of Clause 4 of this Article) who meet the preliminary screening requirements shall be exempt from cultural subject exams but must take arts subject exams and achieve the required arts exam scores set by the school to be considered for admission;

e) The total number of students directly admitted to vocational training centers of a school or a major within a school as stipulated in this Article shall not exceed 20% of the total enrollment quota of the school or the major. If the number of applications for direct admission exceeds 20%, priority shall be given to candidates specified in points a to e of Clause 4 of this Article. Candidates specified in point g of Clause 4 of this Article will be prioritized based on their overall graduation exam scores;

g) Students eligible for direct admission who choose not to use their direct admission rights and instead participate in the vocational training center entrance exam shall receive an additional two points;

6. Annually, candidates eligible for direct admission shall submit an application for direct admission (Form 1 attached as an appendix) to the Department of Education and Training in their place of residence before July 15. The Department of Education and Training shall compile and send the list to the Ministry of Education and Training before July 25. After August 10, applicants for direct admission shall go to the Department of Education and Training to view the results and contact the school that has accepted them for direct admission.

Article 10. Procedures and Documents for Registration to Apply

1. Registration to Apply (RRA)

a) Based on the annual enrollment plan announced by the Ministry of Education and Training, applicants shall record their preferences for registration to apply to schools (or to majors within schools for those schools that enroll students based on majors) in accordance with their abilities and conditions.

b) Applicants may register to apply to one or more schools using the unified application form prescribed by the Ministry of Education and Training.

2. Documents and Application Fees for RRA

a) Applicants submit the RRA documents and application fees at the designated location according to the regulations of the Department of Education and Training. The Department of Education and Training will transfer the RRA documents and application fees to the schools.

b) After the deadline for submitting documents set by the Department of Education and Training, applicants submit the RRA documents and application fees directly to the schools they wish to apply to.

After submitting the RRA documents, if there are changes in family circumstances, personal status, or if errors or omissions are discovered, applicants are responsible for supplementing all legal documents to serve as the basis for implementing preferential policies in selection and other benefits on the day of examination procedures (for examination candidates) or before the deadline for submitting application documents (for candidates applying through review).

Chapter II

ORGANIZATION, DUTIES AND POWERS OF SCHOOLS

IN ENROLLMENT WORK

Article 11. Organization, Duties and Powers of the Admissions Council (AC) of the School

Annually, at each school with admission quotas, the Principal issues a decision to establish the AC to oversee all matters related to the admissions process.

1. Members of the AC of the School include:

a) Chairperson: The Principal or Deputy Principal authorized by the Principal;

b) Vice-Chairman: Deputy Principal or Head of Training Department;

c) Permanent Member: The Director or Deputy Director of the Training Department;

d) Members: Some department heads, faculty heads, committee heads, and subject group leaders.

Individuals with relatives (spouse; child; sibling) applying to the school that year are not allowed to participate in the AC.

2. Duties and Powers of the AC of the School

a) The AC of the School under the Ministry or sector is under the unified direction of the Ministry of Education and Training, the AC of the School under the People's Committee of the province is under the unified direction of the Department of Education and Training;

b) The AC of the School has the duty and power to strictly organize and implement the review process (for majors without examination), examination including stages: setting questions, organizing the exam, grading and re-grading, selecting and summoning successful candidates to the school; collecting and using application fees and examination fees; summarizing the admissions work; resolving inquiries and complaints related to the admissions period, deciding rewards and punishments, and promptly reporting the admissions work to the Ministry of Education and Training and the managing agency (Ministry, sector, or Provincial People's Committee where the school is located) and the Department of Education and Training.

3. Duties and Powers of the Chairperson of the AC of the School

a) Publicize, guide, and organize the implementation of the admissions work according to the Admissions Regulations of the Ministry of Education and Training;

b) Decide and be responsible for all aspects of the admissions work according to the provisions of this Regulation;

c) Issue decisions to establish support staff for the AC of the School including: Secretariat, Question Setting Board, Examination Supervision Board, Grading Board, Re-grading Board, depending on the specific circumstances of each school, the Chairperson of the AC may establish a Facilities Board or designate a group of officials to manage facilities for the school's admissions period. These boards are directly supervised by the Chairperson of the AC of the School.

4. The Vice-Chairperson of the AC of the School assists the Chairperson of the AC in performing tasks assigned by the Chairperson of the AC and replaces the Chairperson of the AC to handle matters when authorized by the Chairperson of the AC.

Article 12. Organization, tasks, and powers of the Secretariat Board of the School's Steering Committee

1. Composition of the Secretariat Board of the School's Steering Committee

a) Chairperson: to be concurrently held by a standing member of the School's Steering Committee.

b) Members: some staff from the Training Department and teachers.

2. Tasks and powers of the Secretariat Board of the School's Steering Committee

a) To carry out tasks assigned by the Chairman of the School's Steering Committee;

b) To receive examination papers from the Examination Board; to inventory and store examination papers;

c) To implement bagging, numbering, and opening examination papers according to the provisions of Article 21 of this Regulation;

d) To hand over candidates' examination papers to the Marking Board and to perform other operational tasks as stipulated in Article 27 of this Regulation;

đ) To manage application files, related documents, and examination records. To prepare minutes for handling examination scores;

e) To report on marking and admission situations to the Chairman of the School's Steering Committee for review;

g) To propose admission score schemes for the Chairman of the School's Steering Committee to review;

h) To print and send examination results and admission notices to candidates.

The Secretariat Board of the School's Steering Committee may only conduct work related to examination papers when at least two members of the Board are present.

3. Tasks and powers of the Chairperson of the Secretariat Board of the School's Steering Committee

a) To select school staff and teachers who have a sense of organizational discipline, high responsibility, honesty, careful working style, confidentiality awareness, and no relatives (spouse; child; siblings) applying to the school that year to submit to the Chairman of the School's Steering Committee for decision to appoint to the Secretariat Board;

b) To be responsible before the Chairman of the School's Steering Committee for directing the operations of the Secretariat Board.

Article 13. Organization, tasks, and powers of the Question Setting Board of the School

1. Composition of the Question Setting Board

a) Chairperson to be concurrently held by the Chairman or Vice-Chairman of the School's Steering Committee;

b) Standing member appointed by the Chairman of the School's Steering Committee or the Chairperson of the Question Setting Board;

c) Depending on the number of subjects of the school, the Chairperson of the Question Setting Board designates the Head of each subject and members of the Question Setting Board.

Supporting the Question Setting Board are one or two staff members tasked with typing, printing, copying, and packaging examination questions. Those with relatives (spouse; child; siblings) applying to the school that year shall not participate in the Question Setting Board or support the Question Setting Board.

2. Tasks and powers of the Question Setting Board

a) To assist the Chairman of the School's Steering Committee in determining examination question requirements, organizing the compilation, printing, packaging, storage, and delivery of examination questions to the Examination Board for use according to the regulations of the Admission Regulations;

b) To draft answers, grading scales, marking guidelines, print, package, and store them for each subject and deliver them to the Marking Board for use according to the regulations of the Admission Regulations;

c) The Question Setting Board operates independently and directly between the Chairperson of the Question Setting Board and each Head of Subject, without conducting collective meetings of the entire Board.

3. Tasks and powers of the Chairperson of the Question Setting Board

a) To select participants in the examination question setting, determine the requirements for compiling examination questions;

b) To organize and direct the implementation of all examination question setting work according to the examination question setting procedures stipulated in Article 19 of this Regulation;

c) To review and decide on the selection of official and reserve examination questions, handle urgent and unusual situations regarding examination questions during the admission period;

d) To be responsible before the School's Steering Committee for the quality and confidentiality procedures of examination questions and all related work.

