CIRCULAR

REGULATIONS ON AIRCRAFT PILOTING AND FLIGHT SUPPORT FOR SPECIAL MISSIONS

Circular No. 28/2010/TT-BGTVT dated September 13, 2010, issued by the Minister of Transport, detailing regulations on aircraft piloting and flight support for special missions, effective from October 28, 2010, has been amended and supplemented by:

Circular No. 53/2015/TT-BGTVT dated September 24, 2015, issued by the Minister of Transport, amending and supplementing certain articles of Circular No. 28/2010/TT-BGTVT dated September 13, 2010, issued by the Minister of Transport, detailing regulations on aircraft piloting and flight support for special missions, effective from December 1, 2015.

Pursuant to the Civil Aviation Law of Vietnam 2006;

Pursuant to the Law on Legislative Documents of 2008;

Pursuant to Decree No. 24/2009/NĐ-CP dated March 5, 2009, issued by the Government, detailing and providing implementation measures for the Law on Issuing Legal Normative Documents; Pursuant to Decree No. 51/2008/NĐ-CP dated April 28, 2008, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 03/2009/NĐ-CP dated January 9, 2009, issued by the Government, on aircraft piloting and flight support for special missions;

The Minister of Transport hereby details regulations on aircraft piloting and flight support for special missions as follows:

Chapter 1

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates the organization, implementation, and assurance of special mission flights of Vietnam. In cases where there are requirements from authorized agencies as provided for in Article 9 of Decree No. 03/2009/NĐ-CP dated January 9, 2009, issued by the Government, on aircraft piloting and flight support for special missions, the provisions of this Circular shall also apply to special mission flights of foreign countries flying to, departing from, or within the airspace of Vietnam.

2. The objects subject to this Circular include organizations and individuals related to the organization and implementation of special mission flight support.

Article 2. Requirements for Vietnamese airlines performing special mission duties

1. Possess a valid aircraft operator certificate issued by the Civil Aviation Administration of Vietnam; have the capacity and scope of operation approved in the certificate that are appropriate to the assigned special mission duties.

2. Have at least five years of experience operating commercial aircraft; have a safety management program and reliability program for aircraft operation and technical assurance in accordance with regulations, fully and comprehensively meeting aviation safety requirements.

Chapter 2

AIRCRAFT, CREW, AND PERSONNEL ON BOARD PERFORMING SPECIAL MISSION DUTIES

Article 3. Requirements for aircraft performing special mission duties

1. Registered with Vietnamese nationality and operated by an airline complying with the provisions of Article 2 of this Circular.

2. Belong to a type of aircraft with two or more engines.

3. Possess a valid airworthiness certificate.

4. At the time of performing special mission duties, must meet the following requirements:

a) Ensuring maintenance work for the aircraft and equipment installed on the aircraft according to the approved maintenance schedule;

b) Fully implementing all airworthiness directives applicable to that type of aircraft;

c) Not having any malfunctions occurring on the same equipment or system with similar malfunction phenomena within three days of operation or seven consecutive flights without thorough rectification, or malfunctions allowed to be deferred according to the Minimum Equipment List (MEL) on critical systems of the aircraft, including propulsion systems, fire detection and extinguishing, hydraulic, and aircraft control systems;

d) Having all emergency and safety equipment in operational readiness.

5. The aircraft body's service life must not exceed 2/3 of its lifespan (life limit), if applicable, as specified by the manufacturer based on calendar time, flight hours, or takeoff and landing cycles.

6. Operation and maintenance records must be complete and clear at the time of preparing for the special mission flight.

7. Must have a configuration capable of meeting diplomatic ceremony requirements when requested.

8. Must have a minimum of two lie-flat seats or comfortable seats for rest for special mission passengers when the flight duration exceeds four hours.

9. Approved in writing by the General Director or Director of the Vietnamese airline for the aircraft to perform special mission duties.

Article 4. Requirements for engines installed on aircraft serving as special aircraft

1. Must be operated and maintained in accordance with operational manuals and maintenance programs approved by the Civil Aviation Administration of Vietnam.

