DECREE
Regulations on reducing greenhouse gas emissions and protecting the ozone layer

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Environmental Protection Law dated November 17, 2020;

At the proposal of the Minister of Natural Resources and Environment;

The Government promulgates this Decree to regulate reducing greenhouse gas emissions and protecting the ozone layer.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree provides detailed provisions for certain Articles of the Environmental Protection Law, including Article 91 on reducing greenhouse gas emissions, Article 92 on protecting the ozone layer, and Article 139 on organizing and developing the carbon market.

Article 2. Applicability

This Decree applies to organizations and individuals involved in activities related to greenhouse gas emissions, reducing emissions and absorbing greenhouse gases; participating in the development of the domestic carbon market; producing, importing, exporting, consuming, and disposing of ozone-depleting substances and controlled greenhouse gases under the Montreal Protocol on Substances that Deplete the Ozone Layer.

Article 3. Explanation of Terms

1. The Intergovernmental Panel on Climate Change (IPCC) is an agency of the United Nations responsible for providing information and scientific basis regarding human-induced climate change, its impacts on nature, politics, and economy, and measures to address climate change.

2. Ozone-depleting substances and controlled greenhouse gases under the Montreal Protocol on Substances that Deplete the Ozone Layer (referred to as controlled substances) are substances and compounds listed in Appendices A, B, C, E, and F of the Montreal Protocol.

3. Industrial processes are industrial activities causing greenhouse gas emissions from non-energy chemical and physical processes; they are among the sectors required to conduct greenhouse gas inventories according to the United Nations Framework Convention on Climate Change.

4. The United Nations Framework Convention on Climate Change (UNFCCC) is an international environmental agreement aimed at minimizing human impact on the global climate system, including stabilizing greenhouse gas concentrations in the atmosphere.

5. Carbon credit trading mechanisms are mechanisms implementing registration and implementation of programs and projects to reduce greenhouse gas emissions and generate carbon credits according to internationally or domestically recognized methods. Carbon credits from these programs and projects can be traded on the carbon market or offset excess greenhouse gas emissions beyond allocated quotas.

6. Nationally Determined Contributions (NDCs) are commitments made by countries regarding climate action, including adaptation and mitigation targets, policies, and measures to address climate change to achieve the goals of the Paris Agreement.

7. Measurement, Reporting, and Verification (MRV) system for reducing greenhouse gas emissions is a system collecting, processing, managing, storing, providing, and verifying information on the implementation of greenhouse gas emission reduction measures to ensure transparency, accuracy, and verifiability.

a) Measurement is the activity of determining the amount of greenhouse gases reduced by mitigation measures according to methods recognized by competent authorities;

b) Reporting is the activity of calculating, compiling, and submitting results of measuring greenhouse gas emission reductions and related information according to guidelines, procedures, and forms issued by competent authorities;

c) Verification is the activity of evaluating reports on measurement results of greenhouse gas emission reductions and related information according to methods and procedures issued by competent authorities.

8. Business-as-usual scenario (BAU) is a scientifically-based assumption about the level of greenhouse gas emissions under normal economic and social development conditions in the future without implementing greenhouse gas emission reduction measures.

9. Greenhouse gas inventory is the activity of collecting information and data on sources of greenhouse gas emissions, calculating greenhouse gas emissions and absorption within a defined scope and specific year according to methods and procedures issued by competent authorities.

10. The Montreal Protocol on Substances that Deplete the Ozone Layer is an international agreement on protecting the ozone layer through phasing out the production and consumption of ozone-depleting substances and greenhouse gases with negative impacts on human health and the environment.

11. Rated cooling capacity is the cooling capacity of refrigeration or air conditioning equipment at standard conditions and marked on the manufacturer's label.

12. Carbon credit exchange is a center handling transactions of buying, selling carbon credits, emission quotas, auctions, loans, payments, transfers of emission quotas.

13. Recycling controlled substances is the process of using technological and technical solutions to recover components from controlled substances for reuse according to their original characteristics.

14. Reusing controlled substances is the act of using controlled substances again after cleaning without changing their properties.

15. Ton of CO₂ equivalent is the quantity of various greenhouse gases converted into tons of CO₂ based on their Global Warming Potential (GWP). The GWP of greenhouse gases is determined by the Intergovernmental Panel on Climate Change.

16. The Paris Agreement is an international agreement under the United Nations Framework Convention on Climate Change, effective from 2021, stipulating the responsibilities of member states regarding adaptation and mitigation of greenhouse gas emissions through Nationally Determined Contributions.

17. Collecting controlled substances is the activity of removing controlled substances from a system and storing them in an external container.

18. Trading emission quotas and carbon credits is the activity of buying, selling, auctioning, lending, paying, transferring emission quotas and carbon credits on the carbon credit exchange.

19. Disposing of controlled substances is the process of destroying controlled substances using technological and technical solutions to avoid negative impacts on human health and the environment.

Article 4. Principles for Reducing Greenhouse Gas Emissions and Protecting the Ozone Layer

1. Reducing greenhouse gas emissions and protecting the ozone layer must be consistent with economic and social conditions, current laws, relevant regulations, and international treaties with the aim of developing a low-carbon economy and green growth linked to sustainable development.

2. Management of activities to reduce greenhouse gas emissions must follow the principles of responsibility, unity, fairness, and transparency; the target for reducing greenhouse gas emissions shall be adjusted by the Prime Minister according to national development priorities and international treaties to which the Socialist Republic of Vietnam is a party.

3. Activities involving the exchange of greenhouse gas emission quotas and carbon credits must ensure transparency and balance the interests of subjects on the carbon market. Organizations and individuals participating in the carbon market do so voluntarily.

4. The import and export of substances that deplete the ozone layer and greenhouse gases can only be carried out with countries that are members of the Montreal Protocol, following the timelines set forth in the Protocol.

Chapter II
REDUCTION OF GREENHOUSE GAS EMISSIONS,
IMPLEMENTATION AND DEVELOPMENT OF THE CARBON MARKET

Section 1

REDUCTION OF GREENHOUSE GAS EMISSIONS

Article 5. Entities Implementing Reduction of Greenhouse Gas Emissions

1. Facilities listed in the sectors and facilities emitting greenhouse gases must conduct greenhouse gas inventories as issued by the Prime Minister.

2. Ministries managing energy, agriculture, land use, forestry, waste management, and industrial processes include the Ministry of Industry and Trade, the Ministry of Transport, the Ministry of Agriculture and Rural Development, the Ministry of Natural Resources and Environment, and the Ministry of Construction.

3. Organizations and individuals not covered under paragraph 1 of this Article are encouraged to implement measures to reduce greenhouse gas emissions in accordance with their own conditions and activities.

Article 6. Establishment and Update of Sectors and Facilities Required to Conduct Greenhouse Gas Inventories

1. Facilities emitting greenhouse gases that must conduct greenhouse gas inventories are those with annual greenhouse gas emissions of 3,000 tons of CO₂ equivalent or more, or fall into one of the following categories:

a) Thermal power plants and industrial production facilities with total annual energy consumption of 1,000 tons of oil equivalent (TOE) or more;

b) Freight transportation companies with total annual fuel consumption of 1,000 TOE or more;

c) Commercial buildings with total annual energy consumption of 1,000 TOE or more;

d) Solid waste treatment facilities with annual operating capacity of 65,000 tons or more.

2. The Ministry of Natural Resources and Environment, in collaboration with ministries specified in paragraph 2 of Article 5 of this Decree and provincial People's Committees, shall review, compile, and establish the list of sectors and facilities required to conduct greenhouse gas inventories, submitting it to the Prime Minister for issuance; every two years, they shall submit to the Prime Minister for decision on updating the list of sectors and facilities required to conduct greenhouse gas inventories.

