BASED ON ARTICLE 34 OF THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992;
BASED ON ARTICLE 69 OF THE LAND LAW PASSED BY THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM AT ITS NINTH SESSION ON JULY 14, 1993 AND ANNOUNCED BY THE STATE COUNCIL ON JULY 24, 1993 ON THE REGIME OF MANAGEMENT AND USE OF LAND FOR RELICS;BASED ON THE ORDINANCE ON THE PROTECTION AND USE OF HISTORICAL AND CULTURAL RELICS AND SCENIC SPOTS NUMBER 14-LCT/HĐNN ANNOUNCED ON APRIL 4, 1984 BY THE STATE COUNCIL OF THE SOCIALIST REPUBLIC OF VIETNAM;BASED ON DECREE NUMBER 81/CP OF NOVEMBER 8, 1993 ISSUED BY THE GOVERNMENT ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF CULTURE AND INFORMATION;
AFTER REVIEWING THE RELIC FILE AND THE DOCUMENT SUBMITTED BY THE CHAIRMAN OF THE PEOPLE'S COMMITTEE OF THAI NGUYEN PROVINCE;CONSIDERING THE PROPOSAL OF THE DIRECTOR OF THE HERITAGE PRESERVATION DEPARTMENT;NOW, WE RECOGNIZE: THE SCENIC RELIC LINH SON CAVE IN LINH SON COMMUNE, DONG HI DISTRICT, THAI NGUYEN PROVINCE
ALL CONSTRUCTION AND EXPLOITATION ACTIVITIES ARE STRICTLY PROHIBITED IN THE ZONED AREAS OF THE RELIC. SPECIAL CASES OF LAND USE IN HISTORICAL AND CULTURAL RELICS AND SCENIC SPOTS MUST BE APPROVED BY THE MINISTER OF CULTURE AND INFORMATION.
THE PEOPLE'S COMMITTEES AT ALL LEVELS SHALL BE RESPONSIBLE FOR IMPLEMENTING THE STATE MANAGEMENT OF HISTORICAL AND CULTURAL RELICS AND SCENIC SPOTS IN ACCORDANCE WITH THE LAW.THE SECRETARY OF THE MINISTRY'S OFFICE, THE DIRECTOR OF THE HERITAGE PRESERVATION DEPARTMENT, THE CHAIRMAN OF THE PROVINIAL PEOPLE'S COMMITTEE, AND THE DIRECTOR OF THE DEPARTMENT OF CULTURE AND INFORMATION OF THAI NGUYEN PROVINCE SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
Upon the proposal of the Director of the Museum Conservation Department,
DECISION:
Article 1. hereby recognizes: The scenic historical site LINH SƠN CAVE Linh Son Commune, Dong Hỷ District, Thai Nguyen Province
Article 2. Strictly prohibit all construction and exploitation activities within the delineated areas of the heritage site. In exceptional cases where land use is required for historical and cultural sites and scenic spots, permission from the Minister of Culture and Information must be obtained.
Article 3. People's Committees at all levels shall be responsible for exercising state management over historical and cultural relics and scenic spots in accordance with the law.
Article 4. The Heads of the Ministry’s Office, the Director of the Museum Conservation Department, the Chairman of the Provincial People's Committee, and the Director of the Provincial Department of Culture and Information, Thai Nguyen Province, are responsible for implementing this Decision./.
