Regulations on Classification and Grouping for Professional Military Personnel and Grouping for Defense Civil Servants

and classify groups for defense civil servants and employees

in the Vietnam People's Army

||| Based on the Law on Legislative Acts of 2008;

Pursuant to Decree No. 104/2008/NĐ-CP dated September 16, 2008 of the Government on the Functions, Tasks, Authorities, and Organizational Structure of the Ministry of National Defense;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;

Article 2. This Circular applies to academies, universities, military officer schools, vocational colleges, secondary technical schools, and military schools (hereinafter referred to collectively as military schools) that organize training in accordance with the law, and related agencies, units, organizations, and individuals; it does not apply to teachers teaching at kindergartens, general education schools, national defense education centers, and security education centers.

CIRCULAR:

Article 1. Scope of Regulation and Applicability

Article 1. Scope of Application This Circular stipulates the classification and grouping for professional military personnel and the grouping for defense civil servants in the Vietnam People's Army.

2. Scope of application.

a) All professional military personnel under the management of units and enterprises (including those on leave before retirement, studying, training, working, or receiving treatment both domestically and abroad) shall be classified and grouped according to this Circular.

b) Non-commissioned officers, soldiers, and defense civil servants who transfer to the professional military personnel system shall be classified and grouped according to this Circular to receive salaries based on the professional military personnel pay scale.

c) Defense civil servants and contractual workers (with recruitment quotas from the General Staff) at agencies, units, and special defense enterprises.

d) Newly recruited defense civil servants and military personnel (including officers, professional military personnel, non-commissioned officers-soldiers) who transfer to the defense civil servant system.

Article 2. Principles for Classification and Grouping of Professional Military Personnel

1. Based on educational level, profession, position, and vocational standards specified in the organizational establishment chart, professional military personnel shall be classified into three types, including:

a) Advanced: divided into two groups (Group 1 and Group 2).

b) Intermediate: classified into one group.

c) Basic: classified into one group.

2. Professional military personnel with a higher educational level than that specified in the vocational standards of the organizational establishment chart shall only be classified according to the specified vocational standards. Those holding positions requiring vocational standards higher than their current educational level shall only be classified according to their current educational level.

3. Professional military personnel assigned to work in professions closely related to those specified in the vocational standards of the organizational establishment chart may apply their obtained qualifications for classification.

Article 3. Classification and Grouping of Professional Military Personnel

1. Professional military personnel classified as advanced:

a) Group 1: Hold a bachelor's degree or higher and are assigned to work in the correct profession, position, and vocational standards as currently defined as bachelor's level or recognized by competent authorities as People's Artist or National Sports Champion.

b) Group 2: Hold an associate's degree or bachelor's degree or higher and are assigned to work in the correct profession, position, and vocational standards as currently defined as associate's level or recognized by competent authorities as Outstanding Artist or First-Class Sports Athlete.

2. Professional military personnel classified as intermediate: Hold an associate's degree or higher or have been trained in military service at an equivalent level (deputy platoon leader, short-term platoon leader training) and are assigned to work in the correct profession, position, and vocational standards as currently defined as associate's level or recognized by competent authorities as Outstanding Artist or First-Class Sports Athlete.

3. Professional military personnel classified as basic: Hold a technical or professional secondary education or higher or have been trained in military service at an equivalent level (platoon leader) or have been appointed and hold a position equivalent to a secondary level, and are assigned to work in the correct profession, position, and vocational standards as currently defined as secondary level.

Article 4. Classification of defense workers and civil servants

Defense workers and civil servants shall be classified to determine the level of national defense-security allowance according to the prescribed regulations, specifically:

1. Group 2, receiving a 30% allowance rate: Applied to defense workers and civil servants, contractual laborers serving at agencies under: the General Staff, the Political Bureau, the Logistics Department, the Technical Department, the National Defense Industry Department, the Second General Department; agencies directly under the Ministry of National Defense; agencies of Military Regions, Military Services, Arms Forces, Border Guard.

2. Group 1, receiving a 50% allowance rate: Applied to defense workers and civil servants, contractual laborers at other agencies and units.

Article 5. Effective Date

This Circular takes effect 45 days from the date of signature and replaces Decision No. 176/2004/QĐ-BQP dated December 30, 2004 of the Minister of National Defense on the Regulations for Classifying Professional Soldiers and Classifying Groups for Defense Workers and Civil Servants; Decision No. 96/2007/QĐ-BQP dated June 7, 2007 of the Minister of National Defense supplementing Decision No. 176/2004/QĐ-BQP dated December 30, 2004 and Decision No. 177/2004/QĐ-BQP dated December 30, 2004 of the Minister of National Defense.

Article 6. Responsibility for Implementation

1. The Chief of General Staff, Chiefs of Departments, Commanders of agencies and units are responsible for implementing the classification and grouping in accordance with this Circular.

2. The Finance Department/BQP is tasked to coordinate with relevant agencies to draft documents for submission to competent authorities for issuance or issuance within their authority regarding salary adjustments when implementing this Circular. Any issues encountered during implementation should be reported to the Ministry of National Defense's Salary Steering Committee (through the Military Affairs Department and the Finance Department) for review and resolution.
