On the Mandatory Application of the Vietnam Standard
TCVN 7440:2005 - Emission Standard for the Thermal Power Industry
MINISTER OF NATURAL RESOURCES AND ENVIRONMENT
On the basis of the Environmental Protection Law dated December 27, 1993;
Pursuant to Decree No. 175/CP dated October 18, 1994 of the Government guiding the implementation of the Law on Environmental Protection, and Decree No. 143/2004/NĐ-CP dated July 12, 2004 of the Government amending and supplementing Article 14 of Decree No. 175/CP dated October 18, 1994 of the Government guiding the implementation of the Law on Environmental Protection;
Pursuant to Decree No. 91/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
Pursuant to Decision No. 1793/QĐ-BKHCN dated July 20, 2005 of the Minister of Science and Technology promulgating the Vietnam Standard TCVN 7440:2005 - Emission Standard for the Thermal Power Industry;
Considering the proposal of the Director of the Environmental Department and the Director of the Legal Department,
DECISION:
Clause 4 of Article 6The Vietnam Standard TCVN 7440:2005 - Emission Standard for the Thermal Power Industry, issued by the Minister of Science and Technology pursuant to Decision No. 1793/QĐ-BKHCN dated July 20, 2005, shall be mandatorily applied as follows:
- New thermal power plant projects and expansion projects of operating thermal power plants must mandatorily apply the Vietnam Standard TCVN 7440:2005 from the date this decision on mandatory application takes effect.
- Operating thermal power plants and thermal power plant projects that have been approved for Environmental Impact Assessment reports before the date this decision on mandatory application takes effect must apply the Vietnam Standard TCVN 7440:2005 from January 1, 2015, except for those listed in the List of Severe Polluting Facilities Required to be Thoroughly Addressed as stipulated in Decision No. 64/2003/QĐ-TTg dated April 22, 2003 of the Prime Minister.
12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentThe regional coefficients (Kv), capacity coefficients (Kp), and methods for calculating the maximum allowable concentrations of SO2, NOX, and dust in emissions from thermal power plants using coal or oil are specified in Appendix 1 attached hereto.
Article 3:This Decision shall take effect fifteen days from the date of publication in the Official Gazette.
The Minister, Heads of Ministries equivalent to Ministries, Heads of Government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Decision./.
