Regulations on the title standards for Directors and Deputy Directors of Provincial Science and Technology Departments under the People's Committees of provinces and centrally governed cities.

Pursuant to the Civil Servants Law on November 13, 2008;
Based on Decree No. 24/2010/NĐ-CP dated March 15, 2010 of the Government on recruitment, utilization, and management of civil servants;
Pursuant to Decree No. 20/2013/NĐ-CP dated February 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
Pursuant to Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government on the organization of specialized agencies under provincial People's Committees and municipal People's Committees directly under the Central Government;
At the proposal of the Director of the Personnel Department and the Director of the Legal Department;
The Minister of Science and Technology issues this Circular to regulate the title standards for Directors and Deputy Directors of Provincial Science and Technology Departments under the People's Committees of provinces and centrally governed cities.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular stipulates the title standards for Directors and Deputy Directors of Provincial Science and Technology Departments in provinces and centrally governed cities (hereinafter referred to collectively as Director of Department, Deputy Director of Department).
Article 2. Scope of Application
This Circular applies to the People's Committees and Provincial Science and Technology Departments in provinces and centrally governed cities.
Article 3. Principles of Application
The Director of Department and Deputy Director of Department standards prescribed in this Circular serve as the basis for competent authorities to implement and monitor the appointment, reappointment, rotation, removal, planning, training, development, and evaluation of civil servants holding the titles of Director of Department and Deputy Director of Department.
Article 4. Position and Responsibilities of the Director of Department
The Director of Department is the managerial position heading the Provincial Science and Technology Department, responsible to the provincial People's Committee and the Chairman of the provincial People's Committee, while also being accountable to the Minister of Science and Technology and the law regarding the performance of the Department's functions and tasks and the authority delegated.
Article 5. Position and Responsibilities of the Deputy Director of Department
Chapter II
The Deputy Director of Department assists the Director of Department in directing certain aspects of work, accountable to the Director of Department and the law for the assigned tasks.
Section 1
GENERAL STANDARDS
STANDARDS FOR THE TITLES OF DIRECTOR OF DEPARTMENT AND DEPUTY DIRECTOR OF DEPARTMENT
Article 6. Political Quality, Morality, and Lifestyle
Point 1. Patriotic, with firm political resolve, loyal to the Party's policies and State laws, steadfast in the reform path, national independence, and socialism; devoted to serving the country and the people.
3. Have a sense of organizational discipline; be truthful, objective, daring to think, act, and take responsibility; enthusiastic about learning, researching, innovating, and being dynamic; have a spirit of self-criticism and criticism.
Point 2. Work with a sense of responsibility, high efficiency; frugal, incorruptible, impartial, dedicated, and selfless; not opportunistic, not corrupt, resolutely fighting against corruption and negative phenomena; practicing thrift and opposing waste.
Point 4. A model in morality and lifestyle; having a democratic and scientific style; trusted by the staff, civil servants, employees, and workers at the workplace and by the local residents; implementing office culture well, maintaining administrative discipline and order.
Article 7. Competence
Point 1. Possess leadership and management capabilities in implementing the Party's policies and State laws on science and technology, developing scientific and technological potential in the province.
Point 2. Have vision and innovative thinking in managing science and technology; possess forecasting and directional capabilities for scientific and technological development in the province; have the ability to organize research and lead scientific and technological projects; propose and implement management solutions and methods for scientific and technological activities serving the provincial People's Committee's state administration.
Article 7. Knowledge
1. Mastering and understanding the Party's guidelines and the State's laws in the field of science and technology; orientation for development, strategies, planning, and national science and technology development plans at provincial and centrally governed city levels.
2. Mastering regulatory legal documents in the field of science and technology and documents issued by the Provincial People's Committee.
3. Understanding management practices in the field of science and technology.
4. Being aware of the political, economic, cultural, social, environmental, and national defense and security situation of the locality, the country, and other countries in the region and worldwide.
