DECREE

REGULATIONS ON REGISTRATION OF NATIONALITY AND REGISTRATION OF RIGHTS FOR AIRCRAFT

Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights for aircraft, which took effect from October 15, 2015, has been amended and supplemented by:

Decree No. 07/2019/ND-CP dated January 23, 2019 of the Government amending and supplementing certain articles of Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights for aircraft, which took effect from March 11, 2019.

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006 and the Law Amending and Supplementing Some Articles of the Civil Aviation Law of Vietnam dated November 21, 2014;

At the proposal of the Minister of Transport,

The Government promulgates the Decree on registration of nationality and registration of rights for aircraft1.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Decree stipulates the registration of nationality and registration of rights for aircraft in Vietnam, including: Registration and cancellation of aircraft nationality; registration and cancellation of rights for aircraft; issuance of codes for registration and cancellation of international rights for aircraft with Vietnamese nationality; registration and cancellation of designation documents for persons entitled to request cancellation of registration or export of aircraft.

2. This Decree does not regulate the registration of nationality and registration of rights for state service aircraft, including military aircraft, specialized aircraft of customs and police forces, and other aircraft used for state purposes, except when state service aircraft are used for civilian purposes.

3. The registration of mortgage or pledge of aircraft shall be carried out in accordance with the provisions of the law on registration of secured transactions.

Article 2. Applicability

This Decree applies to agencies, organizations, and individuals related to the registration of nationality and registration of rights for aircraft in Vietnam.

Article 3. Explanation of Terms

1. Aircraft nationality registration includes registration of aircraft with Vietnamese nationality, temporary registration of aircraft with Vietnamese nationality.

2. Rights for aircraft include:

a) Ownership rights to aircraft;

b) Right of possession of aircraft through lease-purchase or lease of aircraft for six months or more;

c) Mortgage, pledge of aircraft or other secured transactions as provided by civil law;

d) Priority right to payment for salvage costs and preservation of aircraft;

đ) Other rights as provided by international treaties to which the Socialist Republic of Vietnam is a member;

3. The Cape Town Convention and Protocol (referred to as the Cape Town Convention) is the Convention on International Interests in Mobile Equipment and the Protocol on Matters Specific to Aircraft Equipment.

4. International interests in aircraft are the interests held by the secured party, lessor, or seller of aircraft under the Cape Town Convention.

5. Registered international interests in aircraft are the international interests in aircraft registered at the International Registry according to the provisions of the Cape Town Convention.

6. AEP code (Authority Entry Point Code) is the code issued according to the provisions of the Cape Town Convention for the purpose of registering or canceling international interests in aircraft.

7. IDERA document (Irrevocable De-registration and Export Request Authorization) is the document issued according to the provisions of the Cape Town Convention, specifying the person entitled to request cancellation of registration or export of aircraft.

8. Priority payment order is the order of debts that are prioritized for payment according to the law.

Chapter II

REGISTRATION, CANCELLATION OF REGISTRATION OF AIRCRAFT NATIONALITY, EXPORT OF AIRCRAFT

Section 1. REGISTRATION OF AIRCRAFT NATIONALITY

Article 4. Requirements and Conditions for Registration of Aircraft Nationality

1. Requirements for Registration of Aircraft Nationality

a)2 Aircraft owned by organizations or individuals in Vietnam and operated by organizations or individuals in Vietnam (in cases where aircraft are operated by individuals, such individuals must be permanent residents in Vietnam); aircraft leased or hired under a dry lease agreement with a term of at least twenty-four (24) months to operate in Vietnam must be registered with Vietnamese nationality in accordance with this Decree.

b) Within six (06) months from the date of importation into Vietnam, the aircraft must be registered with Vietnamese nationality.

2. Conditions for Aircraft to be Registered with Vietnamese Nationality

a) Not having nationality of any country or having deregistered foreign nationality;

b) Having lawful documents proving ownership of the aircraft; possession rights of the aircraft in cases of lease-purchase or lease of the aircraft;

c)3 For used aircraft, when registering nationality for the first time, it must meet the age requirements applicable to used aircraft at the time of importation into Vietnam according to the provisions of the law.

d) Meeting the conditions and requirements for ensuring national defense, security; aviation safety, aviation security, and environmental protection as prescribed by law.

3.4 Conditions for Temporary Registration of Aircraft with Vietnamese Nationality

Aircraft may be temporarily registered with Vietnamese nationality if the aircraft is in the manufacturing, assembly, or testing phase in Vietnam and meets the conditions stipulated in points b and d of Clause 2 of this Article.

4. Persons entitled to request registration of aircraft nationality include:

a) The owner of the aircraft;

b) The lessee-purchaser of the aircraft, the lessee of the aircraft (hereinafter referred to collectively as the lessee of the aircraft).

Article 5. Procedures for Registration of Aircraft with Vietnamese Nationality

1. The person requesting registration of aircraft with Vietnamese nationality shall submit one set of5 application documents directly, through the postal system, or by other appropriate means to the Civil Aviation Administration of Vietnam and shall be responsible for the accuracy and truthfulness of the information recorded in the application.

2. Application documents for registration of aircraft with Vietnamese nationality, including:

a) Form No. 01 as prescribed in the Appendix issued together with this Decree;

b)6 A copy from the original book or a certified copy or a photocopy from the original or a copy presented with the original for verification of documents and materials proving the legal status of the applicant for registration.

