Provisions on management, operation, and exploitation of the driver's license information system
Regarding the driver's license information system

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Pursuant to Decree No. 64/2007/NĐ-CP dated April 10, 2007 of the Government on the application of information technology in state agency activities;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport.

The Minister of Transport issues this Circular to provide provisions on the management, operation, and exploitation of the driver's license information system,
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular provides provisions on the management, operation, and exploitation of the driver's license information system.
Article 2. Applicability
This Circular applies to agencies, organizations, and individuals related to the management, operation, and exploitation of the driver's license information system managed by the transport sector throughout the country.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. Driver's license information system is a collection and combination of hardware, software, and communication networks built and used to collect, manage, operate, and exploit data on training, examination, issuance, and renewal of driver's licenses. The system includes the central system and the local system.
2. Electronic file of driver's license is a set of electronic documents related to training, examination, issuance, and renewal of driver's licenses that have been digitized in the application for new or renewed driver's licenses.
3. Driver's license database is a structured set of information on training, examination, issuance, and renewal of driver's licenses and information on violations of the Road Traffic Law recorded and updated.
4. Digital signature on driver's license is the signature of the authorized person issued with a digital certificate according to regulations.
Chapter II
MANAGEMENT OF THE DRIVER'S LICENSE INFORMATION SYSTEM
Article 4. Agencies managing the driver's license information system
1. The Vietnam Highway Administration is responsible for uniformly managing the driver's license information system nationwide; the Vehicle and Driver Management Department under the Vietnam Highway Administration performs the functions and tasks of the direct management agency of the driver's license information system at the central level.
2. The Department of Transport is responsible for managing the driver's license information system within the province or centrally-administered city; the Department of Transport’s department assigned the task of managing training, examination, and issuance of driver's licenses performs the functions and tasks of the direct management agency of the driver's license information system at the local level.
Article 5. Tasks of the Vietnam Highway Administration
1. Guide the management, use, updating, exploitation, and management of the driver's license information system.
2. Connect and exchange data with related information systems as prescribed.
3. Invest in, maintain, and upgrade hardware, software systems, and data transmission networks located at the Vietnam Highway Administration.
4. Invest in, build, and upgrade applications within the driver's license information system to be applied nationwide.
5. Manage and guide the use of security technology on driver's licenses.
6. Serve as the focal point for compiling requirements and submitting to the competent authority for issuing digital certificates to eligible persons authorized to sign and issue driver's licenses on behalf of the Minister of Transport.
7. Perform other tasks and powers related to driver's license management assigned by the Ministry of Transport.
Article 6. Tasks of the central agency directly managing the driver's license information system
1. Perform the function of administering the driver's license information system:
a) Managing the electronic portal;
b) Managing user account permissions and security within the system;
c) Managing system configuration;
d) Backing up and restoring data;
đ) Managing system logs.
2. Updating, processing, exploiting, verifying, and synchronizing driver's license data.
3. Providing technical support to ensure continuous operation of the driver's license information system.
4. Offering technical support to agencies using the driver's license information system.
5. Ensuring data security and safety for the driver's license information system.
6. Fulfilling the tasks of the central agency directly managing the driver's license information system as stipulated in Article 8 of this Circular (for units managed by the Vietnam Highway Administration).
7. Performing other tasks as required by management.
Article 7. Tasks of the Department of Transport
1. Investing in, maintaining, and upgrading hardware and software equipment and data transmission networks located at the Department of Transport.
2. Receiving and organizing the implementation of application software systems in the driver's license information system transferred by the Vietnam Highway Administration.
3. Coordinating with relevant agencies at the local level to exchange information as prescribed.
Article 8. Tasks of the local agency directly managing the driver's license information system
1. Updating, processing, exploiting, verifying, and synchronizing driver's license data.
2. Updating information on violations of the Road Traffic Law recorded and transferred from patrol and control forces.
3. Ensuring continuous operation of the driver's license information system; performing data backup and restoration.
4. Offering technical support to agencies and units using the driver's license information system at the local level.
5. Ensuring data security and safety for the driver's license information system.
6. Providing driver's license information to the Department of Transport's electronic portal (if applicable).
7. Performing other tasks as required by management.
Chapter III
OPERATING THE DRIVER'S LICENSE INFORMATION SYSTEM
Article 9. Driver Training Institutions
1. Accepting paper applications, creating electronic files, and sending or transmitting data to the Department of Transport (the local agency directly managing the driver's license information system) or the Vietnam Highway Administration (the central agency directly managing the driver's license information system).
2. Being responsible for the accuracy and legality of the electronic files sent or transmitted to the Department of Transport or the Vietnam Highway Administration.
