Regulations on the management of professional activities of sports fan clubs
Article 1. Other types of artistic performances
Pursuant to Decree No. 45/2010/NĐ-CP dated April 21, 2010 of the Government on organization, operation, and management of associations;
The Ministry of Culture, Sports and Tourism stipulates the contents of managing professional activities of sports fan clubs as follows:
Article 1. Scope and objects regulated
These Circulars regulate the professional cheerleading activities for sports events of sports fan clubs established in accordance with the laws on associations and sports fan clubs established by professional sports clubs, the administrative bodies of teams, and sports delegations; responsibilities of state management agencies at all levels concerning physical culture and sports, and social-professional organizations concerning sports towards sports fan clubs.
Article 2. Contents of Activities of Sports Fan Clubs
1. Sports fan clubs operate in accordance with the provisions of the law, the association's charter, and the following regulations:
a) Strictly define membership and expulsion procedures. Do not immediately admit or expel overly aggressive or uncultured members in cheering for sports;
b) Guide members in cheering for sports;
c) Organize healthy cheering for sports in compliance with the law, sports competition rules, and venue regulations. In case of cheering away from home, the sports fan club must notify the organizing committee of the number and composition of the cheering members at least three days before the event;
d) Propose to relevant authorities to consider and support funding, facilities, professional materials, tickets, costumes, cheering equipment, transportation means, and other conditions to organize cheering activities;
e) Participate in contributing opinions to the administrative body regarding team sports activities.
2. Members of sports fan clubs:
a) Individuals with clear records, meeting the criteria for membership as stipulated by the association, voluntarily joining the association, committing to fully comply with the association's cheering regulations, not violating the law, and not engaging in violent or uncultured behavior during cheering can become members of sports fan clubs. The authority to admit and expel members is regulated by the association.
b) Members of sports fan clubs have rights and responsibilities according to the law, the approved association charter, and the following rights and responsibilities: Participating in cheering activities according to the association's plan; Receiving consideration for support from the association regarding tickets, costumes, cheering equipment, transportation means, and other conditions when participating in cheering activities; Promoting lawful and healthy cheering in accordance with the association's cheering regulations, sports competition rules, and venue regulations; Not using unsightly, offensive, or provocative cheering equipment; Participating in contributing opinions to the administrative body regarding team sports activities.
Article 3. Responsibilities for Managing Sports Fan Clubs
1. General Department of Physical Culture and Sports: The General Department of Physical Culture and Sports advises the Minister of Culture, Sports and Tourism to manage sports fan clubs in accordance with Decree No. 45/2010/NĐ-CP dated April 21, 2010 of the Government and has the responsibility:
a) Organizing guidance for associations to operate in accordance with professional regulations;
b) Creating conditions for associations to participate in the process of socialization of physical culture and sports;
c) Monitoring, promptly identifying, and proactively coordinating with competent agencies to handle violations of the law by sports fan clubs.
2. People's Committees of provinces and centrally governed cities: People's Committees of provinces and centrally governed cities manage sports fan clubs in accordance with Decree No. 45/2010/NĐ-CP dated April 21, 2010 of the Government and have the responsibility:
a) Guiding and supporting the establishment and effective operation of sports fan clubs in accordance with the law;
b) Creating conditions for sports fan clubs to participate in the process of socialization of physical culture and sports at the local level;
c) Organizing inspections, supervision, and strictly handling violations in cheering activities in accordance with the law;
d) Directing specialized agencies to monitor the operation of sports fan clubs in accordance with the law.
3. Departments of Culture, Sports and Tourism of provinces and centrally governed cities implement the management of professional activities of sports fan clubs in accordance with the guidance of the General Department of Physical Culture and Sports;
4. Social-professional organizations concerning sports:
a) Directing member organizations to guide and create conditions for sports fan clubs to operate;
b) Supporting and guiding professional activities for national-level sports fan clubs;
c) Building and implementing regulations on cheering activities when organizing sports events within their authority to ensure security and safety in sports competitions;
d) Strictly handling violations in cheering activities in accordance with the Competition Rules.
5. Administrative bodies of sports teams and delegations:
a) Considering support and creating conditions regarding funding, means, and other conditions for sports fan clubs to cheer for sports teams;
b) Coordinating with relevant agencies to supervise cheering activities of sports fan clubs at competition venues;
c) Being responsible for the activities of sports fan clubs established or recognized by themselves.
Article 4. Effectiveness of this Circular
This Circular takes effect from October 1, 2010. Organizations and individuals involved in the implementation of this Circular, if encountering difficulties, are requested to report to the Ministry of Culture, Sports and Tourism for study and appropriate amendments and supplements./.
