Amending and supplementing some articles of Circular No. 16/2014/TT-BCT dated May 29, 2014 of the Minister of Industry and Trade on the implementation of electricity selling prices

Pursuant to the Law3. Amend Clause 3 Article 2 as follows:effective from December 3, 2004and the Law amending and supplementing certain provisions of the Electricity Law on November 20, 2012;

A pumped-storage hydropower plant is a hydropower plant that uses water storage systems at different elevation levels to store hydro energy and generate electricity, where water is pumped from low-elevation storage areas to higher-elevation storage areas during non-generation periods to store hydro energy and released through turbines to generate electricity when the power system requires it."

The Prime Minister issues this Decision amending and supplementing certain Articles of Decision No.28/2014/QĐ-TTgdated April 7, 2014 of the Prime Minister stipulating the structure of retail electricity price lists;

The Prime Minister issues this Decision amending and supplementing certain Articles of Decision No.24/2017/QĐ-TTgdated June 30, 2017of the Prime Ministerstipulating the mechanism for adjusting average retail electricity prices;

At the proposal of the Director of the Electricity Regulatory Authority,

The Minister of Industry and Trade issues this Circular amending and supplementing certain articles of Circular No.16/2014/TT-BCTdated May 29, 2014 of the Minister of Industry and Trade stipulating the implementation of electricity selling prices.

Article 1. Amending and supplementing certain provisions of Circular No. 16/2014/TT-BCT dated May 29, 2014 of the Minister of Industry and Trade on implementing electricity sale prices

1. Point b Clause 1 Article 4 is amended as follows:

"b) Retail electricity units in industrial zones, clusters of industrial enterprises"

2. Point b Clause 2 Article 5 is amended as follows:

"b) Retail electricity units in industrial zones, clusters of industrial enterprises"

3. Replace the phrase "transformers and electricity consumption" with the phrase "transformers or electricity consumption" in Clause 2 Article 5.

4. The title of Clause 1 Article 6 is amended as follows:

"1. Retail electricity units in rural areas, collective residential areas, community clusters, commercial-service-living complexes, markets, industrial zones, and industrial clusters must meet the following conditions:"

5. Point b Clause 2 Article 9 is amended as follows:

"b) Electricity used for common living purposes and community living purposes for residents in high-rise apartment buildings, urban areas; pumping water for living purposes in collective residential areas, community clusters."

6. Article 11 is amended as follows:

"Article 11. Electricity selling prices at industrial zones purchasing electricity from the national power grid simultaneously with other sources of electricity

Retail electricity units in industrial zones that purchase electricity from the national power grid simultaneously with other sources of electricity (on-site power plants; purchasing electricity from on-site sources such as wind power, solar power, biomass power) to sell electricity to customers using electricity within the industrial zone shall be responsible for developing a pricing plan for electricity sales to these customer groups and submit it to the Department of Industry and Trade for review, then report to the provincial People's Committee for annual approval."

7. Clause 6 Article 14 is supplemented as follows:

"6. In cases where commercial-service-living complexes have customers using electricity for hospitals, kindergartens, primary schools, public lighting, administrative agencies, and public institutions, the wholesale electricity price at the main meter for the portion of electricity consumption of these entities not subject to the three-tier pricing system shall be regulated as follows:

a) Apply the electricity selling price for hospitals, kindergartens, primary schools, public lighting, administrative agencies, and public institutions as stipulated in Article 9 of this Circular;

b) Retail electricity units shall be responsible for coordinating with wholesale electricity suppliers to install three-tier meters to monitor actual electricity consumption and record meter readings for customers on the same day as the main meter reading to ensure accurate calculation of electricity consumption for various uses at the main meter."

8. Article 15 is amended as follows:

"Article 15. Wholesale electricity prices for industrial zones and industrial clusters

1. Wholesale electricity prices at the 110 kV busbar of the 110 kV substation apply to cases where retail electricity units purchase wholesale electricity at the 110 kV busbar of the industrial zone or industrial cluster (the 110 kV substation invested by the buyer) to sell electricity to customers using electricity within the industrial zone or industrial cluster. The wholesale electricity price for each 110 kV substation is determined based on the total capacity of the 110 kV transformers installed in the industrial zone or industrial cluster.

2. Wholesale electricity prices at the medium-voltage busbar of the 110 kV substation or at the branch point of the medium-voltage line entering the industrial zone or industrial cluster apply to cases where retail electricity units purchase wholesale electricity to sell electricity to customers using electricity within the industrial zone or industrial cluster at the medium-voltage level.

3. Wholesale electricity prices sold by the Power Company to retail electricity units at the medium-voltage side of low-voltage substations are set at the retail electricity prices applicable to production sectors at the medium-voltage level.

4. Wholesale electricity prices at the 110 kV busbar of the 220 kV substation or at the branch point of the 110 kV line entering the industrial zone or industrial cluster apply at the retail electricity prices at the 110 kV level or higher for cases where retail electricity units purchase wholesale electricity to sell electricity to customers using electricity within the industrial zone or industrial cluster at the 110 kV voltage level."

9. Clause 1 Article 16 is amended and Clause 3 Article 16 is supplemented as follows:

"1. The Electricity Regulatory Authority is responsible for:

a) Submitting to the leadership of the Ministry of Industry and Trade for issuance of a Decision stipulating electricity selling prices applicable to different categories of electricity users and for retail electricity units based on Decision No. 28/2014/QĐ-TTg dated April 7, 2014 of the Prime Minister stipulating the structure of retail electricity price lists and government and prime ministerial regulations on electricity prices.

b) Submitting to the leadership of the Ministry of Industry and Trade for issuance of guidance documents to resolve issues and problems arising during the implementation of electricity selling prices.

3. Vietnam Electricity Corporation is responsible for reporting to the Electricity Regulatory Authority the structure of electricity consumption volume and retail electricity prices for each category of electricity users annually and the forecasted structure of electricity consumption volume for the next year's category of electricity users as the basis for determining retail electricity prices for different categories of electricity users and electricity prices for retail electricity units when adjusting electricity prices."

10. Repeal the phrase "responsible for household registration" at:

a) Point c Clause 2 and point c Clause 6 Article 12;

b) Point b Clause 2 and point c Clause 6 Article 13;

c) Point c Clause 2 and point c Clause 5 Article 14.

Article 2. Effective Date

1. This Circular takes effect from September 25, 2021.

2. During the implementation process, if there are any obstacles or new issues arising, the relevant units shall report to the Electricity Regulatory Authority for consideration and resolution within their authority, or report to the Ministry of Industry and Trade for resolution./.
