Circular No. 06/2024/TT-BNV amends and supplements certain provisions of Circular No. 12/2022/TT-BNV dated December 30, 2022, issued by the Minister of Home Affairs guiding positions for civil servant leadership and management; common professional tasks; support and service in administrative agencies and organizations and positions for common professional job titles; support and service in public institutions.

Amending and supplementing certain provisions of Circular No. 12/2022/TT-BNV dated December 30, 2022, issued by the Minister of Home Affairs guiding positions for civil servants in leadership and management roles; common professional duties; support and service in administrative agencies and organizations; and positions for common professional titles and occupations; support and service in public service units.

Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 62/2020/NĐ-CP dated June 1, 2020, of the Government, on positions and staffing of civil servants;

Pursuant to Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on job positions and staffing levels in public service units;

The Minister of Home Affairs issues this Circular to amend and supplement certain provisions of Circular No. 12/2022/TT-BNV dated December 30, 2022, issued by the Minister of Home Affairs guiding positions for civil servants in leadership and management roles; common professional duties; support and service in administrative agencies and organizations; and positions for common professional titles and occupations; support and service in public service units.

Article 1. Amending and supplementing Articles 4, 5, and 6 of Circular No. 12/2022/TT-BNV dated December 30, 2022, issued by the Minister of Home Affairs guiding positions for civil servants in leadership and management roles; common professional duties; support and service in administrative agencies and organizations; and positions for common professional titles and occupations; support and service in public service units.

3. Amending and supplementing Clause 5 of Article 4 as follows:

"2. The list of positions for civil servants in common professional duties specified in Appendix II includes:

a) Inspection;

b) International cooperation;

c) Legal affairs (for the position of preventing and resolving international investment disputes, which can be shared with positions for civil servants in specialized professional fields under the judicial sector);

d) Cadre and civil servant organization (organizational structure and human resource management), commendation and reward, administrative reform;

d) Office;

e) Planning and finance;

g) Information technology and information security.

The regulations on the list of positions at point a and point d of Clause 2 of this Article can be shared with positions for civil servants in specialized professional fields under the inspection and home affairs sectors."

2. Amend and supplement Clause 1, Article 5 as follows:

"1. The list of positions for common professional titles and occupations in public service units specified in Appendix IV includes:

a) International cooperation;

b) Legal affairs;

c) Cadre and civil servant organization (organizational structure and human resource management), commendation and reward (which can be applied together with positions for civil servants in specialized professional fields under the home affairs sector);

d) Office (including two positions related to archives that can be shared with positions for professional titles and occupations in specialized fields under the home affairs sector);

d) Planning and finance;

e) Health;

g) Information technology and information security (which can be shared with positions for professional titles and occupations in specialized fields under the information and communication sector)."

3. Amending and supplementing Clause 3 of Article 6 as follows:

"3. Job descriptions and competency frameworks for positions for common professional titles and occupations in public service units shall apply as those specified in Clause 2 of this Article, ensuring consistency with the functions and tasks of the unit. Specifically, the job descriptions and competency frameworks for the positions of Archivist and Intermediate Archivist, which can be shared with positions for professional titles and occupations in specialized fields under the home affairs sector; the positions of Information Technology and Information Security, which can be shared with positions for professional titles and occupations in specialized fields under the information and communication sector; and the job description and competency framework for the position of School Health Officer specified in Appendix VIIa."

4. Replacing Appendices I, II, III, IV, V, VI, VII, VIII, and IX issued along with Circular No. 12/2022/TT-BNV.

Article 2. Effectiveness and responsibility for implementation

1. This Circular takes effect from August 20, 2024.

2. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, persons in charge of organizations established by the Government or the Prime Minister that are not public service units, Chairpersons of provincial and centrally-administered city People's Committees, relevant agencies, organizations, and individuals are responsible for implementing this Circular.

3. In case of difficulties during implementation, please report to the Ministry of Home Affairs and the relevant management ministries and sectors for guidance and resolution.