2. Must have complete and clear operational and maintenance records or major overhaul history.

3. Must not have recurring malfunctions on the same equipment or system with similar malfunction phenomena occurring within a period of three (3) days of operation or seven (7) consecutive flights without being thoroughly resolved, or malfunctions permitted to be deferred according to the Minimum Equipment List (MEL) documentation on critical engine systems such as control systems, fire warning and extinguishing systems, and engine performance parameter indicators.

4. Must be authorized in writing by the General Director or the Director of a Vietnamese airline company to be used for aircraft serving as special aircraft.

Article 5. Pilot Standards for Special Aircraft

1. Must meet conditions appropriate to the type and nature of aircraft operations as prescribed.

2. For Vietnamese pilots:

a) Must possess professional expertise, piloting skills, and proficiency in English at level four (4) or higher according to International Civil Aviation Organization standards;

b) Must have accumulated a minimum of 4,000 flight hours for the chief pilot and 2,000 flight hours for the co-pilot in cases where the average flight duration of the aircraft exceeds two (2) hours; 3,000 flight hours for the chief pilot and 1,500 flight hours for the co-pilot in cases where the average flight duration of the aircraft is less than two (2) hours;

c) Must have accumulated a minimum of 500 flight hours on special aircraft in their respective piloting positions, and 300 flight hours in cases where the average flight duration is less than two hours.

For newly introduced aircraft types, within one (1) year from the date of operation commencement, if there is a requirement to perform special aircraft duties, the aircraft operator must assess the pilot's capability based on having met the accumulated flight hour requirements stipulated herein for previously operated special aircraft types, and report to the Civil Aviation Administration of Vietnam for monitoring.

d) Must have good moral character, work style, sense of responsibility, and organizational discipline, with a clear record;

đ) Must not have committed any violations that threaten safety at or above the level of reprimand during the past twenty-four (24) months prior to undertaking special aircraft missions;

e) Must be authorized in writing by the General Director or the Director of a Vietnamese airline company to undertake special aircraft duties.

3. For foreign pilots:

a) Must have entered into a labor contract with the airline performing special aircraft duties for a minimum of twenty-four (24) months up to the time of selection for special aircraft service; in exceptional cases requiring the use of newly introduced aircraft types operated in Vietnam for less than twenty-four (24) months, pilots with contracts of at least three (3) months may be utilized;

b) Must hold a pilot license issued by the Civil Aviation Administration of Vietnam for the appropriate aircraft type and qualifications suitable for the anticipated special aircraft duties;

c) Must possess professional expertise, a sense of responsibility, and organizational discipline to successfully fulfill Vietnamese special aircraft duties;

d) Must meet the pilot standards for special aircraft as specified in points b, c, d, and đ of Clause 2 of this Article;

đ) Must perform special aircraft duties alongside Vietnamese pilots.

e) Must be authorized in writing by the General Director or the Director of a Vietnamese airline company to undertake special aircraft duties.

Article 6. Standards for Cabin Crew Serving on Special Aircraft

1. Meet the knowledge requirements for passenger cabin safety as prescribed.

2. Hold Vietnamese citizenship.

3. Have accumulated at least 700 hours of cabin crew service experience.

4.4 Have accumulated at least 100 hours of cabin crew service experience on special aircraft.

For new types of aircraft, within one year from the date of operation commencement, if there is a requirement to perform special aircraft duties, the aircraft operator shall be responsible for assessing the cabin crew's capability based on having met the total number of accumulated flight hours stipulated in this point for the previous type of aircraft performing special aircraft duties, and report to the Vietnam Civil Aviation Authority for supervision.

5. Possess good moral conduct, work style, sense of responsibility, organizational discipline awareness, and clear background.

6. Not have committed any disciplinary violations punishable by reprimand or higher within twelve months prior to the date of selection for special aircraft service.

7. Be authorized in writing by the General Director or Director of the Vietnamese airline to perform special aircraft duties.

Article 7. Standards for Technical Personnel Accompanying Special Aircraft

1. Be Vietnamese or foreign nationals, meeting the standards for aircraft technical personnel as prescribed.

2. Hold a certificate confirming completion of maintenance level B1, B2, or C for the type of aircraft they accompany.

3. Possess good moral conduct, work style, sense of responsibility, organizational discipline awareness, and a clear background.

4. Not have committed any disciplinary violations punishable by reprimand or higher within twelve months prior to the date of selection for special aircraft service.