3. Provincial People's Committees shall direct relevant specialized agencies to periodically, every two years, perform the following tasks:

a) Based on the criteria stipulated in paragraph 1 of this Article, review energy consumption data, capacity, and scale of facilities listed in the sectors and facilities emitting greenhouse gases required to conduct greenhouse gas inventories from the previous year;

b) Update and adjust the list of facilities emitting greenhouse gases required to conduct greenhouse gas inventories within their jurisdiction according to the criteria stipulated in paragraph 1 of this Article, sending it to the Ministry of Natural Resources and Environment and relevant sectoral management ministries before June 30 starting from 2023.

Article 7. Objectives, timelines, and methods for reducing greenhouse gas emissions

1. The objectives for reducing greenhouse gas emissions approved by the Prime Minister in the Nationally Determined Contribution (NDC) include reduction targets for greenhouse gas emissions in energy, agriculture, land use and forestry, waste management, and industrial processes, consistent with the country's socio-economic development conditions and international treaties to which the Socialist Republic of Vietnam is a party, detailed in Appendix I attached to this Decree.

2. The Ministry of Natural Resources and Environment shall take the lead and coordinate with relevant ministries and agencies to regularly update the Nationally Determined Contribution according to the Paris Agreement on climate change, and submit it to the Prime Minister for approval.

3. Ministries specified in Clause 2, Article 5 of this Decree shall organize the development and promulgate plans for reducing greenhouse gas emissions in their respective fields for the period up to 2030, with implementation phases until 2025; implement management measures to achieve the greenhouse gas emission reduction targets set out in the Nationally Determined Contribution.

4. Entities specified in Clause 1, Article 5 of this Decree shall implement greenhouse gas emission reductions according to their base-level emission reduction plans and the following timeline:

a) Provide information and data on base-level greenhouse gas inventory activities, develop and implement appropriate greenhouse gas emission reduction measures based on specific conditions of the entity;

b) From 2026 to 2030, conduct greenhouse gas inventories, develop and implement emission reduction plans according to quotas allocated by the Ministry of Natural Resources and Environment, consistent with greenhouse gas emission reduction targets; be permitted to trade and purchase emission quotas and carbon credits on the carbon credit trading platform.

5. Encourage new investment projects to apply technologies, production processes, and service provision methods that emit less greenhouse gases or participate in cooperation mechanisms and methods for reducing greenhouse gas emissions in accordance with laws and international treaties to which the Socialist Republic of Vietnam is a party.

6. Methods for reducing greenhouse gas emissions include:

a) Policy and management measures for reducing greenhouse gas emissions;

b) Sectoral and base-level greenhouse gas emission reduction plans;

c) Technologies and production processes, services emitting less greenhouse gases;

d) Cooperation mechanisms and methods for reducing greenhouse gas emissions in accordance with laws and international treaties to which the Socialist Republic of Vietnam is a party.

Article 8. Enhancing Greenhouse Gas Absorption

1. Organizations, households, individuals, and communities granted forest land, leased forest land, assigned land for forest planting, self-rehabilitation and development of forests, transferred, gifted, or inherited forests in accordance with the law have the responsibility to build and implement sustainable management measures to protect and enhance forest coverage, biomass, and quality to increase the capacity to absorb greenhouse gases.

2. Subjects specified in Clause 1 of this Article may participate in domestic and international carbon credit exchange mechanisms in accordance with the law and international treaties to which the Socialist Republic of Vietnam is a party.

3. The Ministry of Agriculture and Rural Development shall take the lead and coordinate with provincial People's Committees to have the responsibility to:

a) Develop objectives and timelines for implementing methods to enhance greenhouse gas absorption from sustainable forest management, protection, and enhancement of forest coverage, biomass, and quality, integrated into sectoral greenhouse gas emission reduction plans as stipulated in Clause 3, Article 13 of this Decree;

b) Collect data, calculate greenhouse gas absorption levels in forest ecosystems based on forest surveys, compiled in sectoral greenhouse gas inventory reports as stipulated in Clause 3, Article 11 of this Decree;

c) Monitor and evaluate the implementation of activities to enhance greenhouse gas absorption from sustainable forest management, protection, and enhancement of forest coverage, biomass, and quality nationwide.

4. The Ministry of Natural Resources and Environment has the responsibility:

a) Provide written comments on proposals to implement programs and projects participating in carbon credit exchange mechanisms obtained from activities enhancing greenhouse gas absorption to ensure national goals for reducing greenhouse gas emissions and international treaties to which Vietnam is a party;

b) Manage and compile the implementation status of programs and projects participating in carbon credit exchange mechanisms obtained from activities enhancing greenhouse gas absorption;

c) Compile data on greenhouse gas absorption nationwide, prepare periodic national greenhouse gas inventory reports every two years.

Article 9. National System for Measuring, Reporting, and Verifying Greenhouse Gas Emission Reductions

1. The monitoring and supervision of compliance with regulations on greenhouse gas emission reductions shall be carried out through the National System for Measuring, Reporting, and Verifying Greenhouse Gas Emission Reductions.

2. The Ministry of Natural Resources and Environment shall be the lead agency of the National System for Measuring, Reporting, and Verifying Greenhouse Gas Emission Reductions, responsible for inspecting compliance with regulations on measuring, reporting, and verifying greenhouse gas emission reductions as stipulated in Article 10 of this Decree; establishing and operating a national online database on measuring, reporting, and verifying greenhouse gas emission reductions.

3. Ministries specified in Clause 2 of Article 5 of this Decree shall be responsible for:

a) Developing and promulgating procedures and technical regulations on measuring, reporting, and verifying greenhouse gas emission reductions within their respective fields of management;

b) Guiding entities within their respective fields of management to implement measuring, reporting, and verifying greenhouse gas emission reductions;

c) Inspecting compliance with regulations on measuring, reporting, and verifying greenhouse gas emission reductions of entities specified in Clause 1 of Article 5 within their respective fields of management;

d) Establishing and operating an online database on measuring, reporting, and verifying greenhouse gas emission reductions within their respective fields of management, consistent with the national online database on measuring, reporting, and verifying greenhouse gas emission reductions as stipulated in Clause 2 of this Article.

4. Other ministries and equivalent agencies shall be responsible for:

a) Providing operational data and related information to serve national and sectoral measuring, reporting, and verifying greenhouse gas emissions at the request of the Ministry of Natural Resources and Environment and ministries specified in Clause 2 of Article 5 of this Decree;

b) Cooperating with the Ministry of Natural Resources and Environment and ministries specified in Clause 2 of Article 5 of this Decree to inspect compliance with regulations on measuring, reporting, and verifying greenhouse gas emission reductions within their respective fields of management.

5. Provincial People's Committees shall be responsible for directing relevant specialized agencies under their jurisdiction to:

a) Inspect and supervise the implementation of plans for reducing greenhouse gas emissions and compliance with regulations on measuring, reporting, and verifying greenhouse gas emission reductions of entities specified in Clause 1 of Article 5 of this Decree within their jurisdictions;

b) Provide information and operational data to serve national and sectoral measuring, reporting, and verifying greenhouse gas emissions at the request of the Ministry of Natural Resources and Environment and ministries specified in Clause 2 of Article 5 of this Decree.

6. Entities specified in Clause 1 of Article 5 of this Decree, verification units specified in Clause 1 of Article 14, and other related organizations shall be responsible for complying with regulations on measuring, reporting, and verifying greenhouse gas emission reductions; providing additional information and operational data to serve national and sectoral measuring, reporting, and verifying greenhouse gas emissions at the request of the Ministry of Natural Resources and Environment and ministries specified in Clause 2 of Article 5 of this Decree.