In cases where the documents and materials proving the legal status of the applicant for registration are issued by a competent authority of a foreign country, these documents and materials must be legalized consularly in accordance with the provisions of the law, except in cases exempted from consular legalization under international treaties to which the Socialist Republic of Vietnam is a party or on the principle of reciprocity.

c)7 A copy accompanied by the original for verification or a copy authenticated by the same agency, organization, or individual that established the original authenticating documents proving ownership of the aircraft;

d)8 A copy accompanied by the original for verification or a copy authenticated by the same agency, organization, or individual that established the original authenticating documents proving non-registration by the manufacturing state or de-registration by the state of registration;

đ)9 A copy accompanied by the original for verification or a copy authenticated by the same agency, organization, or individual that established the original authenticating documents regarding the technical condition of the aircraft, including: Valid export airworthiness certificate for aircraft manufactured abroad; confirmation document from the manufacturer regarding compliance with design and manufacturing conditions still in effect for newly produced aircraft; complete logbook recording the implementation of all maintenance orders or technical notifications performed on the aircraft; complete logbook recording the technical condition of the aircraft, engines, and other equipment;

e)10 A copy accompanied by the original for verification or a copy authenticated by the same agency, organization, or individual that established the original authenticating purchase contract for the aircraft, lease contract for the aircraft, or lease-purchase contract for the aircraft.

3.11 (Repealed)

4. Within five (05) working days from the date of receipt of complete application documents as prescribed, the Civil Aviation Administration of Vietnam shall issue the Certificate of Registration of Aircraft with Vietnamese Nationality in Form No. 04 as prescribed in the Appendix issued together with this Decree; in case of non-issuance, the Civil Aviation Administration of Vietnam must respond in writing to the applicant and specify the reasons.

In cases where the application documents are incomplete as prescribed, within two (02) working days from the date of receipt of the application documents, the Civil Aviation Administration of Vietnam shall issue a written guidance to the applicant to complete the application documents in accordance with the regulations.

5. The person requesting registration of aircraft with Vietnamese nationality must pay the fee as prescribed by law.

Article 6. Temporary Registration Procedure for Aircraft with Vietnamese Nationality

1. The person requesting temporary registration of aircraft with Vietnamese nationality shall submit one set of documents.12 application documents directly, through the postal system, or by other appropriate means to the Civil Aviation Administration of Vietnam and shall be responsible for the accuracy and truthfulness of the information recorded in the application.

2. The application dossier for temporary registration of aircraft with Vietnamese nationality includes:

a) Form No. 01 as prescribed in the Appendix issued together with this Decree;

b)13 A copy from the original book or a certified copy or a photocopy from the original or a copy presented with the original for verification of documents and materials proving the legal status of the applicant for registration.

c)14 A copy accompanied by the original for verification or a copy authenticated by the same agency, organization, or individual that established the original authenticating documents proving ownership of the aircraft;

d)15 A copy accompanied by the original for verification or a certified copy issued by the agency, organization, or individual that established the original legal document proving that the aircraft is currently in the manufacturing, assembly, or testing phase in Vietnam;

3.16 (abolished).

4. Within five (05) working days from the date of receiving all required documents as stipulated, the Civil Aviation Authority of Vietnam shall issue the Certificate of Temporary Registration for Aircraft with Vietnamese Nationality according to Model No. 05 prescribed in the Appendix attached to this Decree; if not issued, the Civil Aviation Authority of Vietnam must notify the applicant in writing and specify the reasons.

In case the dossier is incomplete, within two (02) working days from the date of receipt of the dossier, the Civil Aviation Authority of Vietnam shall issue a written guidance to the applicant to complete the dossier in accordance with the regulations.

5. The Certificate of Temporary Registration for Aircraft with Vietnamese Nationality is valid for no more than thirty-six (36) months from the date of issuance and cannot be extended.

6. The person requesting temporary registration of aircraft with Vietnamese nationality must pay the fee as prescribed by law.

Article 7. Reissue Procedure for Certificate of Nationality Registration for Aircraft

1. In case the Certificate of Registration for Aircraft with Vietnamese Nationality or the Certificate of Temporary Registration for Aircraft with Vietnamese Nationality is torn, damaged, or lost, the applicant must notify the Civil Aviation Authority of Vietnam in writing to reissue the Certificate.

2. The person requesting reissuance of the Certificate of Nationality Registration for Aircraft shall submit one set of documents.17 application documents directly, through the postal system, or by other appropriate means to the Civil Aviation Administration of Vietnam and shall be responsible for the accuracy and truthfulness of the information recorded in the application.

3. The application dossier for reissuance of the Certificate of Nationality Registration for Aircraft includes:

a) Application form according to Model No. 03 prescribed in the Appendix attached to this Decree;

b)18 A copy from the original book or a certified copy or a photocopy from the original or a copy presented with the original for verification of documents and materials proving the legal status of the applicant for registration.

4. Within three (03) working days from the date of receiving all required documents as stipulated, the Civil Aviation Authority of Vietnam shall reissue the Certificate of Registration for Aircraft with Vietnamese Nationality or the Certificate of Temporary Registration for Aircraft with Vietnamese Nationality; revoke the Certificate of Registration for Aircraft with Vietnamese Nationality or the Certificate of Temporary Registration for Aircraft with Vietnamese Nationality except in cases of loss; publish information on the Civil Aviation Authority of Vietnam's electronic website.

5. The person requesting reissuance of the Certificate of Nationality Registration for Aircraft must pay the fee as prescribed by law.

Section 2. CANCELLATION OF AIRCRAFT NATIONALITY REGISTRATION, EXPORT OF AIRCRAFT

Article 8. Cases of Cancellation of Nationality Registration

1. Cases where aircraft are deregistered from Vietnamese nationality include:

a) Aircraft declared missing under the provisions of the law;

b) Aircraft no longer meet the conditions specified in Article 4 of this Decree;

c) At the request of the aircraft owner or the person requesting registration of the aircraft;

d) At the request of the person designated in the IDERA document;

đ)19 Severe damage to the aircraft making it irreparable and unrecoverable.

2. Cases where aircraft are deregistered from temporary registration with Vietnamese nationality include:

a) The validity period of temporary registration has expired as stated in the Certificate of Temporary Registration for Aircraft with Vietnamese Nationality;

b) The aircraft is no longer in the manufacturing, assembly, or testing phase in Vietnam;

c) At the request of the aircraft owner or the person designated in the IDERA document.

