DECREE [1]

REGULATIONS ON STANDARDS, QUANTUMS AND MANAGEMENT REGIMES FOR THE USE OF STATE ASSETS OF VIETNAMESE AGENCIES ABROAD

Decree No. 166/2017/ND-CP dated December 31, 2017 of the Government stipulates standards, quantums and management regimes for the use of state assets of Vietnamese agencies abroad, which took effect from January 1, 2018, has been amended and supplemented by:

Decree No. 171/2024/ND-CP dated December 27, 2024 of the Government amending and supplementing certain articles of Decree No. 166/2017/ND-CP dated December 31, 2017 of the Government stipulating standards, quantums and management regimes for the use of state assets of Vietnamese agencies abroad, which took effect from January 1, 2025.

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Law on Management and Use of State Assets dated June 21, 2017;

At the proposal of the Minister of Finance;

The Government promulgates this Decree stipulating standards, quantums and management regimes for the use of state assets of Vietnamese agencies abroad.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 1. This Decree stipulates standards, quantums and management regimes for the use of state assets of Vietnamese agencies abroad, including:

a) Office premises, public service bases; housing; ambassadors' private residences;

b) Cars and other transportation means;

c) Machinery and equipment;

d) Other assets as prescribed by law.

2. Management and use of assets exchanged on the basis of Agreements or Arrangements between the Government of the Socialist Republic of Vietnam and the Government of the host country shall be carried out in accordance with the provisions of such Agreements or Arrangements. In cases where investment construction, upgrading, renovation, maintenance, and repair during the use period fall under the responsibility of Vietnam, they shall be implemented in accordance with the provisions of this Decree.

Article 2. Applicability

1. Ministries, ministerial-level agencies, government agencies, and other central agencies (hereinafter referred to as ministries and central agencies) and People's Committees of provinces and centrally-administered cities (hereinafter referred to as provincial People's Committees) have Vietnamese agencies abroad.

2. Vietnamese agencies abroad.

3. Positions working at Vietnamese agencies abroad; including civil servants, public officials, contractual employees as prescribed by law.

4. Other related entities involved in the management and use of state assets of Vietnamese agencies abroad.

Article 3. Sources of formation of state assets of Vietnamese agencies abroad

1. State assets transferred in kind.

2. Assets constructed, purchased, or leased from the state budget or other permitted funds according to the provisions of law.

Article 4. Definitions

In this Decree, the following terms shall be understood as follows:

1. Vietnamese agencies abroad include:

a) Representative agencies are representative bodies of the Socialist Republic of Vietnam abroad as prescribed by law on representative bodies of the Socialist Republic of Vietnam abroad;

b) Other Vietnamese agencies abroad are agencies not part of the organizational structure of representative agencies, funded from the state budget or other permitted funds according to the provisions of law established by ministries, central agencies, and provincial People's Committees as prescribed by law.

2[3]. Office premises of Vietnamese agencies abroad are land, office buildings, and other assets attached to the land serving the activities according to the assigned functions and tasks of Vietnamese agencies abroad.

2a[4]. Detached units with separate funding belonging to representative agencies (hereinafter referred to as detached units) are units whose regular operating funds are not allocated by the Ministry of Foreign Affairs but are allocated by the agency with detached personnel according to the provisions of law on representative bodies of the Socialist Republic of Vietnam abroad.

3. Public service bases of Vietnamese agencies abroad are land, office buildings, public service facilities, and other assets attached to the land serving the management and provision of public services by Vietnamese agencies abroad.

4. Working area of positions is the maximum area determined for one workplace in office premises or public service bases.

5[5]. Ambassadors' private residences are land (if any), houses, and other assets attached to the land used for combined purposes of serving diplomatic work and housing for ambassadors, heads of Vietnamese delegations to international organizations, Consuls General, and equivalent positions. The area of ambassadors' private residences includes the area for diplomatic work and the housing area for ambassadors, heads of Vietnamese delegations to international organizations, Consuls General, equivalent positions, and accompanying members meeting the standards prescribed in this Decree.

6[6]. Housing for civil servants, public officials, and public employees is land (if any), houses, and other assets attached to the land used for housing civil servants, public officials, and public employees of Vietnamese agencies abroad (hereinafter referred to as housing). The housing area for each position includes the housing area for civil servants, public officials, and public employees and the housing area for accompanying members meeting the standards prescribed in this Decree. Housing is arranged within the compound of office premises or public service bases or independently outside the office premises or public service bases of Vietnamese agencies abroad.

7[7]. Ministers and heads of central agencies responsible for determining authority and responsibilities under this Decree are specified as follows:

a) Minister of Foreign Affairs: For representative agencies (excluding detached units of representative agencies as provided for in Clause 2a of this Article);

b) Ministers and heads of central agencies of other Vietnamese agencies abroad, and detached units of representative agencies: For other Vietnamese agencies abroad under central management and detached units of representative agencies.

8[8]. Accompanying members meeting the standards prescribed in this Decree are spouses and minor children accompanying members of Vietnamese agencies abroad.

Article 5. Principles for Applying Standards, Norms, and Managing and Using State Assets of Vietnamese Agencies Abroad

1. The standards and norms for using state assets of Vietnamese agencies abroad stipulated in this Decree shall be used as a basis for planning and preparing budget estimates; allocating, investing in construction, purchasing, leasing assets, and cost-sharing for state asset usage; managing, using, and disposing of state assets of Vietnamese agencies abroad.

2. The management and use of state assets of Vietnamese agencies abroad must comply with the standards, norms, and regulations issued by Vietnamese authorities according to this Decree and relevant laws.

The management and use of state assets of Vietnamese agencies abroad shall be applied in the following order:

a) International treaties to which the Socialist Republic of Vietnam and the host country are members;

b) Laws of the host country;

c) Laws of Vietnam.

3. In cases where an individual holds multiple positions with different standards for using state assets, the highest standard and norm will apply. When a predecessor ends their term of service or transfers to another position and the state assets provided have not yet met the conditions for disposal as prescribed, the successor shall continue to use them without providing new ones.