5. Be authorized in writing by the General Director or Director of the Vietnamese airline to perform special aircraft duties.

Article 8. Confirmation of Technical Status of Special Aircraft

1. In addition to complying with regulations on maintenance completion confirmation, the authorized technical staff of the Vietnamese airline performing special aircraft duties must sign off on the satisfactory preparation of the special aircraft's technical status in the special aircraft flight logbook.

2. The technical staff referred to in Clause 1 of this Article may be Vietnamese or foreign nationals, authorized in writing by the General Director or Director of the Vietnamese airline to perform special aircraft duties.

Article 9. Management of the List of Special Aircraft, Engines, and Crew Lists for Special Aircraft Duties

1. The Vietnamese airline performing special aircraft duties shall establish, manage, and notify in writing to the Vietnam Civil Aviation Authority the list of special aircraft, engines installed on Vietnamese special aircraft, and the list of crews and technical personnel authorized to perform special aircraft duties, meeting the requirements and standards stipulated in Articles 3, 4, 5, 6, 7, and 8 of this Circular.

2. The Vietnamese airline performing special aircraft duties shall notify in writing and by fax to the relevant airport authority the complete list of non-crew personnel of the airline accompanying the aircraft to serve the special aircraft flight before embarking passengers onto the aircraft.

Chapter 3

AIRPORT, AIRFIELD

Article 10. Designated Area for Special Aircraft Flights

1. The airport operator must determine the parking area, aircraft parking position, and passenger terminal to serve special aircraft flights.

2. The parking area and aircraft parking position designated for special aircraft must be surrounded by protective corridors and other security and safety conditions for the special aircraft; ensuring security, safety, solemnity, and convenience for welcoming and seeing off special aircraft guests.

3.5 The airport operator must specify in the airport operation documentation the procedures for operating the parking area, parking positions, taxiways, and passenger terminals serving special aircraft flights at airports under their management.

4.6 The airport operator must take the lead and coordinate with air service providers at the airport to determine the areas and procedures for serving cargo and baggage of special aircraft delegations in the airport operation documentation, ensuring convenience, speed, and compliance with relevant aviation security and safety regulations.

Article 11. Runway, Taxiway, Aircraft Parking Area, and Equipment Systems Ensuring Flight Operations for Special Aircraft Flights

1. The airport operator must carry out runway, taxiway, and aircraft parking area inspection work to ensure safe conditions for flight operations. Inspection work must be completed within 30 to 45 minutes before the scheduled landing or takeoff time of the special aircraft.

2. The airport operator must establish a list, content, and implement inspection work on the technical condition of primary and backup equipment systems ensuring flight operations for the managing enterprise. Inspection work must be completed within 90 to 180 minutes before the scheduled landing or takeoff time of the special aircraft.

3. The inspection work specified in Clause 1 and Clause 2 must be documented and stored at relevant units.

Article 12. Restrictions on Airport Operations During Special Aircraft Activities

1.7 For arrival flights: Five minutes before the aircraft lands, the designated runway must be reserved exclusively for the special aircraft; after the aircraft has landed and moved away from the runway, the runway returns to normal operation and the designated taxiway and parking area are reserved for the special aircraft; the taxiway may only return to normal operation after the special aircraft has entered the parking area. where C is the maximum allowable value of the pollutant parameter in bioethanol production effluent when discharged into receiving water bodies, expressed in milligrams per liter (mg/L); 2.8 For departure flights: The special aircraft's parking position must be protected and isolated from the time the aircraft arrives at the position to prepare for the flight; from the moment the engine start command is given, the air traffic control facility reserves the taxiway for the special aircraft, after the special aircraft moves onto the taxiway, the parking area returns to normal operation. Five minutes before the special aircraft takes off, the air traffic control facility reserves the runway for the special aircraft, after the special aircraft reaches the takeoff hold point, the taxiway may return to normal operation. After the special aircraft takes off, the runway may return to normal operation. For airports with multiple runways, the runway not planned for the special aircraft's takeoff and landing may operate normally according to the parallel runway operation regulations.

3. The airport operator is responsible for promptly notifying via radio and/or telephone persons and vehicle operators currently operating in areas related to special aircraft flight activities to be aware and comply with airport operational restrictions during special aircraft flight activities.