Article 9. Procedure for Removing Aircraft Nationality Registration

1.20 For cases of removal of registration as provided for in Points a, b, and đ Clause 1 and Points a, b Clause 2 Article 8 of this Decree, the Civil Aviation Authority of Vietnam shall decide to remove aircraft nationality registration and issue the Certificate of Removal of Aircraft Nationality Registration according to Form No. 06 prescribed in the Appendix attached to this Decree; recover the Certificate of Aircraft Bearing Vietnamese Nationality or the Temporary Certificate of Aircraft Bearing Vietnamese Nationality, except in cases where such certificates have been lost or destroyed with the aircraft.

2. For cases of removal of registration as provided for in Points c, d Clause 1 and Point c Clause 2 Article 8 of this Decree, the person requesting removal of aircraft nationality registration shall submit one set of documents21 directly, through the postal system, or by other means to the Civil Aviation Authority of Vietnam and must bear responsibility for the accuracy and truthfulness of the information recorded in the documents.

In cases where the IDERA document has already been registered in accordance with this Decree, only the person designated in the IDERA document has the right to request removal of aircraft nationality registration.

3. The application dossier for removing Vietnamese aircraft nationality registration includes:

a) Application form according to Form No. 02 prescribed in the Appendix attached to this Decree;

b)22 A copy from the original book or a certified copy or a photocopy from the original or a copy presented with the original for comparison of documents and materials proving the legal status of the person requesting removal of registration;

In cases where the documents and materials proving the legal status of the person requesting registration are issued by a competent authority of a foreign country, these documents and materials must be legalized consularly in accordance with the law;

c) In cases where the person requesting removal of registration is the person designated in the IDERA document, the dossier must also include the written agreement on removal of registration and export of the aircraft from those international interests holders who have been registered with higher priority than the international interests of the person requesting removal of registration or documents proving that the higher priority international interests have been realized;

d) In cases where the person requesting removal of registration is the security interest holder designated in the IDERA document, the dossier must also include documents proving that the person requesting removal of registration has notified in writing to those international interests holders who have been registered, the aircraft owner, and the person requesting registration of aircraft nationality about the request for removal of registration at least ten days before submitting the application dossier.

4.23 (abolished).

5. Within five (05) working days from the date of receipt of complete dossier as prescribed, the Civil Aviation Authority of Vietnam shall issue the Certificate of Removal of Vietnamese Aircraft Nationality Registration according to Form No. 06 prescribed in the Appendix attached to this Decree; recover the Certificate of Aircraft Bearing Vietnamese Nationality or the Temporary Certificate of Aircraft Bearing Vietnamese Nationality, except in cases where such certificates have been lost or destroyed with the aircraft; in cases where issuance is not made, the Civil Aviation Authority of Vietnam must reply in writing to the applicant and specify the reasons.

In cases where the dossier is incomplete, within two (02) working days from the date of receipt of the dossier, the Civil Aviation Authority of Vietnam shall issue a written notice guiding the applicant to complete the dossier in accordance with the regulations.

6. The person requesting removal of aircraft nationality registration must pay the fee as prescribed by law.

Article 10. Export of aircraft

1. Conditions for exporting aircraft include:

a) Having a valid Export Airworthiness Certificate issued or recognized by the competent state authority;

b) Meeting requirements for national defense and security; aviation safety, aviation security, and environmental protection as prescribed;

c)24 (abolished);

d) The aircraft has been deregistered from its Vietnamese nationality.

2. Persons entitled to propose the export of aircraft include:

a) The owner of the aircraft; the lessor of the aircraft;

b) The person designated in the IDERA document.

3.25 In cases where the owner of the aircraft or the lessor proposes the export of the aircraft, they must have the written consent of the person who registered the aircraft, except in the case provided for in Clause 4 of this Article.

4. In cases where the IDERA document has been registered according to the provisions of this Decree, only the person designated in the IDERA document has the right to propose the export of the aircraft.

5. The export of aircraft shall be carried out in accordance with the provisions of this Decree, regulations on granting airworthiness certificates, and other relevant legal regulations.

Section 3. NATIONALITY MARKS AND REGISTRATION MARKS

Article 11. Nationality marks and registration marks

1. The nationality mark of Vietnam for aircraft includes the emblem of the Vietnamese National Flag and the registration mark of the aircraft carrying Vietnamese nationality.

2. The registration mark of the aircraft carrying Vietnamese nationality is represented by two (02) consecutive letters "VN" followed by a hyphen and one of the following letters and three (03) Arabic numerals:

a) Letter "A" for jet-powered aircraft (Turbofan/Turbojet);

b) Letter "B" for propeller-driven jet aircraft (Turboprop);

c) Letter "C" for piston-engine aircraft;

d) Letter "D" for other types of aircraft.

Article 12. General requirements for painting and affixing nationality marks and registration marks on aircraft

1. When in operation, aircraft carrying Vietnamese nationality must be painted or affixed with nationality marks and registration marks.

2.26 Aircraft carrying Vietnamese nationality may not bear marks that contain content or form similar to or could cause confusion with aircraft carrying the nationality of another country.

3. The Civil Aviation Authority of Vietnam is responsible for notifying the International Civil Aviation Organization (ICAO) about the nationality marks and registration marks of aircraft carrying Vietnamese nationality.

Article 13. Position and size of nationality marks and registration marks

1. The nationality marks and registration marks of aircraft carrying Vietnamese nationality must be displayed on the fuselage and wings of the aircraft to ensure durability, clarity, and easy visibility to the naked eye or by ordinary means of recognition.

2. Requirements for painting or affixing nationality marks and registration marks are as follows:

a) Image of the Vietnamese National Flag27 with a width equal to two-thirds (2/3) of the length, proportionate and appropriate to each type of aircraft; it must be painted or affixed on both sides of the vertical tail fin or both sides of the front part of the fuselage of the aircraft.

b) Letters and numbers representing the registration mark must be presented in uppercase letters and numbers; the height of each character (except the hyphen) within the same group of marks must be uniform;

c) The width of each character (except number 1) must be two-thirds (2/3) of the height of each character; the width of number 1 must be one-sixth (1/6) of the height of each character. The hyphen must be placed in the middle of the height of the character and have a width equal to half the height of the character;

d) The outline of each character must be bold, contrasting in color with the background of the painted or affixed area. The width of the outline must be one-sixth of the height of each character. (The distance between characters must be at least one-quarter (1/4) of the width of each character.

