Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP dated May 19, 2003;
Pursuant to Decision No. 199/QĐ-BKHCN dated February 23, 2005 of the Minister of Science and Technology on maintaining the operation of the Center for Regional Research and Development;
Considering the proposals of the Directors of the Center for Regional Research and Development and the Director of the Department of Organization and Cadres;
DECISION:
Article 1. Enacting this Decision the Charter of the Organization and Operation of the Center for Regional Research and Development.
Article 2. This Decision shall take effect 15 days from the date of publication in the Official Gazette and replace Decision No. 351/QĐ-BKHCNMT dated March 12, 1999 of the Minister of Science, Technology and Environment (now the Ministry of Science and Technology) on the issuance of the Charter of the Organization and Operation of the Center for Regional Research and Development.
Article 3. The Heads of the Office, the Director of the Department of Organization and Cadres, the Directors of the Center for Regional Research and Development and the Heads of related units are responsible for implementing this Decision.
CHARTER
ORGANIZATION AND OPERATION OF
THE CENTER FOR REGIONAL RESEARCH AND DEVELOPMENT

PART I
FUNCTIONS, TASKS, AND POWERS
Article 1The Center for Regional Research and Development (hereinafter referred to as the Center) is a public service unit established by the Minister of Science and Technology with the function of serving as a bridge between scientific and technological activities and economic and social development in regions through research to develop regional economic and social planning, promote science and technology, and study structural economic transformation; Supporting the implementation of economic and social projects in regions through consulting, project development, technology transfer, and training technical experts.
The international name of the Center is: Centre for Regional Research and Development (abbreviated as CRD).
The Center is a legal entity with its own seal, domestic and foreign currency accounts at the State Treasury and banks for its operations and transactions in accordance with the law.
The Center has its headquarters at Floor 5 - 70 Tran Hung Dao - Hoan Kiem - Hanoi.
Article 2. The Center has the following tasks:
1. Continuously updating and processing comprehensive research results and socio-economic materials related to the regions to supplement the database of the regions and provide such information and materials to state management agencies upon the approval of the Ministry's leadership.
2. Based on researching regions and territories and according to the requirements of state management agencies, proposing issues that need to be resolved regarding science and technology, scientific arguments for sustainable development in the region, and structural economic transformation to serve economic and social development at the local level.
3. Annually preparing plans and organizing their implementation upon approval by the Minister for assigned scientific and technological tasks.
4. Organizing the development of projects, providing consulting services, organizing technology transfer, training, vocational upgrading, and international cooperation in relevant fields to serve the implementation of economic and social projects and scientific and technological activities in regions in accordance with current state regulations.
5. Playing the role of a focal point to mobilize organizations and individuals both domestically and internationally to sponsor regional development.
6. Organizing experimental activities and perfecting technology for transfer into production in accordance with the law.
7. Being allowed to engage in joint ventures and collaborations both domestically and internationally to organize experiments in accordance with the law; conducting other activities applicable to units fully self-financing their regular operations under current state regulations.

PART II
ORGANIZATIONAL STRUCTURE
Article 3. The Center operates under the head system.
The Director of the Center is appointed and relieved of duty by the Minister of Science and Technology; he/she is responsible to the Minister of Science and Technology for all work of the Center.
The Director of the Center specifies the specific duties and authorities of subordinate departments; arranges and assigns staff suitable to the functions and tasks of the Center.
Deputy Directors have the responsibility to assist the Director in leading the general work of the Center, are accountable to the Director for the work they are assigned, and have the authority to decide matters within their scope of duties and powers delegated by the Director.
In the absence of the Director, a Deputy Director may be authorized by the Director to handle matters within the Director's authority.
The appointment and removal of Deputy Directors are carried out in accordance with the regulations on cadre management delegation of the Ministry.
Article 4. The organizational structure of the Center includes:
Office.
Research and Development Department.
Project Department.
Technical Services and Technology Department.
Experimental Station (or Workshop).
The appointment and removal of heads and deputy heads of subordinate departments of the Center are carried out in accordance with the regulations on cadre management delegation of the Ministry.
Article 5. The Center has a Scientific Advisory Board decided by the Director of the Center. The Board assists the Center in long-term development orientation and decides academic issues within the scope of the Center's activities. The responsibilities and benefits of members of the Scientific Advisory Board are regulated by the Director of the Center according to the current system.
Article 6. Human Resources of the Center
The staffing quota of the Center is guided by the Ministry in accordance with the current regulations of the State for public service units with income self-sustaining regular operating expenses.
The human resources of the Center include:
1. Staff working under employment contracts (civil servants).
2. Staff working under labor contracts including:
Unspecified term type.
Fixed-term and project-based type.
3. Collaborators, domestic and foreign experts.
The Director of the Center signs various types of contracts in accordance with the current regulations of the State, commensurate with the volume of work and the financial capacity of the Center.
Article 7. The Center implements labor management systems and pays salaries, wages, and other income, implements social insurance and health insurance for officials, staff, and contractual employees from the Center's budget funds in accordance with the current regulations of the State and the Ministry of Science and Technology.
Article 8. The Center is allowed to set aside salary funds and other funds based on legitimate sources of income according to the current regulations of the State for self-financing public service units that ensure regular operating expenses.
The benefits of officials and employees within the Center will be enjoyed under the current system for revenue-generating public service units based on the results of assigned tasks in terms of quantity and quality.
Article 9. Officials and staff working under indefinite-term labor contracts enjoy all training and upgrading benefits in accordance with the regulations applicable to state civil servants.
CHAPTER III
WORK RELATIONSHIPS
Article 10. The Director of the Center manages all activities of the Center based on the Charter of Organization and Operation of the Center and the operational rules of the Ministry of Science and Technology.
Article 11. The Center collaborates with subordinate units of the Ministry of Science and Technology to effectively perform assigned functions and tasks.
PART IV
FINANCIAL MANAGEMENT
Article 12. The Center applies financial management mechanisms for revenue-generating public service units.
The financial resources of the Center include:
a) Budget funds from the State according to assigned tasks.
b) Legitimate income from research, consulting, technology transfer, and other scientific and technological service activities of the Center.
c) Other income as prescribed by law: grants, loans, gifts, etc.
Expenditures include:
Expenses to carry out tasks assigned by the Ministry of Science and Technology.
Expenses for service activities.
Labor rental expenses.
Other expenditures as prescribed.
Article 13. The Director of the Center is responsible for managing and using the Center's financial resources efficiently; fulfilling obligations to the State; setting up development funds for public services, income stability reserves, welfare, and rewards; implementing accounting systems in accordance with current State regulations.
CHAPTER V
IMPLEMENTING PROVISIONS
Article 14. The Center will cease operations in the following cases:
- The Ministry of Science and Technology deems it unnecessary to maintain the Center
- The Center fails to comply with the Charter of Organization and Operation of the Center
- The Center operates ineffectively
- The Center seriously violates the law
The termination of the Center's operations is reviewed and decided by the Minister of Science and Technology.
Article 15. The Director of the Center coordinates with the Head of the Personnel Department to implement this Charter.
Article 16. Any amendments or supplements to this Charter are proposed by the Director of the Center in coordination with the Head of the Personnel Department and decided upon by the Minister of Science and Technology./.