Article 10. Contents of Activities for Measuring, Reporting, and Verifying Greenhouse Gas Emission Reductions

1. Requirements for Measuring, Reporting, and Verifying Greenhouse Gas Emission Reductions

a) Measurement must be conducted according to the measurement, reporting, and verification procedures issued by competent authorities, ensuring the accuracy, transparency, continuity, and consistency of measurement results. Measurement methods shall be established by state management agencies based on the provisions of the United Nations Framework Convention on Climate Change, and adapted to Vietnam’s conditions;

b) Reports on greenhouse gas emission reductions must fully and accurately reflect information on measurement methods, operational data, emission factors applied, technological solutions, management approaches to reduce greenhouse gas emissions, and results of greenhouse gas emission reductions. Reports must ensure the comprehensiveness of activities to reduce greenhouse gas emissions; they shall be developed in accordance with the prescribed formats, methods, and timeframes set forth in the measurement, reporting, and verification procedures issued by competent authorities;

c) Verification of reports on greenhouse gas emission reductions shall be conducted by qualified units following procedures prescribed by the Ministry of Natural Resources and Environment, in compliance with detailed guidelines issued by ministries specified in Clause 2 of Article 5 of this Decree. Results of greenhouse gas emission reductions shall be announced by competent authorities.

2. Measurement of Greenhouse Gas Emission Reductions

a) Entities specified in Clause 1 of Article 5 of this Decree shall measure the outcomes of implementing measures to reduce greenhouse gas emissions at their facilities according to the guidance of sectoral management ministries;

b) Ministries specified in Clause 2 of Article 5 of this Decree shall organize the measurement of outcomes of implementing sectoral measures to reduce greenhouse gas emissions, including the implementation of policies, laws, strategies, programs, plans, and other measures to reduce greenhouse gas emissions within their respective jurisdictions.

3. Reports on Greenhouse Gas Emission Reductions

a) Entities specified in Clause 1 of Article 5 of this Decree shall develop annual facility-level reports on greenhouse gas emission reductions for the previous year according to Model No. 02 of Appendix III attached to this Decree, and submit them to the Ministry of Natural Resources and Environment, ministries specified in Clause 2 of Article 5 of this Decree, and relevant specialized agencies under provincial People's Committees before March 31 starting from 2027;

b) Ministries specified in Clause 2 of Article 5 of this Decree shall develop annual sectoral reports on greenhouse gas emission reductions according to Model No. 01 of Appendix III attached to this Decree, and submit them to the Ministry of Natural Resources and Environment before January 15 starting from 2024;

c) The Ministry of Natural Resources and Environment shall be responsible for reviewing and consolidating sectoral and facility-level reports on greenhouse gas emission reductions, and developing comprehensive reports on greenhouse gas emission reductions.

4. Verification of Greenhouse Gas Emission Reductions

a) 审查减排温室气体的设施级,由本决定第14条规定的实体自2026年起每年实施,按照相关部委根据本决定第5条第2款规定制定的测量、报告和审查程序执行。

b) 审查减排温室气体的行业级,由本决定第5条第2款规定的部委自2023年起每年实施,并提交自然资源与环境部汇总。

c) 审查温室气体减排综合报告由自然资源与环境部负责,与其他部委和部门协调,为准备应对气候变化的国家报告和其他关于气候变化的国家报告提供服务,这些报告是根据《联合国气候变化框架公约》作出的国际承诺。

d) 温室气体减排审查程序由自然资源与环境部部长发布。

第11条 温室气体清册

1. 温室气体清册的要求

a) 温室气体清册的方法应按照政府间气候变化专门委员会发布的温室气体清册指南应用。

b) 用于温室气体清册的数据必须确保连续性、准确性和可靠性,允许验证、比较和评估。

c) 温室气体清册报告必须全面反映清册方法、活动数据、应用的排放因子和温室气体清册的结果。

d) 温室气体清册结果的审查应遵守自然资源与环境部发布的审查程序,确保一致性和可靠性。

đ) 国家和行业层面的温室气体清册结果信息应在气候变化及相关领域的国家管理机构网站上公布。

2. 自然资源与环境部是全国温室气体清册的牵头机构,负责:

a) 领导全国温室气体清册的组织;确定行业和设施级清册周期,以确保一致性,按相关规定执行。

b) 根据政府间气候变化专门委员会的指南传播全国和行业级温室气体清册方法。

c) 协调各行业管理部门发布设施级温室气体清册方法。

d) 发布温室气体清册使用的排放因子清单。

đ) 确保全国温室气体清册的质量,指导行业级温室气体清册结果的审查,并规定设施级温室气体清册结果的审查程序。

e) 组织建设并运行温室气体清册在线数据库;更新活动数据、清册结果和相关信息到国家气候变化数据库中。

3. Ministries specified in Clause 2 of Article 5 of this Decree shall be responsible for:

a) 实施行业级温室气体清册,并根据本决定附件II附表2中的01、02、03、04、05号表格编制报告,以服务于全国温室气体清册,自2023年起在每个报告期前提交自然资源与环境部。

b) 指导并组织实施其管理范围内的设施级温室气体清册,2022年的结果应在2023年12月1日前提交自然资源与环境部。

c) 检查其管理范围内设施级温室气体清册规定的第5条第1款的合规情况。

d) 根据自然资源与环境部的要求提供补充活动数据和相关信息,以服务于全国温室气体清册。

đ) 在其管理范围内组织建设和运行温室气体清册在线数据库。

4. 根据本决定第5条第1款规定的设施应定期每两年一次承担以下责任:

a) 根据行业管理部门的指导,在2023年3月31日前提供上一年度设施级温室气体清册所需的活动数据和相关信息。

b) 实施设施级温室气体清册,编制设施级温室气体清册报告,每两年一次从2024年开始,根据本决定附件II附表2中的06号表格编制,并在2025年前提交省级人民委员会进行审查。

c) 完成设施级温室气体清册结果报告,并在每个报告期开始时于2025年12月1日前提交自然资源与环境部。

5. 行业级温室气体清册结果的审查由本决定第5条第2款规定的部委根据自然资源与环境部发布的审查程序进行。

6. 2024年及以后设施级温室气体清册结果的审查由省级人民委员会下属的相关专业机构根据自然资源与环境部发布的审查程序进行。

7. 本条第2、3、5、6款规定的温室气体清册实施费用和清册结果审查费用将从国家预算中拨付,按照国家预算管理权限分配。

Article 12. Allocation of Emission Quotas for Greenhouse Gases

1. Based on the targets and timelines for reducing greenhouse gas emissions as stipulated in Article 7 of this Decree and the results of the most recent greenhouse gas inventory conducted by the facilities specified in Clause 1 of Article 5 of this Decree, the Ministry of Natural Resources and Environment shall submit to the Prime Minister for issuance of total emission quotas for greenhouse gases, reserve quota ratios, and auctioning rates for the period from 2026 to 2030 and annually.

2. Based on the total emission quotas for greenhouse gases as stipulated in Clause 1 of this Article, the results of the most recent greenhouse gas inventory, and the implementation status of greenhouse gas emission reduction at the facility level, the Ministry of Natural Resources and Environment shall take the lead and coordinate with relevant ministries managing related sectors to establish and issue emission quotas for greenhouse gases per unit product for various types of production and business facilities specified in Clause 1 of Article 5 of this Decree for the period from 2026 to 2030 and annually.

3. The costs for implementing the allocation of emission quotas for greenhouse gases as stipulated in Clause 2 of this Article shall be allocated from the state budget according to the分级管理的国家预算。

Article 13. Plan for Reducing Greenhouse Gas Emissions

1. Requirements for plans to reduce greenhouse gas emissions:

a) Sector-level plans to reduce greenhouse gas emissions shall be developed based on the industry's or sector's development strategies, plans, and master plans; the results of the most recent greenhouse gas inventory, and typical development scenarios during the planning period;

b) Facility-level plans to reduce greenhouse gas emissions shall be developed based on the nature, scale of operations, capacity, current technology, and production and business plans of the facility; the results of the most recent greenhouse gas inventory, and projected levels of greenhouse gas emissions during the planning period;

c) Measures to reduce greenhouse gas emissions shall be selected based on the Nationally Determined Contributions or other measures that are appropriate given technological, financial conditions, readiness for application, and measurability, reporting, and verification;

d) Methods for determining the amount of greenhouse gas reductions achieved through measures to reduce greenhouse gas emissions shall be established in accordance with guidelines on methods for measuring reductions in greenhouse gas emissions recognized by the United Nations Framework Convention on Climate Change or issued by competent authorities;

đ) There shall be monitoring, supervision, and reporting mechanisms for the implementation of measures to reduce greenhouse gas emissions in compliance with regulations on measurement, reporting, and verification.