3. The position and height of painting or affixing the registration mark for heavier-than-air aircraft are as follows:

a) On the wing of the aircraft: Underneath the left wing and possibly the entire underside of both wings if necessary. The mark must be located equidistant from the leading edge and trailing edge of the wing; the top of the mark must point towards the leading edge of the wing. The height of the mark must be at least 50 cm;

b) On the fuselage (or similar structures) and the vertical stabilizer surface: The height of the mark must be at least 30 cm and on both sides of the fuselage, between the wing and horizontal stabilizer or the upper half of both sides for aircraft with a single vertical stabilizer, the upper half of the outer surface of multiple vertical stabilizers for aircraft with multiple vertical stabilizers.

4.28 For heavier-than-air aircraft that do not meet the requirements set forth in Clause 3 of this Article and other non-heavier-than-air aircraft, the painting or affixing of marks must be decided by the aircraft registrant and must comply with the provisions of Clauses 1 and 2 of this Article.

5. In cases where leased aircraft have their own flight crews,29the aircraft must be painted or affixed with nationality marks and registration marks in accordance with this Decree within six months from the date of importation into Vietnam.

Chapter III

REGISTRATION OF RIGHTS TO AIRCRAFT, DE-REGISTRATION OF OWNERSHIP RIGHTS TO AIRCRAFT, RIGHTS OF POSSESSION OF AIRCRAFT

Section 1. REGISTRATION OF AIRCRAFT OWNERSHIP RIGHTS AND AIRCRAFT POSSESSION RIGHTS

1. Large electricity consumers or retail electricity suppliers in authorized zone or cluster models may purchase electricity from the Electricity Corporation to meet their entire demand.

1. Rights to aircraft bearing Vietnamese nationality must be registered in accordance with the provisions of this Decree.

2. Organizations and individuals of Vietnam holding rights to aircraft bearing foreign nationality shall implement registration in accordance with the laws of the country where the aircraft bears nationality.

3. The time point for registering rights to aircraft as stipulated in Clause 1 of this Article is determined based on the date of receiving valid application files.

Article 15. Procedures for Registering Aircraft Ownership Rights

1. The owner of the aircraft requesting registration of aircraft ownership rights shall submit one set of30 application documents directly, through postal services, or by other means to the Civil Aviation Administration of Vietnam and shall bear responsibility for the accuracy and truthfulness of the information recorded in the application documents.

2. Application documents for registering Vietnamese aircraft ownership rights include:

a) Form No. 01 as prescribed in the Appendix issued together with this Decree;

b)31 A copy from the original book or a certified copy or a photocopy from the original or a copy presented with the original for verification of documents and materials proving the legal status of the applicant for registration.

c)32 A copy accompanied by the original for verification or a copy certified by the competent authority, organization, or individual that issued the original legal document proving ownership of the aircraft; in cases of transferring ownership of the aircraft, additional documents proving the ownership of the previous owner must also be provided.

3.33 (abolished).

4. Within three (03) working days from the date of receiving complete application documents as prescribed, the Civil Aviation Administration of Vietnam shall issue the Certificate of Registration of Aircraft Ownership Rights according to Form No. 07 stipulated in the Appendix promulgated together with this Decree; if issuance is not granted, the Civil Aviation Administration of Vietnam must respond in writing to the applicant and specify the reasons.

In cases where the application documents are incomplete, within one (01) working day from the date of receipt of the application documents, the Civil Aviation Administration of Vietnam shall issue a written guidance to the applicant to complete the application documents in accordance with the regulations.

5. The applicant for registering aircraft ownership rights must pay the fee as prescribed by law.

Article 16. Procedures for Registering Aircraft Possession Rights

1.34 The lessee of the aircraft, the person leasing the aircraft for a period of six (06) months or more, requesting registration of aircraft possession rights shall submit one set of35 application documents directly, through the postal system, or by other appropriate means to the Civil Aviation Administration of Vietnam and shall be responsible for the accuracy and truthfulness of the information recorded in the application.

2. Application documents for registering Vietnamese aircraft possession rights include:

a) Form No. 01 as prescribed in the Appendix issued together with this Decree;

b)36 A copy from the original book or a certified copy or a photocopy from the original or a copy presented with the original for verification of documents and materials proving the legal status of the applicant for registration.

c)37 A copy accompanied by the original for verification or a copy certified by the competent authority, organization, or individual that issued the original lease agreement or purchase agreement for the aircraft when the lessor in the Aircraft Lease Agreement or the seller in the Aircraft Purchase Agreement is simultaneously the owner of the aircraft;

d)38 A copy accompanied by the original for verification or a copy certified by the competent authority, organization, or individual that issued the original lease agreement or purchase agreement for the aircraft and documents proving the lessor's or seller's right to sublease the aircraft when the lessor in the Aircraft Lease Agreement or the seller in the Aircraft Purchase Agreement is not the owner of the aircraft.

3.39 (abolished).

4. Within three (03) working days from the date of receiving complete application documents as prescribed, the Civil Aviation Administration of Vietnam shall issue the Certificate of Registration of Aircraft Possession Rights according to Form No. 08 stipulated in the Appendix promulgated together with this Decree; if issuance is not granted, the Civil Aviation Administration of Vietnam must respond in writing to the applicant and specify the reasons.

5. The applicant for registering aircraft possession rights must pay the fee as prescribed by law.

Article 17. Procedure for registering priority payment rights for salvage and aircraft maintenance services

1. Within ninety (90) days from the completion date of the salvage and aircraft maintenance operations, the person requesting registration of priority payment rights for salvage and aircraft maintenance services shall submit one set of documents.40 application documents directly, through the postal system, or by other appropriate means to the Civil Aviation Administration of Vietnam and shall be responsible for the accuracy and truthfulness of the information recorded in the application.

