Regulations detailing certain provisions of the Law on Citizen Identity Cards and
Decree No. 137/2015/NĐ-CP dated December 31, 2015 stipulating
 detailed provisions and implementation measures of the Law on Citizen Identity Cards

Pursuant to the Citizen Identification Card Law on November 20, 2014;

On the basis of Decree No. 137/2015/NĐ-CP dated December 31, 2015 stipulates detailed provisions and implementation measures of the Law on Citizen Identity Cards;

Pursuant to Decree No. 106/2014/NĐ-CP dated November 17, 2014, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the General Police Department;

The Minister of Public Security issues this Circular to detail certain provisions of the Law on Citizen Identity Cards and Decree No. 137/2015/NĐ-CP dated December 31, 2015 stipulating detailed provisions and implementation measures of the Law on Citizen Identity Cards.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular details certain provisions of the Law on Citizen Identity Cards and Decree No. 137/2015/NĐ-CP dated December 31, 2015 stipulating detailed provisions and implementation measures of the Law on Citizen Identity Cards (hereinafter referred to as Decree No. 137/2015/NĐ-CP) regarding the collection, updating, and correction of information in the National Population Database; personal identification number codes; the collection, updating, and correction of information in the Citizen Identity Card Database; issuance, management of Citizen Identity Cards, and the responsibilities of local police units.

Article 2. Applicability

1. Officers and units managing and operating the National Population Database, the Citizen Identity Card Database, issuing, replacing, and reissuing Citizen Identity Cards.

2. Public security units and localities.

3. Agencies, organizations, and individuals related to the National Population Database, the Citizen Identity Card Database, issuing, replacing, and reissuing Citizen Identity Cards.

Chapter II
COLLECTION, UPDATE, AND CORRECTION
INFORMATION IN
THE NATIONAL POPULATION DATABASE, PERSONAL IDENTIFICATION NUMBER CODES
 IDENTIFICATION NUMBERS

Article 3. Collection of citizen information       

The collection of citizen information shall be carried out in accordance with the order prescribed in Clause 3, Article 4 of Decree No. 137/2015/NĐ-CP. In cases where citizen information cannot be collected from household registration books, household registration files, citizen identity card files, the Household Registration Database, the Citizen Identity Card Database, the Civil Status Database, specialized databases, other national databases, or if the citizen information from these sources is inconsistent, then the information shall be collected from citizens in the following sequence:

1. Police stations at communes, wards, and towns shall issue the Citizen Information Collection Form to each household and guide them in filling out the form.

2. Citizens whose information is being collected shall fill out the Citizen Information Collection Form and sign for confirmation.

3. Police stations at communes, wards, and towns shall collect the Citizen Information Collection Forms and compare them with household registration books and civil status records. If the citizen's information is complete and accurate, the Community Police Officer and Police Officer shall sign for confirmation, submit it to the Chief of the Police Station at the commune, ward, or town for signature and stamping. If the citizen's information is incomplete or inaccurate, they shall be required to supplement and correct the information and present legal documents as evidence, the Community Police Officer and Police Officer shall sign for confirmation, submit it to the Chief of the Police Station at the commune, ward, or town for signature and stamping.

4. Police stations at communes, wards, and towns shall transfer the Citizen Information Collection Forms to the county-level police station.

5. County-level police stations shall check and classify the forms:

a) For forms meeting the requirements, the county-level police station shall scan them to upload electronic data to the General Department of Registration and Management of Residency and the National Population Database, and retain the Citizen Information Collection Forms in the household registration files of the county-level police station.

b) For forms not meeting the requirements, they shall be returned to the police stations at communes, wards, and towns for supplementary information collection. Forms not meeting the requirements are those lacking one of the following pieces of information: surname, middle name, and given name at birth; date of birth; gender; place of birth registration; nationality; place of permanent residence; surname, middle name, and given name of father, mother, or head of household; household registration book number; signature of the person providing the information; signature of the Community Police Officer, Police Officer; signature and stamp of the Chief of the Police Station at the commune, ward, or town.

Article 4. Collection of information about citizens from permanent residence registration work

1. At the Public Security Police of districts, cities under central government, towns, provincial cities, the collection of information about citizens shall be carried out as follows:

a) The permanent residence registration officer checks the information of citizens requesting permanent residence registration. In cases where the citizen's information is not yet in the National Population Database, the permanent residence registration officer guides the citizen to fill out the Citizen Information Collection Form, requiring the citizen to check and sign for confirmation.

b) For cases meeting the conditions for permanent residence registration, the permanent residence registration officer checks, signs for confirmation on the Citizen Information Collection Form, proposes to the head of the Administrative Management Police Team to submit for signature and stamping by the Head of the District Public Security Police, then enters the citizen's information into the National Population Database and retains the Citizen Information Collection Form in the household registration file archives of the District Public Security Police.

