CIRCULAR
REGULATING BORDER GATES FOR IMPORT OF CERTAIN FERTILIZER ITEMS
Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
WHEREAS Decree No. 187/2013/NĐ-CP dated November 20, 2013 of the Government provides detailed implementation of the Law on Trade regarding international trade activities and foreign agency buying, selling, processing, and transiting goods;

Article 1. Scope of Regulation
Article 1. This Circular stipulates border gates for import of certain fertilizer items.
Article 2. Fertilizer imports in the following cases are not within the scope of regulation of this Circular:
a) Temporary imported fertilizers for re-export, temporary exported fertilizers for re-import, transshipment, and transit;
b) Fertilizer imports for testing, sample making, and scientific research.
Article 2. Applicability
This Circular applies to state management agencies and traders implementing fertilizer imports.
1. Passenger cars with less than 16 seats may only be imported into Vietnam through the following seaport gates: Quang Ninh (Cai Lan), Hai Phong, Thanh Hoa (Nghi Son), Da Nang, Ho Chi Minh City, Ba Ria-Vung Tau.
Fertilizers listed in the Appendix attached hereto shall only be imported through international border gates and main border gates. Imports through secondary border gates and open passages are only permitted upon approval by the People's Committee of the province based on consensus with the Ministry of Industry and Trade.
Article 4. Effective date
Article 1. This Circular takes effect from July 13, 2017.
Article 2. This Circular abolishes Circular No. 35/2014/TT-BCT dated October 15, 2014 of the Minister of Industry and Trade regulating the application of automatic import permit system for certain fertilizer items.