4. Tasks and powers of the Standing Member of the Question Setting Board

a) To study and thoroughly understand the regulations on examination question setting, prepare textbooks and necessary reference materials to assist the Chairperson of the Question Setting Board in managing the examination question setting work;

b) To plan and schedule reviews of examination questions, record minutes of critiques and reviews during meetings between the Chairperson of the Question Setting Board and the Heads of Subjects;

c) To plan and directly organize printing, copying, packaging, storage, distribution, and use of examination questions for examination venues and rooms.

5. Tasks and powers of the Head of Subject

a) To fully grasp and implement the requirements for setting examination questions;

b) To study proposed examination questions to select, refine, combine, and compile new examination questions meeting the requirements of the admission examination. To propose plans for selecting official and reserve examination questions (including answers and grading scales) for the Chairperson of the Question Setting Board to review and decide;

c) To assist the Chairperson of the Question Setting Board in supervising examinations, answering, and resolving issues related to the examination questions they are responsible for during examination sessions using those questions;

d) The Head of Subject does not participate in deciding on the official examination questions for the examination period.

Article 14. Organization, tasks, and powers of the Examination Board

1. The Examination Board consists of:

a) Chairperson to be concurrently held by the Chairman or Vice-Chairman of the School's Steering Committee;

b) A permanent member兼任秘书长职务;

c) Members including some leaders of departments (Human Resources, Training, Student Affairs, Finance, Security, Administrative Services, Management, Dormitory Board...), some heads of faculties, team leaders of subjects, invigilators, security officers, medical staff, police (where necessary, military control officers may be added);

d) If there are multiple examination venues, the Head of the Examination Board shall designate a member of the Board to serve as the Head of each venue;

đ) Individuals with relatives (spouse; child; siblings) applying for admission to the school that year shall not be members of the Examination Board;

e) In case of shortage of invigilators, the Examination Board is permitted to invite teachers from other schools or staff working at higher-level management agencies of the school to serve as invigilators but must obtain written consent from the school or the agency managing the staff and teachers;

2. Tasks and powers of the Examination Board

Direct all examination supervision work from arranging invigilator forces, monitoring examination rooms, protecting examination rooms, organizing examinations, collecting papers to delivering papers, ensuring safety for the examination period and candidates' papers.

3. Tasks and powers of the Head of the Examination Board

a) Responsible for directing all examination supervision work at the school, deciding on the list of Examination Board members, the list of invigilators, supervisors, security officers, medical staff, police, military controllers, service personnel at examination venues;

b) Decide on handling situations arising during examination sessions;

c) The permanent member of the Examination Board is responsible for assisting the Head of the Examination Board in implementing examination supervision tasks;

4. Tasks and powers of the Head of the Examination Venue

a) Represent the Head of the Examination Board to direct all examination supervision work at the assigned venue;

b) Assign supervisors to monitor examination rooms;

c) Handle situations arising during examination sessions. If the situation is complex, report immediately to the Head of the Examination Board for resolution;

d) Before each session, organize a draw to assign invigilators;

Article 15. Organization, tasks, and powers of the Marking Board

1. The Marking Board consists of:

a) Chairperson to be concurrently held by the Chairman or Vice-Chairman of the School's Steering Committee;

b) A permanent member兼任秘书长职务;

c) Members include: Heads of marking subjects and marking staff;

The list of members and marking schedule must be kept confidential. Individuals with relatives (spouse; child; siblings) applying for admission to the school that year shall not be members of the Marking Board;

2. Tasks and powers of the Marking Board

Implement all marking work according to the regulations of this Regulation;

3. Tasks and powers of the Head of the Marking Board

a) Select and nominate members of the Marking Board for the Chairman of the School Management Council to decide;

b) Direct marking work. Be responsible to the School Management Council for the quality, progress, and marking procedures;

c) In case of shortage of marking staff, the Head of the Marking Board is permitted to invite staff and teachers from other schools to participate in marking. Contracts between the Marking Board and individuals invited must be confirmed by the school or the management agency;

4. Tasks and powers of the permanent member of the Marking Board

Represent the Head of the Marking Board to direct all marking work when authorized;

5. Tasks and powers of the Head of the Marking Subject

a) Be responsible to the Chairman of the School Management Council and the Head of the Marking Board for marking papers under their subject according to the marking procedures;

b) Select and introduce marking staff for the Head of the Marking Board to decide;

c) Before marking, organize for subject marking staff to thoroughly understand the answers, grading scales, and jointly mark 3-5 papers, then convene discussions and draw lessons;

d) Implement the marking plan and be responsible to the Head of the Marking Board for marking papers under their subject;

đ) Regularly check the quality of marking each paper from the first round, promptly correct mistakes made by marking staff. If suspected violations of the Regulations are found, report to the Head of the Marking Board for organizing checks on other subjects of the candidate and conducting joint marking of that paper;

e) Recommend the Head of the Marking Board to change or suspend marking for marking staff who lack responsibility, violate the Regulations, or make many errors;

6. Tasks and powers of marking staff

a) Carry out tasks assigned by the Head of the Marking Board. Conduct marking work according to the marking procedures;

b) Be individuals with high sense of responsibility, impartiality, honesty, good professional qualifications, and currently teaching the assigned subject;

c) Teachers in their probationary period shall not participate in marking. Individuals with relatives (spouse; child; siblings) applying for admission to the school shall not serve as marking staff at that school, including re-marking, even if they are members of the Secretariat Board.

Article 16. Organization, tasks, and powers of the Appeals Board

1. The composition of the Appeals Board includes:

a) The Chairperson shall be held by the Rector or Deputy Rector in charge of training, but during the same examination period, the Chairperson of the Examination Board shall not concurrently serve as the Chairperson of the Appeals Board.

b) Members: some staff members and teachers with appropriate qualifications from various subjects. The list of members and the schedule of work of the board must be kept confidential. Individuals participating in the Appeals Board shall not have relatives (spouse; children; siblings) applying for admission to the school that year. Those who participate in marking the first round of examinations shall not participate in re-marking those examinations.

2. Tasks and powers of the Appeals Board

When candidates submit an appeal request according to the Admissions Regulations, the Appeals Board shall be responsible for:

a) Checking mechanical errors such as incorrect point addition, misrecording of examination scores or transfer of scores between individuals;

b) Re-marking examinations requested by candidates;

c) Marking lost examination papers that have been found;

d) Marking supplementary examination papers due to errors by the Examination Board;

đ) Submitting to the Chairman of the Examination Board for decision on the examination score after re-marking.

Chapter III

SPECIFIC PROVISIONS ON ADMISSION WORK

Section 1

PREPARATION FOR THE EXAMINATION PERIOD

Article 17. Provisions on examination subjects, examination time, and examination rooms. Organizing the receipt of registration files, registration fees, and sending examination notices to candidates

1. The number of examination subjects for admissions is two subjects. The examination subjects are decided by the Rector of the school and must be publicly announced three months before the examination period. Admission examination subjects (except for specialized subjects) must be subjects within the secondary school curriculum or high school curriculum. Candidates must take all the examination subjects prescribed by the school; otherwise, they will not be eligible for selection.

2. The duration of the admissions examination period for vocational college is three days: the first day for examination procedures, the second day for taking the examination, and the third day reserved for necessary contingencies. The examination time for each subject ranges from ninety minutes to one hundred fifty minutes. The examination time and schedule for each day are determined by the Chairman of the Examination Board.

