CIRCULAR
REGULATIONS ON THE AGENCIES AND ORGANIZATIONS IMPLEMENTING TRAINING CONTENT, TIME FOR ISSUING CERTIFICATES OF FORENSIC MEDICAL AND PSYCHIATRIC EXPERTISE TRAINING
On the basis of Law on Forensic Appraisal No. 13/2012/QH13 dated June 20, 2012;
Decree No. 85/2013/NĐ-CP dated July 29, 2013 of the Government detailing measures for implementation of the Law on Forensic Appraisal;
Decree No. 75/2017/ND-CP dated June 20, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Department of Science, Technology and Training;
The Minister of Health issues this Circular to regulate agencies and organizations implementing training content, time for issuing certificates of forensic medical and psychiatric expertise training.
Article 1. Scope of Regulation
This Circular regulates the agencies and organizations implementing (hereinafter referred to as training institutions), time, form, content of training and issuance of Training Certificate in forensic medical or psychiatric expertise.
Article 2. Training Institutions for Forensic Medical and Psychiatric Expertise
1. The National Institute of Forensic Medicine under the Ministry of Health shall be the training institution for forensic medical expertise;
2. The training institutions for psychiatric forensic expertise include:
a) The Central Institute of Forensic Psychiatry under the Ministry of Health;
b) The Central Institute of Forensic Psychiatry Bien Hoa under the Ministry of Health.
Article 3. Duration and Form of Training
1. Duration of training: At least three months.
2. Form of training: Full-time
Article 4. Content of Training on Forensic Medical Expertise
1. Overview of the Forensic Medicine specialty.
2. Specialized and vocational forensic expertise on living persons.
3. Specialized and vocational forensic expertise on corpses and bones.
4. Specialized and vocational forensic genetic expertise.
5. Specialized and vocational forensic pathology expertise.
6. Specialized and vocational forensic toxicology expertise.
7. Specialized and vocational expertise related to natural disasters and catastrophes.
8. Practical experiments and fieldwork at localities.
9. Legal knowledge related to forensic expertise work.
Article 5. Content of Training on Psychiatric Forensic Expertise
1. Overview of the Psychiatric Forensic Medicine specialty,
2. Specialized knowledge in psychiatric forensic expertise.
3. Vocational psychiatric forensic expertise.
4. Procedures for psychiatric forensic expertise.
5. Skills in conducting psychiatric forensic expertise.
6. Legal knowledge related to psychiatric forensic expertise work.
Article 6. Training Programs and Materials
Based on the content of forensic medical and psychiatric forensic expertise training stipulated in Articles 4 and 5 of this Circular, it is assigned:
1. The National Institute of Forensic Medicine under the Ministry of Health to develop and approve the training program and materials for forensic medical expertise.
2. The Central Institute of Forensic Psychiatry and the Central Institute of Forensic Psychiatry Bien Hoa under the Ministry of Health to develop and approve the training program and materials for psychiatric forensic expertise.
Article 7. Issuance of Certificates
1. Trainees shall be issued a Training Certificate in forensic medical or psychiatric forensic expertise by the training institution when they meet all of the following requirements:
a) Not violating the regulations of the training course;
b) Participating fully in the training duration and accumulating the content of the training program;
c) Achieving satisfactory results in capability assessment;
d) Fulfilling all obligations of trainees towards the training institution.
2. The model of the Training Certificate in forensic medical or psychiatric forensic expertise is specified in the Appendix attached to this Circular.
3. The Training Certificate in forensic medical and psychiatric forensic expertise is one of the conditions for appointing judicial experts in the fields of forensic medicine and psychiatric forensic medicine according to the provisions of the Law on Forensic Appraisal.
Article 8. Training Expenses
The training expenses for forensic medical examination and forensic psychiatric examination shall be implemented in accordance with the provisions of the law.
Article 9. Effective Date
1. This Circular takes effect from June 1, 2019.
2. Abolish the content "is a certificate issued by the National Forensic Medicine Institute, the Central Institute of Forensic Psychiatry, or a training institution with a Department of Forensic Medicine or a Department of Psychiatry, granted to participants in training or upgrading courses on forensic examination lasting at least three months according to the approved training program by the Ministry of Health. Those who already have a degree or certificate in forensic medicine or forensic psychiatry specialization are exempted from such training or upgrading." as stipulated in Point c Clause 1 Article 2 of Circular No. 02/2014/TT-BYT dated January 15, 2014, issued by the Minister of Health on standards, files, and procedures for appointing and dismissing forensic examiners and forensic psychiatric examiners.
Article 10. Transitional Provisions
Individuals holding a diploma in the correct specialty of forensic medicine or forensic psychiatry for postgraduate specializations, specialized orientation degrees, or short-term training certificates in forensic medicine or forensic psychiatry with a minimum duration of at least three months before this Circular takes effect but have not been appointed as forensic examiners or forensic psychiatric examiners shall be exempted from training to obtain a certificate in forensic examination and forensic psychiatric examination.
Article 11. Implementation Organization
1. The Science, Technology and Training Department of the Ministry of Health shall be responsible for organizing the implementation of this Circular.
2. The Department of Medical Examination and Treatment Management, the Cadre and Civil Servant Affairs Department, and other Departments, Bureaus, and the Inspectorate of the Ministry of Health shall be responsible for coordinating the implementation of this Circular.
3. The National Forensic Medicine Institute, the Central Institute of Forensic Psychiatry, and the Central Institute of Forensic Psychiatry in Bien Hoa under the Ministry of Health shall be responsible for the following:
a) Organizing the implementation of training and issuing Certificates of Professional Forensic Examination and Forensic Psychiatric Examination in accordance with the provisions of this Circular.
b) Reporting to the Ministry of Health (Science, Technology and Training Department) annually in December on the results of the training course, the number of trainees, the number of certificates issued, and the organization and management of training.
During the implementation of this Circular, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to report to the Ministry of Health (Science, Technology and Training Department) for consideration and resolution./.
