 RESOLUTION

The regular session of the Government in June 2001.

On July 3 and 4, 2001, the Government convened its regular session for June 2001 to discuss and adopt the following issues::

1The Government heard the Minister of Justice's report on the Draft Proposal "Some Opinions on Issues for Amending and Supplementing the 1992 Constitution"; and the Head of the Government Organization-Cadre Department's report on the Draft Proposal "Basic Contents for Amending and Supplementing the Law on the Organization of the Government, the Law on the Organization of People's Councils and People's Committees, and the Law on the Election of Deputies to People's Councils."

Since its promulgation, the 1992 Constitution has timely institutionalized the Party's policies in the early years of renewal, providing a legal foundation for transitioning Vietnam's economy from a planned, centralized, bureaucratic, and subsidized system to a multi-sector market economy operating under a socialist-oriented market mechanism. By now, the country has entered a new phase of development with the important task of accelerating industrialization and modernization, aiming to maintain independence and unity, achieve prosperity for the people and strength for the nation, and build a fair, democratic, and civilized society. Therefore, the Constitution needs to be amended and supplemented to align with the new perspectives summarized at the Ninth National Congress of the Communist Party regarding the functions and responsibilities of state machinery, the market economy, and international economic integration... The amendment of the Constitution this time must harness the strength of the great national solidarity, continue to eliminate factors that are no longer appropriate, pave the way for economic, cultural, educational, scientific, and technological reforms, based on clearly defining the powers and responsibilities of legislative, executive, and judicial bodies, and building a truly people's rule-of-law state.

Regarding the contents for amending and supplementing the Law on the Organization of the Government, the Law on the Organization of People's Councils and People's Committees, and the Law on the Election of Deputies to People's Councils, the Government believes that it is necessary to more clearly define the powers and responsibilities of the Government, the Prime Minister, Ministers, and Chairpersons of People's Committees; delineate the functions and tasks between different levels of government, moving towards reforming the administrative apparatus at all levels to enhance the effectiveness of the Government's and local governments' operations.

The Ministry of Justice, the Government Organization-Cadre Department, the Government Office, and related agencies are tasked with incorporating the opinions of Government members, perfecting the draft proposals for amending the Constitution and the aforementioned Laws, and submitting them to the Prime Minister for consideration and decision on presenting to the Politburo.

2.The Government heard the Minister of Justice's presentation on the draft Resolution of the Standing Committee of the National Assembly on compensation for wrongful convictions caused by authorized persons of criminal proceedings organs; and the Head of the Government Office's report summarizing the opinions of Government members on the draft Resolution.

Judicial organs in general and authorized criminal proceedings organs in particular have made significant efforts in the struggle against crime, contributing to maintaining political security and social order and safety. However, during recent criminal proceedings activities, authorized persons of criminal proceedings organs could not avoid errors when making decisions, while the policy on compensating losses for wrongful convictions still faces many obstacles, causing harm to the parties involved, restricting democracy, and having negative impacts on various aspects of social life. To ensure citizens' rights and legitimate interests, and to improve the quality and effectiveness of criminal prosecution, investigation, prosecution, trial, and enforcement, a Resolution of the Standing Committee of the National Assembly addressing the issue of compensation for wrongful convictions is necessary.

The Ministry of Justice, the Ministry of Public Security, the Government Office, and related agencies are instructed to cooperate, incorporate the opinions of Government members, perfect the draft Resolution, and submit it to the Prime Minister for consideration and decision on presenting to the Standing Committee of the National Assembly.

3.The Government heard the Head of the Government Religious Affairs Department's presentation on the draft Ordinance on Religion; and the Head of the Government Office's report summarizing the opinions of Government members on the draft Ordinance.

The consistent viewpoint of the Party and State is to respect citizens' freedom of belief; preserve the national cultural identity; and uphold the tradition of religious devotion, patriotism, and living a good life and practicing religion well. The Ordinance on Religion aims to promote the strength of religious solidarity within the great national solidarity bloc in building and defending the country.

The Government Religious Affairs Department, the Ministry of Justice, and the Government Office are instructed to incorporate the opinions of Government members, perfect the draft Ordinance, and submit it to the Prime Minister for consideration and decision on presenting to the Standing Committee of the National Assembly.

4-The Government heard the Head of the Government Office's presentation on the draft Report on the Mid-Year Review of Government Leadership and Management Work in 2001.

The Government recognizes that despite encountering many objective difficulties, the leadership and management work of the Government in the first six months of 2001 still ensured timely handling of prominent issues arising in production and daily life, while closely monitoring the main goals of national socio-economic development. This is a result of the high sense of responsibility of the Government collective. Facing the heavy tasks of the last six months, the Government needs to continue to leverage achieved results, actively innovate to enhance the effectiveness of leadership and management, proactively complete the assigned tasks for 2001, and accelerate the progress of completing projects listed in the Government's 2001 work program.

The Government Office is tasked with incorporating the opinions of Government members, perfecting the above report, and submitting it to the Prime Minister for review before sending it to relevant Ministries, sectors, and localities.

5-The Government heard the report from the Minister of Planning and Investment on the implementation of the plan for June and the first six months of 2001; and heard the report from the Minister of Finance on the financial situation and state budget for the first six months of 2001 and measures to manage the state budget for the last six months of 2001.

Generally, the socio-economic situation in the first six months of 2001 continued to show positive changes. The estimated state budget revenue reached 54.9% of the annual plan, achieving the highest level in the past three years. The Gross Domestic Product increased by 7.1%, with the second quarter growing by 7%, lower than the first quarter (7.2%). Some key indicators showed strong growth compared to the same period last year and achieved satisfactory results relative to the plan. Social issues made some progress and achieved certain successes. However, there were still many difficulties and hesitations. Agricultural product prices continued to decline. The consumption of agricultural products had not yet found a fundamental direction, industrial production was showing signs of slowing down, investment in basic construction using credit funds was low, and the export growth rate was gradually decreasing...

To complete the basic targets of the 2001 plan, the Government requests that ministries, sectors, and localities implement more resolutely the additional measures to manage the 2001 economic plan as stipulated in Resolution No. 05/2001/NQ-CP of the Government. Focus on addressing urgent issues such as agricultural product consumption, stimulating investment demand, and exports; ensuring the progress of planning for socio-economic development and the state budget for 2002, linked to the orientation and tasks of the five-year plan from 2001 to 2005. Continue to intensify poverty reduction programs, increase consumer purchasing power based on enhanced investment and production development; maintain social security and order, properly address employment issues, and eliminate social vices; actively implement measures to prevent and respond to floods and storms./.