2. At the Public Security Police of communes, towns under provinces, the collection of information about citizens shall be carried out as follows:

a) The permanent residence registration officer checks the information of citizens requesting permanent residence registration. In cases where the citizen's information is not yet in the National Population Database, the permanent residence registration officer guides the citizen to fill out the Citizen Information Collection Form, requiring the citizen to check and sign for confirmation.

b) For cases meeting the conditions for permanent residence registration, the permanent residence registration officer checks, signs for confirmation on the Citizen Information Collection Form, proposes to the Head of the Commune or Town Public Security Police to sign and stamp, then transfers the Citizen Information Collection Form to the District Public Security Police.

The District Public Security Police will proceed to enter data into the National Population Database and retain the Citizen Information Collection Form in the household registration file archives of the District Public Security Police.

Article 5. Updating information about citizens

1. Updating information about citizens based on the results of permanent residence registration and management work:

a) At the Public Security Police of districts, cities under central government, towns, provincial cities, updating information about citizens shall be carried out as follows:

- The permanent residence registration officer checks legal documents proving the information to be updated, prints the Citizen Information Update and Correction Form, requests the citizen to check the information, sign for confirmation, and proposes to the head of the Social Order Administrative Management Police Team to submit for approval by the Head of the District Public Security Police;

- After receiving the approval result, the permanent residence registration officer updates the citizen's information into the National Population Database and retains the file in the household registration file archives.

b) At the Public Security Police of communes, towns under provinces, updating information about citizens shall be carried out as follows:

- The permanent residence registration officer checks legal documents proving the information to be updated, prints the Citizen Information Update and Correction Form, requests the citizen to check the information, sign, stamp, and transfer the file to the District Public Security Police;

- The District Public Security Police updates the citizen's information into the National Population Database and retains the file in the household registration file archives.

2. Updating information about citizens when requested by citizens shall be carried out as follows:

a) The officer managing the National Population Database checks legal documents proving the information to be updated, prints the Citizen Information Update and Correction Form, requests the citizen to check the information, sign for confirmation, and proposes to the head of the agency for approval;

b) After receiving the approval result, the officer managing the National Population Database updates the citizen's information into the National Population Database and transfers the file into the household registration file archives for retention.

3. Updating information about citizens from specialized databases, other national databases shall be carried out as follows:

Specialized databases, other national databases update the citizen's information into the National Population Database when there is a change in the citizen's information. The updating of information about citizens is through the connection and sharing of data between the National Population Database and specialized databases, other national databases.

Article 6. Procedure for Amending Citizen Information in the National Population Database

1. In cases where the competent authority discovers errors in citizen information during the process of collecting, updating, and managing such information in the database, it shall proceed as follows:

a) The staff member of the competent authority shall verify the legality and accuracy of the information; prepare a record of the discovery of errors in the collection, updating, and management of citizen information, along with relevant documents (if any), and report to the head of the authority for approval;

b) After the head of the authority approves, the staff member of the competent authority shall amend the citizen information in the National Population Database.

2. In cases where organizations or individuals request amendments to citizen information, the competent authority shall proceed as follows:

a) Receive requests for amending citizen information and related documents;

b) Request organizations or individuals to fill out the Application for Updating and Amending Resident Information;

c) Verify the legality and accuracy of the information to be amended. If there is a basis for amending the citizen information, report to the head of the authority for approval. If there is no basis for amending the citizen information, inform the organization or individual and specify the reasons.

d) After the head of the authority approves, amend the citizen information in the National Population Database.

Article 7. Codes in Personal Identification Numbers

1. The codes in personal identification numbers include:

a) The code of the province or centrally governed city where the citizen registered their birth, as specified in Appendix I attached hereto;

b) The code of the country where the citizen registered their birth, as specified in Appendix II attached hereto;

c) The century of birth code, gender code, and year of birth code, as specified in Appendix III attached hereto.

2. The codes specified in Clause 1 of this Article shall be kept confidential in accordance with the laws on protecting state secrets.

