HGuidelines for awarding the Commemorative Medal "For the Cause of Inspection"

Pursuant to the Law on Encouragement and Reward dated November 26, 2003 and the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward dated June 14, 2005;

Pursuant to the Law on Legislative Acts dated June 3, 2008;

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing and guiding the implementation of certain provisions of the Law on Encouragement and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward;
The Inspectorate General guides the awarding of the Commemorative Medal "For the Cause of Inspection" as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the principles, recipients, criteria, dossier, procedures, authority to propose and decide, and organization of presenting the Commemorative Medal "For the Cause of Inspection" (hereinafter referred to as the Commemorative Medal).

3. The Commendation Medal shall not be awarded to individuals whose titles of People's Public Security members have been revoked; who are under criminal investigation; who are placed in compulsory educational facilities; or individuals collaborating with the People's Public Security Force but were dismissed due to betrayal or violations of unit management regulations.

1. The Commemorative Medal is a form of reward given by the Inspectorate General to individuals who have made contributions to the cause of building and developing the Inspection sector, aiming to recognize the achievements of individuals who have contributed to the Inspection cause of Vietnam.

2. The process of awarding the Commemorative Medal must ensure accuracy, fairness, transparency, democracy, and timeliness.

3. The Commemorative Medal is awarded only once to an individual; it is not posthumously awarded; and it is not awarded to individuals who have previously been awarded the Order "For the Cause of Inspection."

Article 3. Organization of awarding the Commemorative Medal

The Inspectorate General awards the Commemorative Medal on the occasion of the anniversary of the establishment of the Inspection sector (November 23) annually and may award it exceptionally in special cases.

Chapter II

RECIPIENTS AND CRITERIA FOR AWARDING COMMENDATION MEDALS

1. Leaders and former leaders of the Party and State; leaders of the Central Committee of the Vietnam Fatherland Front.

1. Civil servants, public officials, and employees currently working in the system of State Inspection agencies, including:

a) Civil servants, public officials, and employees under the Inspectorate General;

b) Civil servants, public officials, and employees under the Inspectorates of Ministries and sectors;

c) Civil servants, public officials, and employees under the Inspectorates of localities;

2. Leaders of Party and State agencies; leaders of the Fatherland Front (FF) and political social organizations at central and local levels:

a) Leaders of the Party, State, Ministries, Sectors, FF, and political social organizations at the central level;

b) Secretaries and Deputy Secretaries of provincial and municipal party committees directly under the central government; Chairpersons and Deputy Chairpersons of provincial and municipal People's Councils and People's Committees directly under the central government;

c) Leaders of the FF and political social organizations at the provincial level; Secretaries and Chairpersons of provincial People's Councils and Chairpersons of provincial People's Committees.

3. Individuals who are overseas Vietnamese or foreigners who have made contributions to the cause of building and developing the Inspection sector of Vietnam.

4. Other special cases as proposed by units within the Inspection sector and the Standing Committee of the Encouragement and Reward Council of the Inspection sector.

Article 5. Recipients Not Eligible for the Commemorative Medal

1. Individuals currently awaiting disciplinary action and those currently undergoing disciplinary action from reprimand upwards; the period of disciplinary action shall not be counted consecutively for the purpose of awarding the Commemorative Medal.

2. Individuals who are civil servants, public officials, and employees of state agencies who have been dismissed due to violations of discipline.

1. Individuals specified in Clauses 1, 2, and 3 of Article 4 of this Resolution comply well with the Party's policies and the State's laws and have contributed to the development process of the Vietnamese National Assembly.

1. Individuals belonging to the category specified in Clause 1, Article 4 of this Circular, who have worked continuously in the system of State Inspection agencies for ten years or more;

2. Individuals belonging to the categories specified in point a and point b, Clause 2, Article 4 of this Circular, who have held positions for one term (five years) or more.

3. Individuals belonging to the category specified in point c, Clause 2, Article 4 of this Circular, who have held positions for two terms (ten years) or more.

4. Individuals belonging to the category specified in Clause 3, Article 4 of this Circular, have made outstanding contributions in establishing and consolidating international cooperation relations, contributing positively to the cause of building and developing the Inspection sector of Vietnam.

5. Individuals belonging to other special cases specified in Clause 4, Article 4 of this Circular, who have achieved particularly outstanding results or have innovative scientific works with practical value that contribute positively and effectively to the cause of building and developing the Inspection sector of Vietnam.

Article 7. Priority Cases for Awarding the Commendation Medal

Civil servants, public officials, and employees working in the system of State Inspection agencies are prioritized for the awarding of the Commemorative Medal:

1. Individuals recognized as Heroes of Labor or Heroes of the Armed Forces, will be awarded immediately upon receipt of the Decision on Reward.

2. Individuals awarded Orders of Labor Merit or National Model Workers will be proposed for early awarding, two years earlier.

3. Individuals awarded Certificates of Merit by the Prime Minister or recognized as Model Workers in the Inspection sector will be proposed for early awarding, one year earlier.

4. Individuals awarded Certificates of Merit by the Chief Inspector or recognized as Model Workers at the grassroots level will be proposed for early awarding, six months earlier.

