Guidelines for implementing Decision No. 31/2006/QĐ-TTg dated February 6, 2006 of the Prime Minister approving the training and capacity building program for Chairpersons of People's Councils and Heads of People's Committees at commune, ward, and town levels during the period of 2006-2010

Based on Point d, Clause 1, Article 2 of Decision No. 31/2006/QĐ-TTg dated February 6, 2006 of the Prime Minister approving the training and capacity building program for Chairpersons of People's Councils and Heads of People's Committees at commune, ward, and town levels during the period of 2006-2010, the Ministry of Home Affairs guides the development and implementation of training and capacity building plans for Chairpersons of People's Councils and Heads of People's Committees at commune, ward, and town levels (hereinafter referred to collectively as Chairpersons of People's Councils and Heads of People's Committees at commune level) as follows:

I. DEVELOPMENT OF PLANS AND ORGANIZATION OF TRAINING AND CAPACITY BUILDING FOR CHAIRPERSONS OF PEOPLE'S COUNCILS AND HEADS OF PEOPLE'S COMMITTEES AT COMMUNE LEVEL

A. Responsibilities of the Ministry of Home Affairs.

1. In 2006, the Ministry of Home Affairs directs the National Academy of Public Administration:

1.1. To organize the development of programs and compile training materials for Chairpersons of People's Councils and Heads of People's Committees at commune level.

1.2. To conduct pilot training courses for Chairpersons of People's Councils and Heads of People's Committees at commune level in three regions: urban, delta, and mountainous and midland areas, to gather experience and supplement and revise the materials.

1.3. To organize training for a team of instructors for provinces and centrally-administered cities.

2. The training and capacity building certificates for Chairpersons of People's Councils and Heads of People's Committees at commune level shall be implemented according to Articles 12 and 13, Section 2, Decision No. 161/2003/QĐ-TTg dated August 4, 2003 of the Prime Minister promulgating the Training and Capacity Building Regulations for Civil Servants and Public Officials.

3. From 2007 onwards, transfer the programs and materials to provinces and centrally-administered cities to directly organize training and capacity building for Chairpersons of People's Councils and Heads of People's Committees at commune level according to their local plans.

4. Annually, the Ministry of Home Affairs will organize inspections and evaluations of the implementation of training and capacity building plans for Chairpersons of People's Councils and Heads of People's Committees at commune level by provinces and centrally-administered cities; coordinate with localities to adjust and resolve difficulties and issues arising during the implementation of Decision No. 31/2006/QĐ-TTg dated February 6, 2006 of the Prime Minister.

B. Responsibilities of Provincial People's Committees and Centrally-Administered City People's Committees:

Develop training and capacity building plans for Chairpersons of People's Councils and Heads of People's Committees at commune level for the period of 2006-2010, submit them to the Ministry of Home Affairs, and implement them.

To ensure that the training programs are effective and suitable for the target groups and practical management characteristics of Chairpersons of People's Councils and Heads of People's Committees at commune level, provincial People's Committees and Centrally-Administered City People's Committees need to organize surveys and categorize the target groups to develop plans as follows:

1. Assess the current situation and training needs for Chairpersons of People's Councils and Heads of People's Committees at commune level for the period of 2006-2010, to plan specific classes:

1.1. For provinces in the delta region and centrally-administered cities, develop plans to open classes for training and capacity building for Chairpersons of People's Councils and Heads of People's Committees at commune level who have not yet completed secondary or higher administrative education (three months of study) and those who have already completed such education (two months of study) according to two programs:

- Program for training and capacity building for Chairpersons of People's Councils and Heads of People's Committees at ward and town levels;

- Program for training and capacity building for Chairpersons of People's Councils and Heads of People's Committees at commune levels in the delta region.

1.2. For provinces in the midland and mountainous regions with ethnic minority populations, develop plans to open classes for training and capacity building for Chairpersons of People's Councils and Heads of People's Committees at commune level who have not yet completed secondary or higher administrative education (three months of study) and those who have already completed such education (two months of study) according to two programs:

- Program for training and capacity building for Chairpersons of People's Councils and Heads of People's Committees at commune levels in midland and mountainous regions with ethnic minority populations.

2. Content of training and capacity building: Localities organize training and capacity building according to programs and materials compiled by the National Academy of Public Administration, including three types of programs, each type having separate programs for Chairpersons of People's Councils and Heads of People's Committees at commune level who have not yet completed secondary or higher administrative education (three months of study) and those who have already completed such education (two months of study), approved and issued by the Ministry of Home Affairs; within which, 20% of the time is allocated for localities to supplement practical aspects of grassroots administration management.

