Regarding the financial mechanism for the Intellectual Property Office

On the basis of Law on Government Organization dated June 19, 2015;

On the basis of Article 1. This Decree regulates the use of state assets to pay investors when implementing construction projects under the Build-Transfer Contract form (hereinafter referred to as BT Project) in accordance with the provisions of the law. June 25, 2015;

On the basis of Law on thrift and waste prevention dated November 26, 2013;

Decree No. Decision No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Fees and Charges;

Decree No. Decision No. 16/2015/NĐ-CP dated February 14, 2015 of the Government stipulating the self-management mechanism of public service units;

Decree No. Decision No. 54/2016/NĐ-CP dated June 14, 2016 of the Government stipulating the self-management mechanism of public scientific and technological organizations;

Pursuant to the proposal of the Minister of Science and Technology;

The Prime Minister issues this Decision on the application of the financial mechanism for the Intellectual Property Office under the Ministry of Science and Technology.

Clause 4 of Article 6The Intellectual Property Office shall apply the self-financing mechanism as a public service unit that self-funds regular expenses and investment costs as prescribed in Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government stipulating the self-management mechanism of public service units and Decree No. 54/2016/NĐ-CP dated June 14, 2016 of the Government stipulating the self-management mechanism of public scientific and technological organizations and the guiding documents for these Decrees.

12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentThe Intellectual Property Office may use retained fee revenue to fund its activities, including investment costs; large-scale procurement, repair, and maintenance of assets, machinery, and equipment; and supplementary income for staff to ensure the completion of assigned tasks.

Article 3. This Decision takes effect from May 5, 2017 and applies from the 2017 budget year.

The Ministers of Science and Technology, Finance, Planning and Investment, Home Affairs, the Director of the Intellectual Property Office, and the Heads of related agencies are responsible for implementing this Decision./.