3. At least one week before the examination period, the Examination Board must organize examination venues and prepare the required number of examination rooms. Each examination room must have sufficient desks, chairs, chalkboards, and ensure ventilation and adequate lighting. The distance between adjacent candidates must be at least 1.2 meters. The location of the examination room must be safe and quiet. Each examination room must have two invigilators.

4. The Rector (or Chairman of the Examination Board) assigns the Training Department (or Secretariat) to organize the receipt of registration files, registration fees, and send examination notices to candidates, while directing the computer department to implement activities.

After completing the examination room list and printing examination notices, schools shall not accept further registration files.

Article 18. Requirements for examination content

1. Vocational college entrance examination questions must meet the requirements of assessing basic knowledge, application skills, and practical skills of candidates within the scope of the high school or secondary school curriculum, mainly the final grade curriculum, suitable for the general level of candidates, consistent with the current curriculum.

2. Examination questions must meet the requirement of classifying candidates' academic levels and be suitable for the time allocated for each subject.

3. The content of examination questions must ensure scientific accuracy, rigor, clarity, and absence of errors.

Article 19. Examination Question Preparation Process

1. Compilation and Introduction of Examination Questions

a) Depending on the specific situation of each school, for each subject, the Chairperson of the Examination Committee shall designate a number of teachers who are highly responsible and have excellent professional qualifications to participate in introducing examination questions;

b) The compilation of examination questions must be based on the requirements for the content of the entrance examination questions, the target group, the level of candidates taking the exam, and other specific requirements of the Chairperson of the Examination Committee to compile and introduce the examination questions along with detailed answers and grading scales;

c) Within the time limit set by the Chairperson of the Examination Committee, those introducing the examination questions must submit the original to the Chairperson of the Examination Committee. Typing, copying into multiple copies, keeping separately, and using the introduced examination questions for tutoring or test preparation is not allowed.

2. Selection and Completion of Examination Questions

a) Based on the introduced examination questions, the Head of the Subject may propose selecting two or three complete questions or choosing questions from different examination questions to form new examination questions. After that, detailed answers and grading scales will be compiled for each examination question and submitted to the Chairperson of the Examination Committee for review and decision;

b) Before the first subject examination day, at a location isolated from the external environment, the Chairperson of the Examination Committee works directly and independently with each Head of the Subject in the presence of the Standing Member of the Examination Committee;

c) The Chairperson of the Examination Committee may change the order of questions, replace one question with another, or request the Head of the Subject to recompile. Based on the Chairperson's comments, the Head of the Subject will finalize the proposed examination questions along with detailed answers and grading scales, sign the original, and hand it over to the Chairperson of the Examination Committee.

3. Selection and Review of Examination Questions

a) The Chairperson of the Examination Committee must organize reviews of examination questions, with at least one reviewer for each subject;

b) The reviewer must independently and directly solve the examination questions within a specified period. During the solving process, there should be no communication or contact with the question setters; no carrying of materials, answers, and grading scales. Review opinions should focus on the following contents:

- The degree of satisfaction with the examination question content requirements as stipulated;

- Comments on the answers, grading scales, difficulty level, and other errors;

- Suggestions from the reviewers.

c) After receiving the review document, the Head of the Subject must convene a meeting with the question setters and reviewers to unify opinions or make necessary revisions and supplements before reporting to the Chairperson of the Examination Committee;

d) After final proofreading of the examination questions, answers, and grading scales with the suggestions of the question setters and reviewers of each subject, the Head of the Subject signs the original and hands it over to the Chairperson of the Examination Committee;

đ) The Chairperson of the Examination Committee assigns numbers to the examination questions and decides to select one among the proposed examination questions as the official examination question, the rest as backup examination questions, and simultaneously decides the grading scale for each part of the official and backup examination questions;

e) All examination questions introduced by teachers, proposed examination questions compiled by the Head of the Subject, official and backup examination questions, answers, grading scales, and related materials are kept confidentially by the Chairperson of the Examination Committee.

4. Typing, Printing, Packaging, Storage, Distribution, and Use of Examination Questions

The typing, printing, packaging, storage, distribution, and use of examination questions are carried out under the direct guidance of the Chairperson of the Examination Committee

a) Typing and Printing of Examination Questions

- Members involved in the typing and printing process are not allowed to carry any means of communication or information storage;

- Computers used for typing examination questions must not be connected to the internet;

- The Head of the Subject directly types or directly checks the typed examination questions after someone else has typed them. The Chairperson of the Examination Committee designates staff with professional expertise and high responsibility to type and print examination questions;

- Before typing or printing, all old papers and documents must be cleared away; - Examination questions must be typed and printed clearly, accurately, cleanly, beautifully, according to specifications, with the correct number of copies, without excess or shortage, and not using paper from failed prints. Failed prints and original examination questions must be handed over to the Chairperson of the Examination Committee for management;

- The Head of the Subject and the Chairperson of the Examination Committee must thoroughly check the typed version and both must sign off before printing the examination questions;

- During the printing process, the Head of the Subject must check the quantity and quality of the printed copies, remove blurry, failed, poor-quality, dirty, torn pages, or blank pages. When printing on both sides of the paper, it must be done head-to-tail and checked to prevent omissions;

- Type or print each examination question individually. Typing or printing of another examination question can only continue after checking the typing area, clearing away, and handing over all relevant papers to the Chairperson of the Examination Committee;

- Absolutely no typing or printing of answers before the examination.

b) Packaging of Examination Questions

- The Standing Member of the Examination Committee must be familiar with the number of candidates for each grade, major, and examination venue to distribute examination questions, record the examination venue name, room number, and number of examination questions on each envelope, then hand over to the person responsible for packaging or package them directly themselves;

- Those packaging examination questions must ensure the correct number of examination questions, the correct subject listed on the envelope, sufficient examination questions for each examination venue, each room without blank or failed pages;

- Envelopes containing examination questions must be sealed tightly, securely, without peeling edges, with complete labels and seals (half seal on the label, half seal on the envelope);

- After completing the packaging of examination questions for each subject, the Standing Member of the Examination Committee must check the number of sealed envelopes and hand over to the Chairperson of the Examination Committee for management, including extra, failed, blurry, poor-quality, torn, dirty prints that have been removed.

c) Storage and Distribution of Examination Questions

- Examination questions must be stored in boxes, cabinets, or safes, locked securely, sealed tightly, and guarded continuously. Keys to the boxes, cabinets, or safes are kept by the Chairperson of the Examination Committee;

- The schedule for distributing examination questions to each venue is determined by the Chairperson of the Examination Committee. When transferring examination questions, there must be a record. When delivering examination questions to venues, police protection is required.

d) Use of Official and Backup Examination Questions

- The envelope containing the official exam questions may only be opened for use in the examination room on the day, at the time, and for the subject specified uniformly by the Chairman of the Examination Board for each examination period, and shall be used for comparison and verification of the exam papers distributed to candidates or written on the board;

- Backup exam questions may only be used if the official exam questions are leaked, provided there is sufficient verified evidence and a formal conclusion from the Examination Board of the school and the local police authority as stipulated in Article 25 of this Regulation;