2. Ministries specified in Clause 2 of Article 5 of this Decree shall develop and approve plans to reduce greenhouse gas emissions for their respective fields up to the year 2030, including phased implementation up to the year 2025, and submit them to the Ministry of Natural Resources and Environment before January 31, 2023.

3. Sector-level plans to reduce greenhouse gas emissions shall be developed according to Model No. 01 of Appendix IV promulgated together with this Decree, including:

a) Results of the most recent greenhouse gas inventory for sectors under management;

b) Typical development scenarios and estimates of potential greenhouse gas emission reductions;

c) Targets for reducing greenhouse gas emissions annually for the period from 2023 to 2025 and from 2026 to 2030, consistent with the targets for reducing greenhouse gas emissions in the Nationally Determined Contributions;

d) Measures to reduce greenhouse gas emissions chosen in line with actual conditions, technological capabilities, available resources, and strategic environmental assessments for national industry and sectoral development strategies, national sectoral master plans, and technical and specialized plans with significant environmental impacts listed by the Government;

đ) Monitoring and supervisory mechanisms for the implementation of plans to reduce greenhouse gas emissions.

4. Facilities specified in Clause 1 of Article 5 of this Decree shall be responsible for:

a) Developing and implementing measures to reduce greenhouse gas emissions at the facility level for the period from 2023 to 2025, in line with the production and business conditions of the facility;

b) Developing and approving plans to reduce greenhouse gas emissions for the period from 2026 to 2030, adjusting and updating annually (if necessary), and submitting them to the Ministry of Natural Resources and Environment, the ministry managing the relevant field specified in Clause 2 of Article 5 of this Decree, and the relevant specialized agencies under provincial People's Committees before December 31, 2025.

5. Facility-level plans to reduce greenhouse gas emissions shall be developed according to Model No. 02 of Appendix IV promulgated together with this Decree.

a) Results of the most recent greenhouse gas inventory for the facility;

b) Projected levels of greenhouse gas emissions during the planning period without applying technologies or measures to reduce greenhouse gas emissions;

c) Targets for reducing greenhouse gas emissions annually for the period from 2026 to 2030;

d) Measures to reduce greenhouse gas emissions chosen in line with actual conditions, technological capabilities, and available resources of the facility;

đ) Monitoring and supervisory mechanisms for the implementation of plans to reduce greenhouse gas emissions.

6. Amending, supplementing, and adjusting plans to reduce greenhouse gas emissions.

a) Ministries specified in Clause 2 of Article 5 of this Decree shall amend, supplement, and adjust sector-level plans to reduce greenhouse gas emissions when there are changes stipulated in Clause 1 of this Article or when significant negative factors or risks affecting the economic and social development strategy of the industry or locality arise, and such adjustments are required by the Minister or Head of an equivalent agency;

b) Facilities specified in Clause 1 of Article 5 of this Decree shall amend, supplement, and adjust facility-level plans to reduce greenhouse gas emissions when there are changes stipulated in point b of Clause 1 of this Article or as needed by the facility owner.

7. The provincial People's Committee shall be responsible for providing data to the ministries specified in Clause 3, Article 7 of the Decree to serve the development of plans to reduce greenhouse gas emissions in the sectors specified in Clauses 2 and 3 of this Article, participate in implementing sectoral plans to reduce greenhouse gas emissions, and monitor the implementation of such plans by the entities specified in Clause 1, Article 5 of this Decree within their jurisdiction.

Article 14. Requirements for Appraisal Units

1. An appraisal unit conducting greenhouse gas emission reduction appraisals is an organization with appraisal capacity recognized by the United Nations Framework Convention on Climate Change; or certified with the TCVN ISO 14065 standard concerning requirements for organizations conducting greenhouse gas emission verification and certification for recognition purposes or other forms of acknowledgment; or has technicians certified upon completion of a course on greenhouse gas inventory verification as stipulated by the United Nations Framework Convention on Climate Change for the relevant field.

2. The appraisal unit shall conduct greenhouse gas emission reduction appraisals in accordance with the regulations of the Ministry of Natural Resources and Environment and shall be responsible for the results of such appraisals.

3. Units that wish to apply may submit Form No. 03 attached as Appendix III of this Decree to prove they meet the conditions to conduct greenhouse gas emission reduction appraisals as specified in Clause 1 of this Article to the Ministry of Natural Resources and Environment to be published on the website of the national administrative agency responsible for climate change management.

Article 15. Responsibilities for Inspecting and Supervising Greenhouse Gas Emission Reduction Activities

1. The Ministry of Natural Resources and Environment shall be responsible for managing, inspecting, and supervising greenhouse gas emission reduction activities; inspecting and supervising the appraisal activities of units specified in Clause 1 of Article 14 of this Decree.

2. Ministries specified in Clause 2, Article 5 of this Decree shall inspect and supervise greenhouse gas emission reduction activities of entities required to conduct greenhouse gas inventories within their respective fields of management.

3. Specialized agencies under the provincial People's Committees related to the inspection and supervision of greenhouse gas emission reduction activities of entities specified in Clause 1, Article 5 of this Decree within their jurisdiction shall cooperate with the ministries specified in Clause 2, Article 5 of this Decree.

Section 2
DEVELOPMENT OF THE DOMESTIC CARBON MARKET
INTRA-COUNTRY CARBON MARKET

Article 16. Participants in the Domestic Carbon Market

1. Entities falling under the category specified in Clause 1, Article 5 of this Decree.

2. Organizations participating in domestic and international carbon credit trading mechanisms in compliance with laws and international treaties to which the Socialist Republic of Vietnam is a party.

3. Other organizations and individuals involved in activities related to investment and trading in greenhouse gas emission quotas and carbon credits on the carbon market.

Article 17. Development Roadmap and Implementation Timeline for the Domestic Carbon Market

1. Until the end of 2027

a) Establish regulations governing carbon credit management, greenhouse gas emission quota trading, and carbon credit activities; develop operational rules for the carbon credit trading platform;

b) Implement pilot programs for carbon credit trading and offset mechanisms in potential sectors and provide guidance on implementing domestic and international carbon credit trading and offset mechanisms in compliance with laws and international treaties to which the Socialist Republic of Vietnam is a party;

c) Establish and operate a pilot carbon credit trading platform from 2025;

d) Enhance capacity and raise awareness about developing the carbon market.

2. From 2028

a) Officially operate the carbon credit trading platform in 2028;

b) Specify activities connecting and facilitating domestic carbon credit trading with regional and global markets.

Article 18. Confirmation of carbon credits and greenhouse gas emission quotas traded on the domestic carbon market exchange transactions on the intra-country carbon market trading platform

1. The Ministry of Natural Resources and Environment shall confirm carbon credits and greenhouse gas emission quotas traded on the exchange, including:

a) The amount of carbon credits obtained from programs and projects under the domestic and international carbon credit trading and offset mechanisms in accordance with the provisions of the law and international treaties to which the Socialist Republic of Vietnam is a party;

b) Greenhouse gas emission quotas allocated as provided for in Clause 2, Article 12 of this Decree.

2. Procedures and formalities for confirmation

a) Organizations and individuals wishing to have their carbon credits and greenhouse gas emission quotas traded confirmed pursuant to Clause 1 of this Article shall submit an application form No. 01 attached as Appendix V of this Decree to the Ministry of Natural Resources and Environment through the online public service system to obtain confirmation;

b) Within fifteen working days, the Ministry of Natural Resources and Environment shall organize verification, issue a confirmation certificate, and notify the organization or individual; if a confirmation certificate is not issued, the reasons must be clearly stated.

