ON SPEAKING AND PROVIDING INFORMATION TO THE MEDIA

THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Decision No. 77/2007/QĐ-TTg dated May 28, 2007 of the Prime Minister promulgating the Regulations on Speaking and Providing Information to the Media;
Considering the proposal of the Director of the Office of the Ministry of Home Affairs.

DECISION:

Clause 4 of Article 6Speaking and providing information to the media

1. The Minister of Home Affairs shall chair press conferences to provide information to the media about important issues of the Ministry of Home Affairs and the State Organization sector in accordance with the Law on Press.

2. In cases where necessary, the Minister may delegate to a Deputy Minister of Home Affairs to speak and provide information to the media on matters within the functions and tasks of the Ministry of Home Affairs in accordance with the Law on Press.

3. In cases where necessary, the Minister may delegate to the Director of the National Archives and Records Administration to speak and provide information to the media on matters related to state management of records and archives.

4. The Minister of Home Affairs shall delegate the Director of the Office of the Ministry to be the regular spokesperson and be responsible for providing information to the media of the Ministry of Home Affairs.

5. Those who are delegated under Clauses 2, 3, and 4 of this Article shall be responsible before the law and the Minister for the content of their statements and information provided to the media.

1. At the direction of the Minister, the Office of the Ministry shall take the lead, in coordination with functional units of the Ministry, to actively coordinate with the Office of the Government in providing information to the media about the activities and work guidance and management of the Ministry at press conferences of the Office of the Government when necessary.

2. Every six months, the Office of the Ministry shall take the lead, in coordination with functional units of the Ministry, to organize press conferences to provide information to the media. The organization of press conferences shall be carried out in accordance with the Law on Press.

Heads of units under and directly subordinate to the Ministry shall be responsible for coordinating and providing information within their areas of responsibility to the Ministry's spokesperson and shall be responsible for the information they provide.

In case of being requested, heads of units under and directly subordinate to the Ministry shall participate directly; in case of absence, they must delegate a Deputy Head to attend the press conference.

Article 3. Speaking and providing information in emergency situations

1. In cases where it is necessary to provide information through the media about significant events and issues causing major impacts in society within the scope of management of the Ministry and the State Organization sector to timely guide and warn society, the Minister of Home Affairs shall decide to organize press conferences or provide information to the media.

2. In cases where it is necessary to provide information to the media about the management area of an agency or unit, heads of units under and directly subordinate to the Ministry shall proactively propose and report to the leadership of the Ministry and coordinate with the Office of the Ministry and the Ministry's spokesperson to organize press conferences or provide information to the media in accordance with regulations.

The Office of the Ministry shall be responsible for compiling requests for information provision, article placement, and interviews with the Minister from the media and organizing the preparation of content for review and decision by the Minister before providing to the media.

Article 4. Rights and responsibilities of the Spokesperson

1. The spokesperson shall implement the rights and responsibilities of the spokesperson according to the Regulations on Speaking and Providing Information to the Media issued together with Decision No. 77/2007/QĐ-TTg dated May 28, 2007 of the Prime Minister.

2. The spokesperson of the Ministry shall be permitted to use the machinery of the Office of the Ministry, plan and organize press conferences and regular information provision to the media; and be provided with technical equipment to facilitate their work.

3. The spokesperson of the Ministry has the right to request heads of units under and directly subordinate to the Ministry to provide information, prepare relevant contents, and participate in press conferences or provide information to the media.

4. The spokesperson of the Ministry has the right to refuse to speak and provide information in the following cases:

a) Draft comprehensive proposals on the organizational structure and senior personnel of the Government for the new term of the National Assembly prepared by the Ministry;

b) Proposals and reviews by the Ministry regarding the organizational structure and staffing of the People's Public Security and the Vietnam People's Army;

c) Documents of the Ministry concerning evaluations and assessments of cadres; appointments and disciplinary actions of cadres under the management of the Politburo and the Secretariat; documents related to high-ranking Party and State leaders currently held by the Ministry of Home Affairs;

d) Instructions of Party and State leaders on civil service organization work;

e) Proposals on the establishment, merger, division, and dissolution of ministries, ministerial-level agencies, and government agencies; proposals on the establishment, merger, and division of administrative units at all levels; documents and data related to the upgrading of cities that have not been announced;

f) Strategic, planning, and long-term development proposals in fields under the Ministry of Home Affairs' management that are still under construction;

g) Proposals on policies and measures for civil service organization work implemented by the Government and the Ministry of Home Affairs;

h) Regular and urgent reports of the Ministry of Home Affairs on cadre work, administrative organization, local government organization, and administrative boundaries that have not been announced;

i) Plans for elections of People's Councils at all levels that have not been announced;

k) Documents on adjustments to administrative boundaries, draft proposals for naming islands, reefs, and submerged banks in Vietnam's maritime areas that the Ministry of Home Affairs is leading;

l) Projects on building, amending, and supplementing salary systems and other benefits for civil servants and public officials; village-level officials that have not been announced;

m) Survey, investigation, and statistical results on the current status of civil servants and public officials, the situation of administrative organizations, local government organization, administrative boundary management, organization of associations, and non-governmental organizations, and archival work that have not been announced;

n) Agreements signed with foreign individuals and organizations, international organizations on the Ministry of Home Affairs' work areas that have not been announced;

o) Examination papers for civil servants' grade promotion prepared by the examination board for the annual grade promotion examination;

p) Information and materials regarding cadre planning, appointment, reappointment, dismissal, transfer, rotation, and disciplinary actions of cadres at the department level and above within the Ministry of Home Affairs that have not been announced;

q) Files of cadres and civil servants from specialist level upwards in the Ministry of Home Affairs, its subordinate units, and provincial home affairs departments. Files and materials concerning ongoing inspection and audit cases; reports on the results of inspections and audits within the Ministry of Home Affairs that have not been announced;

r) Unreleased archival documents, design documents, technical specifications, security and safety regulations for internal computer networks of the Ministry of Home Affairs, National Academy of Public Administration, State Archives and Records Administration, provincial home affairs departments; software and databases managed by the Ministry, software and databases for managing civil servants in the Ministry of Home Affairs, its subordinate units, provincial home affairs departments, and civil servants in state administrative management agencies;

s) Matters classified as state secrets; matters classified under Party principles and regulations; matters outside the scope of authority to make public statements;

t) Criminal cases currently under investigation or yet to be adjudicated, except where administrative state agencies or investigative bodies require information to be disclosed in the media for the benefit of criminal investigations and crime prevention efforts;

u) Policy documents and draft projects still in the drafting process which, according to the law, have not been authorized by competent authorities to be made public or widely solicited for opinions;

Article 5.Implementation

1. The Ministry's Office shall take the lead and coordinate with units under the Ministry to implement this Regulation and report periodically to the Minister on the implementation results;

2. Heads of units under and directly affiliated with the Ministry shall be responsible for coordinating with the Ministry's Office and the Ministry's Spokesperson to implement this Decision;

3. The Planning and Finance Department shall coordinate with the Ministry's Office to develop a budget plan to ensure funding for this work;

4. The Information Technology Center shall coordinate with the Ministry's Office and the Ministry's Spokesperson to plan the provision and technical support for press statements and information dissemination to the media in accordance with general regulations, and compile weekly news related to the Ministry's activities, reporting to leadership and providing to the Ministry's Spokesperson every Friday;

Article 6.This Decision shall take effect fifteen days after its publication in the Official Gazette;

The Head of the Ministry's Office, the Ministry's Spokesperson, and Heads of units under and directly affiliated with the Ministry are responsible for implementing this Decision./.