Article 20. Provisions on Exam Question Confidentiality

a) Exam questions, answers, and grading scales for vocational college entrance exams that have not yet been published belong to the category of State Secrets classified as "Top Secret;"

b) The Head of the Exam Committee must select only trustworthy individuals to participate in creating exam questions. Individuals whose relatives (spouse; children; siblings) are applying to the school that year shall not be selected to participate in creating exam questions. The list of individuals participating in creating exam questions must be kept confidential until the end of all exam sessions. Participants in creating exam questions must not disclose their place of work;

c) The location where exam questions are created must be a secure, secluded, isolated site far from fences and strictly guarded throughout the exam creation period. Windows must be sealed tightly. All security measures, fire prevention, and firefighting equipment must be available. Personnel working in the area must wear special badges and can only operate within permitted areas;

d) All individuals involved in creating exam questions, from the moment they come into contact with the questions, must be completely isolated from the external environment in every form. In necessary cases, only the Head of the Exam Committee may communicate with the Chairman of the Examination Board via telephone under the supervision of security staff;

e) Staff members involved in compiling and reviewing exam questions and those serving the Exam Committee at the exam question creation site may only leave the isolation zone after two-thirds of the exam time for the subject they are responsible for has passed;

f) The Head of the Exam Subject and exam creators must be present throughout the entire period of copying, printing exam questions, and during the exam period to answer and handle issues related to the exam questions;

Article 21. Use of Vocational College Admission Software

During the admission and selection process, schools must necessarily use unified vocational college admission software in the following stages:

1. Assigning registration numbers and preparing candidate lists for the exam;

2. Preparing examination room lists based on the alphabetical order of candidate names according to each major. Absolutely no examination rooms should be arranged by grouping students from the same locality into nearby numbers;

3. Printing admission notices for each candidate (which can also serve as admission cards);

4. Compiling statistical forms regarding the number of candidates registered for each major and province, and sending them to the Ministry of Education and Training one week before the exam date;

5. Compiling marking forms including instructions for bagging, name-number matching sheets, and marking session records;

a) The bagging instruction sheet is a document for the Examination Board Secretariat to bundle exam papers into marking bags. For each subject and major, different bagging rules are applied to ensure the following principles:

- Within each subject and major, the bagging rule is automatically executed by a computer. Each marking bag should not contain more than 50 papers, and no complete room's papers should be bundled together;

- After printing the bagging instruction sheets for each subject and major, they must be placed in individual envelopes, clearly marked with the subject name on the outside, and sealed securely;

b) The name-number matching sheet is a document for the Examination Board Secretariat to assign numbers to each candidate's exam paper;

- Based on the bagging instruction sheet, the Secretariat proceeds to assign numbers to each subject and major in separate areas. The numbering must start from a randomly generated number automatically performed by a computer;

- After printing the name-number matching sheets for each subject and major, they must be placed in individual envelopes, clearly marked with the subject name on the outside, and sealed securely;

c) The marking record is a document for marking staff to record the results of each paper after marking it independently in two rounds and reaching a consensus;

- Exam scores must be recorded both in writing and numerically. If there are corrections, the Head of the Marking Department must sign and stamp them;

- The bagging instruction sheet, name-number matching sheet, marking record, and all related information storage materials such as floppy disks, hard drives, programs, etc., must be kept by the Chairman of the Examination Board under confidentiality regulations;

6. After the marking results and admission statistics are compiled, points for each exam paper and admission points for each category, region, and major are calculated for selection purposes;

7. Printing score reports for each candidate. In case a candidate loses their score report and requests confirmation, the Head of the Secretariat will check the scorebook, issue a confirmation letter, and submit it to the Chairman of the Examination Board for signature;

Section 2

EXAMINATION ORGANIZATION WORK

Article 22. Registration for candidates to take the examination

1. Prior to the examination date, the Secretariat completes the list of candidates for each examination room to be posted outside each room. Each examination room shall have a list of candidate registration numbers along with the list of candidate photographs (LCP) to be handed over to the invigilators for verification and inspection during the examination sessions.

2. In accordance with the published schedule, on the first day of the examination period, the Secretariat assigns staff to disseminate the Examination Regulations, guide candidates to their examination rooms, collect examination fees from candidates, and make corrections to any errors found in the candidates' application forms. These corrections must be confirmed by the admissions officer of the school on Form DKDT number 2 and immediately updated on the computer.

Article 23. Responsibilities of Invigilators and Other Members of the Examination Board

1. Invigilators and supervisors are not allowed to carry mobile phones while performing their duties. Members of the Examination Board are prohibited from assisting candidates in any form, engaging in personal activities, smoking, or using stimulants during their duty hours.

2. Invigilators (I)

a) Individuals whose relatives (spouse; children; siblings) are applying to the school that year are not permitted to serve as invigilators.

b) Invigilators must be present on time and throughout the examination session to perform the following tasks in sequence:

- Record the candidate's registration number at their seat. After each examination session, change the seating position of the candidates;

- Upon instruction, one invigilator calls out the name of the candidate to enter the examination room, the second checks the items the candidate brings into the room, and guides the candidate to sit in the designated seat. Absolutely prevent candidates from bringing in prohibited materials and items as stipulated in Article 24 of these Regulations. Use the examination card and LCP for verification and identification of candidates;

- Both invigilators must sign and clearly write their full names on the answer sheet and rough paper of the candidates. Guide candidates to fold the answer sheet according to regulations, write down the registration number, and fill in all necessary sections before starting the examination;

- Upon instruction, one invigilator collects the questions, and the other reminds candidates of the examination room discipline;

- Upon instruction, one invigilator holds up the sealed envelope containing the questions so that candidates can see both sides remain intact. Open the envelope containing the printed questions and distribute them to each candidate (before distribution, check the number of questions; if there are excess, shortage, or mixed questions, white papers, report immediately to the Examination Center Director for handling);

- If copying the questions is required, one invigilator reads and writes the questions onto the board, the other oversees the process. Subsequently, the second reads and checks the questions while the other oversees. Only read aloud enough for clarity, write clearly, accurately, and verbatim, absolutely do not summarize or add/subtract. Then hand the questions to candidates for self-checking. The Examination Center Director must visit each room to verify the copying of questions;

- Invigilators must protect the questions during the examination, preventing them from leaving the room. Invigilators and those performing examination duties are not allowed to discuss, copy, solve questions, or explain the questions to candidates;

- When candidates start answering, one invigilator verifies the photograph in the examination card to identify the candidate, the other oversees. During the examination period, one oversees from the front to the back of the room, the other from the back to the front until the end of the examination. Invigilators should not stand close to candidates while they are working;

- When a candidate asks a question, invigilators may only respond publicly within the prescribed scope;

- Allow candidates to leave the room earliest after two-thirds of the examination time has passed, after collecting their answers, questions, and rough paper. If a candidate experiences unusual illness or has a legitimate need to temporarily leave the room, the invigilator must inform the room supervisor to promptly report to the Examination Center Director for resolution;

- If a candidate violates the rules, the invigilator must record the incident and handle it according to regulations. In case of unusual situations, report immediately to the Examination Center Director or the Head of the Examination Board for resolution;

- Fifteen minutes before the end of the examination, notify candidates about the approaching end of the examination;

- Upon the instruction to end the examination, require candidates to stop working and collect all candidates' papers, including those who have been disciplined. One invigilator oversees the room while calling out each candidate's name to submit their papers, the other collects the candidates' papers. When collecting papers, count the correct number of answer sheets submitted by each candidate, ask the candidate to correctly record the number of sheets and sign the attendance list. Only allow candidates to leave the room after all papers have been collected;

- Invigilators check and arrange the papers in order of registration numbers. Any disciplinary records (if any) must accompany the candidates' papers. Hand over the papers to the Secretariat member of the Examination Committee immediately after each examination session. Each envelope of papers must be checked publicly and compared with the number of papers and sheets listed on the candidate tracking sheet and any disciplinary records and evidence (if any);

- After handing over, each envelope of papers is sealed on the spot by the Secretariat members. Each envelope is affixed with three seals in the middle of the three edges. On each label, stamp the seal on the right and left sides of the label (half the stamp on the label, half on the envelope). The Secretariat member receiving the handover and the two invigilators must clearly write their full names and sign on the sealing label.

c) Absolutely prevent any confusion or loss of examination papers.