3. The confirmation certificate for carbon credits and greenhouse gas emission quotas traded shall be in Form No. 02 attached as Appendix V of this Decree.

Article 19. Trading of greenhouse gas emission quotas and carbon credits on the domestic carbon market

1. The trading of greenhouse gas emission quotas and carbon credits shall be conducted on the carbon credit exchange and domestic carbon market in accordance with the regulations.

2. Greenhouse gas emission quotas and carbon credits for trading

a) Greenhouse gas emission quotas specified in Clause 2, Article 12 shall be traded on the exchange. One unit of greenhouse gas emission quota equals one ton of CO₂ equivalent;

b) Carbon credits obtained from programs and projects under the carbon credit trading and offset mechanism may be converted into offset units for greenhouse gas emission quotas on the exchange. One carbon credit equals one ton of CO2 equivalent.

3. Auctioning, transfer, borrowing, repayment of greenhouse gas emission quotas, and using carbon credits to offset greenhouse gas emissions

a) Facilities may auction to acquire additional greenhouse gas emission quotas beyond the allocated quota for the same commitment period;

b) Facilities may transfer unused greenhouse gas emission quotas from the previous year to subsequent years within the same commitment period;

c) Facilities may borrow greenhouse gas emission quotas allocated for the following year to use in the preceding year within the same commitment period;

d) Facilities may use carbon credits from projects under carbon credit trading and offset mechanisms to offset excess greenhouse gas emissions over the allocated quota for the same commitment period. The quantity of carbon credits used for offsetting shall not exceed ten percent of the total allocated greenhouse gas emission quotas for the facility;

d) Allocated greenhouse gas emission quotas will automatically be recovered by the Ministry of Natural Resources and Environment when facilities cease operations, dissolve, or go bankrupt;

e) The State encourages facilities to voluntarily repay unused greenhouse gas emission quotas to contribute to the national goal of reducing greenhouse gas emissions;

g) At the end of each commitment period, facilities must pay for the excess greenhouse gas emissions over the allocated quota after applying auctioning, transfer, borrowing, and using carbon credits for offsetting. In addition to paying for the excess emissions, the amount exceeding the allocated quota will be deducted from the allocation for the next commitment period;

h) The Ministry of Natural Resources and Environment shall guide the auctioning, transfer, borrowing, and repayment of greenhouse gas emission quotas.

Article 20. Registration of Programs and Projects under the Mechanism of Carbon Credit Exchange and Offset

1. Subjects establishing and implementing programs and projects under the mechanism of carbon credit exchange and offset

a) Vietnamese organizations with the need to establish and implement programs and projects;

b) Foreign organizations with the need to establish and implement programs and projects on the territory of Vietnam.

2. The subjects specified in Clause 1 of this Article shall submit registration applications for approval of programs and projects under the mechanism of carbon credit exchange and offset within the framework of the United Nations Framework Convention on Climate Change, treaties, and international agreements to which the Socialist Republic of Vietnam is a party, to the Ministry of Natural Resources and Environment through one of the following methods: direct submission, online submission, or postal service. The application for project approval includes:

a) An application form for program and project approval according to Model No. 03 attached as Appendix V to this Decree;

b) Program and project documentation prepared in accordance with guidelines issued by the Ministry of Natural Resources and Environment, consistent with the provisions of the United Nations Framework Convention on Climate Change, treaties, and international agreements to which the Socialist Republic of Vietnam is a party;

c) A technical report or an independent assessment report of the program and project in accordance with guidelines issued by the Ministry of Natural Resources and Environment, consistent with the provisions of the United Nations Framework Convention on Climate Change, treaties, and international agreements to which the Socialist Republic of Vietnam is a party;

d) A copy from the original record or a certified copy of various permits and related documents concerning the specialized activities of the program and project in accordance with current regulations.

3. Evaluation and Approval of Programs and Projects under the Mechanism of Carbon Credit Exchange and Offset within the Framework of the United Nations Framework Convention on Climate Change, Treaties, and International Agreements to Which the Socialist Republic of Vietnam is a Party.

a) Within five working days from the date of receipt of the application, the Ministry of Natural Resources and Environment will notify the organization of one of the following situations: acceptance of a valid application; request for supplementation or completion of the application or rejection if the application is invalid. The deadline for supplementing or completing the application is not more than fifteen working days from the date of the written notification requesting supplementation or completion of the application;

b) Within thirty working days from the date of receipt of a valid application, the Ministry of Natural Resources and Environment will organize the evaluation of the application for program and project approval through soliciting opinions from relevant agencies. The agency solicited must provide a written response within a maximum of seven working days from the date of receipt of the solicitation letter accompanying the application;

c) Within three working days from the date of the evaluation result, the Minister of Natural Resources and Environment will consider and decide on the approval of the program and project and notify the applying organization; in case of non-approval, the reasons must be clearly stated.

4. The Minister of Natural Resources and Environment shall stipulate the organization of the evaluation of programs and projects under the mechanism of carbon credit exchange and offset within the framework of the United Nations Framework Convention on Climate Change, and designate the specialized agency managing climate change as the permanent evaluation agency.

5. The subjects specified in Clause 1 of this Article shall implement programs and projects under the mechanism of carbon credit exchange and offset outside the framework of the United Nations Framework Convention on Climate Change, treaties, and international agreements to which the Socialist Republic of Vietnam is a party on its territory shall be responsible for:

a) When registering programs and projects, they must send registration information to the Ministry of Natural Resources and Environment according to Model No. 04 of Appendix V issued together with this Decree;

b) During the implementation process of the program and project, they must provide annual updates on the implementation status to the Ministry of Natural Resources and Environment before December 31 each year according to Model No. 05 of Appendix V issued together with this Decree.

Article 21. Responsibilities for Developing the Domestic Carbon Market

1. The Ministry of Finance shall take the lead in establishing a carbon credit trading platform and issuing financial management mechanisms for the operation of the carbon market.

2. The Ministry of Natural Resources and Environment shall take the lead and coordinate with relevant ministries to organize pilot operations and formal operations of the carbon credit trading platform to serve the management and monitoring of the carbon market; stipulate activities connecting the domestic carbon credit trading platform with regional and global carbon markets; stipulate the implementation of exchange and offset mechanisms for carbon credits; develop promotional materials and implement capacity-building activities for participants in the carbon market.

3. Ministries, ministerial-level agencies, and provincial People's Committees shall be responsible for coordinating with the Ministry of Natural Resources and Environment and the Ministry of Finance to implement the provisions of Clause 1 and Clause 2 of this Article and activities promoting the development of the carbon market; organize dissemination and promotion through mass media to raise public awareness about the carbon market.

Chapter III
PROTECTION OF THE OZONE LAYER

Article 22. Substances that Deplete the Ozone Layer and the Phasedown Schedule for Such Substances

1. Substances that deplete the ozone layer include:

a) Bromochloromethane;

b) Carbon tetrachloride (hereinafter referred to as CTC);

c) Chlorofluorocarbons (hereinafter referred to as CFC);

d) Halons;

e) Hydrobromofluorocarbons (hereinafter referred to as HBFC);

f) Hydrochlorofluorocarbons (hereinafter referred to as HCFC);

g) Methyl bromide;

h) Methyl chloroform.

2. The phasedown schedule for HCFC substances is as follows:

a) From January 1, 2022 to December 31, 2024: total national consumption shall not exceed 65% of the base consumption level;

b) From January 1, 2025 to December 31, 2029: total national consumption shall not exceed 32.5% of the base consumption level;

c) From January 1, 2030 to December 31, 2039: average annual national consumption shall not exceed 2.5% of the base consumption level;

d) From January 1, 2040: importation and exportation of HCFC substances shall be prohibited.

3. Total national consumption of HCFC substances shall be determined based on the quantity of HCFC substances imported minus the quantity exported. The base consumption level of HCFC substances converted according to their ozone-depleting potential is 221.2 tons.