2. The application dossier for registering priority payment rights for salvage and aircraft maintenance services includes:

a) Form No. 01 as prescribed in the Appendix issued together with this Decree;

b) A certified copy from the original record or a notarized copy or a photocopy from the original or a copy presented with the original for verification of the documents and papers proving the legal status of the person requesting registration.

3. Within three (03) working days from the date of receiving the complete dossier as prescribed, the Civil Aviation Authority of Vietnam shall issue the Certificate of Registration for Priority Payment Rights for Salvage and Aircraft Maintenance Services according to Form No. 09 stipulated in the Appendix issued together with this Decree; if it does not issue the certificate, the Civil Aviation Authority of Vietnam must reply in writing to the applicant and specify the reasons.

4. The person requesting registration of priority payment rights for salvage and aircraft maintenance services must pay the fee as prescribed by law.

Article 18. Registration of priority payment rights for salvage and aircraft maintenance services for foreign-registered aircrafts

The registration of priority payment rights for salvage and aircraft maintenance services for foreign-registered aircrafts shall be carried out in accordance with the laws of the country where the aircraft is registered. The Civil Aviation Authority of Vietnam confirms the salvage and aircraft maintenance operations conducted in Vietnam and informs the country where the aircraft is registered.

Article 19. Procedure for reissuing Certificates of Registration of Rights for Aircrafts

1. If the Certificate of Registration of Rights for Aircrafts issued has been torn, damaged, or lost, the person requesting registration must follow the procedures prescribed in this Decree to obtain a new certificate.

2. The person requesting the reissue of the Certificate of Registration of Rights for Aircrafts shall submit one set of dossiers directly, through postal service, or by other appropriate means to the Civil Aviation Authority of Vietnam and shall bear responsibility for the accuracy and truthfulness of the information recorded in the dossier.

3. The application dossier for reissuing the Certificate of Registration of Rights for Aircrafts includes:

a) Application form according to Model No. 03 prescribed in the Appendix attached to this Decree;

b)43 A copy from the original book or a certified copy or a photocopy from the original or a copy presented with the original for verification of documents and materials proving the legal status of the applicant for registration.

4. Within three (03) working days from the date of receiving the complete dossier as prescribed, the Civil Aviation Authority of Vietnam shall reissue the Certificate of Ownership of Aircraft, the Certificate of Possession of Aircraft, or the Certificate of Registration for Priority Payment Rights for Salvage and Aircraft Maintenance Services; recover the Certificate of Ownership of Aircraft, the Certificate of Possession of Aircraft, or the Certificate of Registration for Priority Payment Rights for Salvage and Aircraft Maintenance Services in case of loss; publish the information on the Civil Aviation Authority of Vietnam's electronic website; if it does not issue the certificate, the Civil Aviation Authority of Vietnam must reply in writing to the applicant and specify the reasons.

In case the dossier is incomplete, within two (02) working days from the date of receipt of the dossier, the Civil Aviation Authority of Vietnam shall issue a written notice guiding the person requesting the reissue of the Certificate of Registration of Rights for Aircrafts to complete the dossier in accordance with the regulations.

5. The person requesting the issuance of the Certificate of Registration of Rights for Aircrafts must pay the fee as prescribed by law.

Section 2. DELETION OF REGISTRATION OF AIRCRAFT OWNERSHIP RIGHTS AND AIRCRAFT POSSESSION RIGHTS

Article 20. Procedures for Deleting Registration of Aircraft Ownership Rights

1. The aircraft owner who requests to delete the registration of aircraft ownership rights shall submit one set of documents directly, through the postal system, or by other appropriate means to the Civil Aviation Authority and shall be responsible for the accuracy and truthfulness of the information contained in the documents.44 The application shall be submitted directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam, and the applicant shall be responsible for the accuracy and truthfulness of the information contained in the application.

2. The application dossier for deleting the registration of Vietnamese aircraft ownership rights includes:

a) Application form according to Form No. 02 prescribed in the Appendix attached to this Decree;

b)45 A copy from the original book or a certified copy or a photocopy from the original or a copy presented with the original for comparison of documents and materials proving the legal status of the person requesting removal of registration;

In cases where the documents and materials proving the legal status of the applicant are issued by foreign authorities with jurisdiction, such documents and materials must be apostilled according to the provisions of the law.

3.46 Within three (3) working days from the date of receipt of all required documents, the Civil Aviation Authority shall issue the Certificate of Deletion of Registration of Aircraft Ownership Rights according to Model No. 10 stipulated in the Appendix promulgated together with this Decree; recover the previously issued Aircraft Ownership Certificate, except in cases where the Aircraft Ownership Certificate is lost. If not issued, the Civil Aviation Authority must respond in writing to the applicant and specify the reasons.

In cases where the dossier is incomplete, within one (1) working day from the date of receipt of the dossier, the Civil Aviation Authority shall issue a written notice guiding the applicant to complete the dossier in accordance with the regulations.

Article 21. Procedures for Deleting Registration of Aircraft Possession Rights

1. The lessee of registered aircraft who requests to delete the registration of aircraft possession rights shall submit one set of documents directly, through the postal system, or by other appropriate means to the Civil Aviation Authority and shall be responsible for the accuracy and truthfulness of the information recorded in the documents.47 The application shall be submitted directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam, and the applicant shall be responsible for the accuracy and truthfulness of the information recorded in the application.

2. The application dossier for deleting the registration of Vietnamese aircraft possession rights includes:

a) Application form according to Form No. 02 prescribed in the Appendix attached to this Decree;

b)48 A copy from the original book or a certified copy or a photocopy from the original or a copy presented with the original for comparison of documents and materials proving the legal status of the person requesting removal of registration;

3.49 Within three (3) working days from the date of receipt of all required documents, the Civil Aviation Authority shall issue the Certificate of Deletion of Registration of Aircraft Possession Rights according to Model No. 10 stipulated in the Appendix promulgated together with this Decree; recover the previously issued Aircraft Possession Certificate, except in cases where the Aircraft Possession Certificate is lost. If not issued, the Civil Aviation Authority must respond in writing to the applicant and specify the reasons.

