JOINT CIRCULAR

Guidelines for adjusting the monthly allowance from January 1, 2008, for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

Pursuant to Clause 2, Article 4 of the Government's Decree No. 184/2007/NĐ-CP dated December 17, 2007, adjusting pensions, social insurance allowances, and monthly allowances for retired village cadres (hereinafter referred to as Decree No. 184/2007/NĐ-CP);

The Ministry of Interior and the Ministry of Finance provide guidelines for adjusting the monthly allowance from January 1, 2008, for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers as follows:

I.APPLICATION OBJECTS

The application objects of this Circular are village cadres who have retired and are receiving monthly allowances according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers (hereinafter referred to as retired elderly village cadres).

II. ADJUSTMENT OF MONTHLY ALLOWANCES

From January 1, 2008, implement the adjustment of monthly allowances for retired elderly village cadres according to the provisions of Article 2 of Decree No. 184/2007/NĐ-CP (increasing the monthly allowance by 20% over the amount received in December 2007) as follows:

1. Formula for adjusting the monthly allowance from January 1, 2008:

In which: The monthly allowance received at the time of December 2007 is the allowance stipulated in Clause 2, Section II of the Joint Circular No. 01/2006/TTLT-BNV-BTC dated September 15, 2006 of the Ministry of Interior and the Ministry of Finance guiding the implementation of the adjustment of monthly allowances from October 1, 2006, for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

2. The monthly allowance received from January 1, 2008, for retired elderly village cadres (rounded off according to the calculation formula specified in Clause 1 above) is as follows:

a) For cadres who were originally Secretaries of the Party Committee, Chairmen of the People's Committee of the village: 675,000 VND/month;

b) For cadres who were originally Deputy Secretaries, Deputy Chairmen, Standing Members of the Party Committee, Secretaries of the People's Committee, Secretaries of the People's Council, Village Militia Chiefs, Chiefs of Public Security Stations: 650,000 VND/month;

c) For other positions: 600,000 VND/month.

III. IMPLEMENTATION

1. Provincial People's Committees and municipal people's committees directly under the central government shall guide and implement the payment of monthly allowances from January 1, 2008, according to the guidelines set out in this Circular for the objects within their jurisdiction.

2. The source of funds for adjusting the monthly allowance for retired elderly village cadres shall be implemented according to the guidance of the Ministry of Finance.

3. Retired elderly village cadres who move to a new legal place of residence within the same district must have a transfer certificate from the People's Committee of the commune; within the same province, they must have a transfer certificate from the Department of Interior - Labor, Invalids and Social Affairs of the district; outside the province, they must have a transfer certificate from the Department of Interior; the transfer certificate must be accompanied by the file and decision on retirement (in case of loss, there must be a confirmation letter from the competent authority at the same level). The local department where the cadre moves to will continue to pay the allowance to the transferred cadre. If a retired elderly village cadre moved to a new legal place of residence before the effective date of Decree No. 184/2007/NĐ-CP, the current paying location will continue to pay the allowance to the object.

4. This Circular takes effect from January 1, 2008.

Abolish the Joint Circular No. 01/2006/TTLT-BNV-BTC dated September 15, 2006 of the Ministry of Interior and the Ministry of Finance guiding the implementation of the adjustment of monthly allowances from October 1, 2006, for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

During the implementation process, if there are any difficulties, ministries, sectors, and localities should report to the Ministry of Interior and the Ministry of Finance for research and resolution./.