4. Methyl bromide may only be imported for quarantine and disinfection purposes for exported goods.

5. Prohibited acts under Clause 11, Article 6 of the Environmental Protection Law include:

a) Producing, importing, temporarily importing, re-exporting, and consuming Bromochloromethane, CTC, CFC, Halon, HBFC, Methyl chloroform, and HCFC 141b;

b) Producing, importing, temporarily importing, re-exporting, and consuming products or equipment containing or produced from Bromochloromethane, CTC, CFC, Halon, HBFC, Methyl chloroform, and HCFC 141b;

c) Producing, importing, and consuming products or equipment containing or produced from banned controlled substances;

d) Producing, importing, and consuming banned controlled substances as prescribed by the Ministry of Natural Resources and Environment.

Article 23. Greenhouse Gas-Inducing Substances to be Controlled and the Phased Management and Elimination of Such Substances

1. Greenhouse gas-inducing substances to be controlled are Hydrofluorocarbons (hereinafter referred to as HFCs).

2. The phased management and elimination of HFCs shall proceed as follows:

a) From January 1, 2024 to December 31, 2028: the national consumption volume shall not exceed the baseline consumption level; the national production volume shall not exceed the baseline production level;

b) From January 1, 2029 to December 31, 2034: the national consumption volume shall not exceed 90% of the baseline consumption level; the national production volume shall not exceed 90% of the baseline production level;

c) From January 1, 2035 to December 31, 2039: the national consumption volume shall not exceed 70% of the baseline consumption level; the national production volume shall not exceed 70% of the baseline production level;

d) From January 1, 2040 to December 31, 2044: the national consumption volume shall not exceed 50% of the baseline consumption level; the national production volume shall not exceed 50% of the baseline production level;

đ) From January 1, 2045: the national consumption volume shall not exceed 20% of the baseline consumption level; the national production volume shall not exceed 20% of the baseline production level.

3. National Consumption Volume of HFCs

a) The national production volume of HFCs is determined based on the amount of HFCs produced minus the amount of HFCs destroyed, converted to equivalent CO₂ volume;

b) The national import volume of HFCs is determined based on the amount of HFCs imported minus the amount of HFCs exported, converted to equivalent CO₂ volume;

c) The national consumption volume of HFCs is determined based on the sum of the national production volume of HFCs and the national import volume of HFCs as specified in points a and b of this clause.

4. Baseline Consumption and Production Levels of HFCs

a) The baseline consumption level of HFCs is determined based on the average consumption level of HFCs converted to equivalent CO₂ volume for the years 2020, 2021, and 2022 plus 65% of the baseline consumption level of HCFCs as stipulated in Clause 3, Article 22 of this Decree, converted to equivalent CO₂ volume;

b) The baseline production level of HFCs is determined based on the average production level of HFCs converted to equivalent CO₂ volume for the years 2020, 2021, and 2022.

5. The Minister of Natural Resources and Environment shall announce the baseline production and consumption levels of HFCs in Vietnam before December 31, 2023; periodically announce the national consumption volume according to the phases specified in Clause 2 of this Article.

Article 24. Registration and Reporting of Usage of Controlled Substances

1. Entities required to register production, export, import; production, import, ownership of equipment, products containing or produced from controlled substances; collection, recycling, reuse, and disposal of controlled substances (hereinafter collectively referred to as organizations using controlled substances) include:

a) Organizations engaged in the production of controlled substances;

b) Organizations engaged in the export, import of controlled substances;

c) Organizations producing, importing equipment, products containing or produced from controlled substances;

đ) Organizations providing services for the collection, recycling, reuse, and disposal of controlled substances.

d) Organizations owning equipment containing controlled substances: air conditioning units with a rated cooling capacity greater than 26.5 kW (90,000 BTU/h) and a total rated cooling capacity of all such equipment exceeding 586 kW (2,000,000 BTU/h); industrial refrigeration equipment with power exceeding 40 kW.

2. Entities as defined in Clause 1 of this Article shall submit one set of application forms for the use of controlled substances (hereinafter referred to as the application form) to the Ministry of Natural Resources and Environment before December 31, 2022, through one of the following methods: direct submission, online submission, or postal service. In cases where the application form is submitted via postal service, the receipt date will be based on the postmark.

3. The application form includes:

a) An application form for the use of controlled substances according to Model No. 01 of Appendix VI issued together with this Decree: one original copy;

b) A document proving the legal status of the registering organization in accordance with the law: one certified copy stamped with the seal of the registering organization.

4. Within three working days from the date of receiving the application form, the Ministry of Natural Resources and Environment shall notify the registering organization about the acceptance of a valid application form or request for additional or completed information. The deadline for supplementing or completing the application form is no more than five working days from the date of notification requesting such action.

5. Within ten working days from the date of receiving a valid application form, the Ministry of Natural Resources and Environment shall compile, evaluate the application form, and publish information about organizations that have completed the registration process for the use of controlled substances on the electronic information website of the state management agency for climate change.

6. Entities as defined in Clause 1 of this Article shall be responsible for submitting reports on the usage of controlled substances to the Ministry of Natural Resources and Environment annually by January 15 through direct submission, online submission, or postal service according to Model No. 02 of Appendix VI issued together with this Decree. In cases where the report is submitted via postal service, the receipt date will be based on the postmark.

7. Entities established and operating after December 31, 2022, as defined in Clause 1 of this Article shall be responsible for completing the registration procedures and reporting on the usage of controlled substances as stipulated in this Article.

Article 25. Requirements for Allocation, Adjustment, and Supplement of Production and Import Quotas for Controlled Substances

1. The production and import quotas applicable to controlled substances as specified in point e, Clause 1, Article 22 and Clause 1, Article 23 of this Decree shall be applied.

2. The quotas allocated annually to organizations shall not exceed the national consumption volume of controlled substances.

3. The allocation of production and import quotas for controlled substances to organizations each year shall be determined based on quota management requirements, usage needs, and the average usage volume of the organization over the last three years. The total allocated quota volume shall not exceed 80% of the quota volume prescribed in Clause 2 of this Article.

4. The allocation of remaining quota volumes shall be carried out in the following priority order:

a) Organizations using controlled substances with low global warming potential that have additional quota needs. The value of low global warming potential is determined based on Vietnam's National Plan for Management and Elimination of Controlled Substances;

b) Organizations registering after December 31, 2022;

c) Organizations already allocated quotas that have additional quota needs.

5. Organizations allocated quotas may only use the allocated quotas within the year they are allocated.

6. The allocation of production and import quotas for controlled substances to organizations registering after December 31, 2022 shall be determined based on an assessment of the application for quota usage needs, company capability documentation, and balancing against the remaining national quota.

7. Organizations using greenhouse gas substances with low global warming potential shall be considered for supplementary production and import quotas based on ranking according to their equivalent CO2 consumption volume ratio over the last three years.

8. Adjustments and supplements to quotas shall be carried out based on the request of organizations allocated quotas, the usage situation of allocated quotas by organizations, and balancing against the remaining national quota.

9. Organizations importing controlled substances under allocated quotas but subsequently exporting them shall be considered for supplementary import quotas not exceeding the exported quantity.

Article 26. Procedures and Formalities for Allocation, Adjustment, Supplement, and Revocation of Production and Import Quotas for Controlled Substances

1. Organizations engaged in the production and import of controlled substances as stipulated in points a and b, Clause 1, Article 24 of this Decree shall be considered for allocation of production and import quotas for controlled substances.

2. Based on the provisions of Articles 24 and 25 of this Decree, within thirty working days, the Ministry of Natural Resources and Environment shall consider and decide on the allocation of production and import quotas for organizations according to Model No. 03A of Appendix VI issued together with this Decree through the following activities:

a) Reviewing and evaluating registration information and reports on the usage status of controlled substances by organizations;

b) Comparing the national consumption volume with targets and management requirements for controlled substances;

c) Conducting on-site inspections to verify registration information, evaluate technical and technological production capacity documentation when necessary;

d) Seeking written opinions from the Ministry of Industry and Trade regarding the proposed quota allocation. The time for the Ministry of Industry and Trade to provide comments shall not exceed ten working days from the date of receipt of the opinion solicitation letter.