Chapter III
NATIONAL CITIZEN IDENTIFICATION DATABASE

Article 8. Procedures and Formalities for Collecting, Updating, and Amending Information in the National Identity Card Database

1. The national identity card database is connected to the National Population Database, the Residency Database, and other specialized databases within the Public Security Force to collect, update, and share information about citizens.

2. The collection and updating of citizen information into the national identity card database during the issuance, replacement, or reissuance of identity cards shall be carried out as follows:

a) Staff members of the identity card management authority responsible for processing the issuance, replacement, or reissuance of identity cards shall have the responsibility to collect citizen information into the national identity card database from the Identity Card Application Form and the Identity Card Information Collection Form.

b) In cases where citizen information changes during the process of replacing or reissuing identity cards, the staff member receiving the application for replacement or reissuance of identity cards shall have the responsibility to prepare an Identity Card Information Adjustment Form and proceed as follows:

- If the change in citizen information is permitted by the competent authority, the staff member receiving the application shall verify the citizen information and report to the head of their own authority to decide on updating the citizen information.

- If the change in citizen information is due to an error in the issuance, replacement, or reissuance of identity cards, the staff member receiving the application shall verify the citizen information and report to the head of their own authority to initiate procedures to propose the head of the identity card management authority at the Ministry of Public Security to decide on amending the citizen information.

3. Any changes in citizen information must be promptly, accurately, and fully updated and amended in the national identity card database.

Article 9. Authority for Collecting, Updating, and Amending Information in the National Identity Card Database

1. The head of the identity card management authority receiving applications for the issuance, replacement, or reissuance of identity cards shall decide on collecting and updating citizen information into the national identity card database during the issuance, replacement, or reissuance of identity cards.

2. The head of the identity card management authority at the Ministry of Public Security shall decide on amending citizen information in the national identity card database; connect the national identity card database with the National Population Database and other databases to collect, update, and share citizen information.

Article 10. Exploiting information in the Citizen Identity Database

1. Cases where information can be exploited in the Citizen Identity Database:

a) The citizen identity management agency may exploit information in the Citizen Identity Database to serve the issuance, replacement, reissuance, and management of citizen identity cards;

b) Public security units at all levels may exploit information in the Citizen Identity Database to serve the requirements of public security operations and crime prevention;

c) Judicial agencies may exploit information in the Citizen Identity Database to serve investigative, prosecution, and trial activities;

d) Citizens may exploit their own information in the Citizen Identity Database;

đ) Agencies, organizations, and citizens not covered under points a, b, c, and d of this Clause must obtain the consent of the head of the citizen identity database management agency if they wish to exploit information in the Citizen Identity Database.

2. Procedures for exploiting information in the Citizen Identity Database:

a) Agencies and organizations wishing to exploit information in the Citizen Identity Database must submit a written request specifying the purpose and content of the information to be exploited, which must be signed and stamped by the head of the agency or organization;

b) Citizens wishing to exploit information must submit a written request specifying the purpose and content of the information to be exploited and present one of the following documents: Birth certificate, Household registration book, citizen identity card, or identification card;

c) Within five working days from the date of receipt of the request for information exploitation, the person authorized under Article 11 of this Circular shall decide whether to allow the exploitation of information in the Citizen Identity Database. In case of refusal to provide information, the reason must be communicated to the agency, organization, or citizen requesting the information;

Article 11. Authority to permit access to information in the National Identity Card Database

1. Provincial Public Security Directors and County Public Security Chiefs have the authority to permit the exploitation of information about citizens residing in their respective localities.

2. The head of the citizen identity management agency under the Ministry of Public Security has the authority to permit the exploitation of information about citizens nationwide.

Chapter IV
ISSUANCE AND MANAGEMENT OF CITIZEN IDENTITY CARDS

Article 12. Procedure for Issuing Citizen Identity Cards

1. The procedure for issuing citizen identity cards is as follows:

a) Citizens fill out the Citizen Identity Card Application Form;

b) Staff receiving applications for citizen identity cards check and compare the citizen's information in the Citizen Identity Card Application Form with the national population database connected to the citizen identity database to accurately identify the person to be issued the card and unify the citizen's information; in cases where the citizen does not have information or the information has changed and not been updated in the national population database, the citizen is required to confirm accurate information and present valid documents regarding the information to be recorded in the Citizen Identity Card Application Form for verification and updating in the database;