4. Purchasing state assets as stipulated in this Decree shall be carried out in accordance with the law and can only be done if it has been allocated in the annual state budget estimate of Vietnamese agencies abroad.

5[9]. In cases of transferring, reallocating, or receiving used state assets, the value of the state asset used to determine the standards and norms is the remaining value recorded in the accounting books, except as provided for in Clause 14 of this Article.

6[10]. The provisions on price levels in the norms for using state assets stipulated in this Decree shall be implemented according to Clause 1 of Article 24 of the Law on Management and Use of State Assets; it does not include insurance fees, various types of fees, and other payments related to the use of state assets as prescribed by the host country's laws. If there is no need to pay or such taxes, fees, and charges are exempted according to the laws of the host country, corresponding procurement funds will not be allocated.

7. The exchange rate conversion for foreign currencies shall be based on the Exchange Rate Table published by the State Bank of Vietnam at the time of allocation, investment in construction, purchase, lease of assets, cost-sharing for state asset usage, and disposal of state assets.

8. The staffing level to determine the standards and norms for using state assets of Vietnamese agencies abroad stipulated in this Decree shall be based on the approved staffing quota of Vietnamese agencies abroad by authorized authorities according to the law.

9. Leasing state assets and cost-sharing for state asset usage shall ensure greater economy and efficiency compared to allocation, investment in construction, and purchase of assets; ensuring conditions for serving diplomatic work and safeguarding state secrets as prescribed by the law on protecting state secrets. Leasing and cost-sharing funds shall be allocated within the annual state budget estimate assigned to Vietnamese agencies abroad.

10[11]. The head of the representative agency shall be responsible for arranging assets equipped to serve the work of officials, civil servants, and employees of the Ministry of Foreign Affairs and officials, civil servants, and employees of related agencies working under the secondment system in the fields of investment, labor, culture, science and technology, and other areas under the representative agency (excluding officials, civil servants, and employees under the secondment unit as prescribed in Clause 2a of Article 4 of this Decree).

11[12]. The quantity of assets, office area, residential area, and price levels stipulated in this Decree are the maximum quantities, areas, and prices. Based on the needs for using assets to fulfill assigned tasks and the budget capacity and other permissible funding sources according to the law, the authority or person with decision-making power may consider and decide on appropriate quantities of assets, areas, and price levels that ensure economy and efficiency.

12[13]. The depreciation rate (%) per year for vehicles of Vietnamese agencies abroad: a) For vehicles serving the work of positions is 16.67%/year; b) For vehicles serving general work is 10%/year.

13[14]. In cases where Vietnamese agencies abroad are directly subordinate to units permitted to apply financial mechanisms similar to enterprises, they shall implement the provision for depreciation of fixed assets according to the regulations.

14[15]. The Minister of Finance decides (for cases involving the reallocation of vehicles between ministries, central agencies, between central and local levels, and between provinces and centrally-administered cities), the Minister, Head of Central Agencies, or Provincial People's Council decides or delegates authority to decide (for cases involving the reallocation of used vehicles with remaining values on accounting records or re-evaluated values according to the law [for vehicles not tracked on accounting records or when re-evaluation is required according to the law] not exceeding the maximum price level prescribed in this Decree or higher by no more than 15% compared to the maximum price level prescribed in this Decree). In necessary cases, the Prime Minister, upon the proposal of the Minister, Head of Central Agencies, or Chairman of the People's Committee of the province concerned, may consider and decide on the reallocation of used vehicles with remaining values or re-evaluated values higher than 15% compared to the maximum price level prescribed in this Decree.

Labor Code amended and supplemented shall be resolved as follows: those parts declared void shall be resolved according to corresponding provisions in current laws and lawful agreements in individual contracts (if any)."

Reorganization and Disposal of State Assets of Vietnamese Agencies Abroad

Vietnamese agencies abroad shall conduct a review of existing assets to ensure compliance with the standards and norms set forth in this Decree; based on this, they shall proceed as follows:

1. For assets that meet the standards and quotas prescribed in this Decree, they shall continue to be managed and used; the representative offices, dispatched units, and other agencies of Vietnam abroad with such assets shall conduct comprehensive statistics and accounting for both physical items and value in accordance with the provisions of the law. 2. For assets exceeding the standards and quotas, the Vietnamese agencies abroad shall report to the competent authorities for handling according to the forms prescribed in the laws on management and use of state assets and the provisions of this Decree.

Chapter 1. STANDARDS AND QUOTAS FOR MANAGEMENT AND USE OF HEADQUARTERS, BUSINESS FACILITIES, HOUSING, AND PRIVATE HOUSES OF THE VIETNAMESE AGENCIES ABROAD

4. In cases where the area of each office room or apartment in the headquarters, existing housing fund, or rental market for office spaces and houses in the area requiring new rentals does not have rooms or apartments with an exact area matching the maximum area specified in Clauses 1 and 2 of this Article, the Minister, Head of Central Agencies, or Provincial People's Council shall decide or delegate authority to allow adjustments in the allocation or new rentals for each position to suit the actual situation but must ensure that the total area allocated or rented for all positions does not exceed the total office area and total housing area for the positions calculated according to the office space and housing area quotas specified in Clauses 1 and 2 of this Article in each location." Article 7. Common Usage Area in Headquarters and Business Facilities

1. The common usage area is the area used to serve general activities in the headquarters and business facilities of Vietnamese agencies abroad, including: Meeting rooms; reception rooms; duty rooms, security rooms; medical rooms; archive rooms for regular documents; telephone switchboard rooms; document copying rooms; dining halls, cafeterias; libraries; main hall, auxiliary hall, corridors, balconies, and other necessary areas that do not fall within the office space of individual positions or specialized areas as defined in Articles 6 and 8 of this Decree.

The common usage area does not include the area occupied by columns, walls, technical boxes, staircases, parking garage areas; these parts are implemented according to construction standards.