Chapter IV

PROCEDURES FOR ISSUING AEP CODES AND REGISTRATION, DELETION OF REGISTRATION OF IDERA DOCUMENTS

Article 22. Procedures for Issuing AEP Codes

1. Organizations and individuals having international interests in Vietnamese-registered aircraft requesting issuance of AEP codes shall submit one set of documents directly, through the postal system, or by other appropriate means to the Civil Aviation Authority and shall be responsible for the truthfulness and accuracy of the information recorded in the documents.50 The application shall be submitted directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam, and the applicant shall be responsible for the truthfulness and accuracy of the information recorded in the application.

2. The application dossier for issuing AEP codes includes:

a) Two (2) copies of the AEP code application form according to Model No. 11 stipulated in the Appendix promulgated together with this Decree;

b)51 A copy from the original book or a certified copy or a photocopy from the original or a copy presented with the original for verification of the documents and materials proving the legal status of the applicant for the AEP code.

In cases where the documents and materials proving the legal status of the applicant for the AEP code are issued by foreign authorities with jurisdiction, such documents and materials must be apostilled according to the provisions of the law, except in cases exempted from apostille under international treaties to which the Socialist Republic of Vietnam is a party or on the principle of reciprocity.

c)52 A copy accompanied by the original for verification or a copy certified by the authority, organization, or individual that established the original legal document proving the international interests in the aircraft of the applicant for the AEP code.

3.53 (abolished).

4. Within three (3) working days from the date of receipt of all required documents, the Civil Aviation Authority shall issue the AEP code and return one copy of the application form to the applicant; if not issued, the Civil Aviation Authority must respond in writing to the applicant and specify the reasons.

5. The applicant for the AEP code shall pay the fee as prescribed by law.

Article 23. Procedures for registering the IDERA document

1. The aircraft owner or the person requesting registration of the aircraft shall submit a set of applications to register the IDERA document.54 The application shall be submitted directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam, and the applicant shall be responsible for the truthfulness and accuracy of the information recorded in the application.

2. The application dossier for registering the IDERA document includes:

a) Two (02) registration forms for the IDERA document according to Model No. 12 prescribed in the Appendix issued together with this Decree;

b)55 A copy from the original record book or a certified copy or a photocopy from the original or a copy presented along with the original for verification of the documents and papers proving the legal status of the person requesting registration of the IDERA document.

In cases where the documents and papers proving the legal status of the person requesting registration of the IDERA document are issued by foreign authorities with jurisdiction, such documents must be apostilled in accordance with the provisions of the law, except in cases where apostille is exempted under international treaties to which the Socialist Republic of Vietnam is a party or on the principle of reciprocity.

c)56 A copy accompanied by the original for verification or a copy issued by the very agency, organization, or individual that established the original to certify the international rights of the designated person concerning the aircraft bearing Vietnamese nationality.

3.57 (Repealed)

4. Within five (05) working days from the date of receipt of the complete dossier as prescribed, the Civil Aviation Authority of Vietnam shall confirm the registration in the registration form for the IDERA document and return one (01) form to the applicant; in case of non-issuance, the Civil Aviation Authority of Vietnam must reply in writing to the applicant and specify the reasons.

5. The applicant for registering the IDERA document must pay the fee as prescribed by law.

Article 24. Procedures for deregistering the IDERA document

1. The person designated in the IDERA document requests to deregister the IDERA document and submits a set of applications.58 The application shall be submitted directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam, and the applicant shall be responsible for the truthfulness and accuracy of the information recorded in the application.

2. The application dossier for deregistering the IDERA document includes:

a) Two (02) deregistration forms for the IDERA document according to Model No. 13 prescribed in the Appendix issued together with this Decree;

b)59 A copy from the original record book or a certified copy or a photocopy from the original or a copy presented along with the original for verification of the documents and papers proving the legal status of the person requesting deregistration of the IDERA document.

In cases where the documents and papers proving the legal status of the person requesting deregistration of the IDERA document are issued by foreign authorities with jurisdiction, such documents must be apostilled in accordance with the provisions of the law, except in cases where apostille is exempted under international treaties to which the Socialist Republic of Vietnam is a party or on the principle of reciprocity.

3.60 (abolished).

4. Within five (05) working days from the date of receipt of the complete dossier as prescribed, the Civil Aviation Authority of Vietnam shall issue a confirmation of deregistration in the deregistration form for the IDERA document and return one (01) form to the applicant; in case of non-issuance, the Civil Aviation Authority of Vietnam must reply in writing to the applicant and specify the reasons.

5. The applicant for deregistering the IDERA document must pay the fee as prescribed by law.

Chapter V

VIETNAMESE AIRCRAFT REGISTRY

Article 25. Vietnamese Aircraft Registry

1. The Vietnamese Aircraft Registry is used to record information related to registration, deregistration of nationality, and rights over aircraft, the handling of collateral assets by aircraft, and other information related to aircraft bearing Vietnamese nationality and temporarily bearing Vietnamese nationality.

The Vietnamese Aircraft Registry is established in the form of a paper record book or an electronic registry.

2. The Vietnamese Aircraft Registry includes the following basic contents:

a) Date entered into the Vietnamese Aircraft Registry for each type of registration;

b) Certificate issued for each type of registration: Book, date of issuance;

c) Nationality and registration number;

d) Type of aircraft;

đ) Aircraft manufacturer;

e) Serial number and date of manufacture of the aircraft;

g) Aircraft category;

h) Aircraft type certificate: Number, issuing authority;

i) Export airworthiness certificate: Number, issuing authority, date of issuance;

k) Airworthiness certificate: Number, issuing authority, date of issuance;

l) Owner; Full name, address, nationality;

m) Holder: Full name, address, nationality;

n) Term of holding for leased aircraft;

o) Operator: Full name, address, nationality;

p) Lessee: Full name, address, nationality;

q) Secured party: Full name, address, nationality;

r) Secured creditor: Full name, address, nationality;

s) Value of the secured obligation;

t) Duration of effectiveness of the registration of the security transaction;

u) Person reporting the handling of collateral assets by aircraft: Full name, address, nationality;

v) Full name, address, nationality of the person performing rescue and preservation of the aircraft;

x) Duration of effectiveness for aircraft registered temporarily with nationality;

y) Deregistration for each type of registration: Date, reason for deregistration;

z) Other necessary information.