Article 8. Other Standards
1. The age for first appointment to the position of Director of Department or Deputy Director of Department shall not exceed fifty-five years old for males and fifty years old for females.
2. Not being in a disciplinary period from a reprimand or higher level of discipline.
3. Having been planned for appointment to the position or a higher equivalent position.
4. Having sufficient health to ensure completion of assigned tasks.
Section 2
SPECIFIC STANDARDS FOR THE POSITION OF DEPARTMENT DIRECTOR
Article 9. Work Experience
Having served in the position of Deputy Director of Department, bureau, or sector at the provincial level or equivalent, or as Secretary or Chairman of the People's Committee at the district level or equivalent, for at least three (3) years; preference given to those who have served in the position of Deputy Director of the Department of Science and Technology.
Article 10. Qualifications
1. Graduated from university or higher, with a major relevant to state management in the field of science and technology.
2. Holding the rank of Senior Specialist or equivalent.
3. Graduated from Advanced Political Theory or equivalent.
4. Possessing a certificate in training for state management in the field of science and technology for Department Directors issued by the Ministry of Science and Technology.
5. Possessing a foreign language certificate at a level equivalent to Level 3 of the Vietnamese Foreign Language Competency Framework as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level Vietnamese Foreign Language Competency Framework. For some provinces, a certificate in ethnic languages may be substituted for a foreign language certificate.
6. Possessing a computer skills certificate meeting the basic standard for using information technology as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications on standards for using information technology.
Section 3
SPECIFIC STANDARDS FOR THE POSITION OF DEPARTMENT DEPUTY DIRECTOR
Article 11. Work Experience
Having at least three (3) years of experience in managing science and technology work, with preference given to those who have served in the positions of head or deputy head of departments or units under the Department of Science and Technology.
Article 12. Qualifications
1. Graduated from university or higher, with a major relevant to state management in the field of science and technology.
2. Possessing a certificate in training for state management at the rank of Senior Specialist or equivalent.
3. Political theory qualifications at a level of intermediate or higher.
4. Possessing a certificate in training for state management in the field of science and technology for Department Directors issued by the Ministry of Science and Technology.
5. Possessing a foreign language certificate at a level equivalent to Level 3 of the Vietnamese Foreign Language Competency Framework as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level Vietnamese Foreign Language Competency Framework. For some provinces, a certificate in ethnic languages may be substituted for a foreign language certificate.
6. Possessing a computer skills certificate meeting the basic standard for using information technology as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications on standards for using information technology.
Chapter III
IMPLEMENTING PROVISIONS
Article 13. Effective Date
This Circular takes effect from May 1, 2015. Decree No. 19/2005/QĐ-BKHCN dated December 8, 2005, issued by the Minister of Science and Technology, concerning the qualification requirements for the position of Director of the Department of Science and Technology at provincial and centrally governed city levels, is hereby abolished.
1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.
1. Provincial People's Committees shall be responsible for:
a) Using the standards prescribed in this Circular to plan for training, planning, and considering appointments, reappointments, transfers, and dismissals from the positions of Department Director and Deputy Department Director.
b) Within ten days from the date the appointment decision becomes effective, notify the Ministry of Science and Technology in writing along with the Appointment Decision and the curriculum vitae of the person appointed to the position of Department Director or Deputy Department Director for tracking and coordinating the implementation of tasks related to training, enhancing management capacity in the field of science and technology, planning leadership positions in subordinate units, and leadership positions within the Ministry of Science and Technology.
2. Departments of Science and Technology shall base their cadre training and planning activities on the standards prescribed in this Circular.
3. For individuals appointed to the positions of Department Director or Deputy Department Director but who do not meet the standards prescribed in this Circular, they must undergo training and enhancement to meet the standards before January 1, 2017.
4. The Ministry of Science and Technology will organize guidance and inspection of the implementation of this Circular./.