2. The common usage area in the headquarters and business facilities of Vietnamese agencies abroad shall be calculated as follows:

a) Up to 70% of the total office space of positions for Vietnamese agencies abroad with 30 or more people;

b) Up to 90% of the total office space of positions for Vietnamese agencies abroad with 15 to less than 30 people;

c) Up to 130% of the total office space of positions for Vietnamese agencies abroad with 5 to less than 15 people;

d) [18] Up to 150% of the total office space of positions for Vietnamese agencies abroad with fewer than 5 people, but ensuring a minimum of 30 square meters.

b) Maximum of ninety percent of the total working area of positions for Vietnamese agencies abroad with a staff of fifteen to less than thirty people;

c) Maximum of one hundred thirty percent of the total working area of positions for Vietnamese agencies abroad with a staff of five to less than fifteen people;

d) Maximum of one hundred fifty percent of the total working area of positions for Vietnamese agencies abroad with a staff of less than five people, but ensuring a minimum of thirty square meters;2 floor.

Article 8. Special-use area within office premises, public service facilities, and the personal residence of the Ambassador

1. The special-use area includes:

a) The area for diplomatic work is the area for receiving international guests, organizing reception and ceremonial activities. Depending on specific conditions, the area for diplomatic work may be arranged at the office premises of the representative agency or the personal residence of the Ambassador, or simultaneously at both the office premises of the representative agency and the personal residence of the Ambassador:

b) The special-use area not included in point a of this clause comprises: Conference room, exhibition hall, sample display room, media room, memorial room, and other special-use areas (if any) at the office premises and public service facilities of Vietnamese agencies abroad.

2. Based on the provisions of Clause 1 of this Article, the decision to apply specific standards and norms for special-use areas of each Vietnamese agency abroad shall be implemented according to the provisions of Clause 4 and Clause 5 of Article 26 of the Law on Management and Use of Public Assets.

3. In cases where a dispatched unit under the representative agency requires the use of the area for diplomatic work at the office premises of the representative agency to receive international guests and organize reception and ceremonial activities, the head of the representative agency shall consider and arrange for the dispatched unit under the representative agency to use the area for diplomatic work specified in point a of Clause 1 of this Article based on the functionality of the asset, ensuring security and safety, and collecting a fee to cover direct costs related to the operation of the asset during the usage period according to the regulations on shared use of public assets stipulated in the Government's Decree detailing certain provisions of the Law on Management and Use of Public Assets.

Section 2. MANAGEMENT AND USE REGIME

Article 9. Investment in construction, procurement of office premises, public service facilities, housing, and the personal residence of the Ambassador

1. Investment in construction and procurement of office premises, public service facilities, housing, and the personal residence of the Ambassador shall be carried out in the following cases:

a) There is no existing office premises, public service facilities, housing, or personal residence of the Ambassador;

b) The current area of office premises, public service facilities, housing, or personal residence of the Ambassador is insufficient compared to the standard and norm, affecting the performance of assigned tasks;

c) Office premises, public service facilities, housing, or personal residence of the Ambassador are deteriorated and do not ensure safety for users;

d) Other cases as decided by the Prime Minister.

2. The procedures, formalities, and authority to decide on investment in construction and procurement of office premises, public service facilities, housing, and the personal residence of the Ambassador of Vietnamese agencies abroad shall be implemented according to relevant laws.

3. Investment in construction and procurement of office premises, public service facilities, housing, and the personal residence of the Ambassador shall be carried out according to the laws of the host country; if the laws of the host country do not provide for such matters, they shall be carried out according to the laws of Vietnam.

Article 10. Leasing of office premises, public service facilities, housing, and the personal residence of the Ambassador

1. Leasing of office premises, public service facilities, housing, and the personal residence of the Ambassador shall be carried out in the cases stipulated in Clause 1 of Article 32 of the Law on Management and Use of Public Assets; specifically, for long-term leasing of 30 years or more, it shall be carried out according to the provisions of Clause 1 of Article 9 of this Decree.

2. The rental price for office premises, public service facilities, housing, and the personal residence of the Ambassador shall be consistent with the rental prices for similar properties and land in the local market of the host country, ensuring compliance with the standards and norms prescribed in this Decree.

3. In the lease contract, if the lessor requires the lessee to pay a deposit, the Vietnamese agency abroad may temporarily advance funds for the deposit. The Vietnamese agency abroad shall be responsible for recovering and refunding the temporarily advanced funds and shall be reimbursed for related expenses such as legal fees, brokerage fees, and other reasonable incidental expenses (if any).

4. The Minister, the head of central agencies, and the People's Councils of provinces shall decide or delegate the authority to decide on leasing office premises, public service facilities, housing, and the personal residence of the Ambassador within the allocated budget estimate and decide on compensation or repair due to damage to office premises, public service facilities, housing, and the personal residence of the Ambassador during the lease period based on the lease contract.

5. For long-term leasing of 30 years or more of office premises, public service facilities, housing, and the personal residence of the Ambassador, the procedures, formalities, and authority to decide shall be implemented according to the laws on public investment.

Article 11. Allocation of Housing Expenses

1. The allocation of housing expenses shall be applied in cases where Vietnamese agencies abroad do not have housing to arrange for positions with specified standards when such positions register to implement the allocation.

2. The level of allocation shall be determined based on the rental price of comparable housing conditions in the local market of the host country, ensuring it is consistent with the housing area according to the standards and norms stipulated in this Decree.

3. The Minister, the head of central agencies, and the People's Councils at the provincial level shall decide or delegate authority to decide on the allocation and level of allocation of housing expenses for Vietnamese agencies abroad, ensuring economy and efficiency.

4. The allocated expenses shall be paid to the recipient along with the monthly living allowance.

Article 12. Maintenance, Repair, Renovation, Upgrade, and Expansion of Office Premises, Institutional Facilities, Housing, and Ambassadors' Private Residences

Maintenance, repair, renovation, upgrade, and expansion of office premises, institutional facilities, housing, and ambassadors' private residences shall be carried out in accordance with the laws of the host country; if the laws of the host country do not provide for such matters, they shall be carried out in accordance with the laws of Vietnam.

