Pursuant to Decree No. 86/2002/ND-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 43/2003/NĐ-CP dated May 2, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Fisheries;
These regulations are hereby promulgated along with this Decision "Regulations on the Transfer, Rotation, and Temporary Assignment of Officials and Civil Servants of the Government Inspectorate."
DECISION:
Article 1. Position and Functions
The Bureau of Quality Management, Food Safety, and Aquatic Animal Health (referred to as the Bureau of Quality and Aquatic Animal Health) is an organization assisting the Minister in implementing specialized state management over quality, food safety, and aquatic animal health from raw material production to processing and consumption of aquatic products with the aim of preventing aquatic diseases, ensuring quality, safety, and hygiene of aquatic food products, and protecting consumer health.
The Bureau of Quality and Aquatic Animal Health has its own seal and is authorized to open accounts at State banks and treasuries.
International trade name: The National Fisheries Quality Assurance and Veterinary Directorate, abbreviated as NAFIQAVED.
The headquarters of the Bureau is located in Hanoi City.
Article 2. Tasks and Authorities
1. Drafting and submitting to the Minister strategic plans, development master plans, long-term and annual plans, programs, and projects concerning quality, food safety, and aquatic animal health.
2. Proposing and submitting to the Minister draft regulatory legal documents on quality, food safety, and aquatic animal health as assigned by the Minister.
3. Implementing regulatory legal documents according to the functions and tasks assigned.
4. Supervising and inspecting the implementation of regulatory legal documents, strategies, plans, projects, and proposing amendments, supplements, or new regulatory legal documents on quality, food safety, and aquatic animal health.
5. Managing quality and food safety of aquatic products:
a) Inspecting, recognizing, or revoking recognition of conditions ensuring food safety for:
- Fishing vessels, fish ports, fish markets, raw material collection facilities, preservation facilities, processing and trading facilities of aquatic products;
- Cultivation facilities, feed and veterinary drug production and trading facilities, chemical and biological product facilities serving aquatic cultivation;
b) Inspecting and certifying national food safety for raw materials and aquatic products in accordance with the law;
c) Participating in monitoring the impact of plant protection chemicals, industrial waste, and household waste on the aquatic cultivation environment, and making recommendations to relevant authorities for timely measures.
6. Managing aquatic animal health:
a) Guiding and organizing the implementation of disease prevention and eradication activities for aquatic animals. Proposing the announcement and cancellation of announcements regarding aquatic animal diseases in accordance with the law. Cooperating with related agencies to implement environmental recovery measures after disease eradication;
b) Directing and organizing the implementation of quarantine inspections for aquatic animals and plants for export, import, and domestic circulation in accordance with the law;
c) Supervising and inspecting compliance with regulations on testing feed, drugs, chemicals, and biological products within the assigned scope; compliance with regulations on the list of quarantine objects, prohibited and restricted import and export items for feed, veterinary drugs, chemicals, and biological products serving aquatic cultivation;
d) Inspecting, recognizing, or revoking recognition of disease safety for cultivation facilities, feed and veterinary drug production and trading facilities, chemical and biological product facilities serving aquatic cultivation;
e) Inspecting and certifying disease safety for feed, veterinary drugs, chemicals, and biological products serving aquatic cultivation.
7. Issuing and revoking licenses and certificates related to quality, food safety, and aquatic animal health; export and import licenses for feed, veterinary drugs, chemicals, and biological products used in aquatic cultivation in accordance with the law;
8. Participating in reviewing planning and investment projects in the field of aquatic products concerning quality, food safety, and aquatic animal health;
Recognizing quality and food safety testing laboratories and aquatic animal disease testing laboratories in accordance with the law.
9. Researching and applying new technological advancements in quality, food safety, and aquatic animal health management.
10. Implementing international cooperation in the field of quality, food safety, and aquatic animal health; signing or submitting to competent authorities for signing cooperation documents in accordance with the law.
11. Conducting inspections, investigations, and handling violations of laws in the field of aquatic products within the assigned jurisdiction in accordance with the law;
12. Directing and organizing professional training for staff in the system on quality, food safety, and aquatic animal health management;
13. Providing professional services in accordance with the law.
14. Managing, using labor, assets, and finances of the Bureau and subordinate units in accordance with the law.
Uniformly managing technical expertise, business operations, and results of activities of organizations under the Bureau's jurisdiction in local areas.
15. Performing other tasks assigned by the Minister.
Article 3. Organizational Structure
The organizational structure of the Bureau of Quality and Aquatic Animal Health includes:
1. The Department Office;
2. Office of General Affairs, Information, and International Cooperation
3. Office of Quality and Food Safety of Aquatic Products;
4. Office of Aquatic Animal Health;
5. Office of Testing Management;
6 Regional Management Bureaus of Quality and Aquatic Animal Health in key fishing regions such as Hai Phong, Da Nang, Khanh Hoa, Ho Chi Minh City, Ca Mau, Can Tho.
Article 4. Effective date
This Decision takes effect 15 days after its publication in the Official Gazette; it replaces Decision No. 648 TS/QD dated August 26, 1994 of the Minister of Fisheries on the tasks, powers, and organizational structure of the Quality Inspection and Sanitation Center and previous provisions contrary to this Decision.
Article 5. Responsibilities for Implementation
The Director of the Bureau of Quality and Aquatic Animal Health is responsible for coordinating with relevant agencies and units to develop a project on the organization of Quality, Food Safety, and Aquatic Animal Health Management in localities; developing regulations on the organization and operation of the Bureau to submit to the Minister for decision;
The Head of the Ministry’s Office, the Director of the Bureau of Quality and Aquatic Animal Health, Heads of Departments, Bureaus, the Inspectorate of the Ministry, Heads of subordinate units of the Ministry, Directors of Fisheries Departments, Departments of Agriculture and Rural Development with fisheries management responsibilities are responsible for implementing this Decision.
