THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

- Based on Decree No. 102/SL-L004 dated May 20, 1957 regarding the right to establish associations,

- Based on Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies,

- Considering the proposal of the Chairman of the Vietnam Public Health Association and the Director of the Department for Non-Governmental Organizations;

DECISION:

Article 1. Approves the Charter of the Vietnam Public Health Association adopted at the First National Congress on December 3, 2002.

Article 2. The Chairman of the Vietnam Public Health Association and the Director of the Department for Non-Governmental Organizations shall be responsible for implementing this Decision.

 

CHARTER

VIETNAM PUBLIC HEALTH ASSOCIATION

PART I
NAME, AIMS, AND OBJECTIVES

Article 1. The Association shall be known as the Vietnam Public Health Association.

International name: Viet Nam Public Health Association.

Article 2. The Vietnam Public Health Association is a voluntary social and professional organization of citizens and organizations engaged in public health activities within the Vietnamese public health system.

Article 3. Objectives of the Vietnam Public Health Association:

To unite and mobilize individuals working in the field of public health to cooperate and support each other in contributing to the care and protection of people's health, the development of the domestic public health profession, and integration with regional and global communities.

To protect and promote the legitimate material and spiritual interests of members.

Article 4. The Vietnam Public Health Association operates nationwide within the public health sector, with its headquarters located in Hanoi, possessing legal personality, seals, symbols, media outlets, and separate accounts as prescribed by law.

The Vietnam Public Health Association may join domestic social organizations, regional and international public health associations according to the provisions of the law.

Chapter II
TASKS AND POWERS OF THE ASSOCIATION

Article 5Tasks of the Association:

1. To unite members, assist each other in enhancing professional expertise, exchange experiences in public health activities, maintain professional ethics. Coordinate with state management agencies in managing public health activities and the practice of members.

2. To participate in providing opinions on policies of the Party and State regarding strategies for caring for and protecting people's health within the public health system.

3. To participate in health education and communication for the people, protecting the rights of those working in the field of public health.

4. To conduct scientific research, disseminate experiences, coordinate training, and enhance capabilities in the field of public health.

5. To cooperate and exchange experiences with related associations both domestically and internationally in accordance with the laws of the Socialist Republic of Vietnam, aiming to integrate Vietnamese public health with the international community.

6. To protect the rights and legitimate interests of members in accordance with the Charter of the Vietnam Public Health Association.

Article 6. Rights of the Association:

1. To represent organizations and members in activities related to the objectives, purposes, and tasks of the Vietnam Public Health Association.

2. To enter into scientific research contracts, implement projects, and provide services to organizations or individuals as stipulated by current laws.

3. To sponsor organizations and members in conducting scientific research activities, participating in the evaluation of scientific research works and projects in the field of public health when invited.

4. To actively participate in building programs and projects in the field of public health to propose solutions to develop the public health sector to relevant state management agencies.

5. To be permitted to publish books and journals of the Association as prescribed by law.

6. To organize training sessions and seminars to disseminate new knowledge and information in the field of public health.

7. To commend and recommend commendation from competent authorities for organizations and members who have achieved results in implementing the objectives, purposes, and tasks of the Vietnam Public Health Association.

8. To discipline organizations and members who violate the Association's charter.

Chapter III
MEMBERS

Article 7. Members of the Vietnam Public Health Association:

1. Organizational members: Organizations operating in the field of public health that recognize the charter of the Vietnam Public Health Association, voluntarily engage in activities for the Association, submit an application to join the Association, and appoint representatives to participate in the Association, will be considered for admission to the Association upon approval by the Executive Board of the Association.

2. Individual members: Vietnamese citizens working in the field of public health who recognize the charter of the Vietnam Public Health Association, voluntarily apply to join the Association, and are admitted upon approval by the Executive Board.

3. Supporting members: Organizations, Vietnamese citizens, and Vietnamese citizens abroad who recognize the charter of the Vietnam Public Health Association and contribute financially to the Association's activities will be recognized as "supporting members" upon approval by the Executive Board.

4. Honorary Members: Individuals who have made significant contributions to the public health cause will be invited by the Executive Board to become "honorary members" of the Association.

Supporting members and honorary members are not eligible to run for election or nomination to leadership positions in the Association and are not entitled to vote on Association matters.

Article 8. Duties of members:

1. Respect the objectives and purposes, comply with the Charter and resolutions of the Society.

2. Actively participate in the activities of the Society.

3. Promote membership development and protect the reputation and credibility of the Association.

4. Unite and assist colleagues within and outside the Society.

5. Participate in organizational activities at a local level of the Society, pay membership fees fully.

Article 9. Benefits of Members:

1. Participate in discussions and voting on all Association matters, be eligible for nomination and election to the Association's executive committees at various levels.

2. Receive professional training and encouragement to develop their abilities in all aspects related to their profession.

3. Be supported by the Association in conducting and publishing scientific research results, as well as protecting authorship rights.

4. Be protected by the Association in their legitimate professional rights.

5. Enjoy other benefits as prescribed by the Association.

6. Members have the right to request withdrawal from the Association.

Chapter IV
ORGANIZATION AND ACTIVITIES OF THE ASSOCIATION

Article 10The organization and operation of the Association follow the principles of voluntarism, self-management, and self-financing. The organizational structure includes:

1. At the central level: The Vietnam Public Health Association.

2. At provincial and centrally-administered city levels (hereinafter referred to as provinces): Provincial Public Health Associations.