Article 26. Provision of Registration Information in the Aircraft Register Book

1. Organizations and individuals related to aircraft operations requesting provision of information registered in the Aircraft Register Book shall submit one set of documents directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam.61 The application shall be submitted directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam.

2. The request for provision of information shall include:

a) Form No. 14 as prescribed in the Appendix attached to this Decree;

b)62 A copy from the original book or a certified copy or a photocopy from the original or a copy presented with the original for verification of the documents and papers proving the legal status of the person requesting the information.

In cases where the documents and papers proving the legal status of the person requesting the information are issued by a competent foreign authority, such documents and papers must be legalized according to the law, except when exempted from legalization under international treaties to which the Socialist Republic of Vietnam is a party or on the principle of reciprocity.

3. Within two (02) working days from the date of receipt of complete documents as prescribed, the Civil Aviation Authority of Vietnam shall provide information, issue extracts, and copies from the Vietnamese Aircraft Register Book to the requester; in cases where information is not provided, the Civil Aviation Authority of Vietnam must respond in writing to the requester and specify the reasons.

4. The requester must pay fees as prescribed by law.

5. Within fifteen (15) working days from the date of issuance of the Certificate of Aircraft Nationality Registration, the Civil Aviation Authority of Vietnam shall provide information about the registration of aircraft nationality to the Ministry of Defense for airspace management, flight management, and other purposes as prescribed by law.

Article 27. Handling Complaints and Suggestions; Correction, Supplement, and Adjustment of Information on Aircraft Nationality Registration, Rights Registration, and IDERA Documentation

1. The Civil Aviation Authority of Vietnam shall be responsible for handling and responding in writing to complaints, suggestions, or requests from organizations and individuals related to aircraft nationality registration, rights registration, and IDERA documentation.

2. The person requesting correction, supplementation, or adjustment of information on aircraft nationality registration, rights registration, and IDERA documentation shall submit one set of documents requesting correction, supplementation, or adjustment of information directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam.64 The application to amend, supplement, or adjust information shall be submitted directly, through the postal system, or by other appropriate means to the Civil Aviation Authority of Vietnam.

3. The request for correction, supplementation, or adjustment of information on aircraft nationality registration, rights registration, and IDERA documentation shall include:

a) Form No. 03 as prescribed in the Appendix attached to this Decree;

b) A copy from the original book or a certified copy from the original or a photocopy from the original or a copy presented with the original for verification of the documents and papers proving the legal status of the person requesting correction, supplementation, or adjustment of information on aircraft nationality registration, rights registration, and IDERA documentation; in cases where the documents and papers proving the legal status of the person requesting correction, supplementation, or adjustment of information on aircraft nationality registration, rights registration, and IDERA documentation are issued by a competent foreign authority, such documents and papers must be legalized according to the law;

c) A copy accompanied by the original for verification or a copy certified by the agency, organization, or individual that established the original document proving the information to be corrected, supplemented, or adjusted.

4. Within one (1) working day from the date of receipt of complete documents as prescribed, the Civil Aviation Authority of Vietnam shall implement the correction, supplementation, or adjustment of information on aircraft nationality registration, rights registration, and IDERA documentation, issue a new Certificate or issue relevant documents.

In cases where the correction, supplementation, or adjustment of information on aircraft nationality registration, rights registration, and IDERA documentation is refused, the Civil Aviation Authority of Vietnam must respond in writing to the requester and specify the reasons.

New Certificates or relevant documents issued by the Civil Aviation Authority of Vietnam after the correction, supplementation, or adjustment process will replace the corresponding initial certificates and documents.

5. The person requesting correction, supplementation, or adjustment of information on aircraft nationality registration, rights registration, and IDERA documentation must pay fees as prescribed by law.

Chapter VI

IMPLEMENTING PROVISIONS

Article 28. Effective Date

1. This Decree takes effect from October 15, 2015.

2. This Decree replaces Decree No. 70/2007/NĐ-CP dated April 20, 2007 on Aircraft Nationality Registration and Rights Registration for Civil Aircraft and Decree No. 50/2012/NĐ-CP of the Government dated June 11, 2012 of the Government amending and supplementing certain Articles of Decree No. 70/2007/NĐ-CP dated April 20, 2007 on Aircraft Nationality Registration and Rights Registration for Civil Aircraft.

Article 29. Transitional Provisions

Certificates related to aircraft registration in Vietnam issued before the effective date of this Decree shall continue to be valid according to the term stated in such Certificates; in case these Certificates expire, new Certificates must be issued in accordance with the provisions of this Decree.

Article 30. Implementation

1. The Ministry of Transport shall be responsible for organizing the implementation of this Decree.

2. The Ministry of Finance shall stipulate the rates of fees and the management and use regimes for various types of fees and charges related to aircraft nationality registration, registration of rights over aircraft, registration of priority payment rights for salvage and maintenance services, issuance of registration numbers, cancellation of international rights for aircraft bearing Vietnamese nationality, registration and cancellation of designated persons' rights to request cancellation of registration or export of aircraft; providing information in the Aircraft Register of Vietnam and amending and supplementing registration information on nationality and rights over aircraft at the request of the Ministry of Transport.

3. Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairpersons of provincial People's Committees under the central government, and organizations and individuals concerned shall be responsible for implementing this Decree./.

