DIRECTIVE
Regarding the Implementation of the Law on Residence
____________
The Law on Residence was passed at the tenth session of the Eleventh National Assembly and took effect from July 1, 2006. It is an important law regulating procedures and formalities for registration and management of residence; rights and responsibilities of citizens, households, agencies, and organizations regarding registration and management of residence.
In order to enhance legal awareness and sense of responsibility among the People's Public Security forces, civil servants, and the people; ensure strict enforcement of the Law on Residence; and create changes in residence management activities and state administration work related to security and public order, the Prime Minister instructs ministries, ministerial-level agencies, agencies under the Government, provincial and municipal people's committees directly under the central government to implement the following tasks:
1. Ministry of Public Security
a) Urgently organize specialized training on the Law on Residence, enhance legal awareness, service consciousness towards the people, administrative reform requirements, and combat bureaucracy and harassment in residence management in the new situation for officers and soldiers of units under the Ministry of Public Security and local public security agencies, focusing on leadership cadres of all levels of public security agencies; officers and soldiers working in direct registration and management of residence; cadres working in registration and management of residence of commune-level people's committees; and individuals participating in permanent residence, temporary residence, stay, and short-term absence registration in residential areas;
b) Take the lead and coordinate with the Ministry of Justice to compile dissemination materials, guidance on implementation of the Law on Residence for civil servants and the people, ensuring clarity and ease of understanding, to ensure uniform implementation of the law;
c) Take the lead and coordinate with the Ministry of Justice and relevant ministries and sectors to promptly draft and submit to the Government for promulgation detailed decrees and guidance on implementing certain provisions of the Law on Residence and a decree specifying conditions for residence management activities and resident data;
d) Issue model books and documents on residence in accordance with the Law on Residence; issue guiding legal documents on implementation of the Law on Residence within their authority; widely announce and publicly post procedures and formalities for registration and issuance of household registration books and temporary residence books for the people to be aware of and comply with;
e) Improve organizational structures, direct units under the Ministry and local public security agencies to allocate sufficient capable and morally sound cadres for residence registration and management work; correct work styles, reception practices, and strictly punish those cadres at all levels engaged in residence registration and management who have inappropriate attitudes, words, or actions causing harassment or inconvenience to agencies, organizations, or individuals; improve work methods to ensure residence management with simple, timely, accurate, transparent, and non-intrusive procedures for permanent and temporary residence registration; promptly address citizen complaints and reports related to residence and residence management according to the law;
f) Quickly and conveniently process registration and issuance of household registration books and temporary residence books for individuals meeting the conditions stipulated by the Law on Residence;
g) Study and develop a project on managing resident data and a project on enhancing material infrastructure, human resources, and investment in advanced technology and techniques for residence registration and management activities, and submit for approval according to regulations;
Directing and guiding functional agencies to coordinate with the Environmental Crime Prevention Police Force
Coordinate with the Ministry of Public Security to guide registration and management of residence for individuals performing military service; officers, non-commissioned officers, professional soldiers, defense officials, and defense workers residing at the location of their unit according to the Law on Residence;
3. Ministry of Justice
Take the lead and coordinate with the Ministry of Public Security to inspect and guide relevant ministries, sectors, and provincial and municipal people's committees directly under the central government to review legal documents related to household registration or provisions contrary to the Law on Residence, and propose amendments or revocations to competent authorities. Complete a list of documents requiring amendment or revocation and report to the Prime Minister before July 1, 2007;
4. Ministry of Culture, Sports and Tourism
Coordinate with the Ministry of Public Security, the Ministry of Justice, and the Government's Steering Committee for Legal Education and Propaganda to direct and guide central and local news media, radio, and television stations to widely disseminate the Law on Residence and its implementation guidelines;
5. The Ministry of Finance
a) Take the lead and coordinate with the Ministry of Public Security, the Ministry of Planning and Investment, relevant ministries, agencies, and provincial and municipal people's committees directly under the central government to ensure funding for the implementation of the Law on Residence in annual regular budgets of ministries, sectors, and localities in accordance with the law. For funding for the implementation of the Law on Residence in 2007, the Ministry of Finance will coordinate with the Ministry of Public Security to calculate and submit to the Prime Minister for consideration and decision to supplement the Ministry of Public Security;
b) Study and propose competent authorities to amend and supplement regulations on residence registration fees to align with the Law on Residence;
6. Ministries, ministerial-level agencies, and agencies under the Government
Within their scope of responsibility and authority, organize propaganda, dissemination, and implementation of the Law on Residence. Conduct inspections and reviews of legal documents and other documents within their management fields related to household registration to amend, revoke, or propose competent authorities to amend or revoke provisions contrary to the Law on Residence and its implementation guidelines;
7. People's Committees of Provinces and Centrally-Administered Cities
a) Organize the implementation of state management of residence at the local level in accordance with the Law on Residence and other relevant laws and regulations as delegated by the Government;
b) Allocate sufficient capable and morally sound cadres for residence registration and management work at the commune level; ensure simple, timely, accurate, transparent procedures for permanent and temporary residence registration in accordance with the Law on Residence and guidance from the Ministry of Public Security.
c) Timely address complaints, petitions, and accusations from citizens related to residence and residence management in accordance with the law; resolutely handle strictly public officials, civil servants, and employees who have inappropriate attitudes, words, or actions, or who harass and cause inconvenience to agencies, organizations, or individuals;
d) Organize reviews of regulatory legal documents and other documents within the scope of management related to household registration regulations to amend, abolish, or request competent authorities to amend or abolish provisions that contradict the Law on Residence and guiding documents for its implementation;
đ) Shall not arbitrarily issue additional regulations, procedures, or impose fees and charges not stipulated in the Law on Residence and guiding documents for its implementation;
8. Effectiveness of enforcement
This Directive shall take effect fifteen days after its publication in the Official Gazette.
The Minister of Public Security is responsible for assisting the Prime Minister in monitoring, urging, inspecting, and reporting to the Prime Minister on the implementation of this Directive.
Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally governed city People's Committees are responsible for implementing this Directive./.