3. At grassroots level: Branches; Grassroots organizations with at least five members can establish branches.

If necessary, provincial public health associations can be established. Their establishment is decided by the People's Committee of the province in accordance with the law. Provincial associations that agree to the charter of the Vietnam Public Health Association and apply to join will be recognized as member associations.

Article 11. The highest governing body of the Vietnam Public Health Association is the National Congress, held every five years. An extraordinary congress may be convened if more than half of the Central Executive Committee members request it. The number and composition of delegates to the congress are determined by the incumbent Central Executive Committee.

Responsibilities of the Congress:

- Summarize and evaluate the Association's activities during the previous term, discuss directions and action plans for the new term.

- Approving and amending the Charter (if necessary)

- Elect the Central Executive Board and the Central Inspection Board.

- Deciding important matters concerning the purpose, mission, rights, and responsibilities of the Association.

Article 12The Central Committee of the Association is the governing body between two congress terms. The number of Central Committee members of the Association is determined and directly elected by the Congress.

The Executive Board has the following responsibilities:

- Lead the implementation of the Congress resolutions.

- Leading the implementation of the Association's Charter

- Develop relations with domestic and international organizations, contributing to the development of the Association.

- Managing the activities of provincial-level Associations and specialized sub-committees.

- Elect the Central Standing Board and the Chairman, (one or more) Vice Chairmen, General Secretary.

- The Central Executive Board meets regularly once every six months (except in emergencies).

Article 13. The permanent office of the Central Committee of the Association is the Standing Committee, consisting of the Chairman, Vice Chairmen, Secretary General, and some members, with the number of Standing Committee members not exceeding 1/3 of the total number of Central Committee members.

The Standing Committee of the Association has the following tasks:

- Direct the implementation of decisions of the Central Executive Board of the Association between two sessions of the Central Executive Board.

- Recognizing the Provincial Association's Executive Board and issuing membership cards.

- Planning and reporting on the Association's activities according to the regulations of the Central Executive Board.

- Monitoring the activities of provincial associations and specialized sub-committees.

- The Standing Committee meets regularly once every three months. When necessary, upon the proposal of the Chairman and Secretary-General, the Standing Committee may convene an extraordinary meeting.

Article 14. The Chairman of the Association is elected by the Central Committee of the Association from among the Standing Committee members, presiding over meetings of the Central Committee of the Association and the Standing Committee, overseeing the implementation of the Central Committee's and Standing Committee's resolutions, and being responsible under the law for all activities of the Association.

Article 15The Vice Chairmen are elected by the Central Committee of the Association, assigned by the Chairman to lead specific aspects of the Association's activities.

Article 16. The Secretary-General is elected by the Central Executive Board, directly handles Association affairs assigned by the Chairman, and manages all activities of the Central Association Office.

Article 17When necessary, upon the recommendation of the Association's Secretary General, the Standing Committee may consider and decide to establish specialized sub-committees and organizations serving the development of the Association. Establishment shall be in accordance with the provisions of the Law.

Article 18. Inspection Committee:

The Central Executive Board elects an inspection committee, which has the following responsibilities:

- Inspecting the implementation of congress resolutions, the Charter, rules, and annual work programs of the Association.

- Inspect members in their activities to commend and reward them, while identifying signs of violations of the law to promptly correct them.

- Inspecting the economic and financial activities of the Association and its affiliated organizations; examining and resolving complaints and reports.

Chapter V
REWARDS AND DISCIPLINE

Article 19. Organizations and members with outstanding achievements are commended by the Association or recommended for commendation by competent state authorities.

Article 20. Organizations and members of the Association that damage the reputation or violate the Charter and Resolutions of the Association will be disciplined from reprimand, warning to expulsion. In cases causing material loss, in addition to disciplinary measures, they must also compensate according to the Law.

Article 21Organizations and individuals of the Association who fail to pay membership fees or do not participate in three consecutive sessions without reason within one year will have their names removed from the membership list.

Chapter VI.
ASSETS AND FINANCES

Article 22. Sources of income for the Association:

- Membership fees are collected annually (the specific amount is determined by the Central Executive Board).

- Income from the Association's activities such as services, consulting, publishing, seminars, training courses...

- Donations and sponsorships from domestic and foreign organizations and individuals.

Expenditures of the Association including expenses for scientific and technical activities, advisory and service activities, communication work, professional training, international cooperation, membership fees, office expenses, insurance, welfare, and administrative costs of the management organization.

Article 23. The finances of the Association are managed according to the regulations of the Central Committee of the Association based on compliance with state financial and accounting policies. Any idle funds of the Association (if any), including foreign currency, may be deposited for savings to increase the Association's fund.

"d) Within no more than one working day from the date of receiving the dossier submitted for administrative procedures by the specialized agency assigned by the Provincial People's Committee, the Chairman of the Provincial People's Committee shall issue a notification of the result of the inspection of plant-based food exports or a certificate at the request of the importing country."When the Association or its organization dissolves, it must inventory assets and funds and report to the Central Committee of the Association for handling in accordance with the provisions of the Law.

Chapter VII
IMPLEMENTING PROVISIONS

Article 25. This Charter consists of 7 chapters and 26 articles, adopted on December 3, 2002, and takes effect from the date approved by the competent state authority.

Article 26. Only the National Congress of the Association has the right to supplement and amend the Bylaws./.