(b) effect the export and physical transfer of the aircraft out of the territory of the Socialist Republic of Vietnam,procure the export and physical transfer of the aircraft from Socialist Republic of Vietnam; and

2. Confirmation that the designated person may undertake the actions specified in clause 1 above upon written request without the consent of the applicant and that, upon such request, the Civil Aviation Authority of Vietnam and relevant authorities will facilitate and cooperate with the designated person to undertake the actions specified in clause 1 above,confirmation that the Authorised Party may take the action specified in clause (i) above on written demand without the consent of the undersigned and that, upon such demand, the authorities in Socialist Republic of Vietnam shall cooperate with the Authorised Party with a view to speedy completion of such action.

1 Decree No. 07/2019/ND-CP dated January 23, 2019 of the Government amending and supplementing some articles of Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights over aircraft is promulgated as follows:

"Based on the Government Organization Law dated June 19, 2015;

Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006, the Law Amending and Supplementing Some Articles of the Civil Aviation Law of Vietnam dated November 21, 2014;

At the proposal of the Minister of Transport;

The Government promulgates the Decree amending and supplementing some articles of Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights over aircraft.”

2 This point is amended and supplemented according to the provisions of point a Clause 1 Article 1 of Decree No. 07/2019/ND-CP dated January 23, 2019 of the Government amending and supplementing some articles of Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights over aircraft, effective from March 11, 2019.

3 This point is amended and supplemented according to the provisions of point b Clause 1 Article 1 of Decree No. 07/2019/ND-CP dated January 23, 2019 of the Government amending and supplementing some articles of Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights over aircraft, effective from March 11, 2019.

4 This clause is amended and supplemented according to the provisions of point c Clause 1 Article 1 of Decree No. 07/2019/ND-CP dated January 23, 2019 of the Government amending and supplementing some articles of Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights over aircraft, effective from March 11, 2019.

5 The number of files implementing administrative procedures according to the provisions of Clause 21 Article 1 of Decree No. 07/2019/ND-CP dated January 23, 2019 of the Government amending and supplementing some articles of Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights over aircraft, effective from March 11, 2019.

6 This point is amended and supplemented according to the provisions of Clause 9 Article 1 of Decree No. 07/2019/ND-CP dated January 23, 2019 of the Government amending and supplementing some articles of Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights over aircraft, effective from March 11, 2019.

The phrase "certified copy (or copy accompanied by original for comparison)" at this point is replaced by the phrase "copy accompanied by original for comparison or copy certified by the agency, organization or individual that issued the original" according to the provisions of Clause 17 Article 1 of Decree No. 07/2019/ND-CP dated January 23, 2019 of the Government amending and supplementing some articles of Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights over aircraft, effective from March 11, 2019.

Paragraph 10 of this Article replaces the phrase "certified copy (or copy accompanied by original for comparison)" with the phrase "copy accompanied by original for comparison or certified copy verified by the agency, organization, or individual that issued the original" pursuant to Clause 17, Article 1 of Decree No. 07/2019/ND-Cabinet dated January 23, 2019, amending and supplementing certain provisions of Decree No. 68/2015/ND-Cabinet dated August 18, 2015 on nationality registration and aircraft rights registration, which took effect from March 11, 2019.

Paragraph 11 of this Article is repealed pursuant to Clause 1, Article 2 of Decree No. 07/2019/ND-Cabinet dated January 23, 2019, amending and supplementing certain provisions of Decree No. 68/2015/ND-Cabinet dated August 18, 2015 on nationality registration and aircraft rights registration, which took effect from March 11, 2019.

Paragraph 12 of this Article specifies the number of administrative procedure files according to Clause 21, Article 1 of Decree No. 07/2019/ND-Cabinet dated January 23, 2019, amending and supplementing certain provisions of Decree No. 68/2015/ND-Cabinet dated August 18, 2015 on nationality registration and aircraft rights registration, which took effect from March 11, 2019.

Paragraph 13 of this Article is amended and supplemented pursuant to Clause 9, Article 1 of Decree No. 07/2019/ND-Cabinet dated January 23, 2019, amending and supplementing certain provisions of Decree No. 68/2015/ND-Cabinet dated August 18, 2015 on nationality registration and aircraft rights registration, which took effect from March 11, 2019.

Paragraph 14 of this Article replaces the phrase "certified copy (or copy accompanied by original for comparison)" with the phrase "copy accompanied by original for comparison or certified copy verified by the agency, organization, or individual that issued the original" pursuant to Clause 17, Article 1 of Decree No. 07/2019/ND-Cabinet dated January 23, 2019, amending and supplementing certain provisions of Decree No. 68/2015/ND-Cabinet dated August 18, 2015 on nationality registration and aircraft rights registration, which took effect from March 11, 2019.

Paragraph 17 of this Article specifies the number of administrative procedure files according to Clause 21, Article 1 of Decree No. 07/2019/ND-Cabinet dated January 23, 2019, amending and supplementing certain provisions of Decree No. 68/2015/ND-Cabinet dated August 18, 2015 on nationality registration and aircraft rights registration, which took effect from March 11, 2019.

65 Article 2 of Decree No. 07/2019/ND-CP amending and supplementing certain provisions of Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government on nationality registration and aircraft rights registration, which took effect from March 11, 2019, provides as follows:

“Article 2. Effective Date

1. This Decree takes effect from March 11, 2019; repealing Clause 3, Article 5, Clause 3, Article 6, Clause 4, Article 9, Point c, Clause 1, Article 10, Clause 3, Article 15, Clause 3, Article 16, Clause 3, Article 22, Clause 3, Article 23, and Clause 3, Article 24 of Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government.

2. Applications for nationality registration and aircraft rights registration being processed before this Decree takes effect shall continue to be handled in accordance with the provisions of Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government on nationality registration and aircraft rights registration."

66 Article 3 of Decree No. 07/2019/ND-CP amending and supplementing certain provisions of Decree No. 68/2015/ND-CP dated August 18, 2015 of the Government on nationality registration and aircraft rights registration, which took effect from March 11, 2019, provides as follows:

"Article 3. Responsibilities for Implementation

1. The Ministry of Transport shall organize the implementation of this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities shall be responsible for implementing this Decree."