4. Upon notification of operational restrictions, persons and vehicles not serving special aircraft currently operating in areas related to special aircraft flight activities must temporarily cease operations.

5. The provisions of Clauses 1, 2, 3, and 4 of this Article do not apply in cases of emergency airport situations.

AIR TRAFFIC CONTROL ASSURANCE

Chapter 4

ĐẢM BẢO HOẠT ĐỘNG BAY

Article 13. Air Traffic Information Notification

1. The Vietnam Air Traffic Management Corporation shall be responsible for issuing NOTAMs regarding restrictions on operations at airports upon receipt of notifications from the Civil Aviation Administration of Vietnam concerning plans for special aircraft flights and any amendments or supplements thereto.

2.9 When the expected takeoff or landing time of a special aircraft differs from the planned air traffic control time by more than 10 minutes, the following actions shall be taken:

a) For arrival flights: the regional air traffic management company shall promptly notify the airport operator; the airport operator shall promptly notify the airport authority, the air traffic information center, and the aircraft operator.

b) For departure flights: the airline shall promptly notify the airport operator; the airport operator shall promptly notify the airport authority, the regional air traffic management company, and the air traffic information center.

c) Relevant units shall implement support services for special aircraft according to their functions and tasks based on the adjusted plan.

Article 14. Standards for Air Traffic Controllers

1. Meeting general standards prescribed for air traffic controllers.

2. Possessing professional skills and experience in handling unexpected situations during flight operations.

3. Having continuously managed flight activities at air navigation service facilities for at least three years.

4. Demonstrating good moral character, work style, sense of responsibility, organizational discipline, and clear background.

5. Not having committed any violations that threaten flight safety within twelve months prior to performing special aircraft duties.

6. Being assessed and authorized in writing by the head of the air navigation service provider or their delegate to perform special aircraft support tasks for subordinate air traffic controllers.

Article 15. Separation Between Special Aircraft and Other Aircraft and Separation Between Special Aircraft

1. Within the airport area: The separation between special aircraft and other aircraft on the ground within the operational area must comply with the limitations set forth in Article 12 of this Circular.

2. In the approach control area, the practice of overtaking special aircraft along the same route or track shall not be applied. The minimum separation value between special aircraft and other aircraft in the approach control area shall be as follows:

a) Radar separation: 10 nautical miles;

b) Other forms of separation shall be applied according to the standard.

3. In the en-route control area:

a) Minimize changes in the cruise altitude and direction of special aircraft compared to the planned flight path;

b) Do not request changes in the speed of special aircraft;

c) The minimum separation value between special aircraft and other aircraft in the en-route control area shall be as follows: radar separation: 20 nautical miles; other forms of separation shall be applied according to the standard.

4. The separation between special aircraft shall be applied according to the current air traffic control separation standards.

Article 16. Management of the List of Non-Pilot Air Traffic Controllers for Special Aircraft Flights

The enterprise providing air traffic service or the authorized person is responsible for establishing and managing the list of non-pilot air traffic controllers permitted to operate special aircraft flights.

Article 17. Priority Principles in Air Traffic Control for Special Aircraft Flights When Multiple Aircraft Are Operating Simultaneously

1. During takeoff: the aircraft on special aircraft mission has the right to take off after combat aircraft have taken off.

2. During landing: the special aircraft has the right to land after emergency landing aircraft and aircraft with insufficient fuel to perform holding or safe alternate airport operations.

Chapter 5

AIRPORT SECURITY

Article 18. Cards and Permits for Airport Security Control Issued to Personnel and Means Serving Special Aircraft Flights

1. The subjects, authority to issue, manage, and use cards and permits for airport security control for personnel and means serving special aircraft flights shall be detailed in the Civil Aviation Security Program and Civil Aviation Security Quality Control issued by the Minister of Transport.

2. The head of the unit participating in serving special aircraft flights and passengers thereof registers a list of regular flight service personnel and passengers with the Vietnam Civil Aviation Authority and Regional Civil Aviation Office to obtain multiple-use cards, specifying the regular duties of the card applicants and the total number of multiple-use security control cards.

3. The head of the unit managing means operating directly in the flight area for special aircraft flights registers a list of such means with the Regional Civil Aviation Office to obtain multiple-use permits, specifying the functions of the means for special aircraft flights.

