Pursuant to the Law on Measurement dated November 11, 2011;
Pursuant to Decree No. 83/2014/NĐ-CP dated September 3, 2014 of the Government on gasoline retail business; Decree No. 95/2021/NĐ-CP dated November 1, 2021 amending and supplementing certain articles of Decree No. 83/2014/NĐ-CP dated September 3, 2014 on gasoline retail business; Decree No. 80/2023/NĐ-CP dated November 17, 2023 of the Government amending and supplementing certain articles of Decree No. 95/2021/NĐ-CP dated November 1, 2021 and Decree No. 83/2014/NĐ-CP dated September 3, 2014 of the Government on gasoline retail business;
On the basis of Decree No. 55/2025/NĐ-CP dated March 2, 2025 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
At the proposal of The Chairman of the National Standardization, Metrology, and Quality Control Committee and the Director of the Legal Department;
The Minister of Science and Technology issues this Circular to amend, supplement, and abolish certain provisions of Circular No. 15/2015/TT-BKHCN dated August 25, 2015 of the Minister of Science and Technology qregulating measurement, quality in gasoline retail business which has been amended and supplemented by Circular No. 08/2018/TT-BKHCN dated June 15, 2018 of the Minister of Science and Technology.
Article 1. Amending, supplementing, and abolishing certain provisions of Circular No. 15/2015/TT-BKHCN dated August 25, 2015 of the Minister of Science and Technology regulating measurement, quality in gasoline retail business, which has been amended and supplemented by Circular No. 08/2018/TT-BKHCN dated June 15, 2018 of the Minister of Science and Technology, as follows:
1. Amending and supplementing Point d Clause 1 Article 6 as follows:
"d) Switches related to the control circuit of the gasoline dispenser must not be installed outside the gasoline dispenser (except for the switch that ends the fuel dispensing process according to the manufacturer's design). Peripheral equipment connected to the gasoline dispenser must ensure that there is no mechanism or function that affects the primary measuring characteristics of the gasoline dispenser compared to the approved model;"
2. Amending Clause 6 Article 6 as follows:
"6. When detecting measurement results that do not meet the requirements specified in Clause 3 of this Article or in cases where the gasoline dispenser is damaged, repair, replacement, or adjustment (hereinafter referred to as repair) of sealed or clamped parts or components must be carried out. The trader shall take the following measures:
a) Stop using and organize the repair of these parts or components;
b) Upon completion of the repair process, a repair record between the trader and the repair facility or individual directly responsible for the repair must be established. The record must include the following basic information: name and address of the repair facility or name, address, and identification number of the individual performing the repair (in case of individual repair); time of repair; type, code, and production number of the repaired gasoline dispenser; details of the repair performed; status of sealing or clamping of the repaired parts (if there are differences from before the repair);
c) Conduct verification of the gasoline dispenser after repair;
d) The repair record specified in Point b and the Certificate of Verification of the measuring instrument after repair must be kept at a convenient location for inspection and supervision for at least twenty-four (24) months; copies of the repair record and the Certificate of Verification of the measuring instrument after repair must be sent to the Department of Science and Technology or the Local Standardization, Metrology, and Quality Control Agency for reporting;
e) In cases where the repair process changes the primary measuring characteristics of the gasoline dispenser compared to the approved model, the gasoline dispenser must be re-approved according to regulations before being put back into use."
3. Abolishing Clause 7 Article 6 of Circular No. 15/2015/TT-BKHCN which has been amended and supplemented by Circular No. 08/2018/TT-BKHCN dated June 15, 2018 of the Minister of Science and Technology.
4. Supplementing Clause 8 after Clause 7 Article 24 as follows:
"8. The trader is legally responsible for ensuring compliance with the requirements set forth in Point d Clause 1 and Clause 6 of Article 6 of this Circular;"
5. Amending Article 25 as follows:
"Article 25. Responsibilities of organizations conducting verification of measuring instruments
1. When conducting verification, if it is found that the gasoline dispenser does not meet all the requirements specified in Points a, b, c, and d Clause 1 of Article 6 of this Circular or if violations of laws on measurement and quality are detected, verification must be stopped immediately, and the matter must be reported and handled in accordance with the law in coordination with the Department of Science and Technology or the Local Standardization, Metrology, and Quality Control Agency.
2. Adhering to the responsibilities of organizations conducting verification of measuring instruments as stipulated in this Circular and other relevant laws on measurement."
6. Amending Clause 2 Article 26 as follows:
"2. Responsible for the repair of gasoline dispensers conducted by the repair facility or authorized units or agents."
7. Amending and supplementing Clause 2, Clause 3 Article 28 as follows:
"2. Approving and organizing the implementation of plans for information dissemination, publicity, and professional guidance on measurement and quality in accordance with this Circular within the local area.
3. Taking the lead or directing the Local Standardization, Metrology, and Quality Control Agency within their scope of duties and powers, taking the lead or coordinating with relevant agencies and units to conduct state inspections on measurement and quality of gasoline of total distributors, distributors, retail outlets, and traders engaged in gasoline transportation services within the local area, and other tasks as stipulated in this Circular and other relevant laws."
Article 2. Implementation clause
1. This Circular takes effect from August 1, 2025.
2. During implementation, if difficulties or obstacles arise, the agency, organization, or individual is requested to report them to the Ministry of Science and Technology (National Standardization and Measurement Committee) for consideration and resolution./.