3. Room Supervisors

Room supervisors represent the Examination Center Director to continuously monitor the implementation of the Admissions Regulations by invigilators, security personnel, and candidates; inspect and remind invigilators to thoroughly collect any prohibited materials and technical devices brought into the room by candidates; record and handle disciplinary actions against invigilators and candidates who violate the Regulations.

4. Security Personnel, Police Officers, and Military Inspectors (if any)

a) Individuals assigned to guard a specific area are responsible for maintaining order and security in that area only, and shall not operate in other areas.

b) Ensure that no unauthorized person enters the examination area or approaches the examination room; do not leave their post; do not entertain guests while on duty; do not enter the examination room; do not communicate with examinees;

c) Report promptly to the Examination Center Head about any situations occurring during the examination for timely handling;

d) Specifically, police officers assigned to support the Examination Centers also have the responsibility to escort and ensure the safety of examination questions and answer sheets;

5. Medical staff

a) Be present throughout the examination period at the location designated by the Examination Center to handle cases where examinees fall ill;

b) When the Examination Center Head reports an unusual illness of an examinee during the examination, medical staff must immediately arrive to provide timely treatment or take them to the hospital for emergency care if necessary;

c) Strictly prohibit any abuse of on-site medical services to engage in actions violating the Regulations;

Article 24. Responsibilities of Examinees During the Examination Period

1. One day before the examination (except for specialized schools with specific regulations), examinees must be present at the registered school to complete registration procedures:

a) Present a temporary graduation certificate (for examinees who just participated in the graduation examination) or a valid copy of the graduation certificate (for those who graduated in previous years);

b) Pay the examination fee;

c) Receive the examination card (if the notification slip does not include the examination card);

d) Receive the examination room and listen to the examination regulations. If there are any errors or mistakes regarding the surname, name, middle name, preferential category, or other details related to the registration, the examinee must report to the School Examination Center for immediate correction. In case of losing the examination card or other necessary documents, the examinee must report and make a declaration for the Examination Center Head to consider under the delegation of the Chief Examiner;

2. Examinees must be present at the examination site at the specified date and time. If an examinee arrives more than 15 minutes late after the test has been opened, they will not be allowed to take the examination. Examinees must complete all subjects prescribed by the school to be considered for selection;

3. Upon entering the examination room, examinees must comply with the following rules:

a) Show the examination card to the invigilator when entering the examination room;

b) Only bring pencils, pens, compasses, erasers, rulers, calculators without alphabetic keys, unused blotting paper, and scratch paper (if the school does not provide scratch paper). Scratch paper must bear the signature of the invigilator to be used;

c) Do not bring charcoal, erasers, materials, weapons, flammable or explosive substances, technical devices for receiving or transmitting information, or recording devices into the examination room. Smoking and using stimulants are strictly prohibited in the examination room;

d) Write down the full registration number (both the alphabetic and numeric parts) on the answer sheet and scratch paper before starting the examination and must request both invigilators to sign on both the answer sheet and scratch paper;

đ) The answers must be clearly and neatly written, not crumpled, marked, or contain personal symbols. It is strictly forbidden to write answers in two different ink colors, use red ink pens, or pencil for the examination (except for circles drawn with a compass which can be done with a pencil). Any incorrect writing must be crossed out with a ruler. Examinees must protect their work and strictly prohibit any form of cheating;

e) If any questions need to be asked from the invigilator, they must be asked publicly. Maintain order and silence in the examination room. In case of unexpected illness, report to the invigilator for appropriate handling;

g) Examinees may only leave the examination room and examination area after two-thirds of the examination time has passed and after submitting their answers and examination papers to the invigilator, except in cases requiring emergency medical attention;

h) At the end of the examination time, stop working and submit the answers to the invigilator. Even if unable to complete the examination, the examinee must still submit the answer sheet. When submitting the answers, the examinee must clearly record the number of submitted answer sheets and sign the attendance list. Scratch paper cannot be submitted instead of the answer sheet;

i) Examinees are responsible for identifying and reporting any violations of the Regulations to the Examination Center for prompt handling.

Article 25. Handling Abnormal Exam Paper Incidents

1. In cases where there are errors in setting the exam questions, printing the exam questions incorrectly, or copying the exam questions onto the board incorrectly

a) When discovering any errors in the exam questions, the invigilator must jointly with the Head of the Examination Venue prepare a record and report promptly to the Head of the Question Setting Committee and the Chairman of the School Examination Board for consideration and issuance of a decision on handling;

b) Depending on the nature and severity of the error, whether it occurs in one or multiple questions of the exam paper, in one examination room, multiple examination rooms, or all examination rooms, and depending on the time of discovery, the Chairman of the School Examination Board must consider and decide on handling according to one of the following options:

- The Chairman of the School Examination Board orders timely correction of the errors and informs the examinees but does not extend the examination time;

- The Chairman of the School Examination Board orders correction, informs the examinees, and extends the examination time for the examinees;

- Not to correct, allowing the examinees to continue the examination, but to handle during marking (the answers and grading scale may be adjusted accordingly);

- Organize a re-examination of that subject immediately after the last examination session using the backup exam paper.

2. Leaking of Exam Questions

a) Only the Chairman of the School Examination Board has the authority to conclude on the leaking of exam questions. Upon determining that the exam questions have been leaked, the Chairman of the School Examination Board decides to suspend the examination of the leaked subject, informing the examinees. Other examination sessions of other subjects will continue normally according to the examination schedule. The leaked subject will be re-examined immediately after the last examination session;

b) After the examination, the Chairman of the School Examination Board will cooperate with relevant departments to inspect, verify, conclude on the cause of the leak, the person responsible for the leak, and those involved, and proceed to handle according to the law, and report to the Ministry of Education and Training and the school's management agency.

Section 3

MARKING WORK

Article 26. Marking Area

1. The marking area includes the marking location and the storage location for answer sheets. The marking location and the storage location need to be arranged close to each other, isolated from the outside, continuously guarded, equipped with sufficient fire prevention and firefighting equipment, security measures, and answer sheet preservation facilities.

2. The door of the storage cabinet for answer sheets is locked with two different locks, the Head of the Subject Marking Committee holds the key to one lock, and the Secretary Board member holds the key to another lock. The door can only be opened when both key holders are present.

3. Absolutely no personal documents, papers, or communication devices may be brought into the marking area.

Article 27. Marking Process

1. The Head of the Marking Committee approves individual marking sheets designed appropriately for the answers and detailed grading scales for each subject.