Article 12a. Transfer of Office Premises, Institutional Facilities, Housing, and Ambassadors' Private Residences

1. The transfer of office premises, institutional facilities, housing, and ambassadors' private residences shall be implemented in the cases prescribed in Clause 1 of Article 42 of the Law on Management and Use of Public Assets.

2. Decision-making Authority:

a) The Minister of Finance decides on the transfer of office premises, institutional facilities, housing, and ambassadors' private residences between ministries, central agencies, between central and local levels, and between provinces and centrally-administered cities based on the proposal of the Minister, the head of central agencies, and the Chairman of the People's Committee of the province concerned:

b) The Minister, the head of central agencies decides or delegates authority to decide on the transfer of office premises, institutional facilities, housing, and ambassadors' private residences among agencies, organizations, and units under their management:

c) The People's Council at the provincial level decides or delegates authority to decide on the transfer of office premises, institutional facilities, and housing among agencies, organizations, and units under local management.”

Article 13. Sale of Office Premises, Institutional Facilities, Housing, and Ambassadors' Private Residences

1. The sale of office premises, institutional facilities, housing, and ambassadors' private residences shall be implemented in the cases prescribed in Clause 1 Article 43 of the Law on Management and Use of Public Assets. The sale shall be carried out in accordance with the laws of the host country:

The Minister, the head of central agencies decides on the sale of office premises, institutional facilities, housing, and ambassadors' private residences within their management scope: The People's Council at the provincial level decides or delegates authority to decide on the sale of office premises, institutional facilities, and housing within their management scope.

3. The proceeds from the sale of office premises, institutional facilities, housing, and ambassadors' private residences shall be deposited into the Temporary Holding Fund of the State Budget at the Vietnamese agency abroad, after deducting related costs, shall be deposited into the State Budget. The amount already deposited into the State Budget shall be used for investment development purposes and prioritized in the budget estimate for State spending according to the laws on the State Budget, laws on public investment, and other relevant laws to fund construction, upgrading, and renovation of office premises, institutional facilities, housing, and ambassadors' private residences according to projects approved by competent authorities.

Article 14. Liquidation of premises, works, and other assets belonging to working offices, public service bases, residential houses, and personal residences of Ambassadors

1. The liquidation of premises, works, and other assets belonging to working offices, public service bases, residential houses, and personal residences of Ambassadors shall be carried out in the cases prescribed in Clause 1 of Article 45 of the Law on Management and Use of Public Assets. The liquidation shall be conducted in accordance with the laws of the host country; if the laws of the host country do not provide for such matters, they shall be implemented according to the laws of Vietnam.

2.[27] Competent authority to decide:

a) The Minister or Head of a central agency decides or delegates the authority to decide on the liquidation of premises, works, and other assets attached to land belonging to working offices, public service bases, residential houses, and personal residences of Ambassadors under their management:

b) The People's Council at the provincial level decides or delegates the authority to decide on the liquidation of premises, works, and other assets attached to land belonging to working offices, public service bases, and residential houses under local management.

3[28]. Based on the decision on asset liquidation by the competent authority, the agency owning the assets to be liquidated shall be responsible for organizing the liquidation in accordance with the laws of the host country; if the laws of the host country do not provide for such matters, they shall be implemented according to the laws of Vietnam.

4. The proceeds from the liquidation of premises, works, and other assets belonging to working offices, public service bases, residential houses, and personal residences of Ambassadors shall be deposited into the Temporary Holding Fund of the State Budget at Vietnamese agencies abroad, after deducting related expenses, shall be deposited into the State Budget.

Article 15. Reorganization and Handling of Working Offices, Public Service Bases, Residential Houses, and Personal Residences of Ambassadors

1. Vietnamese agencies abroad shall reorganize and handle working offices, public service bases, residential houses, and personal residences of Ambassadors in accordance with the assigned purposes of use; comply with standards and norms stipulated in this Decree and be consistent with organizational structures as prescribed by law.

A reorganization plan shall be established for all working offices, public service bases, residential houses, and personal residences of Ambassadors managed and used by Vietnamese agencies abroad, categorized by each area.

2. The reorganization of working offices, public service bases, residential houses, and personal residences of Ambassadors shall aim to separate the use between working offices, public service bases, and residential houses, personal residences of Ambassadors. In cases where independent use is not feasible, the working space and residential areas for positions shall be rearranged appropriately to ensure that it does not affect diplomatic activities.

3[29]. In cases of non-compliant use, the Minister or Head of a central agency, or the Chairman of the Provincial People's Committee shall terminate the non-compliant use; simultaneously, handle the responsibility of organizations and individuals involved according to relevant laws. Vietnamese agencies abroad shall be responsible for depositing the entire proceeds into the Temporary Holding Fund of the State Budget at Vietnamese agencies abroad.

In cases where working offices, public service bases, residential houses, and personal residences of Ambassadors have been equipped but are no longer needed, they shall be sold or transferred to other Vietnamese agencies abroad. The sale and transfer shall be carried out in accordance with Article 12a and Article 13 of this Decree.

4[30]. Vietnamese agencies abroad shall establish a reorganization and handling plan for working offices, public service bases, residential houses, and personal residences of Ambassadors currently being managed and used, report to the Minister or Head of a central agency, and the Provincial People's Committee for approval of the reorganization and handling plan for working offices, public service bases, residential houses, and personal residences of Ambassadors of Vietnamese agencies abroad (except for the case prescribed in point a of Clause 2 of Article 12a of this Decree).

5. The proceeds from the reorganization and handling of working offices, public service bases, residential houses, and personal residences of Ambassadors shall be managed and used in accordance with Clause 3 of Article 13 or Clause 4 of Article 14 of this Decree.

