for sugar imports in 2016

On the basis of Decree No. 95/2012/ND-CP November 12, 2012 Government Decree stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
On the basis of Decree No. 187/2013/ND-CP November 20, 2013 Government Decree detailing the implementation of the Law on Trade regarding international trade activities and agency buying, selling, processing, and transiting goods with foreign countries;
On the basis of Decree No. 17/2010/ND-CP March 4, 2010 Government Decree on auctioning assets;
On the basis of Decree No. 52/2009/ND-CP June 3, 2009 Government Decree detailing and guiding the implementation of certain provisions of the Law on State Asset Management and Use;
Pursuant to the proposal of the Director of Import-Export Department;
The Minister of Industry and Trade issues this Circular regulating the principles for managing tariff quotas for sugar imports in 2016.This Circular stipulates the quantity of tariff quotas for sugar imports and the principles for auctioning tariff quotas for sugar imports in 2016.
Article 1. Scope of Regulation
Article 2. Subjects related to sugar imports under the tariff quota in 2016.
Article 2. Applicability
1. Direct traders who use sugar as raw material for production and traders using raw sugar to produce refined sugar.
Article 3. Quantity of tariff quota for sugar auctioned in 2016
The quantity of sugar (HS Code 1701) imported under the tariff quota in 2016 is 85,000 tons.
Clause 1. The auctioning of the tariff quota for sugar imports in 2016 shall be conducted through the Pilot Tariff Quota Auction Council for Sugar Imports in 2016.
Article 4. Principles of Auction
Clause 3. The Ministry of Industry and Trade establishes the Pilot Tariff Quota Auction Council for Sugar Imports in 2016. The Chairman of the Council promulgates the Auction Rules for the Pilot Tariff Quota Auction for Sugar Imports in 2016.
2. The principles, procedures, and formalities for selling assets at auction shall be carried out in accordance with the laws on auctioning, taking into account the nature of the assets being auctioned.
Clause 2. When handling import procedures for sugar, in addition to complying with current regulations, traders must present the notification from the Ministry of Industry and Trade granting the right to use the tariff quota for sugar imports to the Customs Branch at the border gate.
Article 5. Import Procedures
1. After receiving the Report on the Results of the Auction from the Auction Committee, the Ministry of Industry and Trade shall issue a notification granting the right to use the import duty quota for sugar to the successful bidders.
This Circular takes effect from June 29, 2016 to December 31, 2016.
Article 6. Effectiveness
This Circular takes effect from June 29, 2016 to December 31, 2016.