3. Organizations requiring adjustments and supplements to production and import quotas for controlled substances shall submit requests according to Model No. 04 of Appendix VI issued together with this Decree to the Ministry of Natural Resources and Environment via direct submission, online, or postal service before July 10 each year. Adjustments and supplements to quotas shall be carried out according to the allocation procedures. The Ministry of Natural Resources and Environment shall consider and decide on adjustments and supplements to production and import quotas within thirty working days according to Model No. 03B of Appendix VI issued together with this Decree.

4. Within three working days, the specialized management agency for climate change shall notify organizations of the allocation, adjustment, and supplement of production and import quotas for controlled substances according to Models No. 05A and No. 05B of Appendix VI issued together with this Decree.

5. The decision on allocation, adjustment, and supplement of import quotas serves as the basis for the Ministry of Finance to control export and import activities. Import organizations shall submit the following documents to customs authorities after completing import procedures:

a) One original copy of the notification of allocation, adjustment, and supplement of import quotas for controlled substances from the specialized management agency for climate change;

b) Other documents as required by laws on customs.

When the National Single Window system is connected, quota tracking and deduction shall be conducted through the National Single Window system.

6. The Ministry of Natural Resources and Environment shall decide to revoke the allocation of production and import quotas for controlled substances according to Model No. 06 of Appendix VI issued together with this Decree in the following cases:

a) Providing incorrect information in the report as specified in point b, Clause 1 of this Article;

b) Transferring or improperly using decisions on allocation, adjustment, and supplement of production and import quotas for controlled substances;

c) Other violations as prescribed by law.

Within three working days from the date of the decision to revoke the allocation of quotas, the specialized management agency for climate change shall notify relevant agencies and organizations about the revocation of the allocation of production and import quotas for controlled substances.

7. The Ministry of Natural Resources and Environment shall designate the specialized management agency for climate change to conduct reviews, evaluations, and summaries of registration, reporting, and other activities related to the allocation, adjustment, supplement, and revocation of production and import quotas for controlled substances.

8. The Ministry of Natural Resources and Environment shall coordinate with relevant state management agencies to connect the National Single Window system with the online public service system within their jurisdiction to implement the allocation and management of export and import quotas for controlled substances through the system before June 30, 2022.

Article 27. National Plan on Management and Elimination of Ozone-Depleting Substances and Controlled Greenhouse Gas Emissions

1. The national plan on management and elimination of ozone-depleting substances and controlled greenhouse gas emissions must be consistent with international commitments on protecting the ozone layer that the Socialist Republic of Vietnam is a member of; and consistent with the conditions for managing and eliminating ozone-depleting substances and controlled greenhouse gas emissions in Vietnam.

2. The main contents of the national plan on management and elimination of ozone-depleting substances and controlled greenhouse gas emissions include:

a) Assessment of the current status of use, management, and elimination of ozone-depleting substances and controlled greenhouse gas emissions; forecasting trends in change; objectives, timelines, and targets of the plan;

b) Types and total quantities of ozone-depleting substances and controlled greenhouse gas emissions by phase and by sector of use;

c) Measures for managing and eliminating ozone-depleting substances and controlled greenhouse gas emissions; cooperation solutions and information sharing;

d) Responsibilities of organizations, individuals, and related parties in implementing and deploying the plan.

3. The Ministry of Natural Resources and Environment shall take the lead and coordinate with ministries, ministerial-level agencies, and government agencies to develop and submit to the Prime Minister for issuance the national plan on management and elimination of ozone-depleting substances and controlled greenhouse gas emissions before December 31, 2023.

Article 28. Collection, Recycling, Reuse, and Disposal of Controlled Substances

1. Organizations producing, importing equipment or products containing or produced from controlled substances; owning equipment containing controlled substances as specified in points c and d of Clause 1, Article 24 of this Decree shall carry out collection, recycling, reuse, and disposal of controlled substances according to the following principles:

a) Mandatory collection of controlled substances when they are no longer used in equipment or products starting from January 1, 2024;

b) Encouragement of recycling and reuse of collected controlled substances;

c) In cases where recycling and reuse of controlled substances are not carried out, the organization must dispose of them for destruction in accordance with the laws on hazardous waste management;

d) Annual reporting on the use of controlled substances in accordance with Clause 6, Article 24 of this Decree.

2. Collection, transportation, and storage of controlled substances shall be carried out as follows:

a) Controlled substances generated during installation, repair, and maintenance of individual products or equipment shall be collected, transported, and stored in accordance with this Decree;

b) For cases where collected controlled substances can be recycled or reused, recycling and reuse shall be carried out in accordance with regulations of the Ministry of Natural Resources and Environment;

c) For cases where recycling or reuse is not possible, transportation, storage, and disposal shall be carried out in accordance with laws on hazardous waste management.

3. Collection, transportation, and storage of controlled substances must meet the following requirements:

a) Having minimum equipment for collecting controlled substances including recovery machines, recovery tanks, vacuum pumps, weighing scales, leakage detection devices, pressure gauges, and safety tools;

b) Having technicians meeting the requirements set forth in Clause 4 of this Article;

c) Having safe collection, transportation, and storage procedures in accordance with regulations of the Ministry of Natural Resources and Environment.

4. Technicians installing, operating, maintaining, and repairing equipment containing controlled substances must have appropriate certificates or diplomas; or be certified upon completion of training courses on collection and disposal of controlled substances organized by the Ministry of Labor, Invalids, and Social Affairs in coordination with the Ministry of Natural Resources and Environment.

5. Individuals owning equipment or products containing or produced from controlled substances who no longer use them shall be responsible for transporting them to designated collection points without altering the shape of the equipment or products or transferring them to entities authorized to collect, transport, and dispose of such substances in accordance with regulations.

6. The Ministry of Natural Resources and Environment shall develop and issue national technical standards on collection, transportation, storage, recycling, reuse, and disposal of controlled substances before October 31, 2023.

Article 29. Responsibilities in Managing Controlled Substances

1. The Ministry of Natural Resources and Environment is the national focal agency implementing the Vienna Convention and the Montreal Protocol, responsible to the Government for state management of controlled substances. The Ministry of Natural Resources and Environment shall be responsible for leading and coordinating with relevant ministries and sectors:

a) Implementing the management of controlled substances according to international treaties on ozone layer protection to which Vietnam is a party; allocating, adjusting, and supplementing quotas for production and import of HCFCs and HFCs by stages and annually;

b) Developing and submitting to the Prime Minister for issuance the National Plan on managing and phasing out controlled substances; submitting to competent authorities for promulgation, amendment, and supplementation of the list and guidelines for the use of controlled substances and regulations on conditions for producing and using controlled substances in accordance with commitments under international treaties on ozone layer protection to which the Socialist Republic of Vietnam is a party;

c) Announcing, amending, and supplementing the list of prohibited export and import goods; the list of goods permitted for export and import subject to conditions based on commodity codes within the scope of management, in coordination with the Ministry of Industry and Trade regarding the list of goods and in coordination with the Ministry of Finance regarding commodity codes;

d) Building and operating an online public service system for registration, reporting, allocation, and management of quotas for production and import of controlled substances; connecting the National Single Window portal for managing controlled substances;

đ) Organizing the implementation of the State's obligations under the Montreal Protocol; coordinating with focal agencies of other countries in implementing measures to comply with the Montreal Protocol by Vietnam;

e) Conducting inspections, checks, and supervision of registration, reporting, and quota usage; managing the collection, reuse, recycling, and disposal of controlled substances;

g) Implementing tasks assigned according to the Environmental Protection Law, this Decree, and other related tasks concerning the management of controlled substances.