Chapter III

STANDARDS, QUOTAS, AND MANAGEMENT REGIMES FOR THE USE OF MOTOR VEHICLES AND OTHER TRANSPORTATION MEANS OF VIETNAMESE AGENCIES ABROAD

Article 6. Standards and Quotas for Office Space and Housing Area

Article 16. Types, quantities, prices of cars and subjects using cars for diplomatic missions

[31]

1. For cars serving the duties of positions:

a) Ambassadors and equivalent positions, Representatives, Heads of Vietnamese delegations to international organizations may regularly use 01 car for work purposes with a maximum price excluding taxes being 90,000 USD per car. Consuls and equivalent positions may regularly use 01 car for work purposes with a maximum price excluding taxes being 85,000 USD per car;

b) Based on the price level and requirements for diplomatic activities in each country, region, and the maximum car price specified in point a of this clause, the Ministry of Foreign Affairs shall decide on the types, brands, and prices of suitable cars to equip for work purposes for the positions specified in point a of this clause.

2. For cars serving the common work of diplomatic missions (excluding detached units):

a) Positions within diplomatic missions shall be allocated cars for work purposes according to specific conditions and nature of work as stipulated by the head of the diplomatic mission;

b) The quantity of cars serving common work is as follows:

c) In cases where diplomatic missions have merged units, the usage standards for cars serving common work of the merged units shall be determined corresponding to the number of staff of each unit as stipulated in point b of this clause;

d) Car price;

01 car with a maximum price excluding taxes being 55,000 USD per car;

Remaining cars with a maximum price excluding taxes being 45,000 USD per car.

3. For cars serving the common work of detached units under diplomatic missions:

a) Positions within detached units under diplomatic missions shall be allocated cars for work purposes according to specific conditions and nature of work as stipulated by the Minister, head of central agencies;

b) The quantity of cars serving common work is as follows:

4. Cars specified in Clauses 1, 2, and 3 of this Article are cars from 4 to 16 seats (including pickup trucks).

5. In cases where it is necessary to equip cars over 16 seats for foreign delegations at certain locations, the Minister, head of central agencies shall consider and decide. Cars equipped according to this provision do not count towards the number of cars for work purposes for positions, cars serving the common work of diplomatic missions, and detached units as stipulated in Clauses 1, 2, and 3 of this Article.

Article 17. Types, quantities, prices of cars and subjects using cars for the common work of other Vietnamese agencies abroad

[32]

1. Positions within other Vietnamese agencies abroad shall be allocated cars for work purposes according to specific conditions and nature of work as stipulated by the Minister, head of central agencies, provincial People's Committees;

Article 18. Adjustment of Car Prices

[33]

In case of market price fluctuations leading to an increase in car prices:

1. The Minister, Head of Central Agencies, and Provincial People's Committees shall examine and decide on car prices excluding taxes not exceeding 15% compared to the maximum price stipulated in Articles 16 and 17 of this Decree.

2. In cases where it is necessary to equip cars with prices excluding taxes exceeding 5% compared to the maximum price stipulated in Articles 16 and 17 of this Decree, the Minister, Head of Central Agencies, and Provincial People's Committees shall report to the Prime Minister for examination and decision.

Article 19. Provision of Other Transport Means

[34]

Based on economic and social conditions, geographical features, and specific requirements for serving work activities in each country or territory: The Minister, Head of Central Agencies, and Chairpersons of Provincial People's Committees shall examine and decide on the provision of other types of transport means (excluding cars) to serve the work of Vietnamese agencies abroad within their management scope, ensuring principles of thrift, efficiency, and suitability with the permitted budget funds.

Section 2. MANAGEMENT AND USE REGIME

Article 20. Procurement of Cars and Other Transport Means

1. The procurement of cars and other transport means shall be carried out in the cases prescribed in Clause 1 of Article 31 of the Law on Management and Use of State Assets.

2. The Minister, Head of Central Agencies, and Chairpersons of Provincial People's Committees shall decide on the procurement of cars and other transport means to serve the work of Vietnamese agencies abroad within their management scope in the annual state budget allocation, ensuring thrift and efficiency.

Article 21. Hiring of Cars and Other Transport Means

1. The hiring of cars and other transport means shall be carried out in the cases prescribed in Clause 1 of Article 32 of the Law on Management and Use of State Assets.

2. The rental price of cars and other transport means shall be consistent with the rental price of equivalent means at the local market of the host country, ensuring compliance with standards and norms stipulated in this Decree.

3. The Minister, Head of Central Agencies, and Provincial People's Councils shall decide or delegate authority to decide[35] the hiring of cars and other transport means, ensuring thrift and efficiency.

Article 22. Maintenance and Repair of Cars and Other Transport Means

1. The maintenance and repair of cars and other transport means shall be conducted according to the system and technical standards prescribed by the laws of the host country; if the laws of the host country do not prescribe, they shall be implemented according to the laws of Vietnam.

2. The Minister, Head of Central Agencies, and Provincial People's Councils shall decide or delegate authority to decide on the maintenance and repair of cars and other transport means, ensuring thrift and efficiency. Maintenance and repair costs shall be allocated in the annual state budget allocation of Vietnamese agencies abroad.

Article 23. Sale of Cars and Other Transport Means

1. The sale of cars and other transport means shall be carried out in the cases prescribed in Clause 1 of Article 43 of the Law on Management and Use of State Assets. The sale shall be conducted according to the laws of the host country; if the laws of the host country do not prescribe, they shall be implemented according to the laws of Vietnam.

2. The Minister, Head of Central Agencies, and Provincial People's Councils shall decide or delegate authority to decide on the sale of cars and other transport means of Vietnamese agencies abroad.

3. The proceeds from the sale of cars and other transport means, after deducting related expenses, shall be deposited into the National Treasury Temporary Holding Fund of Vietnamese agencies abroad and then transferred to the state budget.

Article 24. Liquidation and Replacement of Cars and Other Transport Vehicles

1. Cars serving the positions specified in Clause 1, Article 16 of this Decree shall be replaced when they have been used for at least six years. In cases where the laws of the host country provide different regulations from those stipulated herein, such regulations shall be followed.

If cars serving the positions that meet the replacement conditions as prescribed but still ensure operational requirements, they shall be handled according to the provisions of Decree No. 151/2017/NĐ-CP.