If the national population database and the citizen identity database have not yet commenced operation, the citizen is required to present the Household Registration Book;

c) When citizens switch from a nine-digit or twelve-digit identification card to a citizen identity card, staff receiving applications collect, process, and store the old identification card according to the provisions of Article 15 of this Circular;

d) Staff of the citizen identity management agency take photographs, collect fingerprints, and other identifying features of the person applying for the citizen identity card to print on the Citizen Identity Card Information Collection Form and the citizen identity card according to regulations;

The citizen's portrait photograph must be a frontal shot without a hat, clearly showing the face and both ears, without glasses; the attire and demeanor must be serious and courteous, and specialized uniforms cannot be worn when taking the photograph for the citizen identity card; however, for religious or ethnic citizens, religious or ethnic ceremonial attire may be worn, and headscarves may remain intact during photography provided that the face is clearly visible;

Staff of the citizen identity management agency collect fingerprints using fingerprint collection equipment; in cases where fingers are missing, deformed, or otherwise unable to collect fingerprints, specific details are recorded in the corresponding position;

đ) Staff of the citizen identity management agency issue a notice of appointment for the citizen identity card to the applicant. If the application and procedures are incomplete, the staff guide the citizen to complete them to obtain the citizen identity card;

e) The agency receiving the application issues a confirmation of the identification card number (if applicable) and returns the citizen identity card according to the time and location specified in the appointment notice. The location for returning the citizen identity card is the place where the application was made; if the citizen requests delivery to another location, the specific address for delivery must be noted on the Citizen Identity Card Application Form. The agency receiving the application ensures timely delivery at the requested location and the citizen must pay the service fee for delivery according to regulations;

2. Persons suffering from mental illness or other diseases that impair cognitive or behavioral control must have a legally authorized representative accompany them to follow the procedures stipulated in points a, b, c, đ, and e of Clause 1 of this Article.

Article 13. Procedures for Replacing and Issuing New Citizen Identity Cards

The procedures for replacing and issuing new Citizen Identity Cards shall be as follows:

1. Implement the procedures as prescribed in Article 12 of this Circular;

2. In cases where the Citizen Identity Card needs to be replaced due to changes in information recorded on the card, which have not yet been entered or updated in the National Population Database, the citizen must submit a copy of the relevant authority's document regarding the change of such information for verification and updating in the database.

3. Collect the previously used Citizen Identity Card when the citizen applies for replacement of the Citizen Identity Card;

4. Citizens must pay the fee for replacing or issuing new Citizen Identity Cards as prescribed.

Article 14. Issuance, Replacement, and Reissuance of Citizen Identity Cards for Personnel in the People's Army and People's Public Security Force

1. For citizens officially registered in the personnel rolls of the People's Army and People's Public Security Force who reside in barracks or collective housing without registering their permanent residence at a specific address when applying for issuance, replacement, or reissuance of Citizen Identity Cards, they are responsible for completing all procedures as stipulated in Articles 12 and 13 of this Circular. Specifically, presenting the household registration book can be substituted with a certificate issued by the People's Army or People's Public Security Force; if there is no such certificate, then a recruitment decision, transfer order, or work assignment notice should be presented.

For the above cases, when applying for issuance, replacement, or reissuance of Citizen Identity Cards, it is necessary to attach an introduction letter from the unit head, and the place of permanent residence on the Citizen Identity Card should be recorded according to the address of the unit where the citizen is directly working.

2. The authority to issue introduction letters for personnel in the People's Army and People's Public Security Force to apply for Citizen Identity Cards is the head of the unit directly managing those officers and soldiers (signed, clearly stating name and stamping); for units in the People's Army and People's Public Security Force that do not use their own seals, the person issuing the introduction letter is the head of the higher-level unit that uses its own seal.

The person issuing the introduction letter for applying for Citizen Identity Cards must bear responsibility for issuing it to the correct individuals as prescribed.

3. For citizens officially registered in the personnel rolls of the People's Army and People's Public Security Force who have registered their permanent residence at a specific address, the procedures for issuance, replacement, and reissuance of Citizen Identity Cards shall be carried out similarly to other citizens.