Chapter III

PROCEDURE FOR AWARDING AND PRESENTING THE COMMENDATION MEDAL

Article 8. Responsibilities for Establishing Nomination Files and Recommending the Commendation Medal

1. Heads of Departments, Units under the Inspectorate General are responsible for preparing dossiers and proposing the awarding of the Commemorative Medal to individuals within their units who belong to the category specified in point a, Clause 1, Article 4 of this Circular;

2. Inspectors General of Ministries and sectors are responsible for preparing dossiers and proposing the awarding of the Commemorative Medal to leaders of Ministries and sectors and individuals belonging to the category specified in point b, Clause 1, Article 4 of this Circular;

3. Inspectors General of provinces and centrally-administered cities are responsible for preparing dossiers and proposing the awarding of the Commemorative Medal to individuals belonging to the categories specified in point c, Clause 1, and points b and c, Clause 2, Article 4 of this Circular;

4. The Head of the Office of the Inspectorate General is responsible for preparing dossiers and proposing the awarding of the Commemorative Medal to individuals belonging to the category specified in point a, Clause 2, Article 4 of this Circular;

5. The Director of the Department of International Cooperation - Inspectorate General is responsible for preparing dossiers and proposing the awarding of the Commemorative Medal to individuals belonging to the category specified in Clause 3, Article 4 of this Circular;

6. Heads of agencies and units within the Inspection sector (including Departments, Units under the Inspectorate General, Inspectorates of Ministries and sectors, provinces, and centrally-administered cities) and the Standing Committee of the Encouragement and Reward Council of the Inspection sector are responsible for preparing dossiers and proposing the awarding of the Commemorative Medal to individuals belonging to other special cases specified in Clause 4, Article 4 of this Circular.

Article 9. Documents for requesting to be considered for the Commendation Medal

1. The dossier for nominating the Commendation Medal includes one set comprising:

a) A letter requesting the award of the Commendation Medal;

b) A list of nominees for the Commendation Medal (Form No. 1 attached);

c) A summary of the work history (Form No. 2 attached);

d) Copies of the award decisions and related files with confirmation from the managing authority (if applicable) for cases given priority consideration.

2. Deadline for submitting the dossier: Agencies and units must submit the dossier for nominating the Commendation Medal to the Cadre Organization Department - Government Inspectorate (through the Standing Committee of the Competition and Award Council of the Inspection Sector) before September 1st each year.

Article 10. Procedure for awarding the Commendation Medal

1. The Cadre Organization Department - Government Inspectorate is responsible for compiling the dossier for nominating the Commendation Medal and presenting it to the Competition and Award Council of the Inspection Sector before October 1st each year.

2. The Standing Committee of the Competition and Award Council of the Inspection Sector is responsible for coordinating with the Departments, Units under the Government Inspectorate, Inspectors of Ministries, Sectors, provinces, centrally governed cities, to review, verify the dossier and propose the Competition and Award Council of the Inspection Sector to consider; and present to the Chief Inspector for approval to confer the Commendation Medal before October 30th each year.

Article 11. Organizing the Presentation of the Commendation Medal

1. The ceremony for conferring the Commendation Medal will be organized during the anniversary of the Inspection Sector (November 23rd) each year.

2. The agency or unit proposing the nomination for the Commendation Medal is responsible for organizing the ceremony to present the medal to individuals according to current regulations, in coordination with the Standing Committee of the Competition and Award Council of the Inspection Sector.

3. The Office of the Government Inspectorate coordinates with the Cadre Organization Department to organize the presentation of the Commendation Medal to leaders of Party and State agencies, leaders of the Vietnam Fatherland Front and political social organizations at the central level, individuals who have worked or are currently working at the Government Inspectorate, and some special cases.

Article 12. Rights and responsibilities of individuals receiving the Commendation Medal

1. Individuals meeting the conditions and criteria for receiving the Commendation Medal shall be nominated for consideration in accordance with the provisions.

2. Individuals whose appointment to receive the Commendation Medal is signed by the Chief Inspector shall be awarded a certificate, the Commendation Medal "For the Cause of Inspection", and a monetary reward not exceeding 0.6 times the general minimum wage, with the financial implementation carried out in accordance with current financial regulations.

3. Individuals receiving the Commendation Medal are responsible for continuing to uphold and promote the traditions of the Vietnamese Inspection Sector, setting a good example in implementing the policies and laws of the Party and State.

4. Organizations and individuals proposing the nomination for the Commendation Medal bear legal responsibility for the accuracy and truthfulness of the nomination dossier.

5. Organizations and individuals have the right to appeal or report on the nomination and awarding of the Commendation Medal in accordance with the Law on Appeals and Complaints and the Law on Competition and Awards.

Chapter IV

IMPLEMENTATION

Article 13. Implementation Organization

1. This Circular takes effect 45 days from the date of issuance.

Repeal Decision No. 1692/2005/QĐ-TTCP dated September 14, 2005, issued by the Chief Inspector regarding the Regulations on awarding the Commendation Medal "For the Cause of Inspection".

2. The Standing Committee of the Competition and Award Council of the Inspection Sector, Heads of Departments, Units under the Government Inspectorate, Chief Inspectors of Ministries, Sectors, provinces, centrally governed cities, and relevant agencies, units, and individuals are responsible for implementing this Circular.

3. In the process of implementation, if there are difficulties or obstacles, the Heads of agencies and units should promptly reflect them to the Standing Committee of the Competition and Award Council of the Inspection Sector for reporting to the Chief Inspector to consider timely amendments and supplements./.