2. Cars serving the common operations of Vietnamese agencies abroad shall be liquidated according to the regulations of the host country. In cases where the laws of the host country do not specify, they may be liquidated under the following circumstances:

a) Having been used for more than ten years or operated over 200,000 kilometers;

b) Not yet expired but damaged beyond repair or repairs would be ineffective (the estimated repair costs exceed 30% of the original price).

3[38]. (Repealed)

4. When there is an opportunity to replace cars serving work due to preferential treatment from the host country, the head of the Vietnamese agency abroad shall report to the Minister, the head of the central agency, and the Chairman of the Provincial People's Council for consideration and decision within the allocated budget.

5. Other transport vehicles shall be liquidated according to the laws of the host country. In cases where the laws of the host country do not specify, they shall be handled according to the laws of Vietnam.

6. The Minister, the head of the central agency, and the Provincial People's Council decide or delegate authority to decide on the liquidation of cars and other transport vehicles.

7. The proceeds from the liquidation of cars and other transport vehicles shall be deposited into the Temporary Holding Fund of the State Budget at the Vietnamese agency abroad, after deducting related expenses, shall be deposited into the State Budget.

Chapter IV

STANDARDS, QUOTAS, AND MANAGEMENT REGIMES FOR THE USE OF EQUIPMENT, DEVICES, AND OTHER ASSETS OF VIETNAMESE AGENCIES ABROAD

Article 6. Standards and Quotas for Office Space and Housing Area

Article 25. Standards and Quotas for the Use of Common Office Equipment

1. Common office equipment of Vietnamese agencies abroad includes office equipment provided for positions and position offices.

2. The standards for common office equipment for positions and position offices are detailed in Appendix 1 attached to this Decree.

3. The Minister, Head of Central Agencies, and Provincial People's Councils shall decide or delegate authority to decide [40] The ceiling prices for common office equipment applied to each area based on:

a) Equipment with technical standards meeting job requirements, commonly used in agencies and offices of the host country; avoid purchasing equipment with high technical standards that cause waste;

b) Prices of at least three suppliers listed and widely announced in the host country or information officially published by suppliers through the Internet for equipment according to the technical standards specified in point a of this clause;

c) Compatibility with the state budget capacity.

4. Based on actual conditions, working conditions in each country, and annual budget estimates, The Minister, the head of the central agency, and the Provincial People's Council Decide or delegate authority to decide on the provision of common office equipment as stipulated in Clause 2 of this Article, ensuring it does not exceed the ceiling price as prescribed in Clause 3 of this Article, being economical, effective, suitable for the nature of work, diplomatic relations, and bearing responsibility for their decisions.

5. Besides the common office equipment specified in Appendix I attached to this Decree, The Minister, Head of Central Agencies, and Provincial People's Councils shall decide or delegate authority to decide[42] or delegate to the head of the Vietnamese agency abroad to decide on the provision of additional necessary common office equipment suitable for functions, tasks, the nature of work, usage needs, and state budget capacity, ensuring economy and effectiveness.

Article 26. Standards and Quotas for Machinery and Equipment Serving Common Activities

1. Machinery and equipment serving common activities of Vietnamese agencies abroad include:

a) Machinery and equipment installed in rooms serving common activities of Vietnamese agencies abroad;

b) Machinery and equipment attached to buildings, architectural structures, construction projects, and machinery and equipment serving common activities of Vietnamese agencies abroad.

2. Based on functions, tasks, usage needs, design of office premises, operational bases, and state budget estimates of Vietnamese agencies abroad, the Minister, Head of Central Agencies, or Provincial People's Council shall decide or delegate authority to decide on equipping machinery and equipment serving common activities of Vietnamese agencies abroad in a manner that ensures economy and efficiency.

Article 27. Standards and Quotas for Specialized Machinery and Equipment

1. Specialized machinery and equipment of Vietnamese agencies abroad refers to machinery and equipment with higher performance, capacity, and configuration than commonly used office machinery and equipment, and machinery and equipment serving special tasks of Vietnamese agencies abroad.

2[44]. Based on the provisions of Clause 1 of this Article, the decision on applying specific standards and quotas for specialized machinery and equipment of each Vietnamese agency abroad shall be carried out according to the provisions of Clause 4 and Clause 5 of Article 26 of the Law on Management and Use of State Property.

3. The Minister, Head of Central Agencies, or Provincial People's Council shall decide or delegate authority to decide on purchasing specialized machinery and equipment of Vietnamese agencies abroad within their management scope in accordance with the established standards and quotas under Clause 2 of this Article, ensuring economy and efficiency, and bearing responsibility for their decisions.

4. The issuance of standards and quotas for specialized machinery and equipment as stipulated in Clause 2 of this Article applies to machinery and equipment meeting the criteria for fixed assets according to the regulations on the management and depreciation of fixed assets at agencies, organizations, and units.

Specialized machinery and equipment not meeting the criteria for fixed assets, The Minister, Head of Central Agencies, or Provincial People's Council shall decide or delegate authority to decide on equipping in accordance with functions, tasks, nature of work, usage needs, and available financial resources, ensuring economy and efficiency.

Article 28. Standards and Quotas for Living Equipment at Residences of Ambassadors

1. Living equipment provided for positions working at Vietnamese agencies abroad and accompanying members who meet the standard includes living equipment attached to residences of Ambassadors such as air conditioners, sets of desks and chairs for work, sets of tables and chairs for receiving guests, dining room sets, filing cabinets, televisions, landline phones, wardrobes, beds, mattresses, refrigerators, washing machines, microwave ovens, integrated kitchen cabinets (including kitchen cabinets, sinks, faucets, stoves, exhaust hoods), water heaters, vacuum cleaners, and other necessary equipment.

2. Living equipment attached to residences of officials, civil servants, and employees at Vietnamese agencies abroad shall be implemented according to the provisions set forth in Appendix II issued together with this Decree.