2. The marking process is carried out in two independent rounds. Strictly prohibited is the use of erasable pens or pens with the same ink color as the examinee's writing while marking.

a) First round of marking

- After numbering, perforating, and matching the marking sheets, the Secretary Board together with the Head of the Subject Marking Committee organize for the marking officers to draw lots for the answer booklets and record the symbol of the booklet drawn by the marking officer in the list of received papers to mark. The marking officer checks the number of papers, pages, and perforation numbers in each paper simultaneously signing the drawing list before marking. Only valid papers are marked. Papers written on different paper than provided for the examination, rough drafts, papers with two different handwriting styles or containing inappropriate drawings, papers with markings, papers written in two different ink colors, or papers with fold marks are not marked;

- During the first round of marking, the marking officer crosses out all remaining blank portions of the paper that the examinee did not write on and absolutely does not write anything on the examinee's paper. Component scores, total scores, and comments (if any) are recorded on the marking sheet of each paper simultaneously, the marking officer clearly records their name and signature on each sheet;

- After completing the marking of a booklet, the marking officer directly hands over the booklet and all marking sheets to the Secretary Board.

b) Second round of marking

- After completing the first round of marking, the Secretary Board retains the set of marking sheets and continues organizing for the marking officers to draw lots for the answer booklets for the second round of marking but must take measures to ensure that the booklet does not return to the original marker;

- The second round marker marks directly on the examinee's paper. Records component scores, total scores, and signs their name clearly on the examinee's paper;

- After completing the marking of a booklet, the marking officer directly hands over the booklet to the Secretary Board.

Article 28. Grading Scale and Point Processing Rules

1. Grading Scale

a) The grading scale for examinations is out of 10 points. Minor points can be awarded up to 0.25 points.

For special skills subjects, a different grading scale may be applied, but the total score must be converted to the 10-point scale. Examiners must grade according to the 10-point scale. The calculation of coefficients is performed by computer.

b) Examiners must grade papers strictly according to the approved grading scale and official answers. When grading, individual paper scores should not be rounded off. Computer rounding follows the principle that if the total score of two subjects has a decimal from 0.25 to under 0.5, it will be rounded to 0.5, and from 0.75 to under 1.0, it will be rounded to 1.0.

Papers with correct answers and creative solutions different from the official answers may be awarded bonus points. The level of bonus points is proposed by the examiner and decided by the Head of the Examination Board, but the bonus points cannot exceed 1 (one) point.

2. Handling Grading Results and Writing Examination Grading Records

The Secretariat compares the results of two independent grading sessions and handles them as follows:

a) If two examiners give the same score, they hand over the test booklet to those two examiners who record the score on the answer sheet, Form 4, then both sign to confirm on the answer sheet and Form 4.

In cases where the total score is the same or differs by 0.25 points but component scores differ, the two examiners check and agree on the correct score according to the prescribed answers.

b) If the results of the two grading sessions differ by 0.5 points or more, the paper is handed back along with the first grading form to the Head of the Examination Board to organize a third direct grading session using a different ink color.

If two out of three grading sessions yield the same result, that score becomes the official score. If all three results differ, the Head of the Examination Board calculates the average of the three scores (rounded to two decimal places) as the final score. The Head of the Examination Board records the score on the answer sheet, Form 4, then signs to confirm on the answer sheet and Form 4.

Any incorrect addition of component scores must be corrected immediately.

c) When there are insufficient graders, schools must still fully comply with the examination grading regulations stipulated in this Regulation when signing contracts with other schools or organizing cross-grading.

Article 29. Management of Examination Scores Before Announcing Selection Scores

Prior to announcing selection scores, all materials related to examination scores must be sealed and directly managed by the Secretariat Chairperson.

It is strictly prohibited to adjust scores upward or disclose scores before announcing selection scores.

Section 4

APPEAL AND REVIEW OF EXAMINATION SCORES

Article 30. Organization of Appeals and Resolution of Disputes Regarding Examination Scores

1. Appeal Period: The Examination Committee receives appeals regarding examination scores from candidates within 15 days from the date of score announcement and must respond to the applicant no later than 20 days from the date of receipt (except for special skills subjects). Candidates requesting a review must pay the appeal fee as prescribed. If the score needs to be adjusted after the review, the Examination Committee refunds the appeal fee to the candidate.

2. Organization of Appeals

a) The organization of appeals proceeds subject by subject under the direct management of the Review Board Chairperson. The working area of the Review Board is designated by the Examination Committee Chairperson and is protected similarly to the grading area.

b) Before handing over the examination papers to the Review Board, the Examination Committee Secretariat performs the following tasks:

- Refer to Form 3 to find the examination number from the registration number, retrieve the examination paper, and compare with the candidate tracking list to verify the examination paper number.

- Conduct a preliminary check of the examination paper status, compare the sections requested for review in the paper and the appeal letter. Sum up the component scores and compare with the announced score to identify any errors or tampering. If any irregularities are found, a report is made to the Examination Committee Chairperson for decision.

- Collect examination papers of the same subject into one or more bags, clearly marking the number of papers and pages in each bag, and hand over to the Review Board. The transfer of examination papers between the Secretariat and the Review Board follows the same procedures as the initial grading.

- During the handling of matters related to appeals, at least two people must be present. Strictly maintain confidentiality regarding the relationship between registration numbers and examination numbers, the origin of examination papers, and avoid combining examination numbers.

- Each examination paper is reviewed independently by two graders, directly marking the candidate's work with a different colored ink.

c) After the review, the Examination Committee Secretariat handles the papers as follows:

- If the results of the two review sessions yield the same score, the paper is handed to the Review Board Chairperson to round the score (to two decimal places), record the score on the answer sheet, and sign to confirm the official score.

- If the results of the two review sessions differ, the paper is handed to the Review Board Chairperson to organize a third direct review session using a different colored ink.

- If two out of three review sessions yield the same score, that score becomes the official score. If all three results differ, the Review Board Chairperson calculates the average of the three scores (rounded to two decimal places) as the official score. The Review Board Chairperson rounds the score (to two decimal places) and signs to confirm.

- In cases where a candidate moves from non-selection to selection (or vice versa) or the difference is 0.5 points or more after the review, the Examination Committee must organize a direct dialogue between the initial graders and the review graders (with a record) for all papers with score adjustments. If the Examination Committee determines that the initial grading was incorrect to the extent requiring adjustment, the Examination Committee publicly announces the list of initial graders for learning purposes or if negative behavior is observed, it is handled according to Article 38 of this Regulation.

The review score, after the dialogue between the two grading pairs and approval by the Review Board Chairperson and signed by the Examination Committee Chairperson, becomes the official score of the examination.

3. Adjustment of Examination Scores

After the examination results are announced, if any mistake or error regarding the examination scores is discovered, the Examination Review Board must review and adjust the examination scores up or down in the following cases:

a) The score recorded in the examination marking record is incorrect;

b) The examination paper was lost but has now been found, or the examination paper was missing due to the school examination committee's error and has since been resupplied and marked;

c) The score confirmed by the Chairman of the School Examination Committee after the review process is the official score.

The adjusted score shall be proposed by the Head of the Examination Review Board for the Chairman of the School Examination Committee to decide, then reported to the Ministry of Education and Training (or provincial education and training department) for local schools, and notified to the examinees.

Article 31. Examination of Review Results

1. After receiving the report on the review results from the School Examination Committee, if deemed necessary, the Ministry of Education and Training will establish an Examination Result Verification Committee. The Verification Committee of the Ministry shall be chaired by the Director of the Professional Education Department, with members being highly qualified staff and teachers who do not work at the school whose examination papers need to be verified.

2. The Examination Result Verification Committee of the Ministry of Education and Training has the final authority to determine the official score of the examination after consulting with the School Examination Committee.

Chapter IV

SELECTION AND CONVOCATION OF ADMISSION CANDIDATES

Article 32. Regulations on Establishing Selection Scores

1. Based on the enrollment quota assigned, after deducting the number of students admitted directly and recommended, based on statistical data provided by computers for different categories and regions participating in the exam, and based on the framework of preferential scores, the Secretariat of the School Examination Committee proposes several selection plans (model 2 attached appendix) for the Chairman of the School Examination Committee to consider. Schools enrolling students by major must establish separate selection score tables for each major.