2. The Ministry of Industry and Trade is responsible for coordinating with the Ministry of Natural Resources and Environment in allocating, adjusting, and supplementing quotas for import and production of controlled substances; providing opinions on lists of goods prohibited from export and import and goods allowed for export and import subject to conditions within the scope of management.

3. The Ministry of Agriculture and Rural Development is responsible for leading and coordinating with the Ministry of Natural Resources and Environment and relevant ministries and equivalent agencies:

a) Implementing the management and issuing permits for exporting and importing methyl bromide for purposes specified in Clause 4, Article 22 of this Decree;

b) Connecting the National Single Window portal with the online public service system for managing methyl bromide by the Ministry of Agriculture and Rural Development;

c) Providing and sharing information and data on controlled substances within the scope of management to the national focal agency for compilation and construction of the national report on the implementation of the Montreal Protocol in Vietnam before January 30 each year according to Model No. 07 of Appendix VI issued together with this Decree and when requested by the national focal agency.

4. The Ministry of Finance is responsible for leading and coordinating with the Ministry of Natural Resources and Environment and relevant ministries and equivalent agencies:

a) Coordinating the management and control of exports and imports of controlled substances through the National Single Window portal;

b) Providing and sharing customs information and data on activities of exporting and importing controlled substances and goods containing controlled substances within the scope of management to the national focal agency for compilation and construction of the national report on the implementation of the Montreal Protocol in Vietnam before January 30 each year according to Model No. 08 of Appendix VI issued together with this Decree and when requested by the national focal agency.

5. The Ministry of Labor, Invalids, and Social Affairs coordinates with the Ministry of Natural Resources and Environment:

a) Building and implementing training programs, capacity building, certification issuance for individuals working in fields related to controlled substances before December 31, 2022;

b) Incorporating content related to controlled substances into minimum knowledge requirements and competency standards for graduates of secondary vocational education and higher vocational education in fields related to controlled substances;

c) Issuing national technical regulations on occupational safety for refrigeration systems and air conditioning systems before December 31, 2023.

6. The Ministry of Public Security, the Ministry of Industry and Trade, the Ministry of Defense, and relevant ministries and sectors, and provincial People's Committees within their respective jurisdictions coordinate with the Ministry of Natural Resources and Environment in preventive work and detection of violations of laws on managing, controlling, reducing the use, and phasing out controlled substances.

7. Provincial Departments of Natural Resources and Environment coordinate with relevant ministries and equivalent agencies:

a) Supervising the implementation of phasing out and regulations on collecting, recycling, reusing, or disposing of controlled substances by organizations under their jurisdiction;

b) Providing information and data related to organizations using controlled substances under their jurisdiction upon request of competent state authorities;

c) Handling cases of violation of regulations on managing and phasing out controlled substances within their authority or reporting to competent authorities according to this Decree and relevant laws.

Chapter IV
MEASURES TO PROMOTE ACTIVITIES TO REDUCE GREENHOUSE GAS EMISSIONS AND PROTECT THE OZONE LAYER
GREENHOUSE GAS EMISSIONS AND OZONE LAYER PROTECTION

Article 30. Building and implementing cooperation mechanisms and methods

1. The Ministry of Natural Resources and Environment is the national focal point for implementing international conventions and treaties on reducing greenhouse gas emissions and protecting the ozone layer, responsible for leading negotiations to build, implement, and provide information on the implementation of cooperation mechanisms and methods according to the provisions of international conventions and treaties on reducing greenhouse gas emissions and protecting the ozone layer to which the Socialist Republic of Vietnam is a member.

2. Ministries, ministerial-level agencies, political-social organizations, and provincial People's Committees shall develop and implement bilateral and multilateral cooperation programs and projects on reducing greenhouse gas emissions and protecting the ozone layer.

Article 31. Scientific research and technological development

1. Scientific research, technological development, and technology transfer for reducing greenhouse gas emissions and protecting the ozone layer shall be carried out in accordance with the laws on science and technology.

2. The Ministry of Science and Technology, the Ministry of Natural Resources and Environment, and relevant ministries and sectors shall implement scientific research activities, technological development, and application and technology transfer related to reducing greenhouse gas emissions and protecting the ozone layer to ensure national, sectoral, and field objectives at each stage.

Article 32. Strengthening capacity and raising awareness

1. Ministries, ministerial-level agencies, and provincial People's Committees shall organize dissemination and propaganda through mass media, enhance international cooperation to improve community capacity and raise awareness about reducing greenhouse gas emissions and protecting the ozone layer, and mobilize public participation in these efforts.

2. Measures to strengthen capacity and raise awareness include:

a) Enhancing the capacity of state management officials responsible for reducing greenhouse gas emissions and protecting the ozone layer;

b) Training and developing a specialized workforce for greenhouse gas inventory, measurement, reporting, and verification of greenhouse gas emission reductions for facilities, sectors, and localities; technicians for installation, operation, maintenance, and repair of equipment containing controlled substances;

c) Popularizing knowledge on reducing greenhouse gas emissions and protecting the ozone layer through the education system at all levels and mass media;

d) Incorporating content promoting activities to reduce greenhouse gas emissions and protect the ozone layer into the activities of scientific and technical associations, political-social-professional organizations, social-professional organizations, and other organizations;

đ) Organizing exhibitions of products and technologies, and holding creative competitions on reducing greenhouse gas emissions and protecting the ozone layer.

Article 33. Encouraging activities to reduce greenhouse gas emissions and protect the ozone layer

1. Activities to reduce greenhouse gas emissions and destroy greenhouse gases are subject to the mechanism of cooperation, exchange, and carbon credit offsetting as stipulated in Article 20 of this Decree.

2. Organizations and individuals engaged in researching, applying, transferring, and developing technologies to reduce greenhouse gas emissions and protect the ozone layer, using climate-friendly substitutes shall enjoy incentives under the laws on science and technology.

3. Organizations and individuals implementing technology conversion aimed at reducing greenhouse gas emissions and protecting the ozone layer; providing services for collecting and processing controlled substances shall enjoy incentives and support as stipulated in Article 141 of the Environmental Protection Law and related guiding documents.

Chapter V

IMPLEMENTING PROVISIONS

Article 34. Effective Date

1. This Decree takes effect from January 7, 2022.

2. Organizations allocated import quotas for HCFCs before the effective date of this Decree; organizations that have registered import quotas for HCFCs for 2022 do not need to follow the registration procedures as stipulated in Clause 1, Article 24 of this Decree.

Article 35. Responsibility for Implementation

1. The Minister of Natural Resources and Environment is responsible for guiding, inspecting, and organizing the enforcement of this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities shall be responsible for implementing this Decree.

Điều 1. Phân bổ hạn ngạch sản xuất, nhập khẩu các chất làm suy giảm tầng ô-dôn, chất gây hiệu ứng nhà kính được kiểm soát trong khuôn khổ Nghị định thư Montreal về các chất làm suy giảm tầng ô-dôn cho các tổ chức có tên tại các Phụ lục kèm theo Quyết định này.

Điều 2. Trách nhiệm của tổ chức được phân bổ hạn ngạch

1. Sử dụng các chất được kiểm soát theo đúng lượng hạn ngạch trong năm được phân bổ.

2. Tuân thủ nghĩa vụ về báo cáo đối với chất được kiểm soát đã được phân bổ hạn ngạch sản xuất, nhập khẩu trước ngày 15 tháng 01 hằng năm.

3. Tuân thủ các quy định pháp luật có liên quan đến hoạt động sử dụng các chất được kiểm soát.

- Trường hợp doanh nghiệp xuất khẩu các chất được kiểm soát đề nghị bổ sung hạn ngạch nhập khẩu, đề nghị cung cấp thông tin và tờ khai hải quan về hoạt động xuất khẩu đã thực hiện để làm cơ sở xem xét, bổ sung hạn ngạch nhập khẩu.