4. The head or authorized person of the unit participating in serving special aircraft flights registers with the Civil Aviation Office a list of persons and means applying for single-use cards and permits, presents security control cards or identification documents, signs in the issuance tracking book. After completing the special aircraft service work, the signatory is responsible for recovering and returning the issued cards and permits to the Civil Aviation Office and signing confirmation of full return.

5. The head or authorized person of the unit responsible for serving and welcoming special aircraft passengers registers with the Civil Aviation Office a list of persons and means applying for single-use cards and permits, presents security control cards or identification documents; submits identification documents of the card applicants, signs in the issuance tracking book. After completing the work, the signatory is responsible for recovering and returning the issued cards and permits to the Civil Aviation Office, signing confirmation of full return, and retrieving submitted identification documents.

6. The location for issuing single-use cards and permits must be outside the special aircraft service area. The signatures of those registering to receive cards and permits as stipulated in Clause 4 and Clause 5 of this Article must be registered in advance with the Civil Aviation Office. The issuance and recovery of cards and permits must be recorded and retained in the issuance book by the issuing authority with the following contents: name of the recipient, place of work, duty performed, card and permit number, signature, issuance and return.

Article 18a. Exemption from aviation security inspection

1. Persons and carry-on baggage of subjects served on special aircraft flights as prescribed in Article 5 of Decree No. 03/2009/NĐ-CP dated January 9, 2009 of the Government on ensuring special aircraft flight operations shall be exempted from aviation security inspection.

2. Aviation security inspection shall be exempted for high-ranking Party officials, State officials, and foreign diplomatic representatives coming to receive or see off subjects served on special aircraft flights, including:

a) Heads of Party bodies under the Central Committee and equivalent positions or higher;

b) Ministers and equivalent positions or higher;

c) Secretaries and Chairmen of provincial-level cities directly under the Central Government and equivalent positions or higher;

d) Heads of foreign diplomatic agencies in Vietnam.

3. Aviation security control forces shall cooperate with units under the Command of Security Guard - Ministry of Public Security in conducting aviation security inspections and monitoring special aircraft flights according to regulations on ensuring special aircraft flight operations.

Article 19. Ensuring public order and aviation security in public areas and restricted areas of airports when there are special aircraft flights

1. Aviation security control forces shall coordinate with local police to establish checkpoints at entrances and exits and public areas of airports; deploy aviation security personnel, equipment, and support tools in conjunction with local police to organize patrols, controls, and maintain order in public areas of airports throughout the preparation and service of special aircraft; promptly detect, prevent, and handle actions that threaten the security and safety of special aircraft flights.

2. Enterprises providing aviation security services at airports shall allocate sufficient security personnel and equipment to monitor and control people, vehicles entering and exiting, and activities within the special aircraft service area; luggage and goods brought into the special aircraft service area; prevent, detect, and stop actions threatening the security and safety of special aircraft flights.

Article 20. Ensuring security for meals served to special aircraft passengers

1. Food processing enterprises shall be responsible for ensuring food safety and security for meals served on special aircraft departing from Vietnam; seal and retain meal samples for special aircraft passengers for at least 24 hours from the time they are loaded onto the aircraft.

2. The aviation security control force shall be responsible for coordinating with the airline operating the special aircraft flight and the food processing enterprise to visually inspect meals for special aircraft departing from Vietnam before placing them in the aircraft's meal storage compartment, sealing the storage compartment securely, and deploying aviation security personnel to escort the meals from the processing location to the aircraft.

3. Airlines operating special aircraft flights shall coordinate with the Command of Security Guard to conduct appropriate security checks on meals for special aircraft flights when abroad.

4. The flight crew may only accept sealed security storage compartments containing meals for special aircraft passengers onboard the aircraft.

Article 21. Quality of fuel for special aircraft

1. The airline shall inspect and supervise the assurance of fuel quality for special aircraft in accordance with regulations.

2. Fuel must have a Certificate of Fuel Quality Inspection before being loaded onto special aircraft.

3. Remaining fuel on board the aircraft must be inspected according to aircraft maintenance documentation; fuel that does not meet requirements must be removed from the aircraft, and the aircraft's fuel tank must be cleaned before refueling.