3. The Minister, Head of Central Agencies, and Provincial People's Councils shall decide or delegate authority to decideThe ceiling price for living equipment applicable to each location is based on:

a) Living equipment with technical standards meeting living requirements, commonly used in the host country, without purchasing equipment with high technical standards that cause waste;

b) Prices from at least three suppliers listed and widely announced in the host country or obtained from officially published information by suppliers through the Internet for living equipment meeting the technical standards specified in point a of this clause;

c) Compatibility with the state budget capacity.

4. Based on actual conditions and working circumstances in each country, annual state budget estimates, The Minister, Head of Central Agencies, or Provincial People's Council shall decide or delegate authority to decide on equipping living equipment as stipulated in Clause 2 of this Article, ensuring it does not exceed the ceiling price set forth in Clause 3 of this Article, ensuring economy and efficiency, and being suitable for living conditions in the host country, and bearing responsibility for their decisions.

5. In cases where rented housing has been equipped with appropriate living equipment by the landlord, additional living equipment can be supplemented according to the provisions of this Decree.

6. Apart from the living equipment specified in Appendix II issued together with this Decree, The Minister, Head of Central Agencies, or Provincial People's Council shall decide or delegate authority to decide on equipping other necessary living equipment suitable for living conditions in the host country and the actual needs of Vietnamese agencies abroad.

Article 29. Provision of Other Assets

Based on economic and social conditions and specific service requirements for work activities in each country or territory; The Minister, Head of Central Agencies, Provincial People's Council shall decide or delegate authority to make decisions[51] on the provision of other assets (excluding machinery and equipment specified in Articles 25, 26, 27, and 28 of this Decree) to serve the operations of Vietnamese agencies abroad within their management scope, ensuring principles of thrift, efficiency, and suitability with the permitted budgetary funds.

Section 2. MANAGEMENT AND USE REGIME

Article 30. Procurement of Machinery, Equipment, and Other Assets

1. The procurement of machinery, equipment, and other assets shall be carried out in cases prescribed in Clause 1 of Article 31 of the Law on Management and Use of Public Assets.

2. The Minister, Head of Central Agencies, Provincial People's Council shall decide or delegate authority to make decisions[52] or delegate authority to make decisions on the procurement of machinery and equipment; decide on the procurement of other assets of Vietnamese agencies abroad within their management scope.

Article 31. Leasing of Machinery, Equipment, and Other Assets

1. The leasing of machinery, equipment, and other assets shall be carried out in cases prescribed in Clause 1 of Article 32 of the Law on Management and Use of Public Assets.

2. The rental price of machinery, equipment, and other assets shall be determined in accordance with the rental prices of equivalent machinery, equipment, and other assets in the local market of the host country, ensuring compliance with standards and norms stipulated in this Decree.

3. The Minister, Head of Central Agencies, Provincial People's Council shall decide or delegate authority to make decisions[53] on leasing machinery, equipment, and other assets to ensure thrift and efficiency.

Article 32. Allocation of Budget for Use of Common Office Machinery and Equipment

1. The allocation of budget for the use of common office machinery and equipment shall be implemented voluntarily and applied in the following cases:

a) Positions with standards and norms but not yet equipped with machinery and equipment according to those standards and norms;

b) Existing common office machinery and equipment that are damaged, unusable, or unsafe when used and meet the conditions for disposal.

2. The level of budget allocation for the use of common office machinery and equipment shall be determined according to the following formula:

Where:

- The market price of new common office machinery and equipment is the general price on the market (price listed or announced by suppliers in the host country or obtained from officially published information by suppliers under the laws of the host country through the Internet for machinery and equipment according to technical standards) or reference prices from previous purchases, ensuring they do not exceed the ceiling price stipulated in Article 25 of this Decree.

- The usage period of common office machinery and equipment shall be determined according to the laws of the host country; if the laws of the host country do not specify, it shall be implemented according to the laws of Vietnam. For common office machinery and equipment not regulated by the laws of the host country or Vietnam, the usage period shall be calculated as five years.

3. Based on the type of common office machinery and equipment and the actual working conditions of officials, civil servants, and employees at Vietnamese agencies abroad, The Minister, Head of Central Agencies, Provincial People's Council shall decide or delegate authority to make decisions[54] on the allocation of budget for the use of common office machinery and equipment for positions at Vietnamese agencies abroad to ensure security, safety, and full performance of assigned functions and tasks; ensuring thrift and efficiency.

4. Positions receiving budget allocation for the use of common office machinery and equipment shall be responsible for self-provisioning, maintenance, and repair of machinery and equipment to ensure service requirements for work.

5. The allocated budget shall be paid to the recipient along with monthly subsistence allowances.

Article 33. Liquidation of machinery, equipment, and other assets

1. The liquidation of machinery, equipment, and other assets shall be carried out in accordance with the laws of the host country; in cases where the laws of the host country do not provide for such matters, they shall be carried out in accordance with the laws of Vietnam.

2. In cases where machinery, equipment, and other assets are related to state secrets or national preservation, their liquidation shall be carried out in accordance with relevant laws.

3. Minister, Head of Central Agency, Provincial People's Council decides or delegates authority to decide on the liquidation of machinery, equipment, and other assets.

4. The proceeds from the liquidation of machinery, equipment, and other assets, after deducting related expenses, shall be deposited into the State Treasury Temporary Holding Fund at Vietnamese agencies abroad.

Chapter V

IMPLEMENTING PROVISIONS

Article 34. Implementation Provisions

[56]

1. This Decree takes effect from January 1, 2018.

2. Matters concerning the management and use of public assets of Vietnamese agencies abroad that are not specified in this Decree shall be implemented in accordance with the provisions of the Law on Management and Use of Public Assets and guiding documents.

3. Repeal Decree No. 23/2010/NĐ-CP dated March 12, 2010 of the Government on the management and use of state assets of Vietnamese agencies abroad, Decision No. 08/2012/QĐ-TTg dated February 8, 2012 of the Prime Minister on standards, quotas, and management and use systems for office premises, activity bases, and housing of Vietnamese agencies abroad, Decision No. 30/2010/QĐ-TTg dated March 15, 2010 of the Prime Minister on the issuance of standards, quotas, and management and use systems for transportation means serving the work of Vietnamese agencies abroad, Circular No. 341/2016/TT-BTC dated December 29, 2016 of the Ministry of Finance on standards, quotas, and management and use systems for machinery and equipment of Vietnamese agencies abroad.