Article 15. Collection, Submission, and Processing of Identification Cards When Citizens Transition from 9-Digit or 12-Digit Identification Cards to Citizen Identity Cards and Confirmation of Identification Card Numbers for Citizens

When citizens apply to transition from 9-digit or 12-digit Identification Cards to Citizen Identity Cards, the staff receiving the application must collect the 9-digit or 12-digit Identification Cards submitted by the citizens and proceed as follows:

1. For 9-digit Identity Cards:

a) If the 9-digit Identification Card is still clear (photo, identification number, and text), the upper right corner of the front side of the card will be cut off, each edge of the right angle being 2 cm, noted in the file, and the Identification Card with the cut corner returned to the applicant. Immediately after receiving the Identification Card with the cut corner or subsequently, if requested by the citizen, the agency that cuts the corner of the 9-digit Identification Card is responsible for issuing a Certificate confirming the Identification Card number to the citizen;

b) If the 9-digit Identification Card is damaged, peeled off, or unclear (photo, identification number, and text), the card will be collected and canceled, noted in the file, and a Certificate confirming the Identification Card number will be issued to the citizen.

2. For 12-digit Identification Cards, the upper right corner of the front side of the card will be cut off, each edge of the right angle being 1.5 cm, noted in the file, and the Identification Card with the cut corner returned to the applicant.

3. If a citizen has lost their 9-digit Identification Card and applies for issuance of a Citizen Identity Card, upon request by the citizen, the agency receiving the application for the Citizen Identity Card is responsible for issuing a Certificate confirming the lost 9-digit Identification Card number to the citizen.

Article 16. Hierarchical Authority for Issuance, Replacement, and Reissuance of Citizen Identity Cards

When the National Population Database and the Citizen Identity Card Database have not yet commenced operation or have not fully collected information about citizens, the hierarchical authority for issuance, replacement, and reissuance of Citizen Identity Cards shall be implemented as follows:

1. The Citizen Identity Card Management Agency under the Public Security Department at the district level and equivalent administrative units shall receive applications for issuance, replacement, and reissuance of Citizen Identity Cards for citizens whose permanent residence is in that locality.

2. The Citizen Identity Card Management Agency under the Provincial Public Security Department shall receive applications for issuance, replacement, and reissuance of Citizen Identity Cards for citizens whose permanent residence is within the province or centrally-administered city; cases of replacing Citizen Identity Cards as prescribed in point a, b Clause 1 Article 23 of the Citizen Identity Card Law and reissuing Citizen Identity Cards for citizens whose permanent residence is in another province or centrally-administered city.

3. The Citizen Identity Card Management Agency under the Ministry of Public Security shall receive applications for replacing Citizen Identity Cards when citizens request and other special cases decided by the head of the Citizen Identity Card Management Agency under the Ministry of Public Security.

Article 17. Organization of Issuance, Replacement, and Reissuance of Mobile Identity Cards in Necessary Circumstances

Clause 1. The identity management agency shall organize the issuance, replacement, and reissuance of identity cards at highland, remote, border, island communes where travel is difficult, or at agencies, units, schools, and areas if deemed necessary.

Clause 2. The identity management agency shall organize the issuance, replacement, and reissuance of identity cards at temporary detention centers, pre-trial detention centers, prisons, educational facilities for rehabilitation, compulsory education facilities, and compulsory drug rehabilitation facilities upon receipt of a written request from the heads of these agencies.

Clause 3. The identity management agency shall organize the issuance of identity cards at the place of residence of citizens for elderly, sick, or injured individuals who cannot travel, with confirmation from the police station of the commune where they reside.

Article 18. Arrangement, Storage, and Management of Files for Issuance, Replacement, and Reissuance of Identity Cards

Files for the issuance, replacement, and reissuance of identity cards shall be arranged and stored according to the regulations stipulated in the identity management archives of the provincial police force where the citizen usually resides for management and exploitation.

Chapter V
RESPONSIBILITIES OF POLICE UNITS AND LOCAL AUTHORITIES REGARDING
NATIONAL DATABASE ON POPULATION, IDENTITY MANAGEMENT DATABASE,
ISSUANCE, AND MANAGEMENT OF IDENTITY CARDS NATIONAL IDENTIFICATION DOCUMENT

Article 19. Responsibilities of the National Police Agency

Clause 1. Advising and proposing competent authorities to build and promulgate normative legal documents on the National Population Database, Identity Management Database, issuance, and management of identity cards. Directing, guiding, urging, and inspecting local police forces in implementing normative legal documents on the National Population Database, Identity Management Database; issuance, and management of identity cards.

Clause 2. Taking the lead and coordinating with related units to advise the leadership of the Ministry of Public Security to build and perfect the National Population Database, Identity Management Database; developing plans and directing, guiding, and inspecting local police forces in implementing data collection, updating, and exploitation in the National Population Database, Identity Management Database.