4.19 Security inspection work for vehicles and personnel operating fuel transportation for special aircraft before entering the airport area in Vietnam:

a) In cases where fuel transport vehicles pass through public areas, they must be accompanied by security personnel from the fueling unit.

b) Airport security forces are responsible for inspecting all fuel transportation vehicles, ensuring that the discharge and loading ports of the fueling vehicles remain sealed before entering restricted areas.

c) The fueling unit must assign skilled and morally upright personnel to operate the vehicle and perform fueling tasks; strictly follow the procedures for inspecting fueling vehicles and equipment before commencing fueling operations.

5.20 Security and safety inspection and supervision work before and during the fueling of special aircraft:

a) Fueling of aircraft in Vietnam is carried out under direct supervision of a monitoring team consisting of representatives from the Port Authority, the technical preparation team for special aircraft, the airport operator, the airport security control unit, and the fueling unit, with a record made by a representative of the Port Authority.

b) Fueling of aircraft abroad is carried out under direct supervision of a monitoring team consisting of representatives from the technical preparation team for special aircraft and the General Staff of Escort Services.

c) The monitoring team is responsible for: verifying the legality of the Fuel Quality Inspection Certificate; checking the seals on the discharge and loading ports of the fueling vehicle; supervising the entire fueling process; and supervising the sampling and sealing of samples after fueling when the operation takes place in Vietnam.

d) The Fuel Quality Inspection Certificate according to the standard TCVN ISO/IEC 17025 specified in this clause must be signed and confirmed by the head or authorized person of the fuel supply unit or the person in charge of the testing laboratory.

6. Sampling, storing fuel samples, and fuel quality inspection certificates in Vietnam:

a) Before fueling, samples of remaining fuel on the aircraft and fuel in the fueling vehicle must be taken, sealed, and stored; storage containers must have a minimum capacity of 01 liter and be made of material that does not alter the properties of the fuel.

b) Each sample must clearly indicate: aircraft number being fueled, fueling vehicle number, sampling time, sampler's name, sealing date, sealer's name and signature.

c) The Fuel Quality Inspection Certificate and special aircraft fuel samples must be stored at the fuel supply unit and airport operator until the special aircraft safely lands at its destination airport.

7. For foreign special aircraft, implement the provisions of this Article and other requirements of the aircraft operator.

Article 22. Security Assurance for State Aircraft Flights

Clause 21. The enterprise providing air security services at airports shall arrange air security control forces to guard, monitor, and protect state aircraft from the time the aircraft is positioned for operation until the completion of the service for the state aircraft.

Clause 22. In cases where state aircraft are parked overnight, the airline must seal the aircraft doors and hand them over to the air security control force of the enterprise providing air security services at the airport; the area where the aircraft is parked must be adequately lit and guarded by personnel or monitored by cameras to detect and prevent unauthorized access to the aircraft. Stairs, airstair tubes, conveyor belts, and other service equipment must be removed from the aircraft.

Clause 23. The inspection, screening, and monitoring of air security for state aircraft, passengers, baggage, and cargo, as well as the assurance of air security during the flight, shall be carried out according to the provisions of the Civil Aviation Security Program and civil aviation security quality control, except for the cases specified in Clause 1 and Clause 2 of Article 18a of this Circular.

Clause 4. Air security inspection and monitoring of items served on state aircraft:

a) Items served on the aircraft must be inspected for air security using X-ray machines or visual inspections and continuously monitored for security until they are loaded onto the aircraft;

b) Items served on the aircraft when being loaded onto or unloaded from the aircraft must be inspected for security and counted and checked for types;

c) Items served on the aircraft that have been inspected and are used for regular domestic flights may remain on the aircraft for state aircraft flights without having to be unloaded and re-inspected for security.

Article 23. Security Assurance for Foreign State Aircraft Flights

Clause 1. The air security control force at the airport is responsible for inspecting all persons, baggage, goods, and items of the foreign state aircraft delegation at the airport; coordinating with the security of the foreign state aircraft delegation to escort checked baggage and goods from the security check point to the state aircraft.