3. Training and capacity building locations: Based on the geographical features and transportation conditions of their own locality, Provincial People's Committees and Centrally-Administered City People's Committees select appropriate locations to organize classes in different regions to facilitate the travel, accommodation, and living arrangements of Chairpersons of People's Councils and Heads of People's Committees at commune, ward, and town levels.

For provinces in the delta region with a small number of Chairpersons of People's Councils and Heads of People's Committees at commune levels in midland and mountainous regions, and for provinces in the mountainous region with a small number of Chairpersons of People's Councils and Heads of People's Committees at ward and town levels, they may collaborate with neighboring provinces to organize joint classes or report to the Ministry of Home Affairs for planning and organizing classes.

2. Content of training and capacity building: Localities organize training and capacity building according to programs and materials compiled by the National Academy of Public Administration, including three types of programs, each type having separate programs for Chairpersons of People's Councils and Heads of People's Committees at commune level who have not yet completed secondary or higher administrative education (three months of study) and those who have already completed such education (two months of study), approved and issued by the Ministry of Home Affairs; within which, 20% of the time is allocated for localities to supplement practical aspects of grassroots administration management.

4. Instructor team: To ensure successful training and capacity building sessions for Chairpersons of People's Councils and Heads of People's Committees at commune, ward, and town levels, based on the class plans, Provincial People's Committees and Centrally-Administered City People's Committees should select and send sufficient numbers of instructors to attend the training sessions organized by the National Academy of Public Administration.

5. Implementation budget: Starting from 2007, provinces and centrally-administered cities should prioritize funding for training and capacity building classes for Chairpersons of People's Councils and Heads of People's Committees at commune, ward, and town levels; in addition to the training and capacity building funds allocated by the central government, they should also allocate additional local budget funds according to the State Budget Law.

II. IMPLEMENTATION ORGANIZATION

For provinces in the delta region with a small number of Chairpersons of the People's Councils and Chairpersons of the People's Committees of midland and mountainous communes, and for mountainous provinces with a small number of Chairpersons of the People's Councils and Chairpersons of the People's Committees of wards and towns that are insufficient to form a class, they may coordinate with adjacent provinces to organize joint classes on a provincial cluster basis, or report to the Ministry of Home Affairs to develop plans for organizing such classes.

4. Teaching staff: To ensure the success of training courses for Chairpersons of the People's Councils and Chairpersons of the People's Committees of communes, wards, and towns, based on the class schedules, the People's Committees of provinces and centrally-administered cities shall select and dispatch an adequate number of lecturers to attend the training sessions organized by the National Academy of Public Administration.

5. Implementation funds: Starting from 2007, provinces and centrally-administered cities shall prioritize funding for training courses and capacity building programs for Chairpersons of the People's Councils and Chairpersons of the People's Committees of communes, wards, and towns; in addition to the training and capacity building funds allocated by the central government, local budgets shall be supplemented according to the provisions of the State Budget Law.

II. IMPLEMENTATION ORGANIZATION

1. The People's Committees of provinces and centrally governed cities shall direct the Departments of Home Affairs to act as the lead agency in coordinating with relevant agencies to develop and implement training and capacity-building plans for Chairpersons of People's Councils and Chairpersons of People's Committees at the commune level in their respective localities based on Decision No. 31/2006/QĐ-TTg dated February 6, 2006, of the Government Prime Minister and this Circular; they shall inspect and evaluate the implementation of these plans, promptly supplementing and adjusting them to align with actual conditions, requirements, and tasks of the locality.

2. In developing and implementing training and capacity-building plans for Chairpersons of People's Councils and Chairpersons of People's Committees at the commune level, each locality shall classify the target groups according to different administrative unit types (urban, delta, midland and mountainous regions) and provide training or capacity-building programs lasting two or three months accordingly.

3. Annually, the People's Committees of provinces and centrally governed cities shall submit reports to the Ministry of Home Affairs before December 15 to compile and report to the Government Prime Minister on the progress and results of the training and capacity-building activities for Chairpersons of People's Councils and Chairpersons of People's Committees at the commune level.

III. IMPLEMENTATION PROVISIONS

1. This Circular shall take effect fifteen days from the date of publication in the Official Gazette;

2. During the process of organizing and implementing, if difficulties arise, the People's Committees of provinces and centrally governed cities shall promptly reflect such issues to the Ministry of Home Affairs for consideration and resolution./.
