This Circular sets forth the import ports for fertilizers with the aim of strictly managing the importation of fertilizers into Vietnam. This Circular applies to state management agencies and traders implementing fertilizer imports.

- Fertilizers listed in the Appendix may only be imported through international border gates and main border gates (Article 3).
- Importing fertilizers through secondary border gates or open passages is only permitted after obtaining permission from the People's Committee of the province based on consistent discussions with the Ministry of Industry and Trade (Article 3).
- Temporary imported re-exported fertilizers, temporary exported re-imported fertilizers, transshipment fertilizers, and transit fertilizers are not within the scope of this Circular (Article 1.2.a).
- Fertilizers imported for testing, sample making, and scientific research are also not within the scope of this Circular (Article 1.2.b).
- This Circular takes effect from July 13, 2017, and revokes Circular No. 35/2014/TT-BCT dated October 15, 2014, issued by the Minister of Industry and Trade (Article 4).

CIRCULAR
REGULATING BORDER GATES FOR IMPORT OF CERTAIN FERTILIZER ITEMS

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 187/2013/NĐ-CP dated November 20, 2013 of the Government detailing the implementation of the Law on Trade regarding international trade activities and foreign trade agency, purchase, sale, processing, and transit activities;
At the proposal of the Director of the Import-Export Department,
4. Supplement Clause 7 following Clause 6 Article 2 as follows: regulating border gates for import of certain fertilizer items.
Article 1. Scope of Regulation
Article 1. This Circular stipulates border gates for import of certain fertilizer items.
Article 2. Fertilizer imports in the following cases are not within the scope of this Circular:
a) Temporary imported fertilizers for re-export, temporary exported fertilizers for re-import, transshipment, and transit;
b) Fertilizers imported for testing, as samples, and scientific research.
Article 2. Applicability
This Circular applies to state management agencies and traders implementing fertilizer imports.
1. Passenger cars with less than 16 seats may only be imported into Vietnam through the following seaport gates: Quang Ninh (Cai Lan), Hai Phong, Thanh Hoa (Nghi Son), Da Nang, Ho Chi Minh City, Ba Ria-Vung Tau.
Fertilizers listed in the Appendix attached hereto shall only be imported through international border gates and main border gates. Imports through secondary border gates and open passages are permitted only after approval by the People's Committee of the province based on consensus with the Ministry of Industry and Trade.
Article 4. Effective date
Article 1. This Circular takes effect from July 13, 2017.
Article 2. This Circular abolishes Circular No. 35/2014/TT-BCT dated October 15, 2014 of the Minister of Industry and Trade on the application of automatic import license regime for certain fertilizer items./.
