THE MINISTER OF FINANCE
Pursuant to Decree No. 77/2003/ND-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 138/2007/ND-CP dated August 28, 2007 of the Government on the organization and operation of local development investment funds;
At the proposal of the Director of the Department of Financial Affairs of Banks and Financial Institutions,
DECISION:
Article 1. This Decision hereby promulgates a model Charter applicable to local development investment funds established by provinces and centrally governed cities.
Article 2. The Charters of local development investment funds must include the provisions of the model Charter and are not limited to the contents of the model Charter; they must be consistent with the legal regulations on local development investment funds and related legal documents.
Article 3. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.
Article 4. Within twelve months from the effective date of Decree No. 138/2007/ND-CP, local development investment funds currently operating under pilot programs must re-register their Charters governing organization and operations in accordance with the provisions of Decree No. 138/2007/ND-CP and the model Charter issued together with this Decision.
Article 5. Provincial People's Committees are responsible for reporting to the Ministry of Finance within five days from the date of issuance or amendment of the Charter governing the organization and operation of local development investment funds.
Article 6. The Director of the Office of the Ministry of Finance, the Heads of the Department of Banking and Financial Organizations, the Heads of relevant units under the Ministry of Finance, local development investment funds, and related organizations and individuals are responsible for implementing this Decision./.
