THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decree No. 82/2006/NĐ-CP dated August 10, 2006 of the Government on management of export, import, re-export, entry from sea, transit, breeding, growing, and artificial propagation of endangered wild fauna and flora species;

Considering the proposal of the Director of the Forest Protection Department and the Head of the Cadre and Civil Servant Affairs Department,
DECISION:
Article 1. Establishing the Management Authority of Vietnam for the Convention on International Trade in Endangered Species of Wild Fauna and Flora (hereinafter referred to as the CITES Management Authority of Vietnam).
International Name: CITES Management Authority of Vietnam
Article 2. Tasks and Powers of the CITES Management Authority of Vietnam
1. Acting on behalf of the Minister of Agriculture and Rural Development to exercise the rights and obligations of a member state under the Convention on International Trade in Endangered Species of Wild Fauna and Flora (hereinafter referred to as the CITES Convention).
2. Submitting to the Minister of Agriculture and Rural Development for promulgation the list of endangered wild fauna and flora species specified in the Appendices of the CITES Convention.
3. Coordinating with relevant agencies and units in drafting regulatory legal documents for managing and implementing the CITES Convention.
4. Organizing information dissemination, propaganda, and training activities on the implementation of the CITES Convention.
5. Managing, issuing, and revoking various types of CITES permits and certificates as prescribed.
6. Organizing scientific research and international cooperation activities in the implementation of the CITES Convention:
a) Taking the lead and coordinating with CITES Scientific Authorities and other relevant agencies and organizations in implementing the CITES Convention in Vietnam;
b) Proposing amendments and supplements to the list of endangered wild fauna and flora species specified in the Appendices of the CITES Convention;
c) Conducting international relations activities in the implementation of the CITES Convention.
7. Managing breeding farms, growing farms, and artificial propagation facilities of endangered wild fauna and flora species listed in the Appendices of the CITES Convention:
a) Managing, guiding, inspecting, and registering with the Secretariat of the CITES Convention international breeding farms, growing farms, and artificial propagation facilities of endangered wild fauna and flora species specified in Appendix I of the CITES Convention;
b) Guiding the handling of specimens specified in the Appendices of the CITES Convention that have been confiscated according to Vietnamese law and the CITES Convention;
c) Inspecting export, import, re-export, and transit activities of endangered and precious wild fauna and flora specimens at airports, railway stations, seaports, and border areas as prescribed by law.
8. Performing other tasks assigned by the Minister of Agriculture and Rural Development.
Article 3. Organizational Structure of the CITES Management Authority of Vietnam
1. The CITES Management Authority of Vietnam has a Director and Deputy Directors assisting the Director. The Director of the Forest Protection Department is the Director of the CITES Management Authority of Vietnam, accountable to the Minister of Agriculture and Rural Development and to the law for performing the tasks of the CITES Management Authority of Vietnam. The Director of the Forest Protection Department assigns a Deputy Director of the Forest Protection Department concurrently as Deputy Director of the CITES Management Authority of Vietnam. The Deputy Director of the CITES Management Authority of Vietnam is accountable to the Director of the CITES Management Authority of Vietnam and to the law for performing the assigned tasks.
2. The permanent office (called the CITES Vietnam Office) is located at the Forest Protection Department. The CITES Vietnam Office includes enforcement, information dissemination and training, licensing, management of breeding farms, artificial propagation facilities of endangered wild fauna and flora species, and international relations departments.
3. The representative offices of the CITES Management Authority of Vietnam in the South and Central regions as stipulated by current State regulations. The Director of the Forest Protection Department appoints, dismisses the Heads of the CITES Vietnam Office and the Representative Offices of the CITES Management Authority of Vietnam in the South and Central regions; specifies their tasks, issues work regulations, arranges staff, and resolves operational funding for the CITES Vietnam Office and the Representative Offices of the CITES Management Authority of Vietnam in the South and Central regions within the staffing quota assigned by the Minister of Agriculture and Rural Development and the State budget allocated to the Forest Protection Department; manages the assets of the CITES Management Authority of Vietnam as prescribed.
Article 4. The CITES Management Authority of Vietnam and its representative offices in the South and Central regions have separate seals, and their operational funding is guaranteed by the State budget.
Article 5. This Decision takes effect fifteen days after its publication in the Official Gazette and replaces Decision No. 43/2000/QĐ/BNN/TCCB dated April 19, 2000 of the Minister of Agriculture and Rural Development on the establishment of the CITES Vietnam Office.
Article 6. The Permanent Secretary of the Ministry, the Heads of the Cadre and Civil Servant Affairs Department, the Forest Protection Department, and the heads of relevant agencies and units under the Ministry of Agriculture and Rural Development are responsible for implementing this Decision./.