Article 10. Driving License Examination Centers
1. Receiving data on examination schedules, candidate lists, compiling, and storing results according to prescribed data regulations.
2. Sending or transmitting examination result data to the local agency directly managing the driver's license information system as prescribed.
3. Being responsible for the accuracy of examination result data.
Article 11. Local Agency Directly Managing the Driver's License Information System
1. Accepting paper applications, creating electronic registration files for issuing new or replacement driver's licenses,
2. Approving and updating electronic files in the driver's license information system.
3. Sending and receiving electronic files for verification, comparison, and updating into the driver's license database managed by the Vietnam Highway Administration.
4. Verifying digital signatures of authorized signatories on electronic driver's license issuance files.
5. Implementing the printing process for driver's licenses.
6. Inspecting the quality of printed driver's licenses and synchronizing data into the driver's license database managed by the Vietnam Highway Administration as prescribed.
7. Converting and updating all driver's license data not made of PET material according to the planned schedule.
8. Being responsible for the accuracy and legality of electronic files sent or transmitted to the Vietnam Highway Administration.
Article 12. Central agency directly managing the driving license information system
1. Receive electronic files from local agencies directly managing the driving license information system to verify and synchronize with the driving license database managed by the Vietnam Highway Corporation.
2. Process and send back verified data to the local agency directly managing the driving license information system for printing the driving licenses.
3. Receive and manage driving license data transferred and updated from provincial Departments of Transport to synchronize with the driving license database.
4. Update and operate the electronic information page on the driving license information system as prescribed.
Article 13. Responsibilities of authorized persons using digital signatures on the driving license information system
1. Use digital certificates to sign approval for issuing driving licenses.
2. Safeguard and secure digital certificates in accordance with regulations.
Article 14. Data retention period for driving licenses
The head of the agency or organization is responsible for directing the implementation of electronic document management in accordance with regulations.
1. The data retention period for training and examination records for issuing driving licenses at driver training facilities and examination centers is a minimum of five years.
2. The data retention period for training, examination, issuance, and renewal of driving licenses at provincial Departments of Transport under central cities and provinces is a minimum of fifty years.
3. The data retention period for driving licenses at the Vietnam Highway Corporation is a minimum of one hundred years.
Chapter IV
EXPLOITATION OF DATA ON THE DRIVING LICENSE INFORMATION SYSTEM
DRIVING LICENSE PERMIT
Article 15. Principles of exploitation
1. Exploitation of driving license data shall be carried out in accordance with laws on information technology.
2. The agency managing the driving license information system as stipulated in Article 4 of this Circular shall be responsible for protecting personal information in the driving license database on the network in accordance with laws on information technology.
3. Services for exploiting driving license data information shall be provided to agencies, organizations, and individuals in accordance with regulations.
Article 16. Forms of exploitation of the driving license database
1. Direct Exploitation
Agencies, organizations, and individuals may exploit driving license data directly from the driving license electronic information page (http://www.gplx.gov.vn) in accordance with the level of security and permissions for using and exploiting driving license data.
2. Indirect Exploitation
Agencies, organizations, and individuals requiring detailed exploitation of driving license data, depending on the level of security, shall be provided with information extracted from the driving license database.
a) Information recorded on the driving license.
b) In cases where there is a request from an authorized agency, in addition to the information printed on the driving license, information on training, examination, and traffic law violations will also be provided.
3. Individuals seeking to exploit certain information recorded on the driving license can search through the SMS system.
Chapter V
IMPLEMENTING PROVISIONS
Article 17. Reports on management, operation, and exploitation of the driving license information system
1. The Vietnam Highway Corporation is responsible for compiling and reporting to the Ministry of Transport and relevant agencies annually once before January 15 of the following year on the situation of management, operation, and exploitation of the driving license information system nationwide.
2. Provincial Departments of Transport are responsible for compiling and reporting to the People's Committees of provinces and centrally-administered cities and the Ministry of Transport (through the Vietnam Highway Corporation) annually once before January 5 of the following year on the situation of management, operation, and exploitation of the driving license information system locally.
Article 18. Effective Date
This Circular takes effect from July 1, 2013.
Article 19. Responsibility for Implementation
2. The Heads of the Office, the Inspectorate, the Department Directors, the Director of the General Department of Vietnam Roads, the Directors of Provincial Departments of Transport under central cities and provinces, the Heads of agencies, organizations, and individuals related to this matter are responsible for enforcing this Circular./.
2. The Director of the Ministry’s Office, the Inspector General of the Ministry, Heads of Departments, the Director-General of the Vietnam Highway Corporation, Directors of Provincial Departments of Transport under centrally-administered cities and provinces, Heads of agencies, organizations, and individuals related to this Circular are responsible for its implementation./.