Clause 2. For separate foreign state aircraft flights, if there is a diplomatic note from the foreign side informing Vietnam or a written request from the Ministry of Foreign Affairs not to conduct air security checks, the Civil Aviation Administration of Vietnam shall issue a document requesting the air security control force at the airport to implement the content of the diplomatic note or letter of request regarding persons, baggage, and goods of the foreign state aircraft delegation.

Clause 3. The airport operator, the enterprise providing air security services at the airport, shall cooperate with relevant agencies of the Ministry of Foreign Affairs and the General Guard Command to implement enhanced security measures for foreign state aircraft, delegations, baggage, and goods in the airport area upon request from authorized government agencies or through agreements with foreign representative offices.

Article 24. Management of Lists of Security Personnel and Aircraft Servicing Staff for Special Aircraft Flights in Vietnam

Aviation sector agencies and units shall establish lists of their personnel participating in servicing special aircraft flights and notify such lists to Civil Aviation Port Authorities and aviation security forces for monitoring purposes.

Chapter 6

RESPONSIBILITIES FOR GUARANTEEING SPECIAL AIRCRAFT FLIGHTS

Article 25. Responsibilities of the Civil Aviation Authority of Vietnam

1. Receive and implement tasks related to guaranteeing special aircraft flights conducted by Vietnamese airlines, foreign special aircraft flights, and any changes related to special aircraft flight plans to be communicated to the following entities:

a) Civil Aviation Port Authorities;

b) Vietnam Air Traffic Control Corporation;

c) Vietnam Airports Corporation and airport operators with special aircraft taking off and landing.

2. The deadlines for receiving and transmitting notifications of special aircraft flights of Vietnam are as follows:

a) For flights using separate aircraft: at least five days before the planned date for domestic flights; at least ten days before the planned date for international flights;

b) For combined commercial flights: at least twenty-four hours before the scheduled departure time for domestic flights; at least five days before the implementation date for international flights;

c) For unexpected special aircraft flights that do not meet the deadlines specified in points a and b of Clause 2 of this Article, the Civil Aviation Authority of Vietnam shall directly coordinate with relevant authorities to ensure compliance with the special aircraft standards set forth in Article 7 of Decree No. 03/2009/NĐ-CP dated January 9, 2009, issued by the Government regarding the guaranteeing of special aircraft flights concerning aircraft, crew, and fuel; and disseminate these requirements to relevant organizations and monitor their implementation.

3. Coordinate and unify the implementation plan for special aircraft flights with the airline assigned the task of executing the special aircraft flight and supervise the execution of the plan.

4. Organize supervision over the implementation of security and safety measures for special aircraft flights; urge and monitor the preparation work for special aircraft flights, and handle any unusual situations during the execution of special aircraft tasks.

5. Implement flight permits for special aircraft flights within its authority; coordinate and support Vietnamese airlines in obtaining flight permits from foreign countries for special aircraft flights.

Article 26. Responsibilities of Regional Civil Aviation Authorities

1. Receive special aircraft tasks from the Civil Aviation Authority of Vietnam.

2. Organize the implementation of special aircraft tasks to state management agencies operating at airports; coordinate with relevant agencies and organizations to execute special aircraft guaranteeing tasks.

3. Directly supervise the implementation of special aircraft tasks, adherence to technical standards, and security and safety measures for special aircraft flights by organizations and individuals under their jurisdiction at airports.

Article 27. Responsibilities of Airport Enterprises, Airport Operators, and Air Cargo Security Service Providers Where Special Aircraft Take Off and Land

1. Responsibilities of Airport Enterprises: direct, inspect, urge, and supervise the implementation of special aircraft guaranteeing tasks.

2. Responsibilities of Airport Operators

a) Lead the assurance of fire and explosion prevention for special aircraft, special aircraft passengers, and cargo and baggage of special aircraft passenger groups in the airport area; coordinate with the assurance of special aircraft security;

b) Arrange dedicated parking areas and security guards for special aircraft and lead coordination for guarding special aircraft;

c) Provide all favorable conditions for departments serving and preparing special aircraft to perform their duties, ensuring the schedule for takeoff and landing of special aircraft;

d) Coordinate the organization of appropriate welcoming and farewell ceremonies suitable to the nature of special aircraft tasks, meeting the requirements of competent authorities;

đ) For foreign special aircraft flights, airport operators shall coordinate with responsible agencies of the Ministry of Foreign Affairs and the Ministry of Public Security to enhance security and fire and explosion prevention for foreign special aircraft and passengers in the airport area when requested by foreign parties.

