Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 143/2016/NĐ-CP dated October 14, 2016 of the Government stipulating conditions for investment and operation in the vocational education sector;

At the proposal of the Director General of the Vocational Education Department,

The Minister of Labor, Invalids and Social Affairs promulgates this Circular amending and supplementing certain provisions of Circular No. 05/2017/TT-BLDTBXH dated March 2, 2017 of the Minister of Labor, Invalids and Social Affairs on the regulations for admission and determining enrollment quotas at intermediate and higher vocational levels.

Article 1. Amending and supplementing certain provisions of Circular No. 05/2017/TT-BLDTBXH dated March 2, 2017 of the Minister of Labor, Invalids and Social Affairs on the regulations for admission and determining enrollment quotas at intermediate and higher vocational levels

1. Clause 2, Article 2 shall be amended and supplemented as follows:

"2. This Circular does not apply to the admission of intermediate and higher vocational level students for teacher training programs and does not apply to foreign joint training programs or studying abroad."

2. Point b Clause 2 Article 3 is amended and supplemented as follows:

"b) For higher vocational level:

- Students who have completed secondary general education or equivalent;

- Individuals holding a certificate of completion of intermediate vocational level and a certificate of completion of secondary general education or having passed the required subjects of secondary general education according to the regulations of the Ministry of Education and Training;

- Students who have completed junior secondary education but wish to continue their studies at the higher vocational level must pass the required subjects of secondary general education according to the regulations of the Ministry of Education and Training and obtain a certificate of completion of intermediate vocational level."

3. Article 5 shall be amended and supplemented as follows:

Article 5. Application forms and procedures for registering for admission at intermediate and higher vocational levels

1. The application form for registration includes:

a) An application form for vocational education registration according to the model attached as Appendix 03 to this Circular;

b) Legally certified copies of other necessary documents as required and based on the criteria for admission or examination of each school (if applicable).

2. Forms of registration for admission

a) Register directly on the application form for vocational education registration and submit the application form at junior secondary schools, secondary schools, centers for continuing education, or local Departments of Labor, Invalids and Social Affairs or directly at the school applying for admission;

b) Online registration on the vocational education recruitment information website of the General Department of Vocational Education and Training at http://tuyensinh.gdnn.gov.vn or on the information websites of local Departments of Labor, Invalids and Social Affairs or on the websites of individual schools;

c) Online registration through the "Choose Career" software installed on mobile devices (smartphones, tablets).

3. Submission of application forms for registration for admission

a) Application form for vocational education registration: Submit directly as prescribed in Point a Clause 2 of this Article or register online as prescribed in Points b and c Clause 2 of this Article;

b) Legally certified copies of other necessary documents as required and based on the criteria for admission or examination of each school (if applicable): Submit directly to the school applying for admission or send via postal service as requested by the school.

4. Schools shall announce the methods of receiving application forms for registration for admission and the recruitment fees, creating the most favorable conditions for candidates.

4. Amending and supplementing Article 25 as follows:

Article 25. Responsibilities of the General Department of Vocational Education and Training, Ministry of Labor, Invalids and Social Affairs

1. Provide specific guidance on the work of admitting students at intermediate and higher vocational levels; unify management, direct and support localities and schools in the work of admission.

2. Inspect, check and supervise the work of admission, determining enrollment quotas and implementing enrollment quotas of schools in accordance with the law.

3. Take the lead in coordinating with relevant ministries, agencies; provincial People's Committees to conduct re-inspection of results at subordinate schools if they receive feedback from candidates.

5. The name of Article 26 is amended as follows:

Article 26. Responsibilities of Ministries, ministerial-level agencies, and government agencies

6. Supplementing Article 26a as follows:

Article 26a. Responsibilities of Provincial People's Committees

1. Direct the Departments of Labor, Invalids and Social Affairs, and Education and Training to guide junior secondary schools, secondary schools, and centers for continuing education to implement分流后的第二部分，请继续翻译剩余的内容。

2. Direct the Department of Labor - Invalids and Social Affairs to coordinate with relevant agencies and units in organizing the career education recruitment counseling day. The number of times the counseling day is organized in a year shall be decided by the locality.

7. Add Article 26b as follows:

"Article 26b. Responsibilities of the Department of Labor, Invalids, and Social Affairs

1. Guide the recruitment work for vocational education at junior high schools, high schools, and regular education centers; announce procedures and formalities for receiving and registering for vocational education; coordinate with relevant agencies and units to organize career counseling days for vocational education recruitment.

2. Direct and organize the issuance of application forms for vocational education recruitment to junior high schools, high schools, and regular education centers within its jurisdiction; receive application forms for vocational education recruitment from junior high schools, high schools, and regular education centers, compile and send them to schools where candidates have registered; direct, guide, and support schools in their recruitment work.

3. Monitor, direct, and guide vocational education institutions in implementing recruitment and managing students according to the provisions of the law.

4. Regularly report to the General Department of Vocational Education as stipulated in this Circular.

5. Carry out other contents as prescribed in this Circular.

8. Amend and supplement Article 27 as follows:

"Article 27. Responsibilities of Schools

1. Develop admission regulations as prescribed in this Circular; proactively coordinate with Departments of Labor, Invalids, and Social Affairs, and relevant agencies and units to issue application forms for vocational education recruitment to junior high schools, high schools, regular education centers, and on the school's website.

2. Ensure the truthfulness and accuracy of data regarding lecturers, teachers; and physical facilities in determining annual admission quotas.

3. Provide complete information when requested by the General Department of Vocational Education and the Ministry of Labor, Invalids, and Social Affairs to verify the admission quotas that have been registered.

4. Report the results of the previous year's admissions and register the next year's admission quotas within the specified time frame.

5. Organize inspections, checks, and supervision of all stages in the recruitment process at their own institution according to the school's charter."

Article 2. Effective Date

1. This Circular takes effect from April 22, 2019.

2. During implementation, if there are any difficulties, please promptly reflect them to the Ministry of Labor, Invalids, and Social Affairs for research, amendment, and supplementation to ensure appropriateness./.