2. If the number of admitted candidates in the first round does not meet the quota, the school may supplement by lowering the selection score uniformly for all categories and regions to meet the assigned quota.

3. If lowering the selection score uniformly for all categories and regions to a certain level leads to exceeding the quota, the school may lower the selection score separately for each category and region according to priority order: Region 1 Priority 1, Region 1 Priority 2, Region 2-Northern Priority 1, Region 2-Northern Priority 2, Region 2 Priority 1, Region 2 Priority 2.

For majors that are difficult to recruit in schools enrolling students by major, after determining the selection score at the permissible level according to the training requirements of the school and still falling short of the number required, the school may admit candidates who did not pass other majors but achieved the specified score and voluntarily enrolled in the under-subscribed major. If the number of candidates meeting the transfer criteria exceeds the quota, they will be selected based on descending order of their exam scores until the quota is filled through a public process.

Article 33. Determination of Selection Scores and Notification to Candidates

1. Based on the proposed selection score determination plans by the Secretariat of the School Examination Committee, the Chairman of the School Examination Committee decides and approves the official selection score so that the number of admitted candidates entering the school does not exceed the assigned quota. The Chairman of the School Examination Committee must send the official selection score record to the Ministry of Education and Training, relevant ministries and sectors, provincial education and training departments, and simultaneously announce it publicly through mass media.

2. In cases where a candidate lacks points in a subject due to the School Examination Committee's error in losing the examination paper, the Chairman of the School Examination Committee is responsible for informing the relevant ministries and sectors (for schools under ministries and sectors), provincial education and training departments (for schools under provincial people's committees), and the candidate about the decision to organize a supplementary exam, and the time of the supplementary exam. The costs for the candidate's travel and participation in the supplementary exam are borne by the School Examination Committee. Candidates who do not participate in the supplementary exam will not be considered for admission.

3. In cases where a candidate lacks points in a subject due to the School Examination Committee's error, but the total points of the remaining subjects equal or exceed the selection score for the school they applied to in their region, the Chairman of the School Examination Committee shall notify the candidate of their admission score according to the major they applied for (if applicable) without needing to organize a supplementary exam.

Article 34. Summoning successful candidates to the school

1. The Chairman of the School's Admissions Committee shall directly review the list of successful candidates admitted to the school and sign the summons for candidates to attend the school. The summons must clearly state the necessary conditions for candidates to complete enrollment procedures.

2. Candidates must undergo a comprehensive health check organized by the school. The health examination must follow the guidelines set out in the Circular jointly issued by the Ministry of Health and the Ministry of Education and Training. The health examination certificate shall be issued by the school's health examination board and supplemented into the student management file.

3. Successful candidates must submit the following documents:

a) High School Graduation Record Book or Junior High School Graduation Record Book;

b) Temporary Graduation Certificate for those who are admitted immediately upon graduation, or a valid copy of the graduation certificate for those who have graduated in previous years. Those who submit a temporary certificate must present the original graduation certificate for verification and inspection at the beginning of the next academic year;

c) Birth certificate;

d) Certificates confirming preferential status (if applicable), such as certificates of children of martyrs, disabled veteran cards, certificates of benefits equivalent to those of disabled veterans for parents or themselves, permanent resident registration of the candidate, etc.;

e) Admission notification;

f) Admission file;

4. Candidates who delay their enrollment at the school by more than 15 days from the date specified in the admission notification, without a legitimate reason, will be considered as having withdrawn from the program. If the delay is due to illness or accident, with confirmation from a district or county hospital, the schools will consider and decide whether to accept them for study or allow them to defer their admission results until the following year.

5. Successful candidates who are retained by local authorities and not allowed to attend school have the right to appeal to the provincial People's Committee and the Ministry of Education and Training. Only the Chairman of the provincial People's Committee has the authority to issue a decision to retain a successful candidate, but must explain the reasons and legal basis for that decision to the concerned party.

In cases where localities or schools fail to resolve issues properly and candidates file appeals, after joint consideration by relevant central and local authorities, the Ministry of Education and Training will make the final decision regarding the candidate's education.

Article 35. Examination of test results and files of successful candidates

1. After the admission examination period, schools must verify the legality of all examination papers of each successful candidate admitted to their institution; the implementation of the Regulations in all stages: marking work, comparing scores on the examination paper with the scores recorded in the marking record book, score sheet, and score report. If violations of regulations or suspicious cases are discovered, a report should be made to the Principal to take measures to verify and handle the situation.

2. During the process of collecting files or while students are studying at the school, if fake files are discovered, they must be reported to the school Principal for handling according to the provisions of this Regulation.

Chapter V

INSPECTION WORK, REWARD AND DISCIPLINARY ACTION

AGAINST VIOLATIONS

Article 36. Inspection of admissions

1. Admissions inspections shall be carried out in accordance with current laws on inspection.

2. The Minister, Head of an agency equivalent to a ministry, and the Chairman of the Provincial People's Committee, where there is a school organization or appointed officials, shall cooperate with the Ministry of Education and Training's inspection team to inspect the implementation of the Admissions Regulations.

3. Schools are responsible for organizing self-inspection and supervision of all stages of the admissions process at their institutions in accordance with the guidance of the Ministry of Education and Training.

Article 37. Awards

1. Persons who have made significant contributions and actively completed their assigned enrollment tasks excellently shall be commended by the President of the School Council or proposed for commendation by the Ministry of Education and Training or the People's Committee of the province, depending on specific achievements.

2. The commendation fund is extracted from the admissions fee.

Article 38. Handling of Enrollment Staff Violating Regulations

1. Those involved in enrollment work who commit violations of the Regulations (discovered while performing duties or after the enrollment examination period), if there is sufficient evidence, will be subject to disciplinary measures according to current laws, based on the severity of the violation, as follows:

a) Reprimand: for those who make minor mistakes while performing their duties;

b) Warning: for those who violate any of the following:

- Altering candidates' application files to misrepresent information;

- Setting questions that do not align with the curriculum or exceed the scope of the curriculum for the target group;

- Allowing candidates to copy, bring, and use materials or communication devices in the examination room, which are discovered and documented by examination supervisors or enrollment inspectors;

- Writing questions on the board with errors but failing to promptly correct them;

- Marking exams or adding points to exam papers with numerous errors;

- Revealing candidates' scores before the School Council officially announces the selection results.

c) Depending on the severity of the violation, they may face salary reduction, demotion, dismissal (if they are civil servants or public officials), or forced withdrawal from studies (if they are students or pupils supervising examinations) for committing any of the following:

- Setting incorrect questions;

- Directly solving examination questions and guiding candidates during the examination;

- Cheating when marking exams, giving points outside the prescribed range, or lowering candidates' scores improperly.

d) Forced termination of employment or prosecution under criminal law for those committing any of the following:

- Negligence in question paper management leading to loss or damage of question papers;

- Leaking question papers, revealing candidate identification numbers, buying or selling question papers;

- Taking question papers out of the examination area or bringing solutions into the examination room during the examination;

- Altering candidates' answers;

- Unauthorized correction of scores on examination papers, marking sheets, or score lists;

- Swapping candidates' examination papers, identification numbers, or scores;

- Losing candidates' examination papers during collection, transportation, or marking;

- Deception in selecting and summoning successful candidates (including altering school records, cheating in bonus point calculations, high school graduation exam scores, or junior high school graduation exam scores to qualify candidates for direct admission or successful selection).

e) For other violations of the law, depending on the nature, severity, and impact, they will be handled according to one of the forms specified in this Article; in cases of serious violations causing significant consequences, criminal responsibility may be pursued.

f) In cases where question papers are leaked or serious breaches of the enrollment regulations occur, the Principal, President of the School Council, and heads of related organizations will be disciplined from reprimand to forced termination of employment or criminal prosecution, depending on the consequences, impact, and degree of involvement.