3. Manage the National Population Database, the National Identity Card Database.

Clause 4. Organizing production and management of identity cards; taking the lead and coordinating with the Logistics and Technical General Department and related units to ensure operating funds, supply materials, equipment, and forms for the issuance and management of identity cards.

Clause 5. Inspecting, auditing, resolving complaints and denunciations, and handling violations related to the National Population Database, Identity Management Database, issuance, and management of identity cards in accordance with the law.

Clause 6. Summarizing, concluding, and statistics on the National Population Database, Identity Management Database, issuance, and management of identity cards.

Article 20. Responsibilities of General Departments and Units under the Ministry

Clause 1. The Political General Department of the People's Public Security has the responsibility to take the lead and coordinate with the National Police Agency to propose organizational models, staffing, policies, training, and personnel development to meet the requirements of building and managing the National Population Database, Identity Management Database, issuance, and management of identity cards.

Clause 2. The Logistics and Technical General Department has the responsibility to take the lead and coordinate with the National Police Agency to guide local police forces on technical and technological aspects in building and managing the National Population Database, Identity Management Database.

Clause 3. The Planning and Investment Department has the responsibility to take the lead and coordinate with the Finance Department, the Logistics and Technical General Department, and the National Police Agency to allocate regular funding for the construction and maintenance of the National Population Database, Identity Management Database, issuance, and management of identity cards in accordance with the law.

Article 21. Responsibilities of Provincial Public Security Authorities

1. Directly implement and advise the provincial People's Committee on organizing the implementation of legal documents concerning the National Population Database, the National Identity Card Database, issuance, management of Identity Cards; organize the collection, updating, standardization of information about residents within their jurisdiction into the National Population Database.

2. Train, develop, propose staffing for cadres serving the construction, collection, updating of information and operation of the National Population Database, the National Identity Card Database, issuance, management of Identity Cards within their jurisdiction.

3. Organize the issuance and management of Identity Cards at the local level.

4. Inspect, audit, handle complaints, denunciations, and violations related to the National Population Database, the National Identity Card Database, issuance, management of Identity Cards within their jurisdiction.

5. Summarize, conclude, and statistically analyze the National Population Database, the National Identity Card Database, issuance, management of Identity Cards within their jurisdiction and report to the Ministry of Public Security.

Article 22. Responsibilities of District Public Security Authorities

1. Develop plans and implement the collection, updating, and correction of information about residents within their jurisdiction.

2. Direct, guide, inspect the Village, Ward, Town Police regarding the collection of citizen information into the National Population Database.

3. Organize inspections on the use of Identity Cards by citizens within their jurisdiction according to the provisions of the law.

4. Handle complaints, denunciations related to the National Population Database; the National Identity Card Database; issuance, management of Identity Cards according to the provisions of the law.

5. Organize summaries, conclusions, and statistical analysis of the National Population Database, the National Identity Card Database, issuance, management of Identity Cards according to the provisions.

Article 23. Responsibilities of Village, Ward, Town Police

1. Collect information about citizens into the National Population Database.

2. Propose the District Public Security Authority to collect and update information about citizens into the National Population Database.

3. Monitor changes in information about citizens, the number of people eligible for issuance, replacement, reissuance of Identity Cards at the local level.

4. Organize inspections on the use of Identity Cards within their jurisdiction according to the provisions of the law.

Chapter VI
IMPLEMENTATION

Article 24. Effective Date and Transitional Provisions

1. This Circular shall take effect from March 20, 2016.

2. In places where conditions for issuing, replacing, reissuing Identity Cards according to the Law on Identity Cards have not yet been met, continue to issue, replace, reissue Identification Cards according to the provisions of Circular No. 04/1999/TT-BCA(C13) dated April 29, 1999 of the Minister of Public Security guiding certain provisions of Decree No. 05/1999/NĐ-CP dated February 3, 1999 on Identification Cards and Clause 2, Article 6 of Circular No. 61/2015/TT-BCA dated November 16, 2015 of the Minister of Public Security on the model of Identity Cards.

Article 25. Responsibilities for Implementation

1. The Director of the Criminal Police General Corps shall be responsible for guiding and inspecting the implementation of this Circular.

2. The Directors of the General Corpses under the Ministry of Public Security, heads of units directly under the Ministry of Public Security, Directors of Public Security, Directors of Fire Prevention and Fighting Departments of provinces and centrally-administered cities, and relevant organizations and individuals shall be responsible for implementing this Circular.

During the implementation process, if there are difficulties or obstacles, local police units shall report to the Ministry of Public Security (through the General Police Department) for timely guidance./.