Article 35

(Repealed)

Article 36. Responsibility for Implementation

1. The Ministry of Finance shall guide the organization and implementation of this Decree.

2[58]. Ministers, Heads of Central Agencies, Chairpersons of Provincial People's Committees shall have the responsibility:

a) To direct and guide Vietnamese agencies abroad under their jurisdiction to manage and use office premises, activity bases, housing, and private residences of Ambassadors; cars and other transport vehicles: machinery, equipment, and other assets of Vietnamese agencies abroad (including rented houses of Vietnamese agencies abroad) in accordance with this Decree and other relevant documents;

b) To organize inspections, audits, and handle violations of laws regarding the management and use of public assets of Vietnamese agencies abroad under their jurisdiction within their authority;

c) To direct the reporting and data entry of public assets of Vietnamese agencies abroad under their jurisdiction into the National Database on Public Assets in accordance with the guidance of the Ministry of Finance;

d) To perform other tasks and powers as stipulated in this Decree and relevant laws.

2a[59]. Provincial People's Council decides or delegates authority to decide on the management and use of public assets under local jurisdiction in accordance with Clause 2 of Article 17 of the Law on Management and Use of Public Assets.

3. Heads of Vietnamese agencies abroad shall be responsible for performing rights and obligations as prescribed in Article 23 of the Law on Management and Use of Public Assets.

[1] This document is consolidated from the following two Decrees:

- Decree No. 166/2017/NĐ-CP dated December 31, 2017 of the Government on standards, quotas, and management and use systems for public assets of Vietnamese agencies abroad, which took effect from January 1, 2018.

- Decree No. 171/2024/ND-CP dated December 27, 2024, of the Government amending and supplementing certain articles of Decree No. 166/2017/ND-CP dated December 31, 2017, of the Government stipulating standards, quotas, and management and usage regulations for state assets of Vietnamese agencies abroad, shall take effect from January 1, 2025.

This Consolidated Document does not replace the aforementioned two Decrees.

[2] The basis for promulgating Decree No. 171/2024/ND-CP dated December 27, 2024, is as follows:

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Management and Usage of State Assets dated June 21, 2017; the Law Amending and Supplementing Certain Articles of the Securities Law, Accounting Law, Independent Audit Law, State Budget Law, Law on Management and Usage of State Assets, Tax Administration Law, Personal Income Tax Law, National Reserve Law, Administrative Violation Handling Law dated November 29, 2024;

Pursuant to the Law on Agencies Representing the Socialist Republic of Vietnam Abroad dated June 18, 2009; the Law Amending and Supplementing Certain Articles of the Law on Agencies Representing the Socialist Republic of Vietnam Abroad dated November 21, 2017;

At the proposal of the Minister of Finance,

The Government promulgates this Decree amending and supplementing certain articles of Decree No. 166/2017/ND-CP dated December 31, 2017, of the Government stipulating standards, quotas, and management and usage regulations for state assets of Vietnamese agencies abroad.

[3] This Clause is amended according to Clause 1, Article 1 of Decree No. 171/2024/ND-CP dated December 27, 2024, and shall take effect from January 1, 2025.

[38] This clause is repealed pursuant to Clause 3 Article 2 Decree No. 171/2024/NĐ-CP dated December 27, 2024, and shall take effect from January 1, 2025.

[55] Replace the phrase “The head of the Vietnamese agency abroad decides" with the phrase "The Minister, Head of Central Agency, Provincial People's Council decides or delegates decision-making authority", pursuant to Point b Clause 1 Article 2 Decree No. 171/2024/NĐ-CP dated December 27, 2024, and shall take effect from January 1, 2025.

[56] Article 3 of Decree No. 171/2024/NĐ-CP dated December 27, 2024 stipulates the effective implementation clauses as follows:

Article 3. Implementation Provisions

1. This Decree takes effect from January 1, 2025.

2. Transitional Provisions

a) In cases where households, central agencies, provincial People's Committees have issued standards and usage quotas for specialized assets before this Decree takes effect, and such standards and quotas remain consistent with the provisions of this Decree, they shall continue to be implemented according to the previously issued standards and quotas.

b) For construction projects of office premises, public service facilities, housing, and ambassadors' residences that have been approved by competent authorities in accordance with regulations prior to the effective date of this Decree but have not yet commenced construction, the competent authority or person authorized to decide on investment construction may choose to continue implementing the project according to the approved plan or adjust the investment project to comply with the standards and quotas set forth in this Decree, ensuring that the total investment amount of the project does not change due to adjustments in area. The adjustment of the investment project shall be carried out in accordance with laws on public investment and related laws.

c) In cases where housing leases are governed by the standards prescribed in Decree No. 166/2017/NĐ-CP, the leased housing should continue to be used until close to the end of the lease term as stipulated in the signed lease agreement. After the lease expires and is not renewed, based on the budget estimate allocated and other permissible funding sources under the law, the competent authority or person authorized to decide on asset leasing shall consider and decide on leasing housing according to the standards and quotas specified in this Decree.

3. The Minister, Heads of Central Agencies, Chairmen of Provincial People's Committees, Heads of Organizations, Units, and positions working at Vietnam's offices abroad are responsible for implementing this Decree.

[57] This provision is repealed pursuant to Clause 3, Article 2 of Decree No. 171/2024/NĐ-CP dated December 27, 2024, and takes effect from January 1, 2025.

[58] This clause has been amended pursuant to Clause 19, Article 1 of Decree No. 171/2024/NĐ-CP dated December 27, 2024, and takes effect from January 1, 2025.

[59] This clause has been added pursuant to Clause 19, Article 1 of Decree No. 171/2024/NĐ-CP dated December 27, 2024, and takes effect from January 1, 2025.
