Circular No. 07/2020/TT-BVHTTDL stipulates the training content for drivers of watercraft and safety skill guidance for participants in underwater recreational activities.

 CIRCULAR

REGULATIONS ON TRAINING CONTENT FOR OPERATORS OF WATER SPORTS AND RECREATION EQUIPMENT AND SAFETY SKILL GUIDANCE FOR PARTICIPANTS IN UNDERWATER RECREATIONAL ACTIVITIES

Pursuant to the Tourism Law dated June 19, 2017;

Pursuant to Decree No. 48/2019/NĐ-CP dated June 5, 2019 of the Government on management of activities of equipment for underwater recreational purposes;

Pursuant to Decree No. 79/2017/NĐ-CP dated July 17, 2017, of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director General of the Vietnam National Administration of Tourism;

The Minister of Culture, Sports and Tourism issues this Circular stipulating training content for operators of equipment for underwater recreational purposes and safety skill guidance for participants in underwater recreational activities.

Article 1. Scope of Regulation

This Circular stipulates training content for operators of equipment for underwater recreational purposes and safety skill guidance for participants in underwater recreational activities in accordance with Decree No. 48/2019/NĐ-CP dated June 5, 2019 of the Government on management of activities of equipment for underwater recreational purposes.

Article 2. Applicability

1. Operators of equipment for underwater recreational purposes.

2. Participants in underwater recreational activities.

3. Organizations and individuals providing underwater recreational services.

4. Agencies, organizations, and individuals related to underwater recreational activities.

Article 3. Training for operators of equipment for underwater recreational purposes

1. The training content for operators of equipment for underwater recreational purposes includes:

a) Regulations on ensuring traffic safety and environmental protection in the recreational area.

b) Safe operation procedures, control skills, maintenance of equipment; swimming and diving techniques training, initial first aid methods, drowning rescue methods; instructions on using protective equipment, firefighting equipment.

c) Practical exercises of the skills specified in point b of this clause.

d) Risks and preventive measures when using equipment for underwater recreational purposes.

đ) Rescue instructions: information about rescue forces, communication methods, telephone numbers, duty points, signal flares.

e) Other related contents.

2. Provincial People's Committees organize guidance on implementing the training for operators of equipment according to the provisions of Clause 1 of this Article and relevant laws.

Article 4. Content of safety skill guidance for participants in underwater recreational activities

1. General information on underwater recreational activities: safe areas where recreational equipment can operate and be moored; operating hours; environmental protection; age, gender, health conditions for participants in underwater recreational activities.

2. Measures to ensure safety when participating in underwater recreational activities.

3. Instructions on using life jackets, lifesaving equipment, firefighting equipment on recreational equipment during underwater recreational activities.

4. Risks and preventive measures when using equipment for underwater recreational activities.

5. Rescue instructions: information about rescue forces, communication methods, telephone numbers, duty points, signal flares.

Article 5. Effective Date

This Circular takes effect from December 1, 2020.

Article 6. Implementation Organization

1. Provincial People's Committees organize implementation, inspection, and supervision of relevant agencies, organizations, and individuals to implement this Circular.

2. The Vietnam National Administration of Tourism shall take the lead and coordinate with relevant agencies and units to guide and organize inspections of the implementation of this Circular./.
