Pursuant to Ordinance No. 16/2011/UBTVQH12 dated June 30, 2011 on the management and use of weapons, explosives, and tools, and Ordinance No. 07/2013/UBTVQH13 dated July 12, 2013 amending and supplementing certain provisions of the Ordinance on the management and use of weapons, explosives, and tools.

Pursuant to Decree No. 25/2012/NĐ-CP dated April 5, 2012 of the Government detailing the implementation of certain provisions of the Ordinance on the management and use of weapons, explosives, and tools.

Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the request of the Director of the Legal Department,

The Minister of Culture, Sports and Tourism issues this Circular specifying the procedures and formalities for accepting applications to issue permits for carrying weapons and tools into and out of the territory of Vietnam for exhibition and display in cultural and artistic activities; procedures and formalities for permitting the deployment and use of weapons, explosives, and tools as props.

Article 1. Scope of Regulation

This Circular specifies the procedures and formalities for accepting applications to issue permits for carrying weapons and tools into and out of the territory of Vietnam for exhibition and display in cultural and artistic activities; procedures and formalities for permitting the deployment and use of military weapons, hunting rifles, sports weapons, explosives, and tools with functional and operational capabilities as props.

Article 2. Applicability

This Circular applies to:

1. Vietnamese organizations and individuals and foreign organizations and individuals engaged in cultural and artistic activities in Vietnam.

2. Cultural, sports, and tourism authorities at all levels.

3. Relevant agencies, organizations, and individuals.

Article 3. Authorities receiving applications for permits to carry weapons and tools into and out of the territory of Vietnam for exhibition and display in cultural and artistic activities.

The Heritage Department and the Fine Arts, Photography, and Exhibition Department shall, based on their assigned functions, tasks, and powers, receive applications from organizations and individuals for permits to carry weapons and tools into and out of the territory of Vietnam for exhibition and display in cultural and artistic activities, and submit these applications to the Public Order Administrative Management Police Bureau under the Ministry of Public Security for issuance of the permit.

Article 4. Procedures and formalities for accepting applications for permits to carry weapons and tools into and out of the territory of Vietnam for exhibition and display in cultural and artistic activities.

1. Organizations and individuals as stipulated in Clause 1 of Article 5 of the Joint Circular No. 24/2014/TTLT-BVHTTDL-BCA dated December 30, 2014 of the Ministers of Culture, Sports and Tourism and Public Security on the management and use of weapons, explosives, and tools as props or for exhibition and display in cultural and artistic activities (hereinafter referred to as Joint Circular No. 24/2014/TTLT-BVHTTDL-BCA) shall directly submit one (01) set of application documents to the authority with jurisdiction to accept such applications as specified in Article 3 of this Circular to request issuance of the permit.

2. Application documents for requesting issuance of the permit shall be prepared in accordance with the provisions of Clause 2 of Article 3 of Circular No. 30/2012/TT-BCA dated May 29, 2012 of the Ministry of Public Security detailing the implementation of certain provisions of the Ordinance on the management and use of weapons, explosives, and tools and Decree No. 25/2012/NĐ-CP dated April 5, 2012 detailing the implementation of certain provisions of the Ordinance on the management and use of weapons, explosives, and tools.

Request for permission to carry weapons and tools into or out of the territory of Vietnam (Model No. 01 issued together with this Circular).

3. Within five (05) working days from the date of receipt of complete and valid application documents, the authority receiving applications as specified in Article 3 of this Circular shall examine and send the request letter along with the application documents to the Public Order Administrative Management Police Bureau under the Ministry of Public Security for issuance of the permit.

The request for permission to carry weapons and tools into or out of the territory of Vietnam by the authority with jurisdiction as specified in Article 3 of this Circular must clearly state the reasons, duration of carrying in or out; full name, identification number, date of issuance of Identity Card or Passport still in effect of the person carrying weapons and tools; quantity, type, brand, serial number of weapons and tools; ammunition stock, accessories (if any), and means of transportation (in case of large quantities); border gate for carrying weapons and tools into or out of the territory of Vietnam.

In cases where there are insufficient documents to request the Public Order Administrative Management Police Bureau under the Ministry of Public Security to issue the permit, the authority receiving applications as specified in Article 3 of this Circular shall respond in writing stating the reasons.

4. Procedures and formalities for issuing permits to carry weapons and tools into and out of the territory of Vietnam for exhibition and display in cultural and artistic activities shall be implemented in accordance with the provisions of the Ordinance on the management and use of weapons, explosives, and tools and guiding documents for its implementation.

Article 5. Procedures for granting permission to organizations to deploy and use military weapons, hunting guns, sports weapons, explosives, and supportive tools with functional and operational capabilities as props.

Cultural and artistic organizations shall submit directly or send via postal service one (01) set of application documents to the direct supervisory authority or the Department of Culture, Sports and Tourism/Department of Culture and Sports to request permission to deploy and use military weapons, hunting guns, sports weapons, explosives, and supportive tools with functional and operational capabilities as props in accordance with the film script or artistic performance program content as stipulated in point c, Clause 2, Article 6 of Circular Joint Circular No. 24/2014/TTLT-BVHTTDL-BCA.

1. The documents include:

a) A request form for permission to deploy and use military weapons/hunting guns/sports weapons/explosives/supportive tools as props according to Form No. 02 issued together with this Circular;

b) A certified copy of the decision on establishment or business registration certificate of cultural and artistic organizations;

c) Film script or Content of artistic performance program.

2. Within five (05) working days from the date of receipt of complete and valid application documents, the direct supervisory authority or the Department of Culture, Sports and Tourism/Department of Culture and Sports shall examine and issue a written response agreeing to implement the deployment; in case of disagreement, a written response must be issued stating the reasons. The response document shall be implemented according to Form No. 03 issued together with this Circular.

3. Cultural and artistic organizations are responsible for contacting the General Police Department, Provincial Police Departments under the Central Government to organize the deployment and use of military weapons, hunting guns, sports weapons, explosives, and supportive tools with functional and operational capabilities as props after receiving the written approval for implementation.

The use of military weapons, hunting guns, sports weapons, explosives, and supportive tools with functional and operational capabilities as props shall be carried out in accordance with the provisions of the Ordinance on Management and Use of Weapons, Explosives, and Supportive Tools, Joint Circular No. 24/2014/TTLT-BVHTTDL-BCA, and related legal documents.

Article 6. Effectiveness

This Circular takes effect from September 1, 2015.

Article 7. Implementation Organization

1. Heads of agencies and units under the Ministry of Culture, Sports and Tourism, Directors of Departments of Culture, Sports and Tourism/Departments of Culture and Sports, and relevant organizations and individuals are responsible for implementing this Circular.

2. During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals should promptly report to the Ministry of Culture, Sports and Tourism (through the Legal Affairs Department) for research, amendment, and supplementation.
