CIRCULAR

Guidelines for the development and implementation

of training and capacity-building targets for civil servants

Implementing the Anti-Corruption Law on November 29, 2005, and the Law on Thrift and Combating Wastefulness on November 29, 2005;

Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decision No. 161/2003/QĐ-TTg dated August 4, 2003 of the Prime Minister promulgating the Training and Capacity-Building Regulations for Civil Servants;

The Ministry of Home Affairs provides guidelines for the development and implementation of training and capacity-building targets for civil servants as follows:

I. ON THE OBJECTIVES AND APPLICABLE SUBJECTS OF TRAINING AND CAPACITY-BUILDING TARGETS FOR CIVIL SERVANTS

1. The objective of developing training and capacity-building targets for civil servants is to organize courses to train and enhance knowledge in state management, political theory, professional skills, computer science, foreign languages, and other supplementary knowledge to equip and improve the knowledge and management capabilities of civil servants.

2. The subjects eligible for training and capacity-building targets include:

a) Administrative civil servants working in central and local Party and State agencies, and political-social organizations;

b) Staff members in public service units;

c) Members of People's Councils at all levels;

d) Civil servants at commune, ward, town levels, and other subjects as prescribed by relevant State authorities. Hereinafter referred to collectively as civil servants.

II. REQUIREMENTS, TYPES OF TRAINING AND CAPACITY-BUILDING TARGETS, AND BASIS FOR DEVELOPMENT AND ALLOCATION OF TRAINING AND CAPACITY-BUILDING TARGETS FOR CIVIL SERVANTS

1. Requirements for the development and guidance on implementing targets:

a) The development and guidance on implementing training and capacity-building targets for civil servants shall be carried out in accordance with the provisions of the State Budget Law and other regulations governing the training and capacity-building of civil servants.

b) The development and guidance on implementing training and capacity-building targets for civil servants must ensure transparency and consistency among the Ministry of Finance (MF), the Ministry of Planning and Investment (MPI), and the Ministry of Home Affairs.

c) Training and capacity-building targets for civil servants must be allocated and utilized according to the intended recipients and purposes, preventing waste, practicing thrift, and combating corruption.

2. Types of training and capacity-building targets for civil servants:

a) Targets for domestic training and capacity-building for civil servants.

b) Targets for overseas training and capacity-building for civil servants.

3. Basis for developing and allocating training and capacity-building targets for civil servants:

a) Functions, tasks, organizational structures, and characteristics of the civil servant workforce of each ministry, sector, and locality;

b) The number of authorized positions and the demand for training and capacity-building of civil servants in ministries, sectors, and localities;

c) Annual and long-term results of training and capacity-building for civil servants, and the outcomes of target programs for training and capacity-building (if any) in ministries, sectors, and localities;

d) The ability to allocate funds according to the approved state budget estimate of ministries, sectors, and localities.

III. PROCEDURES FOR DEVELOPING AND GUIDING THE IMPLEMENTATION OF TRAINING AND CAPACITY-BUILDING TARGETS FOR CIVIL SERVANTS

1. This Circular takes effect fifteen days after its publication in the Official Gazette. Ministries and sectors should proactively arrange within their assigned state budget estimates to implement it.

2. During the implementation process, if there are difficulties or obstacles, please reflect them to the Ministry of Home Affairs for research and resolution./.