3. Responsibilities of Air Cargo Security Service Providers

a) Lead coordination for the security assurance of special aircraft, special aircraft passengers, and cargo and baggage of special aircraft passenger groups in the airport area;

b) For foreign special aircraft flights, air cargo security service providers shall coordinate with responsible agencies of the Ministry of Foreign Affairs and the Ministry of Public Security to enhance security for foreign special aircraft and passengers in the airport area when requested by foreign parties.

Article 28. Responsibilities of Air Carriers Fulfilling Official Aircraft Duties

1. Accept and implement tasks to ensure the operation of official aircraft flights.

2. Develop service plans for official aircraft, including: identifying the aircraft to be used for official duties, backup aircraft, flight routes, lists of countries requesting permission to fly through, land in, enter and exit, details related to exploitation, technical assurance, and report to the Civil Aviation Authority of Vietnam as follows:

a) For flights using separate aircraft: at least two days before the planned date for domestic flights; at least three days before the planned date for international flights;

b) For combined commercial flights: at least twelve hours before the scheduled departure time for domestic flights; at least two days before the planned date for international flights.

3. Organize the implementation of urgent official aircraft missions according to regulations for the aircraft, engines, and crew assigned to such missions, which are notified outside the deadlines specified in point c, Clause 2, Article 25 of this Circular, and report to the Civil Aviation Authority of Vietnam as soon as possible.

4. Apply for flight permits for Vietnamese official aircraft flights within the country in accordance with current regulations. Coordinate with the Consular Department of the Ministry of Foreign Affairs to apply for flight permits for Vietnamese official aircraft flights on international routes.

5. Establish procedures for serving, seating arrangements, and selecting passengers when serving official aircraft passengers together with regular passengers, notify the Central Party Office, National Assembly Office, State President's Office, Government Office, National Reception Service, Civil Aviation Authority of Vietnam, and organize its implementation.

6. Take the lead in coordinating with relevant units to ensure safety, security, and flight schedules for Vietnamese official aircraft throughout the mission; closely coordinate with the Central Party Office, National Assembly Office, State President's Office, Government Office, National Reception Service, and advance teams to develop service plans at foreign airports.

7. Lead and coordinate with relevant agencies and units to serve official aircraft passengers thoroughly and safely, meeting the requirements of authorized agencies; take the lead in guiding, maintaining order, and ensuring security on official aircraft when there are accompanying personnel and other individuals flying with the official passengers.

8. Coordinate to ensure safety and security for the cargo, luggage, documents, and property of the official aircraft passenger group.

9. Coordinate with the Security Guard Command to ensure security for the official aircraft, official passengers, luggage, and cargo of the official aircraft passenger group abroad.

10. For combined commercial official aircraft flights, Vietnamese air carriers are responsible for coordinating with relevant agencies and units to implement effective measures to minimize risks to the security and safety of official passengers; do not transport special passengers as required by aviation security regulations on combined commercial official aircraft flights.

Article 29. Responsibilities of Enterprises Providing Services to Ensure Flight Operations

1. Coordinate with the air traffic control agency and military airspace management agency to manage air traffic.

2. Coordinate the implementation of regulations regarding restricted operations at airports.

3. Ensure separation between official aircraft and other aircraft, flight corridors, and communication methods during the management of official aircraft flights.

4. Ensure continuous operation of air traffic control equipment throughout the management of official aircraft flights.

5. Be prepared to handle abnormal situations.

Article 30. Management of files for the execution of special aircraft missions

Agencies and units participating in the execution of special aircraft missions shall be responsible for recording and storing all details regarding the handover, preparation, implementation, and handling of incidents related to special aircraft missions in accordance with regulations on storage and state requirements.

Chapter 7

IMPLEMENTING PROVISIONS

Article 31. Effective Date

This Circular takes effect 45 days from the date of signature and revokes Decision No. 02/2004/QĐ-BGTVT dated February 23, 2004, issued by the Minister of Transport on the issuance of the Special Aircraft Civil Aviation Regulation.

Article 32. Responsibility for Implementation

The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular.
