Pursuant to Decree No. 29/CP dated March 30, 1994 of the Government on the tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of ministries and ministerial-level agencies;

Pursuant to Decision No. 15/1998/QĐ-BGD&ĐT dated April 1, 1998 by the Minister of Education and Training regarding the issuance of the "Regulation on Graduation Examinations for General Secondary Education, Specialized Secondary Education, and Junior Secondary Education"

At the proposal of the Director of the Secondary Education Department,

DECISION:

Article 1: Amend certain Articles in the "Regulation on Graduation Examinations for General Secondary Education, Specialized Secondary Education, and Junior Secondary Education" issued together with Decision No. 15/1998/QĐ-BGD&ĐT dated April 1, 1998 as follows:

1. Article 9 is amended as follows:

“Article 9: The subjects mentioned in Point 2 of Article 7 shall be recognized as meeting the conditions for examination if:

1. They have not exceeded 21 years old for the Junior Secondary Education graduation examination or 24 years old for the General Secondary Education (or Specialized Secondary Education) graduation examination.

2. They have a certificate of moral character:

- From the local authority (commune or ward) where they reside permanently or temporarily: Not during the period of pre-trial detention, detention, or deprivation of civil rights.

- From their former school: Not during the period of disciplinary action prohibiting them from taking examinations.

3. For students who are not allowed to take the examination due to poor academic performance, in addition to meeting the conditions 1 and 2 above, they must also be registered for an examination and re-evaluated by the school regarding their academic performance: If they still rank poorly, they will not be allowed to take the examination. The organization of the re-examination shall be carried out according to the regulations for retaking exams stipulated in Circular No. 29/TT dated October 6, 1990 by the Ministry of Education and Training.

In cases where they meet the conditions for examination, the Principal will record the points and confirm the new academic ranking in the student's transcript.

2. Amend Point 3 of Article 10 as follows:

“3. Students belonging to the category defined in Point 2, Article 7, in addition to the required documents specified in Point 1, must also provide:

3.1. An application form for the examination (according to the model) written by the student themselves.

3.2. A certificate of moral character: According to the contents of Point 2, Article 9.

3.3. Identity card or a letter of introduction from the People's Committee of the commune or ward.”

3. Amend the beginning of Article 24 concerning the composition of the Examination Board and examination supervision as follows:

“"d) Within no more than one working day from the date of receiving the dossier submitted for administrative procedures by the specialized agency assigned by the Provincial People's Committee, the Chairman of the Provincial People's Committee shall issue a notification of the result of the inspection of plant-based food exports or a certificate at the request of the importing country.": The Examination Board and examination supervision at the Ministry shall be established by the Minister's decision and include:

Chairman: Deputy Minister of Education and Training

Vice-Chairman: Director (or Deputy Director) of the Secondary Education Department, relevant Departments, and Head (or Deputy Head) of the Inspectorate of Education.

Members: Specialists from the Secondary Education Department, relevant Departments, and the Inspectorate of Education.

4. Add the following sentence at the end of Article 28:

“Each examination must include a main test and a backup test. Both tests should be of equivalent difficulty.”

5. Article 36 is amended as follows:

“Article 36: To ensure the democratic rights of students and parents, schools need to publicly post the preliminary list of graduating students and announce the examination scores immediately after the Provincial Department of Education and Training (for General Secondary Education and Specialized Secondary Education examinations) and the District Department of Education and Training (for Junior Secondary Education examinations) have reviewed the results and transferred them to the schools. Within seven days from the date of announcing the preliminary results, the schools (for General Secondary Education and Specialized Secondary Education) and the District Department of Education and Training (for Junior Secondary Education) shall organize the receipt of complaints about the examination and transfer the examination papers that meet the complaint criteria to the Provincial Department of Education and Training for resolution. Complaints about the examination shall be resolved according to the annual schedule and shall be processed immediately upon the expiration of the complaint submission period.

6. Article 37 is amended as follows:

“Article 37: 1. The resolution of complaints about examination scores shall be implemented as follows:

1.1. Students may complain about examination scores if the score is lower than the average score of the subject for the entire year (rounded to 0.5) by 2 points or more.

1.2. Re-examined examination papers shall be re-sealed and given to two examiners to independently re-grade and independently from the initial grading.

1.3. If the re-grading differs from the initial grading by less than 0.5 points, the initial grade shall remain unchanged.

1.4. Cases where the change is 2 points or more and where the graduation ranking changes from good to excellent shall require a dialogue between the re-graders and the initial graders.

All examination papers with adjusted scores after re-grading (including those without changes in the graduation result or ranking) must be reported to the Ministry of Education and Training (for General Secondary Education and Specialized Secondary Education) or the Provincial Department of Education and Training (for Junior Secondary Education) for approval. Examination papers (and seals attached) with changed scores must be sealed and separately preserved.

When necessary, the Ministry of Education and Training may establish a Review Board to review the re-grading results of the Provincial Department of Education and Training. The re-grading score by the Ministry shall replace the previous scores.

Within ten days from the conclusion of the Complaint Resolution Board's work, the Provincial Department of Education and Training shall notify the provisional results to the parties concerned.

After being approved by the Ministry (for General Secondary Education and Specialized Secondary Education) or the Provincial Department of Education and Training (for Junior Secondary Education), the resolution of examination complaints shall become officially valid.

2. Other complaints about the examination (other than scores and examination documents) shall be resolved by the Inspectorate of the Provincial Department of Education and Training according to general regulations.

Article 2: This Decision shall take effect fifteen days from the date of signature. All previous regulations that conflict with this Decision are hereby abolished.

The term "General Secondary Education" mentioned in this Regulation and Decision has the same meaning as "Secondary General Education" in the Education Law.

Article 3: Chairmen of the People's Committees of Provinces and centrally-administered cities, Heads of the Office, Directors of the Secondary Education Department, Heads of units related to the Ministry of Education and Training, and Directors of Provincial Departments of Education and Training are responsible for implementing this Decision.