2. The President of the School Council and relevant staff members of the Question-setting Board, Marking Board of the school, or teachers setting examination questions and marking for another school, if they violate current regulations on setting questions or marking, will be dealt with according to the corresponding forms stipulated in this Article.

3. If the President of the School Council sets unreasonable admission criteria leading to exceeding quotas significantly, they will be disciplined from reprimand to forced termination of employment, depending on the extent of the violation.

Article 39. Handling Candidates Who Violate Regulations

For candidates who violate the regulations, a record must be made and disciplinary measures shall be taken according to the following forms depending on the severity of the violation:

1. Reprimand: applied to candidates who commit a single offense for the first time such as looking at their peers' papers; exchanging or discussing with peers (this form of discipline is decided by the Examination Board in the record). A candidate reprimanded during an examination will have 25% of the points for that subject deducted.

2. Warning: for candidates who commit any of the following offenses:

a) Having been reprimanded once but still continue to violate the regulations during the examination of that subject;

b) Exchanging answer sheets or scratch paper with peers;

c) Copying another person's work. If it is concluded that two answer sheets are identical, they will be treated equally. If the person being disciplined can provide sufficient evidence proving they were forced to copy, the Chairman of the Examination Board may consider reducing the disciplinary action from a warning to a reprimand;

d) The candidate will have 50% of the points for that subject deducted if they are disciplined with a warning;

đ) The warning disciplinary measure is recorded by the Examination Board, confiscated items are collected, and the proposed disciplinary form is clearly stated in the record;

3. Suspension from the examination for candidates who commit any of the following offenses:

a) Bringing weapons, explosive, flammable materials, or other dangerous objects into the examination room;

b) Having been warned once but still continue to violate the regulations during the examination of that subject;

c) Bringing into the examination room: study materials, devices containing information that could be exploited to complete the exam, technical equipment for receiving, transmitting, recording audio;

d) Taking the examination questions out of the examination room or bringing solutions from outside into the examination room;

đ) Writing or drawing unrelated content;

e) Engaging in behavior such as forcibly taking another candidate's test paper, quarreling, threatening examination officials, or threatening other candidates;

g) A candidate suspended from the examination during the examination of a subject will receive zero (0) points for that subject and must leave the examination room immediately after two-thirds of the examination time has passed; they cannot take subsequent subjects and cannot participate in examinations at other schools in the same year;

h) The suspension from the examination is recorded by the Examination Board, confiscated items are collected, and decided by the Head of the Examination Venue;

4. Revocation of admission results for that year and deprivation of the right to participate in university entrance examinations for the next two years, in serious cases, the relevant authorities may be requested to prosecute before the law for candidates who commit any of the following offenses:

a) Engaging in fraudulent acts to benefit from preferential policies based on region or category in admissions;

b) Using illegal graduation certificates;

c) Asking others to take the exam or complete the exam on their behalf in any form;

d) Engaging in actions to sabotage the examination, assaulting officials or other candidates.

This disciplinary measure is decided by the Chairman of the Examination Board.

5. For other violations, depending on the nature and degree of the violation, the Principal or the Chairman of the Examination Board shall handle disciplinary measures according to the forms prescribed in this Article.

The disciplinary record of the candidate must be made public for the candidate to know and must be signed by the candidate and two invigilators. If the candidate refuses to sign the record, the record remains valid. If there is disagreement between the Examination Board and the Head of the Examination Venue regarding the handling method, both parties' opinions must be clearly stated in the record to report to the Chief Invigilation Board for decision.

Article 40. Handling Special Cases of Violations of Regulations

1. Officials, students, and pupils from universities, colleges, vocational schools, high schools, and middle schools who do not participate in the admission process but engage in negative actions such as taking exams on behalf of others, organizing the leakage of exam questions outside, providing solutions to candidates, causing disturbances that disrupt order at the examination site, or disclosing candidates' scores before the official announcement by the Examination Board of the school, shall be subject to disciplinary measures ranging from warnings to dismissal (if they are civil servants or public officials) or suspension of studies for a period or expulsion (if they are students or pupils).

2. The above disciplinary measures shall be decided by the Rector or the Chairman of the Examination Board of the school (if the violator is under the management of the school) or a record shall be made to propose measures to the local police, education and training department, or the Ministry of Education and Training (if the violator is not under the management of the school). During the examination and marking periods, if the examination supervision teams established according to the regulations of the Ministry of Education and Training discover violations of the regulations, they shall make records on the spot and request the Chairman of the Examination Board of the school to handle them in accordance with these regulations.

Article 41. Handling Special Cases Discovered During Marking

The Secretariat and the Marking Committee have the responsibility to detect and report to the Head of the Marking Committee any examination papers showing signs of violation of the regulations that need to be addressed, even without a record from the Examination Committee. After the Head of the Marking Committee has reviewed and concluded on the cases of violation, they shall be handled in the following ways:

1. Deducting Points from Examination Papers

For examination papers suspected of having marks that indicate intentional misconduct, collective marking shall be organized. If there is sufficient credible evidence for the examiners and the Head of the Examining Department to conclude that it is due to the candidate's intentional misconduct, fifty percent of the total score of the paper shall be deducted.

2. Assigning Zero Points to Parts of Examination Papers or Entire Papers:

a) Papers done on scratch paper or incorrect paper, torn or crumpled, or with unusual folds;

b) Submitting two papers for one subject or papers written in different types of characters or ink.

In particular, for papers torn and crumpled by other candidates, if confirmed by two examiners, separate marking or re-examination for the candidate may be organized if necessary.

3. Annulment of Examination Results for Candidates:

a) Writing or drawing irrelevant content to the examination;

b) Having someone else take the exam or complete the paper in any form: correcting or adding/subtracting to the submitted work; using another person's paper to submit.

Chapter VI

REPORTING AND RECORD KEEPING REGIME

Article 42. Reporting Regime

1. Seven days before the official examination date or the selection date (for schools not holding examinations), the schools must report to the Ministry of Education and Training and their supervising authorities on the following contents:

a) Decision to establish the Examination Board;

b) Number of candidates registered for admission, direct admission hotline, email address, fax number, examination date (selection date), examination venue, and number of examination rooms (for schools conducting entrance examinations).

2. Immediately after the last examination session ends, the Examination Boards of the schools must send a quick report, examination questions, and answers to the Ministry of Education and Training.

3. After the admission period, the schools must send reports to the Ministry of Education and Training, relevant ministries and sectors, and provincial education and training departments on the situation and results of admissions, grade books, and lists of successful candidates in that year's examination (in a unified format and on floppy disks).

4. After announcing the admission scores, the Examination Board of the school must send grade books and lists of successful candidates to the provincial education and training departments where candidates who were successfully admitted to the school in that year's admission period come from.

The Chairman of the Examination Board of the school is responsible for the content and timing of the above reports.

5. Before November 15 each year, the schools must send their planned admission plans for the following year to the Ministry of Education and Training.

Article 43. Retention System

All examination papers of successful candidates, materials related to the admission period, must be preserved and stored throughout the training period in accordance with the Archiving Ordinance. At the end of the training period, the Rector shall issue a decision to establish an Examination Committee to review and cancel. The examination papers of unsuccessful candidates shall be stored for one year from the date of the examination. Materials and examination results (candidate's name, scores of subjects, admission score) must be stored permanently.
